Monday June 15, 1959
Mayor Irby called the regular meet-
ing of the City Council to.order at 7:30 o'clock P.M.
Councilmen Presents Lambert, Bryant, Waite, Terry, Irby.
Councilmen Absents bone.
Business Licenses On motion. by Bryant seconded by
Terry the applications for license to conduct business in
the City of Huntington Beach as approved by the Health
Officer, Building Inspector, Chief of Police, and Fire Chief
were granted as follows:
Co Russ Shinnefield Inc., business of bath & Plaster Con-
tractor, Wheel Tax, of 10801 Dale Avenue, Stanton, California.
Goode & Schroeder, Inc., business of Asphalt Paving, of
14045 Century Blvd, Santa Ana, California.
R.E. Russell, business of Plumbing Contractor, Wheel Tax,
of 192 Wells`Place, Costa Mesa, California.

ed and ordered filed. Motion carried.
Term. Drlg. Bond On motion by Waite seconded by Lambert
Atlantic Oil Co.
the request of the Atlantic Oil Company
Miller & Ford for termination'of the Pidelity and Deposit Com-
pany of Maryland drilling bond No. 73845970 covering their
well No. 18, located in Block 1706 Fast Side Villa Tract, hav-
ing complied with section 2427,3 of the Huntington Beach Ord-
inance Code, and the Operator and bonding Company be notified
of the approval of bond termination. Motion carried.
Monthly Report - On motion by Bryant seconded by Waite
Police Chief
the report of the Police Chief for the
month of May, 1959, as read by the Clerk be accepted and ordered
filed. Motion carried.
Ord. #725 - The Clerk gave the second reading bf
Job Classifications
Ordinance No, 725 by title, an Ordin-
ance of the City of Huntington Beach relating to Job Classifi-
cation; amending Sections 1577.1 and 1577.2 of the Huntington
Beach Ordinance Code,
On motion by Lambert seconded by Waite
Ordinance No. 725 was passed and adopted by the following roll
call votes
AYES: Councilmen: Lambert, Bryant, Terry, Waite, Irby.
NOES: Councilmen: None.
ABSENT: Councilmen: None.
Use Var. #151 - The Clerk read a transmittal from the
Clement C. Fearns
Planning Commission relative to the
public hearing held by the Planning Commission on Use Variance

151 filed by Clement C. Fearns, 12691 Dale Street, Garden Grove,
California, to allow a 28 unit apartment to be constructed in
an R-4 Suburban Residential District where only 9 units would
be allowed, located at 18092 Huntington Beach Blvd. A. motion
was made by Davis and seconded by Schryer to recommend to the
City Council the approval of Use Variance 151 subject to the
following conditions:
REQUIRED ALLEY
1. A fully improved alley of 30 feet width to City Engineer's

specifications will be required to extend from the"
applicant's property to Talbert Avenue.
STREET DEDICATION
2. There shall be offered for dedication for street
purposes a parcel the width of the described lot
.and to a depth of 40 feet.

3. There shall be required one garage or carport for
each unit constructed.

Granted
On motion by Terry seconded,by Bry-»
ant`in accordance with recommend-
ations of the Planning Commission, Use Variance 151 be
granted subject to conditions requested be imposed by the
Planning Commission. Motion carried.
Planning Commission The Clerk read tkansmittal from the
Reso. #62 to amend
Subdivision Ord. Planning Commission informing the
City Council that a Pnblic'Hearin.g was held on June 2nd,
19599 by the Planning Commission to consider proposed sub-
division amendments ab requested'by the City Council ini-
tiated action. A motion was made by Davie°and seconded by
Schryer to adopt Resolution No. 62 enumerating specified
amendments to the City Subdivision Ordinance and recommend-
ing their adoption to the City Council. Motion carried.
The Clerk read Resolution No. 62
adopted by the Planning Commission to amend specific sec-
tions of the City Subdivision Code.'
City Attorney The City Attorney informed the City
Council a public hearing is required on the proposed amend-
ments to the Subdivision Code.
Public Hearing - On motion by Waite seconded by Terry
Proposed Amendments
to Subdivision Code the Clerk be instructed to publish
notice for public hearing on the proposed amendments to the
subdivision code and said hearing to be held at 8;00`orclock
P.M., Monday July 6th, 1959• Motion carried•
Ord. #726 The Clerk gave Ordinance No. 726,
Trailer Parks
An Ordinance of the City of Huntington
Beach relating to Trailer Parks; adding Sections 8712*4 and
8712.5 and amending Section 8726 of the Huntington Beach Ord-
inance Code* its first reading in full.

First Assembly of. On motion by Terry seconded by Bryant
God Church to sell
cold drinks - 4th the request of the First Assembly of

God Church for permission to place a
cold drink stand to sell cold drinks during the 4th of July
parade at 5th Street and Orange Avenue be granted,. Motion.

Public Hearing Mayor Irby opened the public hearing
DV129 and DV130
John F. Thomason on the appeal by John F. Thompson on
the decision of the Planning Commission denying the Conditional -
exception for DV129 and DV130.
Notice of The Clerk read the legal notice of
Hearing read

and place for the hearing on the appeals filed by John F.

Appeals filed by The Clerk read the appeals for the
John F. Thompson
Conditional Exceptions to DV129 and
DV1.30 filed by John F. Thompson with the.City Council. John
F. Thompson addressed the Council Members and reiterated the
reasons given in the appeals filed with the City Council.
T.B. Talbert T.B. Talbert, Realtor, addressed the
City Council and stated the other land owners excepting the
ownas.of parcel at corner of the proposed Ronald Road and High-
way #39 have given assurance to dedicate the remaining required
portion of the proposed street known as Ronald Road.
City Attorney
The City Attorney briefed the Council
Members on the requirements of the State Map Act and the City
Subdivision Code requirements and in his opinion. the Division

of Lands as proposed are not . legal.
City_ Engineer
The City Engineer pointed out to the
applicant that the proposed division of lands was -merely a means
to circumvent the requirements of the subdivision ordinance.
.He also pointed out the property owners could accomplish their
purpose by using the 1911 Street Improvement Act.
Council Discussion A full discussion on the appeals by
John F. Thompson was held by the Council Members and the appli-

cant was informed he would have to guarantee by posting
an adequate bond or give evidence that the entire right
of way for street purposes to State Highway 39 has been
deeded or dedicated by all the property owners involved.
John F. Thbmpson On motion by Terry seconded by

Bryant the City Council allow the
City Planning Commission to approve the request of John

lots and subject to all the requirements of the City Sub-
division Ordinance Code provisions. Motion carried.
Fox Hills Trailer On motion by Terry seconded by
Sales to erect Sign

Hike Trailer Sales for permission to erect a sign at
the curb line on City property near the junction of`
Highway 39 and 101 and said applicant to file a certifi-
cate of insurance naming the City as an additional assured
and said permit to be revocable and subject to cancella-
tion b y order of the City Council at anytime. Motion '
carried.
Norman Wells On motion by Terry seconded by
Director of Build-
ing & Safety Resigns Bryant the resignation of Norman
Wells - Director of Building and Safety be accepted,
Notion carried.
Position'of Building On motion by Terry seconded by
& Safety Director
Advertised Lambert the City Personnel Officer
be instructed to advertise for applications to fill the
position of Building and Safety Director. Notion carried.
Part-time Personnel On motion by Terry seconded by
Municipal Trailer Park
Lambert the request of the Manager
of the Municipal Trailer Park to employ one part time
man and one part time female in code Classific"ton;. 1577.8
and 1577.81 in the appropriate salary range and bracket.

Sheila Orris Inter. On motion by Terry seconded by Lambert
Typist Clerk
the request of the City Clerk to place
Sheila M. Orris on the regular payroll in Classification Inter-
mediate Typist Clerk in the appropriate salary range and bracket
effective June 16, 1959. Motion carried,
Demands On motion by Waite seconded by Bryant
the demands as approved by the Finance Committee be ordered
paid. Motion carried.
Canvassing of This being the date in accordance with
ballots - Special
Referendum Election the requirement of the City Charter for
of June 2th, 1959
the canvassing of the ballots cast at
the Special Referendum Election held on Tuesday, June 9th, 1959,
the Clerk presented the envelopes containing the tally sheets
received from the election precinct inspectors.
Absentee Ballots There being no errors the Clerk pre-
sented the absentee ballots for canvassing by the City Council.
It was determined that there were seven (7) absentee ballots
cast for the measure:
For the measure - Yes- 4
Against the measure - NO-3.
Reso. #1380 - There being noerroms the City Clerk
Special Election
Returns presented and read resolution No. 1380,
a Resolution of the City Council of the City of Huntington
Beach, California, canvassing the returns of the Special Refer-
endum Election held on Tuesday, June 9th, 1959s in said.City.
Reso. #1380 Adopted On motion by Lambert seconded by Waite
Resolution No. 1380 was passed and adopted by the following
roll call vote:
AYES: Councilmen: Lambert, Bryantt Terry, Waite, Irby.
NOES: Councilmen: None.
ABSENT: Councilmen: None.
Statement of Result of Election
1. That the whole number of votes cast in the City of Hunt -
