On motion by Stang and seconded by Presson the Minutes of the Huntington Beach Planning Commission Minutes of October 27th, 1959, and November 3rd, 1959 as trans- cribed and mailed by the Secretary were, accepted as mailed. ZONE CASE NO 101 To consider a petition for Applicant - Glen D. Robertson - W... A. Young a CHANGE OF ZONE, relative to proposed change of district boundary and use classification from: R-4 County Land Use Ordinance No 351, as adopted by Interim Ordinance No 668 TO C-1 Neighborhood Commercial District. The following parcel of real property as submitted on the applicant's petition is described herewith: Located on approximately 7 acres of the NW corner of Talbert Avenue and Huntington Beach Blvd., and legally described as: PARCEL I: that portion of the W. 15 acres of the S. 20 acres of the SE 4 of the SE J� of Sec. 26, T.5.S.9 R.11.W.9 SBB & M., lying E. of a line which is parallel with and distant 627 ft. Villy from the E. line of said section. PARCEL, II: The E 2 of the SE 4 of the SE 4 of the SE a of Sec. 26, T.5.S., R.11.W., SBB & M., EXCEPTING THEREFROM that portion lying within boundaries of Huntington Beach Blvd. The Secretary reported that there was no formal protest submitted to his office and 254. Robertson, representing the applicant, addressed the Commission to give a resume of the contemplated shopping center. Robertson presented a graphic presentation in the form of a perspective render- ing. He stated that the shopping center proposed would contain a chain grocery, a chain drug, a chain variety and other supporting stores and personal services. There being no further comment the hearing was closed. Discussion of the zoning proposal was :held by the Commission. The Comm- ission disclosed its philbsbphy by asking the applicant if -he would object to the clause which would require the applicant to take out building permits on the shopping center within 18 months after approval of the zoning. The penalty for failure to take out the building permits would be that the property would automatically change its zoning status back to R-4 Districting as out- lined in the Huntington Beach Ordinance Code. The applicant stated that he did not want to encourage such a clause, but that he would accept it if he had no alternative. It was point- ed out by members of the Commission, that the applicant had the blessings of the city if he were to truly carry out the proposal as presented. But they felt if the applicant failed to develop within a reasonable amount of time, then the zoning should revert back one step to allow other developers to take the initiating steps for a shopping center. The Commission approved the proposed rezoning in principle. 2. 255 Page r3 Minutes— - Ii: B. ZONE CASE NO 102 To consider a petition for a Applicant - Alco Pacific ConstructionCHANGE OF ZONE, relative to Co. - Ted E. Lewis, Sec. proposed change of district boundary and use classification from: A-1 General Agricultural District, as adopted by Interim Ordinance No 668 TO C-2 Community Business District. The following parcel of real property as submitted on the applicant's petition is described herewith: Located on approximately 18 acres on the west side of Huntington Beach Blvd., having a triangular shape with side and rear boundaries being the Orange County Flood Control Channel C-5 and a line parallel to and a distance of 1320 feet from Heil Avenue. Legally described as: Beginning at a point at the intersection of Heil Avenue - and Huntington Beach Blvd., being the NE corner of the SE 4 of Sec. 23, T.5.S.9 R.11.W., thence S'ly along the E'ly line of said section approximately 1320 feet, thence Wily along the N. line of the S 2 of the SE 4 of said 3. 256 Page #4 Minutes- H: B. Said Flood Control Channel runs through the intersection of Huntington Beach Blvd., and Heil Avenue and extends SW'ly thereof. The Secretary reported that there was no formal protest submitted to his office and that the only communications involved inquiries. Chairman Bazil opened the hearing to the audience. Ted Lewis, representing the applicant, addressed the Commission. He gave a brief outline of what the 22 acre community type shopping center would consist of. Included in the proposal was one and possibly two chain markets, a junior depart - meat store, two chain drugs, variety stores, and support- ing business which might include professional offices. There being no further comment the hearing was closed. The Commission held a discussion on the various aspects of the proposed center and what implications it -had for the surrounding areas. The applicant, Ted Lewis, was asked if he had any comment about the 18 month restrictions. He stated that it would not hamper his plans in the least. It was point- ed out'that if there was to be unpredictable delays in meeting the 18 month deadline, then such a condition could be extended by Commission approval and Council consent. RESOLUTION NO 75 A resolution recommending approval of C-2 zoning for 22 acres of land on the SW corner of Heil Avenue and Huntington Beach Blvd. within a triangular parcel 4. 257 Page 715 Minutes- H. South of Aldrich Street. Legally described as: Lots 1 thru 13 and 34, 35, Tract 417, M. M. 16-47. The hearing was opened to the audience. There was no comment. Chairman Bazil asked if any representatives for the applicants were present, there being none the hearing was closed. Discussion of the proposed zoning ensued. Members of the Commission felt that if the applicants had no representation at the hearing, there was little need to take immediate action. Chairman Bazil, at the re- quest of the Commission, continued the hearing to the next meeting of December 1st, 1959. The Commission held a discussio# of the proposed project. The Commission reached the de- cision that the project was in actuallity a full fledged subdivision, but that they should have a recommendation of approval for the exceptions of the substandard front- ages. In all other respects, the Commission felt that the applicants should comply with the subdivision code of five or more lots. This would include curbs, gutters, sidewalks, street lighting, etc. 6. 25 Page ;`7 Minutes - H. B. That all provisions of the subdivision requirements shall be applicable, such as curbs, gutters, sidewalks, street lights, tree planting, etc. 2. That the RECORD OF SURVEY as submitted shall be submitted to the office of the County Surveyor and recorded in the office of the County Recorder. CONDITIONAL EXCEPTION To consider a petition for a AREA VARIANCE: AV 174 Applicant - CONDITIONAL EXCEPTION to regulations 011in C. Cleveland of the Districting Ordinance as adopted by key Ordinance 495. To allow rear yard to be 16 feet setback instead of 20 feet which is required in R-1 Zone. Located at 12th Street and Park Street and legally described as Lots 33 and 34, Block 911, Wesley Park Tract, Huntington Beach, California. The hearing was opened to the audience, there being no comment, the hearing was closed. Discussion of the Commission arrived at the following conclusion: Where the applicant is providing, a 11 feet side yard instead of the required minimum 4 feet side yard, then the applicant should be entitled to a variance of 4 feet to the rear yard setback where the proposed home is an asset to the neighborhood. CONDITIONAL EXCEPTION: AV 176 Applicant - Rallande Gomes To allow a deviation from the R-1 Single Family District regulations re- quiring a 20 feet rear setback. Application requests that the rear yard area be reduced to a 6 feet setback whereby the side yard patio area will equivalently substitute for the reduced rear yard area. Located at 1815 Main Street and legally described as Lot 339 Block 1704, Tract 51. The hearing was opened to the audience, there being no comment it was closed. The Commission discussed the case at hand and arrived at the following conclusion: That where the applicant is seeking to better the neighborhood, and where the applicant will not adversely affect his neighbors property, and where the applicant compensates for the yard variance by the inclusion of yard area at other locations on the lot; then the applicant has reasonable grounds for favorable consideration. Planning Commission Tuesday, November 17th, 1959 SCHOOL --SITE APPROVAL Site location is the 15 acres Elementary Site No 2 Applicant - located approximately 280 feet H. B.-Elementary School District south of Indianapolis Avenue and 1320 feet east of Hunt- ington Beach Blvd. Legal description as follows: Beginning- at the SW corner of the NE-2- of the SW a of Sec. 12, T.6.S., R.11.W., SBB & M; thence E. on the S. line of the NE 4 of the SW 4 of said Section a distance of 730 feet to a point, thence N. 968 feet on a line parallel to the W. line of said NE a to a point, thence W. 730 feet on a line parallel to the S. line of said NE a to a point in its W. line, thence S. on said W. line 968 feet to a point of beginning. The hearing was opened to the audience, there being no comment the hearing was closed. Discussion of the Commission was held concerning the feasibility of the proposed site. The Planning Director was questioned in regards to state approval of a school site within 800 feet of a proposed refinery. The answer was given that Dr. Knife, the representative of the state school housing authority had supported the site proposed on the grounds that if it the area was accept- able for residential housing, then the area should be acceptable for school housing. Planning Commission Tuesday, November 17th, 1959 TENTATIVE TRACT MAP NO 3508 Applicant - Doyle & Shields Total Acreage 55 Engineer - Voorheis-Trindle Total No of Lots 234 & Nelson Located on the north side of Heil Avenue between Graham Street and Bolsa Chica Road. Legally described as a portion of the S -j of the NE 4 Section 21, T.5.S., R.11.W.9 SBB & M. The Planning Department recommended a pedestrian bridge and walkway easement for OCFCD Channel crossing (Westminster Channel). The hearing was opened for comment to the applicant engineers. Ken Carlson, representing the applicant, addressed the Commission and asked for relief from the Planning Department re- commendation. The Planning Director explained the reasons why the Department was asking for the foot bridge - primarily on the grounds of traffic safety for school children. Ken Carlson stated that he was not aware of the new school site proposal, and on the basis of the new information, he dropped his official protest against the foot bridge. There being no further comment on the part of the engineer or Commission the hearing was closed. A MOTION WAS MADE BY PRESSON AND SECONDED BY DOUTT TO APPROVE OF TENTATIVE TRACT 3508 WITH THE FOLLOWING CONDITIONS: 1. Notes No 7 and 11 shall be deleted. 2. There shall be required a 10 feet pedestrian easement and bridge with identical alignment to pedestrian easement required in Tract 3616 where the two tracts are separated by the Westminster Flood Channel. RECONSIDERATION - In order that the newer members CONDITIONAL EXCEPTION TENTATIVE TRACT UP 3616 of the Commission may become better acquainted with the case in question, the Chairman continued action to the next meeting. TENTATIVE TRACT 1;3AP 3595 Subdivider - B.C. Deane Total Acreage 155 Engineer - Jennings and Total No of Homes 642 Halderman Located on the east side of Highway #39 between Atlanta Avenue and 660 feet north of Indianapolis Street, and legally described as a portion of the West z of Section 12, M.S., R.11.W.9 SBB & M. The Secretary read a letter of the City Engineer addressed to the City Council, in which the Council is given the discretion of timing for the establishment of a drainage survey and establishment of a drainage improvement district. The Secretary reported that the Council had taken the problem under advisement but that there has been no commitments made. The City Engineer was asked to make a report to the Commission in regards to the development of the Tract. The City Engineer stated that development of the lower basin area hinges upon a proper drainage control program. While development of the basin is feasible, the cost of the drainage projects cannot be financed by the City directly. He believed it would be necessary, depending on the results of the drain- age survey, to establish a separate basin drainage district whereby the cost of the project could be prorated to the benefiting property owners. The City Engineer recommended 11. 264. Page JJ12 Minutes - H. B. Planning Commission Tuesday, November 17th, 1959 that the proposed tract be delayed until there was assurance the drainage study could be solved. Chairman Bazil asked for a report from the oil committee because there was several oil drilling sites proposed within the tract. Dr. Kaufman, Committee Chairman, submitted the following requirements as the basis for establishing the drilling islands within the tract. 1. Landscaping and a 6 ft. masonry or block wall where the drill -site abuts a residential lot. 2. Soundproofing required where the drill site abuts a residential lot. 3. Electrification of pumping operations. 4. Underground (Kobe pumping units required where the Commission can prove it feasible from a reservoir standpoint.) 5. Height limitation on production tanks shall be 8 ft. above ground level. 6. Trucking and loading from drill site shall be limited to the hours of 8:00 A. M. and 6:00 P. M. without exceptions. 7. All standards of performance as required within the Ise-1-A Restricted Manufacturing District as outlined in the Huntington Beach Ordinance Code, shall be applicable to all drill sites. Discussion of all aspects of the subdivision followed. Members of the Commission indicated that they believed the subdivision was a bit premature. It was the consensus of opinion that the tract should be delayed until something more concrete in the way of drainage control district was established. RECONSIDERATION - The parking plan for the USE VARIANCE W 7'r151 Applicant - proposed 27 unit apartments Warren Crafton as approved with appropriate parking was submitted to the Commission for their consideration. Marren Crafton, applicant, addressed the Commission and explained how the traffic circulation was to function. Discussion was held by members of the Commission. The policy of parking regulations as conceived by the Commission was not unanamous . A MOTION WAS MADE BY STANG AND SECONDED BY PRESSON TO APPROVE OF PARKING PLANS SUBMITTED FOR UV r151 AS BEING SUFFICIENT FOR A BUILDING PERMIT. THE MOTION CARRIED. VARIANCE PERP,IIT: VP 175 Applicant - E. R. Severin The applicant requests deviation to Orange County Land Use Ordinance No 351 as amended by Ordinance No 916 - requiring the dedication and improvement along frontage of a trailfr park where it abuts an arterial highway. The proposed trailer park is located on the south side of Garfield Avenue between Huntington Street and Delaware Street and is legally described as Blocks 3203, 3204, 3103, and 3104, East Side Villa Tract. The Secretary recommended that the Commission take under advisement the fact 13. 266 Page #14 Minutes - H. B. Planning Commission Tuesday, November 17th, 1959 that item No 14 - requirements for street -dedication was also on the agenda. The hearing was opened to the public. Jack Brennan, representing the applicant, addressed the Commission and asked for relief. He stated that the applicant could ill afford to develop the streets and the trailer park also. John Thompson, 727 Williams Street, Huntington Beach, California, addressed the Commission and stated that he had the 24 apartment units which were built north of the applicants property on the west side of Garfield. He stated that he could ill afford to not have the street improvements if the trailer park was developed. He explained that the curbs and gutters would be an essential part of protecting his and surround- ing property from flooding hazards. There being no further comment, the hearing was closed. A MOTION WAS MADE BY KAUFMAN AND SECONDED BY DOUTT TO RECOMMEND DENIAL OF VP #175 - IT BEING INCONSISTENT WITH ESTABLISHED CITY POLICY. PROPOSAL TO INTAKE STREET DEDICATION AND IlvIPROVEMENTS OF ALL INDUSTRIAL AND COMMERCIAL DEVELOPMENT A UNIFORM REQUIREIENT. Discussion was held on the problems of making street dedication and improvements uniform throughout the city for all industrial and commercial developments. 14. 267 Page #15 Minutes - H. B. Planning Commission Tuesday, November 17th, 1959 The Planning Department recommended the requirements which would be identical to that which is required in the 11-1-A District. It was pointed out that this version of street dedication is•more flexible than that which the county requires in their Ordinance No 916. A MOTION WAS MADE BY KAUFMAN AND SECONDED BY STANG TO SET THE DATE OF PUBLIC HEARING FOR DECEMBER 15th, 1959• THE MOTION CARRIED. PROPOSED R-5 REVISIONS A MOTION WAS MADE BY KAUFMAN AND SECONDED BY DOUTT TO CONT- INUE THE HEARINGS UNTIL FINAL REVISIONS CAN BE MADE FOR PRESENTATION. THE MOTION CARRIED. PROPOSED REVISIONS A MOTION WAS MADE BY DOUTT AND LIAYING CONDITIONAL EXCEPTIONS PROCEDURE SECONDED BY PRESSON TO SET THE UNIFORM DATE OF PUBLIC HEARING ON THE MATTER FOR DECEMBER 15th, 1959. THE MOTION CARRIED. PROPOSAL TO ELIMINATE The members of the Commission ALL HOME OCCUPATIONS CLAUSES FROM ALL ZONES were divided in their opinions of the proposal. There was no action taken.
