T?INUTES : On motion by Schryer and seconded by Stang, the Minutes of the Huntington Beach Planning Commission Meeting of Tuesday, July 7th, 1959, as transcribed and mailed by the Secretary were accepted as mailed. CONDITIONAL EXCEPTION: UV 7t157 - Applicant - Ross LaFond be a legal building site. To allow a single family dwelling on an irregularly shaped lot of 4189 sq. ft. to Legally described as Lots 11 2, Block 8129 Wesley Park Tract; EXCEPT: The SVI 65 ft. thereof. Located at the SVI corner of 13th and Main Streets, Huntington Beach, California. A petition submitted to the Secretary was read to the Commission. The petition contained the signatures of 28 home owners in the general R-1 District. Twenty of the signatures were of home owners within the immediate vicinity. The hearing was opened to the public. Tim Talbert, agent re- presenting the applicant, addressed the Commission and explained that his client would build a neat 3 bedroom home within the required setback regulations on the lot proposed. He read a letter written by Jay Tucker, 1024 Main Street, Huntington Beach, stating that Tucker was not nor has been opposed to the granting of the variance and requested that this be inserted into the records. Talbert reviewed the history of the con- troversial lot. The approval of the Dahlke case and the Council approval of the Seuffert case were given as examples where -. less than regulation size lots were approved. Chairman Bazil pointed out that the Dahlke case was one where the lot had originally been laid out in the subdivision, there had been no attempt to circumvent the R-1 requirements, and the rear of the lot was adjoining an alley. The Seuffert case, he explained, was more nearly identical to the case at hand because the intent of the original owner was to circumvent the R-1 regulations in a dubious manner. He further pointed out that the Planning Commission voted unanimously to -deny the Seuffert case request on Park and Utica Avenues where there was a shortage of 200 sq. ft. below the minimum requirement. He concluded that to remain consistent the Planning Commission would have to recommend denial in spite of the fact that the City Council reversed the recommend- ation and approved the Seuffert case. Lb, s. M. J. Blodgett, 1016 Delaware Street, Huntington Beach, the applicant, addressed the Commission and reiterated her statement that they had invested 4000 dollars, their life savings,in a lot in good faith in order to build on it. It was only recently she learned of the necessity to get a variance. She stated that she had consulted her attorney who advised her that 2. 182 Page #3 Minutes — H. B. She further objected to the failure of city officials to apprise her of her situation when she purchased the lot. It was pointed out by the Chairman that it was not the duty of the city official to advise in private matters without being requested to do so. Ray Walker, 1015 Main Street, Huntington Beach, addressed the Commission and protested the request to make the lot a legal building site. He complained of the size and lack of access -to the alley for trash and garbage removal. Jake Steidinger, 811 — 12th Street, Huntington Beach, addressed the Commission and objected to the proposed variance. He stated that the substandard lot would be detrimental to the neighborhood and would depreciate the property values. Paul Doutt, 921 — 13th Street, Huntington Beach, addressed the Commission and protested against the requested conditional exception. He strenously objected to the substandard conditions of the lot and declared that if approved it would harm property values. THE HEARING WAS CLOSED. The Secretary made a report -re- A letter was read to the Commission submitted by a protesting petitioner. J. L. Henricksen, 618 E. Quincy Street, Huntington Beach, stated to the Commission that if the applicant was granted permission to build the ten units on the property and he and the party owning the remaining property in the vicinity were allowed to build equal amount, then there would be a population density on three pairs of lots which would be equal to R-1 density of the whole block. He declared that such a high density factor was folly when the City already had a parking and traffic problem in this area. Jenison V. and Elizabeth Walton, 807 Delaware Street, Huntington Beach, addressed a letter to the Commission petitioning a request that the variance case be denied, stating that as the immediately adjacent property owners, they were unalterably opposed to the granting of the variance. The hearing was opened to the public. Edward C. itatry, 616 Hartford St., Huntington Beach, California, addressed the Commission and vehemently opposed the requested variance. He stated that such a radical departure from the R-2 provisions would be an outrage to the neighborhood. He compared the applicant's proposed parking as equivalent to a used car lot. Coupland, 904 Delaware Street, Huntington Beach,• opposed the request for variance on the same grounds as Mr. Watry. Lillie Ann Coker, 812 Delaware Street, Huntington Beach, opposed the request for UV 159 for the same reasons as E. C. Vlatry. Rose Berezansky, 508 - 24th Street, 11anhattan Beach, and 806 Delaware Street, Hunt- ington Beach, opposed the requested UV 159 same reasons as above. Mrs. Dallas K. TENTATIVE, TRACT MAP 3469 A total of 676 lots on Applicant - Hintz Construction approximately 150 acres east of Bolsa Chica Road and north and south of Smeltzer Avenue. The conditions as recommended by the Fire, Engineering and Planning Departments were read by the Commission. Planning Commission Tuesday, July 21st, 1959 Ken Carlson, Engineer for the sub- divider, stated he objected to conditions No. 1 thru 4. Condition No-2 was deleted as it was a misprint. Jack Hintz, applicant, also stated that he objected to conditions No. 1, 3, and 4. A lengthy discussion was held between the applicant and members of the Commission. A MOTION WAS MADE BY S CHRYER AND SECONDED BY STANG TO APPROVE TENTATIVE TRACT MAP 3469, WITH THE FOLLOWING CONDITIONS: 1. There shall be required the full dedication and improvement of Bolsa Chica Road from the north boundary of Tract 3469 to Smeltzer Avenue. 2. Condition No. 2 DELETED. 3. There shall be required the full improvement of proposed Flood Control Channel No C-4 from Bolsa Chica Road easterly 1320 feet - to east boundary of Tract 3469. 4. There shall be required a betterment agreement bet- ween the developer and the Orange County Flood Control District for Bolsa Chica Road bridge crossing of proposed Channel C-4, which runs parallel to Smeltzer Avenue. 5. There shall be required construction of a pedestrian bridge, 5 feet minimum width at the east boundary of Tract 3469 crossing proposed Flood Control Channel C-4. 6. Deletion of Note No. 2 on Tentative Map. 7. Change Note No. 3 to read"Sewage Disposal to be pro- vided by the City of Huntington Beach. 8. All existing or indicated Flood Control Channels shall be fenced in accordance with the Orange County Flood Control District standards along all lots .abutting said Channels. Said fencing shall be indicated on the Final Map. 9. Street slopes shall meet City standards. Deviations shall be subject to the approval of the City Engineer. 10. TENTATIVE TRACT MAP 3440 Applicant - Hintz Construction A total of 75 lots on approximately 18.9 acres located at the southeast corner of Heil and Newland Streets. The conditions as re- commended by the Fire, Engineering and Planning Depart- ments were read by the Commission. The applicant was re- quested to express his opinion and objections --if any to the conditions. Jeff Millett, subdividing Engineer, stated that he had a last minute revision in plans which would alter the one condition required. The City Engineer, upon presentation of the plan agreed to allow the altered plan. A MOTION WAS MADE BY DAVIS AND SECONDED BY SORK TO APPROVE TENTATIVE TRACT MAP 3440 WITH THE FOLLOWING CONDITION: 1. That the drainage of the tract shall be allowed to drain with sheet overflow onto -the south 40 acres provided that the owner of the southerly 40 acres shall so authorize by recorded note. Said condition shall be allowed until such time as the Orange County Flood Control District Channels as indicated on the Tentative Map are sufficiently completed to accept drainage waters. The conditions as recommended by the Fire, Engineering and Planning Departments were read by the Commission. The applicant was requested to express an opinion of the conditions. Jeff Millett, subdividing Engineer, stated that he had a revision similar to 3440. Upon presentation of the plan, the City Engineer agreed to allow the altered plan. B., Planning Commission Tuesday, July 21st, 1959 The conditions as recommended by the Fire, Engineering and Planning Departments were read by the Commission. The Applicant was requested to ex- press an opinion on the conditions to be imposed. Frank Bissell, applicant, stated that he objected to the required rezoning in that -he did not want the zoning procedure to delay his final map and consequently raise his cost of financing. Members of the Commission agreed to compromise and require that the applicant file a petition to rezone the property to a residential use district class- ification prior to the filing of the final map. The Secretary was further instructed to contact other property owners in the area and e1quire if it was their desire to rezone the neighborhood from 14-2-0 to some type of residential classification whether it be R-4 or R-1. A MOTION WAS MADE BY PRESSON AND SECONDED BY SORK TO APPROVE TENTATIVE TRACT MAP 3510 WITH THE FOLLOWING CONDITION: 1. Planning Commission Tuesday, July 21st, 1959 The Conditions as recommended by the Fire, Engineering and Planning Departments were read by the Commission. The applicant was requested to express an opinion on the conditions to be opposed. Ken Carlson, the subdividing Engineer, stated that he objected to the dedication of access of Lot 22 from Highway 39 to the City of Huntington Beach. He was advised by the City Engineer that this was in accordance to the Master Plan of Streets and Highways and . in accordance with the subdivision code. He suggested an alternative of dedicating a service road. There was no further comment. Restricted access shall be required along the Highway 7r39 frontage of Lot 22 and notes to this effect shall be indicated on the final map. 2. There shall be required a 20 ft. paved alley along the southerly boundary of Tract 3478 with a hammer- head turnaround at the westerly boundary. This condition may be waived if the property is rezoned to R-1 Single Family Residential prior to approval of the final map. 3. Final approval of Tract 3478 shall be subject to the removal of all encumbering right-of-way easements or separate parcels iithin Lot 14. Located at the southeast corner of Patter- son Way and La Paloma Way. The hearing was opened to the public, there being no comment it was closed. The Chairman inquired whether the applicant was present, there was no reply. The Commission unanimously moved to postpone the hearing until the next meeting of August 4th, 1959, in order that thi�-applicant could appear and give reasons for his request. AREA VARIANCE: AV 153 To allow a 6 ft. fence to be Applicant - George McCracken built in the front yard area of a M-1 zoned plumbing shop yard. Fence to be constructed of 3/4 inch plywood. Located at the SE corner of Gothard Street and Slater Avenue and legally described as: W 300 ft. of S 85 ft. of SE n of SE 4 of Section 26-5-11, S. B. B. & M. The hearing was opened to the audience. George 14cCraken, applicant, addressed the Commission and illustrated the need for the fence with pictures of his existing fence. He pointed out that he was already allowed to go four feet high, however it would give much more protection against theft etc., if he could build it six feet high as he had originally planned. THE MOTION CARRIED. I,1INOR REVISION OF HASTER A letter from the Orange PLAN OF STREETS lulD HIGHWAYS. County Highway Department as transmitted by the City Council was read to the Commission. The letter in essence re- quested assistance on the City official's part in order to work out a mutual highway program enabling this City to participate in the Arterial Highway financing program. It emphasized the importance of instituting a new Ord- inance for setback requirements within a years time in order to qualify for the cooperative aid financing pro- gram. It also reiterated the need for changes to be made on the present IYTaster Plan of Streets and Highways in order that a compromise can be made as proposed by both City and County planning and engineering staff. The Compromise would enable the City and County Master Plan to coincide. The City Engineer recommended the revision of the blaster Plan of Streets and Highways as the initial step in carrying out the program. A MOTION WAS MADE AND SECONDED TO SET A PUBLIC HEARING FOR THE REVISION OF THE MASTER PLAN OF STREETS AIM HIGHWAYS FOR AUGUST 18th, 1959. THE I,40TION CARRIED. PROPOSED ADDITIONS TO The proposed changes as mailed ZONING CLASSIFICATIONS FOR OLD CITY ZONING to the Commission and Council ORDINANCE NO 495 were read by the Commission. A further addition was added in the form of parking re- quirements for dwellings. This section would require parking be provided in all residential zones in the form of .a carport or garage at the ratio of one garage or car- port per dwelling unit. A MOTION WAS MADE AND SECONDED TO SET THE DATE FOR PUBLIC HEARING ON PROPOSED ADDITIONS FOR AUGUST 4th, 1959• THE MOTION CARRIED. REZONING STUDY FOR AREA ABOUT TENTATIVE TRACT 3510 In order that -a more comprehensive area can be given consideration, the Secretary was requested by the Commission to contact the property owners within the neigh=-• be/ borhood, to determine whether they would interested in rezoning their property from M-2-0 to R-3, R-2 or R-1 for their ovni protection. The Commission stated that the re- action of the property owners would determine the extent if any, the rezoning proposal would take. The Commission were of the opinion that all rezoning actions shall be at the request of the property owners and shall be in- itiated by them. TRANSTIITTAL OF REQUEST The Secretary reported that the OF SEN. IJURDY TO CITY COUNCIL Mayor had been approached by Senator Murdy in regards to de- dicating certain property to the City for park purposes. The general area under consideration would be all that land within a legal subdivision described as Tract 392, Block A and B. It would encompass approximately 20 acres and would lie north of proposed Flood Control 13. 193 Page ;f14 Minutes - H. B. Planning Commission Tuesday, July 21st, 1959. Channel C-5 or 660 feet north of Wintersburg Avenue on the east side of Golden Wiest Street. The Mayor reported that Senator Murdy would offer to dedicate 70 lots within this tract for park purposes providing the City would offer to condemn the remaining lots within the tract for park purposes. The Commission referred to the City Attorney for comment on the procedure for condemning the required number of lots and what expense would be in- volved. The Commission was advised that more than likely a service like the band Acquisitions Service mould have to be hired to assist in the efforts that would have to be made to condemn the vast number of lots. This service it was explained could be very costly de- pending upon a number of factors. However it was suggested that a study be originated to determine the value of the 20 acres as a whole and to estimate the total land ac- quisition cost by condemnation. Prior to any action being taken to originate condemnation, it was pointed out that the blaster Plan of Parks and Recreation should be reviewed and a study of the proposed site be made to determine its value as a recreational park site. PECK ESTATE - The Secretary reported to the REQUEST FOR REZONING Commission that an application for rezoning had been filed by the Peck Estate interests. The rezoning would entail vast holdings within Sections 9-5-119 10-5-11 and 16-5-11 which would be rezoned to M-1 for light industrial uses within an industrial park if the request were granted. STUDY OF VILER LAND USE PLAN With the meeting running late in the evening, it was agreed by the Commission at the request of the Chairman to hold studies of proposed revisions of the Master Land Use Plan at the next meeting.
