The Secretary presented
pertinent information as requested by the Chairman.
A letter from the Board of Trustees of the Huntington
Beach Elementary School District was read to the
Commission. The school board requested an opportunity
to acquire a school site within -the tract.
The Secretary reported
that the complete drainage report as requested by the
Commission was not available. The City Engineer was
unable to attend. The Secretary pointed out however
that the drainage problem had been work out in principle,
but that the financial obligation of the subdivider
had not yet been clearly established. Members of the
Commission indicated a desire to personally quiz the
City Engineer regarding the flood control. problem.
The hearing was opened
to the audience. Hugh E. Halderman, subdividing
engineer, addressed the Commission requested that both
the School problem and the drainage problem be contingent
conditions for a conditional approval of Tentative
Map No 3595.
Members of the Commission
indicated that they desired solutions to the major

problems before a Tentative Map was approved.
Chairman Bazil ordered the
hearing continued until the meeting of November 17th, 1959.
PUBLIC HEARING: Proposed Repeal of Sections
Governing Exceptions To Set-
back Requirements.

The Secretary reported to the
Commission that it was the recommendation of the Planning
Office that it would highly desirable to eliminate super-
fluous and misinterpreted specific exceptions to the
code when they were unenforceable and quite often in-
equitable.
The hearing was opened to the
audience, there being no comment the hearing was closed.
Discussion was held by the
Commission. Commissioner Stang requested an explanation
of what the side yard requirements would be if the ex-
ceptions were repealed. It was explained that the side
yards would remain as they -always have been in the past,
but that there would no further imposition of additional
setbacks due to the location of adjoining houses. It
was generally agreed by the Commission that the elimin-
ation of the subject sections would help to streamline
the code.
A MOTION WAS MADE BY KAUFMAN
AND SECONDED BY STANG TO ADOPT RESOLUTION NO 73.

THE MOTION CARRIED.
PUBLIC HEARING: Proposed Revision to Provisions of
the R-5 Multiple Unit and Trailer
Park Zone.
The Secretary reported to the
Commission that the Planning Office was not prepared to
present the new version to the R-5. Explanation was
given that there has been a quantity of recent legis-
lation regarding bulk and height controls which should
be incorporated into the new R-5 provisions.
Chairman Bazil continued the hearing
to the November 17th, 1959 meeting.
DISCUSSION OF POSSIBLE REVISIONS TO THE CODE TO PLACE
ALL CONDITIONAL EXCEPTIONS UNDER ONE CODE WITH AN
EQUAL COST.
The Secretary reported to the
Commission that the Planning Office recommends placing
conditional exceptions for all cases under a single set
of charges. He explained that the cost of applying
for a variance depends upon which part of the City the
property involved is located. It was explained that the
only fair way to handle the cases was to charge an
equal cost to all applicants.
The Commission requested a present-
ation of the proposed change at the next meeting at
which time a hearing date may be set.
FURTHER CONSIDERATION
OF DV 137 - Walter Charamza, City Attorney,
Applicant, City of
Newport Beach. Newport Beach, addressed the
Commission and presented a copy of
the proposed contract agreement which would require
the City of Newport Beach to dedicate and install full
improvement under specifically spelled out conditions.
Charamza stated that he had submitted the contract to

the City Attorney of Huntington Beach for approval as to
legal form. Charamza stated to the Commission that the
contract had been worked out by City Engineers and Planning
Directors of both cities. The Secretary interjected the
statement that no provisions of the contract were discussed
in his presence, and that discussion was only to consider
how much improvements were to be required - not specific
provisions.
Chairman Bazil challenged
the condition which would require development to be under-
taken across the street prior to allowing the City of
Huntington Beach to exercise the options within the
contract. He pointed out that there was no good reason
why this city's right to require full improvements should
be contingent upon development across the street. Chairman
Bazil ordered that this particular undesirable clause be
stricken from the contractual agreement before the
Commission would consider action.
Said undesirable clause was
stricken from the contract and represented to the Commission.
A MOTION WAS MADE BY STANG
AND SECONDED BY PRESSON TO AMEND DV 137 TO ALLOW THE
CONTRACT AS SPECIFICALLY PRESENTED BY THE CITY OF
NE`'iVPORT BEACH TO SUPPLANT THE CURB AND GUTTER AND PAVING
REQUIREMENTS, PREVIOUSLY ADOPTED.

TENTATIVE TRACT NO 3616 (Being a portion of original
Tentative Tract No 3469)
Total No of acres: 38.8 Subdivider: Doyle & Shields
Total No of Lots: 172 Engineer: Voorheis-Trindle-
Nelson.
The Secretary presented Tentative
Tract Map No 3616 with the explanation that it was
merely a portion of previously approved Tentative Tract
Map 3469. There was a minor street change however.
The Planning Department recommendations were the re-
tention of conditions applicable to Tract 3469 and the
requirement that a 10 feet pedestrian easement be place
over a 10 feet drainage easement.
The applicant was asked for
comment. Ken Carlson, engineer representing the sub-
divider, had no objections. It was noted that the drain-
age had been previously approved when it was a portion
of Tract 3469.
A MOTION WAS MADE BY PRESSON
AND SECONDED BY LETSON TO APPROVE TENTATIVE TRACT MAP
NO 3616 WITH THE FOLLOWING CONDITIONS:
1. All existing Flood Control Channels shall be fenced
in accordance with the Orange County Flood Control
District standards along all lots abutting said
channels. Said fencing shall be indicated on the
final map.
2. Street slopes shall meet city standards. Deviations
shall be subject to the approval of the City Eng-
ineer.
3. Vehicular access rights to Sugar, Smeltzer Avenues
and Bolsa Chica Road within Tract 3469 shall be
dedicated to the City of Huntington Beach, and
contractual agreement to this effect shall be en-
tered into at the time the final map is adopbd.
4. There shall be required a 6 feet high masonry wall
along all eastside Bolsa Chica Road property
frontage where no service roads are proposed. Said
Wall shall be indicated on final map, and shall be
placed on the public right-of-way and dedicated to
the City of Huntington Beach.

5. There shall be required a 10 feet pedestrian easement
from Sisson Avenue south through a proposed drain-
age easement to the existing OCFCD channel.
6. Note No 12 shall be changed to read - All property
line return radii shall be 20 feet except where a
street intersects a declared Arterial Highway,
then it shall be 30 feet.

DISCUSSION OF REVISIONS
TO THE 6-11 C-29 AND
ICI-1 DISTRICTS.
Chairman Bazil reported
that the sister city of
Laguna Beach has adopted
provisions to their commercial zones requiring full street
improvements at the time the building permit.is issued.
The Secretary reported that the County has a similar
ordinance, Ordinance No 916, which accomplishes the same
thing. As a matter of fact, it was pointed out that the
mentioned Ordinance is applicable to the existing
zoning in the annex areas.
Discussion was held by
members of the Commission in which it was agreed that the
properties should be treated equally throughout the city
in respect to these type of provisions..
The Secretary was ordered
by the Chairman to present a proposed ordinance which would
make the street improvements requirement uniform through-
out the city.
