Councilmen Present: Lambert, Bryant, Terry, Waite,, Irby. Councilmen Absent:: None. Minutes On motion by Bryant seconded by Waite the Council Minutes for the meetings of June 1st, June 15th,, June 17th, as transcribed and mailed to the City Council, Department Heads, Boards,. and Commissions be accepted and ordered filed. Motion carried. Monthly Reports The Clerk read the reports of the Department &eads for the month of June, 1959. 0n motion by Terry seconded by Lambert, the reports of the Department Heads for the month of June as read by the City Clerk be received and filed. Motion carried. Motion carried. Public Hearing - Mayor Irby opened the hearing at Need Abatement charaes 7:45 P.M. to receive objections of property owners which are assessed for the weed and rubbish abatement charges included on the partial list of weed and rubbish charges for the year 1959,.which were posted outside the Council Chambers by the Street Superintendent,. The Mayor asked if there were any property owners present who wished to make any protest can the weed abatement charges as posted by the Street Superintendent. There being noaoral or written protest the Mayor declared the hearing closed. Weed charges a.yaproved On motion by Waite seconded by Lambert, and certified to Co. Auditor the City Council find the weed abate- ment charges on the partial list of the weed and rubbish abatement charges for the year 1959 submitted to the City Council and posted outside the Council Chambers by the Street Superintendent are fair and just and approve. the charges, and the City Clerk be instructed to certify, the charges for the weed abatement shown on the partial list posted by the Street Superintendent, to the County Auditor for inclusion on the 1959-1960 assessment roll that are not paid by -August lst, 1959• Motion carried. OnvZotion by Waite seconded by Lambert, to cut curb on Bain Street & acacia Street the request of the Southern California Edison Company District Manager for permission to cut the side- walk at two locations on Main Street, and two on Acacia Street, to provide area to permit decorative tree planting and said work to be done under the supervision and direction and to the satisfaction of the City Engineer, be approved.. Motion carried. Betty E. :smith & On motion by Lambert seconded by Bryant, Joanne M. Renfro employed in Police in accordance with request of the Chief Dept. of Police to employ Betty Elaine Smith as a clerk dispatcher in the appropriate salary range and bracket and Joanne Renfro be employed as a parking control officer in the appropriate salary range and bracket and said employment to become effective immediately, be approved. Motion carried. Motion withdrawn On motion by Bryant seconded by Lambert, in accordance with the request of D.G. Higgins, Fire Chief; for the personnel, officer to conduct an oral examination for the position of a Battalion Chief in the Fire Department and said examination to be a promotional examination to qualify one of the three captains, Groover, Hengoed and-Brown,of the Fire Department to the position of Battalion Chief. Councilman. Bryant and Councilman Lambert respectively withdrew the motion and second. Public Hearing - At 8:00 o'clock P.M. Mayor Irby announced amendments to §jbdivision code that in accordance with the Legal. Notice that this is the date and hour set for a public hearing on the proposed amendments to the City's Subdivision Code as recommend- ed by the City Planning Commission. The Clerk reported that. no written or oral protests had been filed up to 5:00 P.I. as of July b, 1959. Mayor Irby asked if anyone in the audience present wished to make any statement -for or against the proposed amendment to the Subdivision Code. Lyndon'+'rell.s Lyndon Wells appeared before the City Council and asked for a copy of the proposed Ordinance now. He was informed by the Clerk that there were no copies available in 4. 3i'4. Mr. Wells informed the City Council that they wished to have this matter delayed as they had not had an opportunity to receive copies or look at the proposed Subdivision Amendments. Attorney Bauer Attorney Bauer informed the Council the procedure upon which the public hearings were held espec- ially on Ordinances and that there was a period between the publication and the hearing which there is an opportunity to receive copies or look at the document in the office of the City Clerk or the Planning Director. Lyndon Wells Lyndon Wells asked that the Ordinance be read. Ord. #727 - 1st The Clerk gave Ordinance No. 727, reading - Subdivision its first. reading in full, An Ord- inance of the City of Huntington Beach relating to sub- division requirements, adding Section 9720 and amending Sections 9741.6, 9751.1, 9751.2 of the Huntington Beach Ordinance Code. Byron Wineke employed On motion by Bryant seconded by Waite, as License Inspector in accordance with the recommendations of the Administrative Officer that Byron Wineke having. passed the written and oral tests given for License Inspector, be employed in the classification of License Inspector in the appropriate range and bracket to be effective as of July 16th, 1959, was passed..by the following roll call vote: AYES: Councilmen: Lambert, Bryant, Terry, Waite, Irby. NOES: Councilmen: None. ABSENT: Councilmen: None. Public Hearing - Mayor Irby announced that this is Proposed Budget 1959-1960 � the time and date set for the public hearing on the proposed 1959-1960 Budget. The Council Members held a full discussion on the proposed budget as presented by the depart- 5. Page #6 - minute:, July 6, 1959 ■- . ment heads and Administrative Department covering all details of the budget. Mayor Irby opened the Budget hearing to the public. Lyndon We`lls Lyndon Wells addressed the City Council and requested the City Clerk to explain the $750.00 transport- ation expense in the Planning Department°Budget. A full explanation of the expense was made by the Administrative Officer. Lyndon Wells asked if the amount in the. Planning Department Budget for contractual consulting services was for the firm of Hahn, Wiser and Barber. Mr. Wells was informed by the City Council that it was not, that it could be for other contract- ual services. Lyndon Wells asked the Council if they had cancelled the contract with Hahn, Wise and Barber. Contract terminated- On motion by Waite seconded by Terry, Hahn, Wise, & Barber the City Council order the termination of the contract with Hahn, Wise and Barber for contractual con- sulting services and that the City Clerk be instructed to so notify the firm of Hahn, Wise and Barber in accordance with provisions of the contract. Motion carried. Hearing closed There being no further statements for or against the proposed 1959-1960 budget, the Mayor declared the hearing closed. 1959-1960 Budget On motion by Waite seconded by Terry, adopted the City Council adopt the 1959-1960 Budget with deletions as ordered, was approved by the following roll call vote: AYES: Councilmen: - NOES: Councilmen: ABSENT: Councilmen: Memo. of Agreement Division of Highways Terry, Waite, Irby, Lambert, Bryant. Page #7 - Minutes, July 6, 1959 Reso. -#1382 - The Clerk read Resolution No. 13829 ap-roving memo. of agreement a Resolution of the City Council of the City of Huntington Beach adopting budget and approving memorandum of agreement for expenditureof funds allocated under Section 2107.5 of the Street and Highways Code. On motion by Bryant seconded by Terry, Resolution No. 1382 was passed and adopted by the following roll call vote: AYES: Councilmen: Lambert, Bryant, Terry, 'Waite, Irby. NOES: Councilmen: None. ABSENT: Councilmen: None. A,:.,reement- H.B. The Clerk read the agreement between Chamber cf Co=nerce the City of Huntington Beach and the Huntington Beach Chamber of Commerce, non-profit organization whereby the City requests that certain advertising and furn- ish;.Lng of certain information to the general public regarding the City of Huntington Beaah.be done and the City agrees to pay certain sums of money towards the maintenance of the offices of the Chamber of Commerce. On motion by Waite seconded by Terry, the City Council instruct the Mayor and the City Clerk to execute the agreement between the City of Huntington Beach and the Huntington Beach Chamber of Commerce for the fiscal year 1959-1960, and the Mayor to set up a meeting with the Chamber of Commerce and the City Council to discuss the Chamber of Commerce functions for the City, was approved by the following roll call vote: AYES: Councilmen: Terry, Waite,. Irby. NOES: Councilmen: Lambert, Bryant. ABSENT: Councilmen: None Oral Exam.- On motion by Lambert seconded by _Plumbing Inspector Bryant that the personnel officer be instructed to hold an oral examination for the job class- ification of Plumbing Inspector, be approved. Request On motion by Lambert seconded by Bryant for a ton track in accordance with the request of the Building & Safety Director, the Purchasing Agent be instructed to receive informal bide on a one-half (-J) ton pickup truck to be used for Building Inspection work, be approved. Motion carried. City Engr. to On motion by Lambert seconded by Waite, attend Traffic Engr. course in accordance with the request of the City Engineer to attend a short course in Traffic Engineering at the University of California to be held during the week of August 24*-i28, and reasonable expenses and.transportation be permitted, in addition to the registration fees, be approved. Motion carried. American Legion On motion by Waite seconded by Bryant., Auxiliary - Memorial Hall. the communication received from the American Legion Auxiliary and read by the City Clerk complain- ing about the manner in which the Memorial Ball Janitorial Ser- vices is being conducted and lack of equipment for setting up tables for 150 people eto., be received and ordered filed. Motion carried. Demands On motion by Waite seconded by Terry, the demands as approved by the Finance Committee be ordered paid. Motion carried. Fund Transfer, On motion by Bryant seconded by Waite in accordance with the request of the City Treasurer the Council confirms the transfer of the following fund balances as of June 30, 195g to reimburse the General Fund. TRAFFIC SAFETY FUND S 26,205.30 a/c.Maintenance and replacement of Traffic. signs & Markings. IN LIEU OF MOTOR VEHICLE LICENSE FEES S 489553.41 a/c law enforcement, enforcement regulation of traffic. Re - abandonment of line the City approve the procedure of the basis of the Pacific Electric Railway Company offer for the City's interest in the right-of-way contingent on the Pacific Electric abandoning the line between First Street and the end of the line in Newport Beach. Such abandonment will depend on further negotiations with the City of Newport Beach and said settlement based on the appraisal for the entire width r of right-of-way between the westerly line of the old 40 foot Southern Pacific Company right of way at "A" Street and the southerly City limits of Huntington Beach, and.the City Clerk be instructed to execute the copy of the letter of the proposal and return the same to the office of the Pacific Electric Railway Company and also request the Pacific Elect- ric Company to furnish the City for its file a copy of the appraisal to be used as the basis of settlement, be approved. Motion carried. Benches on Pier On motion by Waite seconded by Bryant the City Engineer be instructed to place or construct benches and to properly anchor same on the "T" areas of the pier as required, be approved. Motion carried. FerpusorL to cut curb On motion by Terry seconded by Waite in accordance with the recommendations of the City Engineer, the request of Mr. Ferguson to out curb at 1201 Alabama Avenue, for driveway purposes be granted. Motion carried. Ord. No. 728 The. Clerk gave the first reading in Pier Hales full of Ordinance No. 728, an Ord- inance of the CityofHuntington Beach relating to pier rules, amending section 7629.1 of the Huntington Beach Ord- inance Code. On motion by Waite seconded by Terry the regular meeting of the City Council of the City of Hunt- ington Beach adjourn. 9.
