Letson. On motion by Stang and seconded by Presson the Minutes of the Huntington Beach Planning Commission Meeting of Tuesday, October 6th, 1959p as transcribed and mailed by the Secretary were accepted as mailed. CONDITIONAL EXCEPTION:DV 139 To allow a conditional DIVISION OF LAND Applicant - K. E. Griffin exception to Section 9741.4 subdivision Ordinance of the Huntington Beach Ordinance Code. The Code re- quires 70 feet of frontage on corner lots, 60 feet of frontage on interior lots and 7000 sq. ft. and 6000 sq. ft. respectively. Located at the SE corner of Knoxville Street and Georgia Avenue and legally described as: DIVISION I: The north 53.89 ft. of Block 1008-A, Vista Del Mar Tract. DIVISION II: The south 107.77 ft. of the north 161.66 ft. of Block 1008-A, Vista Del Mar Tract. DIVISION III: The north 53.89 ft. of the south 107.77 ft. of Block 1008-A, Vista Del Mar Tract. DIVISION IV: The south 53.89 ft. of Block 1008-A, Vista Del Mar Tract. Chairman Bazil, requested that the public hearing be deferred until the proper legal notice could be given. He pointed out that at a meeting of the City Attorneys section of the California League of Cities convention, there was a seminar 244. Page #2 Minutes - H. B.-Planning Commission Tuesday, October 27th, 1959 explaining the new requirements of the State Government Code under the Planning and Conservation Act. Here it was pointed out that regular variance notice procedure was required to hold public hearings on even the most minor yard variances. The City Attorney concurred with the chairman's statements and advised continuance of the public hearing until legal notice was published and the notices mailed in accordance with the new state requirements just adopted. AREA VARIANCE: AV 172 Applicant - Vivian Lance withdrawn. USE VARIANCE: UV 173 Applicant-- Phil Dodd Association Chairman amateur midget race track. At the request of the applicant, the case was To allow the use of the land for the location of a nonprofit children's Located approximately 800 feet south of Smeltzer Avenue on the west side of Springdale Street,.and legally described as the east 4 acres of the S z of the NE 4 of Sectimn 219 T.5.S.9 R.11.Wi., S.B.B. & M. The Secretary read a letter received from Howard Smith, large land holder in the adjoining area,'in which the author wished to protest UV 173 on the grounds that it would deter future subdivisions which he had planned for his property. Doyle & Shields, a potential developer of the Smith property substantiated the letter of protest by phone call to the Planning Office. Frank Doyle of the men- tioned firm stated that his financing would be hand- icapped if the track were on the premises regardless of the conditions of the variance. 2. 245 Page #3 Minutes - H. B.-Planning Commission Tuesday, October 27th, 1959 H. J. Dontanville, 742 Rose - moat Avenue, Pasadena, an adjoining land owner protested the variance on the grounds that the noise and adver- sities of even a small race track would hurt his pro- perty values. He stated that he did not want to be malious, but that it was not realistic to establish what amounts to a hobby, where the hobby would devaluate the surrounding property potential. Phil Dodd, applicant, addressed the Commission and asked for consideration. He however stated that he would not fight it, if the surrounding property owners were so strongly opposed to the project. William Gallienne, Chamber Director, addressed the Commission and warned that the Commission must look to the future. Especially he pointed out that when the track became popular with so many people, they would find themselves unable to enforce conditions of the variance nor would it be easy to re- voke the variance. Gallienne suggested -that the race track should not be allowed to put their foot in the door, especially in the best firgin land the City has. A MOTION WAS MADE BY KAUFMAN AND SECONDED BY STANG TO RECOMMEND DENIAL. AYES: Presson, Doutt, Kaufman, Stang, Chairman Bazil. NOES: None. ABSENT: Letson. THE MOTION CARRIED. (Note - the application was withdrawn immediately after Planning Commission action) WEST ANNEXATION NO 2 A letter of transmittal was received from the .City Council requesting recommendation on the feasibility of proposed West Annexation No 2. The Commission discussed the 246, Page #4 Minutes - H. B. Planning Commission Tuesday, October 27th, 1959 Boundary Commission Reports and a submitted map. The area of influence was discussed together with the re- quirements and possibilities the City might have to provide the sewers and utilities needed for future development. Upon a lengthy discussion of the proposed annex, the Commission expressed them- selves to be unanamously in favor of the annexation. RESOLUTION -NO 72, A Resolution of the Planning Commission Recommending Approval of proposed Annexation No 2. A MOTION WAS MADE BY STANG AND SECONDED BY PRESSON TO ADOPT RESOLUTION NO 72.
