HomeMy WebLinkAbout1959-10-05393 MINUTES Council Chamber, City Hall Huntington Beach, California Monday, October 5, 1959 Mayor Irby called the regular meeting of the City Council of the City of Huntington Beach to order at 7:30 o'clock P.m. Councilmen Present: Lambert, Terry, Waite, Irby, Councilmen Absent: Bryant. Minutes On motion by Lambert seconded by Waite the Minutes of the meetings of the -City Council of September 8th and September 21st, as transcribed and mailed by the City Clerk be accepted without changes and approved. Motion carried. Resignation- The Clerk read the resignation of Councilman R_2 D, Bryant Roy D. Bryant, received at the City Hall on September 22, 1959, and said resignation requested to be effective as of October 1st, 1959. On motion by Waite seconded by Lambert the City Council accept the resignation of Councilman Roy D. Bryant, effective October lst, 1959, be approved. Motion carried. Plaque- On motion by Waite seconded -by Lambert the City Roy D. Bryant Clerk be authorized to order a plaque in re"' cognition of the services of Councilman Roy D. Bryant during his tenure of office, be approved. Motion carried. Mayor Irby Mayor Irby presented to the City Council the name of Gordon L. Sork, to fill the unexpired term of Council- man. Roy D. Bryant Gordon L. Sork 'On motion by Terry seconded by Lambert the appointed Councilman recommendation of Mayor Irby to appoint Gordon L. Sork to the unexpired term of Councilman Roy D. Bryant, be confirmed and approved. Motion carried. The City Clerk -gave the oath of office to Gordon L. Sork. Following the oath of office Gordon L. Sork took his seat vacated by former Councilman Roy D. Bryant. On motion by Terry seconded by Waite the reports of the department heads as read by the Clerk be received and ordered filed. Street Lighting- On motion by Terry seconded by Waite -luntington Crest in accordance with the recommendations of the City Engineer, the City Engineer be instructed to pro- ceed with the street lighting in the Huntington Crest Tract, at a project cost of approximately $4,500.00, be approved. Motion carried. Public Hearing -Master Plan of Streets & Highways Mayor Irby announced that a public hearing had been advertised for 8:00 o'clock P.M., this date, and asked the Clerk to read the notice of public hearing. "'.public hearing will be held by the City Council of the City of Huntington Beach in the Council Chamber of the City. Hall, at the hour of 8:00 o'clock P.M., on Monday, October 5th, 1959, to consider amendments to the Master Plan of Streets and Highways revised, as recommended by the City Planning Commission following a public hearing held by the City Planning Commission on the 18th day of August, 1959, upon the proposal to amend the Master Plan of Streets and Highways." Councilman Sork Councilman Sork informed the City Excused from Voting Council that he had acted and voted on the revision of the Master Plan of Streets and Highways ` while a member of the Planning Commission and he refrained, from the discussions and deliberations on the matter and re- frained from voting. The Clerk reported that no oral or written statements had been made or filed with the City Clerk. Clifford Tripp- Clifford Tripp, Planning Director, Plannin3z Director explained the minor changes in the revision to the Master Plan of Streets and Highways and used the map posted in the City Council Chamber for reference .as he outlinedthe changes. Ar,., Thomoson Mr. Thompson appeared before the City Council and opposed Yorktown Street being made a second- ary Street. dm. Gallienne William Gallienne appeared before the City Council and stated he desired and recommended that Adams Street be maintained with a 120 feet instead of the 100 foot as proposed. 4. Public Hearing Mayor Irby announced that a public hearing had been set for 8:15 o'clock P.M. and asked the Clerk to read the legal notice of Public Hearing. Public Hearing- The Clerk read the legal notice, A - Master Land Use Plan Notice of Public Hearing published in the Huntington Beach News, on September 17th, 1959, setting a Public Hearing for 8:15 o'clock P.M., on Monday, October 5th, 1959, to consider revision of the Master Land Use Plan encom- passing all territory in the present City Limits as recommended by the City Planning Commission, following a Public Hearing, held by the Planning Commission on July 6th, 1959. Clifford Tripp- Planning Director Clifford Tripp ex - Planning Director -�' plained the proposed revision of the Master Land Use Plan as recommended for adoption by the Planning 5. 41 Page #r6 - �'inutes, Cctoter 5, 1959 Commission and referred to the Master Land Use Plan Map in the Council Chamber. uouise_Jenkins Louise Jenkins appeared before the City Council and stated she objected to the Land Use classifi- cation shown for the area South of Palm to Ocean Avenue and West to 23rd Street, and East to 14th Street, as an M-1 proposed use and said it should be proposed for residential use. Councilman Sork Councilman Sork informed the City excused from vot _a Council that he had voted on the proposed revision of the Master Land Use Plan while serving on the Planning Commission and he refrained from the discussions and deliberations on the matter and refrained from voting. Jack O'Brien Jack O'Brien appeared before the City Council and stated that he liked the revised Master Land Use Plan explained by the Planning Director except for various slight revisions. Gra-yr Meplie Gray Meglie appeared before the City Council and also was opposed to the M-1 Use for the area re- ferred to by Louise Jenkins. Lee Allen Lee Allen appeared before the City Council and stated that he would like to see the upgrading of all proposed planning for the City of Huntington Beach. Mr. Hill Mr. Hill a resident in the area of -Smeltzer stated that he spoke for a number of residents in the area who have a cow, chickens, rabbits, and desired that the area south of Wintersburg Road be retained as an A-1 area as people like himself living in that area desired to do a little gentlemen farming. :v:aring Cont, on Master On motion by Terry seconded by Waite ,andUse Plan the City Council continue the hearing on the proposed revision of the Master Land Use Plan until the first meeting of the City Council to be held in November, 1959. Paze #7 - Yli_nu tes, October 5, 1959 Public Hearing Mayor Irby announced that a hearing had been set for 830 o'clock P.M. this date and asked the Clerk to read the legal notice of Public Hearing. Pub] -ic Hearing The Clerk read the legal notice of -1-A Restricted Industrial District Public Hearing published in the Hunt- ington Beach News, September,24, 1959, relative to the proposed amendment adopted by the City Planning Commission recommending the addition of a new zone districting classification to be known as M-1-A, Restricted Industrial District Uses permitted and regulations thereof. The Clerk reported that no oral or written statements for or against the proposed M-1-A, dlassi- fication had been received. A representative from the. Quinton Eng- ineer's stated they desired the M-1-A classification to be set up as they desired that classification to be applied in the area North of Smeltzer Avenue, for the new proposed planned indust- rial area. There being no further statements for or against the proposed M-1-A classification the Mayor declared the hearing closed. City Att'y to prepare On motion by Terry seconded by Waite the Orr. RE: M-1-A Restricted Industrial District City Attorney be instructed to pre- pare the required Ordinance to provide for an M-1-A Restricted Industrial / District, be approved. Motion carried. Mayor:.Irby ordered a recess at 9:30 o'clock F.M. The City Council reconvened at 9:45 o'clock P.M., and called to order by Mayor Irby. Public Hearin Mayor Irby announced that a Public Hear- ing was set for 8:30 o'clock P.M. and asked the City Clerk to read the Notice of Public Hearing. Hearing Re: Uniform City Attorney Bauer called to the attent- Sign Code to be Readvertised ion of the City Council that the hearing set for'8:30 o'clock P.M. on the adoption of a Uniform Sign Code by reference, would have to be readvertised as the new 7. Page #8 - Minutes, October 5, 1.959 State law indicated that a period of 14 days between publication and the date of Public Hearing would be necessary as against the prior period of ten days. 'ublic Hearing- On motion by Terry seconded by ,, n Ordinance #733 Waite that the Clerk be instructed to place the required notices of public hearing in the Hunting- ton Beach News, setting a hearing on the proposed adoption of Ordinance No. 733, An Ordinance of the City of Huntington Beach adopting by reference the Uniform Sign Code 1958 Edition of the Internation Conference of Building Officials for 8:15 o' clock P.M., October 26th, 1959, and said publication to be placed in the Huntington Beach News on October the 8th and 15th, 1959, respectfully. Re: The Clerk read a communication 'c!) avin2 Cannery St. from the City Engineer, James Wheeler, making recommendations to the City Council regarding two alternatives in accomplishing the repaving of Cannery Street, as the Sanitation District job is nearing completion and arrangement to handle the repaving must be made before the contractor can receive final payment from the District and that action should be taken by the City Council at the meeting of October 5th, 1959. proposed by the City Engineer. The Clerk read the two alternatives On motion by Terry seconded by Waite the City Council in accordance with the recommendation, - of the City Engineer, grant the request of the Sanitation contractor for the Sanitation District to do the work of paving of Cannery Street subject to the following conditions: 1. Provide a performance bond, in the full amount of the assessment of the Ordinance ($36,500), to be effective for twelve months 2. Commence reconstruction by Nov. 15, 1959, and reconstruction, to be completed within 30 working days of commencement of work. Page #9 - Minutes, October 5, 1959 3. Engineering and inspection to be provided by City. 4. Materials for the 3" oil mix paving to be obtained from a source approved by the City Engineer. 5. Mix design to be approved by the City Engineer. If the contractor fails to comply with the performance of this work, the City will pick up his bond and have the work done with the capital made available by that means, and recommended that funds in excess of the contract price, less engineering and inspection costs, be refunded to the contractor, and the City Attorney be instructed to draw up the agreement in accord- ance with the provisions recommended by the City Engineer, be approved. Mayor Irby referred to the City Engineer, J.'e: 1.85 Acres and the City Attorney and the Garrish Bros. to make a study on the approximately 1.85 acres of land, a part of which is located on the Garrish Engineering, Inc. Plant, and said land containing an area of 1.85 acres, follow- ing study of easements and agreeable to Garrish Engineering Inc., and the City Council, to be sold to Garrish Engineering Inc., for the sum of $10,000.00. Re-classify- Douglas On motion by Lambert seconded,by Terry D'Arnall, Michael Hennessey & Gary Read the request of Vincent Moorhouse, Life- guard Chief, to change the classification of employees Douglas D'Arnall, Michael Hennessey and Gary Read from Lifeguard Sea- sonal to Lifeguard Fulltime, in the appropriate Salary Range, and Bracket and said classification changes to be effective October 6, 1959. Vincent Moorhouse- On motion by Waite seconded by Terry Annual Vacation the request of Vincent Moorhouse, Life- guard Chief, for permission to take part of;his annual vacation starting October 16, 1959, be granted. Motion carried. Ramona Potter- On motion by Lambert seconded by Terry Deputy City Clerk in accordance with the request of the City Clerk, Ramona Potter be appointed a Deputy City Clerk, be approved. On motion by Lambert seconded by Waite the City Council gives consent to the execution by the Recreation Commission the agreement between the Huntington Beach Union High;School Dis- trict and the Public Recreation Commission of the City of Huntington Beach_, whereby the Huntington Beach Union High School District grants to the Commission.the right to use certain school facilities for recreation purposes, be approved. Motion carried. Agreement -Ocean View On motion by Lambert seconded by Elementary School & 11 ecr._Dept. Waite the City Council give con- sent to the execution by the Recreation Commission in the agreement between the Ocean View Elementary School District and the Public Recreation Commission of the City of Huntington Beach, whereby the school grants the Commission the right to use certain school facilities for the purpose of recreation, be approved. Motion carried. Demands On motion by Waite seconded by Lambert the demands as approved by the Finance Committee be ordered paid. Motion carried. . : eso. 1'o. 1,395 - The Clerk read Resolution No. accepting Deed to :eat Property 1395, A Resolution of the City Council of the City of Huntington Beach accepting Deed to certain real property and authorizing the recording of said Deed. On motion by Terry seconded by Lambert Resolution No. 1395 was passed and adopted by the following roll call vote: AYES: Councilmen: Sork, Lambert, Terry, Waite, Irby. NOES: Councilmen: None. ABSEM -Councilmen: None. 1st Reading -Ord. #734 The Clerk gave the first reading in full of Ordinance No. 734, An Ordinance of the City of Huntington Beach relating to salary classification; adding 10. 1 �I 403 Page #11 - Minutes, October 5, 1959 amending, and repealing sections of the Huntington Beach Ord- inance Code. Lifeguard Chief to On motion by Lambert seconded by Waite conduct underwater breathing class in accordance with the request of the Lifeguard Chief, Vincent Moorhouse, for permission to conduct a class for underwater breathing and rescue team, be approved. Motion carried. Councilman Lambert On motion by Terry seconded by Waite appointment to West Orange County Water the appointment of Councilman Lambert Board to the West Orange County Water Board, to replace the vacancy caused by the resignation of Councilman Roy D. Bryant as recommended by the Mayor be confirmed and approved. Motion carried.
