To consider a petition for a
CHANGE OF ZONE, relative to proposed change of district
boundary and use classification from: A-1 General
Agricultural District, as adopted by Interim Ordinance No
668 TO C-1 Neighborhood Commercial District.
The following parcel of real
property as submitted on the applicant's petition is
described herewith:
Located on the west side of
Huntington Beach Blvd., to a depth of 150 feet between
Smeltzer Avenue and 50 feet south of Aldrich Street.
Legally described as: Lots
1 thru 13, and 34, 35, Tract 4172 M. M. 16-47.
A report was read to the
Commission. The hearing was opened to the audience:
Floyd A. Wright, broker re-
presenting the applicants, addressed the Commission and
stated his interest in constructing a commercial building

at the SW corner of Aldrich Street and Highway #39.
Chairman Bazil asked the
applicant's representative to review the report and
make some comment. Mr. Wright explained that he had
spent considerable time and money in his proposal to
develop his property. But he stated that he had no
actual tenants for his proposed building at this time.
There being no further comment, the hearing was closed.
Chairman Bazil then reviewed the policy for spot zoning.
The Commission then entered the discussion on the basis
of eliminating the zoning by granting a variance instead.
The situation would not lend itself to a variance it
was ascertained because there was no definite use pro-
posed at this time. Commissioner Dr. Kaufman brought
out the point that the demand for the business should
exist before the very localized type of business zoning
should be granted. The Commission declared themselves
against rezoning to commercial on the basis of pure
speculation without intent to develop. It was pointed
out by members of the Commission that this case, in
reality, was a strategic one in that here was a situation
where the applicant needed rezoning for his 50 feet of
frontage along a highway but had to necessarily involve
250 feet of other frontage which was actually to be used
residentially for many years to come. It was established
by the Commission, that here was a case where, if granted,
would eliminate any future objections to strip zoning
the Commission may have. Established precedence would
overrule future arguments in future cases, of which many
are expected shortly.
Chairman Bazil pointed out
that the lack of depth was a serious handicap for proper

development of the property. He stated that he would
favor the rezoning if all the, property involved were
combined in a single development where points of in-
gress and egress could be controlled. Otherwise, it
was pointed out, the properties have all the makings
of sub -marginal business sprawl.
It was pointed out that
the applicant would have recourse to a variance in the
event he acquired the prospective tenants.
A MOTION WAS MADE BY
DOUTT AND SECONDED BY KAUFMAN TO RECOMMEND DENIAL FOR
THE FOLLOWING REASONS.AS FORMALLY STATED IN RESOLUTION 77:
1. Depth of proposed C-1 lots are only 150 feet and
are considered inadequate for proper development.
2. The present Commission policy which is expected to
be adopted in Ordinance form is the requirement of
a 50 feet setback from Highway #39 for all types of
commercial development excepting service station

3. The number of 25 and 50 ft. lots in the area present
a problem of uncontrolled access to the expressway.
Ingress and egress without limitation would hamper
traffic flow and create serious traffic hazards.
4. There are 3 single family homes in the area which
will present a serious conversion problem in that
they would not meet the code for commercial structures,
yet the property owners could not afford to abandon
them.
5. There is the threat of more pressure for commercial
strip zoning extending south, along highway frontage
of the same tract.

The following parcel of real
property as submitted on the applicant's petition is
described herewith:
Located on approximately
1000 acres at the NW boundary of the City of Huntington
Beach and legally described as portions of 9-5-119 10-5-11,
and 16-5-11 as submitted on two pages of applicant's file.
The Secretary gave an oral
report and explained the supporting maps and charts of
the Aldrich R. Peck property development.
The hearing was opened to the
audience. Bud Crow, representing Quinton Engineering,
addressed the Commission and answered several questions
concerning their clients plans for the proposed in-
dustrial park. There being no further comment, the
hearing was closed.
Commission discussion was
favorable towards the zoning proposal.

to the audience, there being no comment, the hearing was
closed.
Commission discussion
brought out the fact that several of the new homes in
that very block had made identical requests, and that the
quality of the homes warranted deviation from the code
where no determent resulting from the action could be
ascertained.

District.
Located approximately 85 feet
southerly of Olive Avenue on the westerly side of 15th
Street, Huntington Beach, and legally described as Lots
15, 17, 19, and the S'ly 16 feet of Lot 21, Block 215,
Huntington Beach Tract.
The Secretary gave an oral
report considering the area in which the variance was
requested. He emphasized that the area which advocated
for M-1 on the Master Land Use Plan did not have the
blessings of the Commission nor some of the property
owners. It has long been recognized as an area for
controversy. The Secretary recommended further public
hearings or other types of surveys to determine the
sentiment in the whole area. It was pointed out, that

for the area to become rejuvenated and reformed back to
residential use, it would be necessary to eliminate oil
zoning - an act which is never popular when the chips
are down. -

addressed the Commission: Al Cusolito, 828 - 14th St.,
Huntington Beach, - protested M-1 use -and W 1779
Paul C. Porter, 9142 - 10th Street, Huntington Beach -
protested W 177 - stated that he was in the process
of cleaning up his lease. He advocated multiple
residential use. Sylvia Shandrick, 228 Main Street,
Huntington Beach, - protested, advocated residential.
John F. Thompson, 727 Williams Street, Huntington Beach,
stated that he had property on 17th Street and that he
favored UV 177. Paul Hoffman, stated, that he had a
house nearby and that he did not object to UV 177.
Jack O'brien, Agent for Houston Real Estate, Huntington
Beach, stated that he had many requests for property in
the neighborhood for long range plans of residential
development. Carl Robinson, applicant, stated that he
was in the process of cleaning up his lots recently ac-
quired from the city, he felt there was no harm in a
temporary yard which could be removed at the time the
nearby properties were cleaned up for residential use.
He sympathized with the persons who were interested in
residential development. But he concluded that unless
the property owners in the area were willing to clean up
and take some positive action, then they had no right to
oppose any development M-1 or otherwise. Blanche Wood,
201 5th Street, Huntington Beach, advocated rejuvenating
the area for residential. Others - similar feelings.

There being no further comment,
Chairman Bazil began the
discussion by stating he had conferred with several
independent oil operators in the area who had admitted
that within another year the area would not be used
for oil drilling. He pointed out that the decision
should be made at a public hearing to decide the fate
for the entire area. This would call for a revision
of a specific area of the Master Land Use Plan.
Chairman Bazil further
questioned members of the audience who were property
owners in the area. Those questioned, stated that they
advocated repeal of oil zoning. Other members of the
Commission felt that the Commission should not be
rushed into making a quick decision, and that a public
hearing was appropriately called for.

oral report. The hearing was opened to the audience.
The applicant - firs. Lottie Stevens, addressed the Commiss-
ion and gave several answers to questions as asked by the
Commission. There being no further comment, the hearing
was closed.
Commission discussion
concluded with the need for a pedestrian and utility
easement along the westerly property line.

Upon due consideration of
the proposed tentative tracts, and the tract under con-
struction, the Commission concluded that the site was one
of necessity and was appropriate under the circumstances
of having other lands around it under the process of
subdivision.

FREE�JAY REQUEST The Secretary read a letter of
transmittal from City Engineer,
who had received a comunique from the State Division of
Highways District No VII requesting a position be taken
concerning the City of Westminster request for an under-
pass beneath the projected San Diego Freeway. Mr. Wheeler's
position was to support the contention of the City of
Westminster only if the Alignment of Hoover Street were to
remain on the west side of the Railroad right-of-way where
the alignment approaches the freeway right-of-way. Wheeler
pointed out that if the City of Huntington Beach allowed
Westminster to align the Hoover Street right-of-way on the
east side of the RR R/W then the City of Huntington Beach
would be stuck with an expensive highway to develop in-
cluding an RR R/W grade crossing plus signalization etc.
And besides the reasons stated,the Westminster alignment
would not coincide correctly with the Gothard Street

alignment and therefore be of little value to this city.
Wheeler suggested either dropping any underpass request or
demand realignment.
A MOTION WAS MADE BY STANG
AND SECONDED BY DOUTT TO RECOMMEND NO__FURTHER PARTICIPATION
IN THE PLAN BY THIS CITY UNLESS THE WEST SIDE ALIGNMENT IS
AGREED UPON.

The applicant requested
deviation to the frontage requirements,the alley requirements,
and area requirements of corner lots all in deviation the
City Subdivision Ordinance.
Lowell Evans, applicant,
addressed the Commission and explained his planned project.
John F. Thompson, 727 Williams Street, Huntington Beach,
addressed the Commission and asked for assurance that there
would be no drainage to the north which would ruin the pro-
perties. The Secretary reported that the developers planned
to drain westerly across Huntington Avenue and on to the south
to a natural ponding basin. There being no further comment
the hearing was closed. A discussion followed.

CONSIDERATION OF SUBDIVISION
MINIMUM LOT SIZE REVISION The Secretary reported
the action of the local
Chamber of Commerce Directors who signed a petition re-
quested that minimum lot sizes be raised to a minimum
of 7200 sq. ft. He further reported the action of
a subcommittee of interested persons who held a meeting
at the Huntington Beach Country Club at a luncheon to
establish the reason if any for the need of lowering the
density of prospective subdivisions. The participants
of the meeting, which included mostly representatives
of the Chamber of Commerce, concluded that the need was
well established for controlling density of new sub-
divisions by any means available.
RESOLUTION NO 76 Recomending adoption of revisions to
the subdivision ordinance requiring
7200 sq. ft. minimum lot sizes.

LETSON AND SECONDED BY DOUTT TO ADOPT RESOLUTION NO 76.

CREATION OF USE PERMITS FOR The Secretary reported
TEMPORARY SUBDIVISION SIGNS
AND SALES OFFICES the immediate need of
legislation for use permits
to control subdivision signs and sales office. He
further suggested that they be required to post adequate
bonds to guarantee removal at the appropriate times.
The Commission agreed
to consider any such proposals as may be drafted and
presented to the Commission.
