EINUTES: On motion by Liles and seconded by Sork, the Minutes of the Huntington Beach Planning Commission Meeting of Tuesday, June 16th, 1959, as transcribed and mailed by the Secretary were accepted as mailed. He explained that the 7 lots would make 3 large pair and the 4000 sq. ft. lot left over at the corner. He stated that the lot adjacent to the corner and the corner lot were to be sold to two parties who were close friends, so that there would be no objection from the adjacent property owner. THE MOTION CARRIED. CONDITIONAL EXCEPTION: W 155 To allow 4 apartment Applicant - Ken E. Griffin units to be built on a pair of lots where 3 apartment units are the maximum allowable in the existing R-2 District. Legally described as Lots 11, 12, Block 1203, Vista Del Mar Tract. Located at the southeast corner of Memphis Street and Huntington Avenue. Acting Chairman Schryer opened the hearing to the audience. Lyndon A. Wells, 101 Walnut Avenue, Huntington Beach, addressed the Com- mission and requested that he be furnished a copy of the blueprints before any further action was taken. Chairman Schryer invited Mr. Wells to come forward to the desk and check them. Mr. Wells refused and further demanded that the.prints be brought to him. The request was denied. CONDITIONAL EXCEPTION: UV 156 To allow 5 apartment Applicant - Ken E. Griffin units to be built on a pair of lots where 4 apartment units are the maximum allowable in the existing R-2 District. Legally described as Lots 16, 17, and Id 2 of Lot 18, Block 1203, Vista Del Mar Tract. Located approximately 140 feet south of Memphis Street on the east side of Huntington Avenue. The hearing was opened to the public, there being no comment it was closed. A MOTION WAS MADE BY PRESSON AND SECONDED BY LILES TO RECOI:ZLIEITD APPROVAL WITH ONE CONDITION; GARAGES: 1. CONDITIONAL EXCEPTION: UV 157 To allow a single Applicant - Ross ',7. LaPond family duelling on an irregularly shaped lot of 4189 sq. ft. to be a legal building site. Legally described as Lots 1, 2, Block 812, Wesley Park Tract; EXCEPT: the SU 65 feet thereof. Located at the SW corner of 13th Street and 1,1ain Street, Huntington Beach, California. to the public. The hearing was opened Raymond W. Walker, 1015 Main Street, Huntington Beach, addressed the 3. 174 Page 7r4 Minutes - H. B. Planning Commission Tuesday, July 7th, 1959 Commission and protested any action to make the lot under consideration a legal building site. He complained of the size and lack of utilities. Tim Talbert, representing the applicant, addressed the Commission and explained that his client wished to build a small 3 bedroom home which would fit within the required setback laws. He explained that there was a 10 feet utility easement on the north side of the property running to the alley. Jay D. Tucker, 1024 Main Street, Huntington Beach, addressed the Commission and protested the conditional exception which would allow the subject lot to be a legal building site. Paul A. Doutt, 921 - 13th Street, Huntington Beach, addressed the Commission and protested against the requested Conditional Exception. He argued that there was no means to carry out the trash and garbage without putting it on public display. He stated that he too had some 4000 sq. ft. of vacant land on his R-1 lot, but that he had built in good faith and desired to keep the integrity of the R-1 area intact. Mrs. M. J. Blodgett, 1016 Delaware Street,'Huntington Beach, the present property owner, addressed the Commission and stated that they bought the lot in good faith that it was a legal building site. She stated that they would suffer con- siderable financial loss if the Conditional Exception was not granted. Doris Neeld, 1010 Main Street, Huntington Beach, addressed the Commission and protested the requested UV 157. There being no further comment the hearing was closed. Commission discussion brought out the following facts: The pair of lots was built upon in the rear five years past. At that time il- legal setbacks were observed. The intent was obviously to circumvent the R-1 Districting requirements. The lot was divided and the front portion was sold off to an innocent third party. Actually the lot was not a legal building site because it did not contain 5000 sq. ft. At that time there was no lot split ordinance to control this type of activity. A ruling was obtained from the City Attorney as follows: The fact that house has been constructed on the rear of the lot with illegal set- backs does not alter the requirements of the zoning code. That the house already exists does not con- stitute compliance with the law. The intent to violate the ordinance still exists whether or not the front portion was sold off to the innocent third party. There being only four members of the Commission present to make a minimum quorum, a motion was made and seconded to continue the hearing to July 21st, 1959, 7 : 30 P. 1,1. THE 110TION CARRIED. CONDITIONAL EXCEPTION Located on the west side of TENTATIVE, TRACT 3478 Applicant - Highway 7r39 and adjoining on Arnold Eddy the south side of an easement known as Ronald Road. Legally described as the N 2 of SE of SE 4 of Section 26, T. 5. S. , R. 11. W. , S. B. B. & 11. EXCEPTING the north 428 feet thereof. 5. 17e; Page r6 Minutes - H. B. TENTATIVE TRACT MP 3469 At the mutual request of Applicant - Hintz Construction the City Engineer and the subdividing engineer, the hearing was continued to the next meeting, July 21st, 1959, 7:30 P. I,2. CONDITIONAL EXCEPTION Located on the property TENTATIVE TRACT 3510 Applicant - Frank Bissell northerly of Yorktown between England and Florida Streets, and legally described as Block 2506 East Side Villa Tract EXCEPTING the W 50 feet of the E 100 feet of the S 118.5 feet. The applicant is requesting that Lot 8 be a permissible lot with 50 feet of frontage and a lot area of 5425 sq. ft. in variance to the sub- division requirements of 70 feet frontage on corner lots and 7000 sq. ft. The applicant was questioned as to the possibility of acquiring the adjoining lot which restricts the size of Lot 8. Planning Com::iission Tuesday, July 7th, 1959 Discussion of the Commission arrived at the determination that all the basic criteria for a conditional exception to be granted prevailed in this particular case. STREET NA1.1E CHANGES The Secretary reread a letter from the Orange County Street Naming Committee requesting that the Huntington Beach Planning Commission take appropriate action to change the name of Bolsa Chica Road to Miller Street and Huntington Beach Blvd. to Beach Blvd. in conjunction with the Master Plan of Street Names for Arterial Highways. Sentiment on the plan was divided, however a motion was made and seconded to set the date of August 4th, 1959, as a date for a public hearing on the matter. THE 1,I0TION CARRIED. REQUEST FOR ZONE CHAIIGE : Applicant - 1dartha B. Hurst The Secretary read a petition from property owner 1.1artha B. Hurst requesting -.that her, property be rezoned from`the existing R-4 Suburban Residential District as adopted by Interim Ordinance No 668 to County Ordinance C-1 Local Business District. The property is located at the NW corner of Talbert Avenue and Huntington Beach Blvd., and legally described as follows: Parcel 1. That portion of the West 15 acres of the South 20 acres of the Southeast quarter of the Southeast quarter of Section 26, T. 5.S.1 R. 11. W. , S. B. EXCEPTING therefrom the South 220 feet of the East 198 feet thereof. ALSO EXCEPTING therefrom any portion lying within the North one-half of the Southeast quarter of the Southeast quarter of said Section 26. Parcel 2. The East half of the Southeast quarter of the Southeast quarter of the Southeast quarter of Section 26, T. 5. S., R. 11. W., S. B. B. & M. The Planning Director pointed out to the Commission that before any formal action could be taken, the legal status of the zoning change would have to be determined. following report: The City Attorney made the Immediate action would have to be preceded by a lengthy study of the existing legal question. He made an informal recommendation that in order to prevent the remainder of the Interim Ordinance from reverting back to R-1 entirely or even to no zoning, the Master Land Use Plan must be studied and revised . to current thinking. With a current edition of the Land Use Plan to use as a basic guide, several new zoning classifications could be added to the Old City Zoning Ordinance 495• With these new added zoning class- ifications added in conjunction with a revised Land Use Plan, rezoning as requested by property owners could proceed in the annexation areas in an orderly fashion. Using this report as a basis for action, the Planning Commission requested the Planning Department prepare and present a study map for revision of the Master Land Use Plan, along with proposed new zoning classifications to be added to the 91 179 Page #9 Minutes - H.
