LIINUTES: On motion by Stang and seconded by Letson, the Minutes of the Huntington Beach Planning Commission of Decemb_pr cl5_, 1959, as transcribed and mailed by the Secretary were accepted as mailed. ZONE CASE NO 105 Located on approximately 40 acres Applicant - Dr Adrian Hubbell at the NE corner of Heil Avenue and Bolsa Chica Road. To consider a petition for a CHANGE OF ZONE TO: C-1 3.8 acres R-3 3.6 acres R-5 12.0 acres R-1 Residential The hearing was opened to the audience. Dr. Hubbell, applicant, addressed the Commission and requested permission to amend the case in order that he may request R-5 District zoning -in place of that was requested for R-3 Districting. Chairman Bazil explained that such action would require an amendment to the case and readvertisement and reposting of the property. Chairman Bazil asked for any further comment from the audience, there being none the hearing was closed. Approx. 5 acres Art ►ebb Boats To consider a petition for a CHANGE OF ZONE from: R-4 Suburban Residential District as adopted by Interim Ordinance No 668 TO C-2 Community Business. Located at the southwesterly corner of Main Street and Huntington Beach Blvd., in the Five Points Area. Legally described as: Lots3 and 4, Block "H", Tract No 7. The Secretary made an oral report in support of the requested zoning. It was pointed out that the area has been proposed for commercial use on the Master Land Use Plan, the area has actually been rezoned by the City in a previous rezoning attempt, and the ultimate development is proposed as a super gasoline service station to be built in the immediate future. Plans for the Service Station were submitted by the applicant. The hearing was opened to the public, there being no comment, the hearing was closed. RESOLUTION NO 85 A Resolution of the Planning Commission recommending approval of Zone Case No 111 to City Council with statement of reasons. That the application for. a proposed change of zone does meet the criteria for a well designed and logical commercial district. And that the proximity of the property to an existing stop light which controls traffic along Beach Blvd. and Main Street, each of which are considered major arterials, lends itself 2. 296 Page r3 Minutes - H. Planning Commission Tuesday, January 5th, 1960 TENTATIVE TRACTS Engineering - Voorheis-Trindle- CONTINUED Nelson Representative - Ken Carlson Located at the SW corner of Springdale Avenue and Smeltzer Street, Huntington Beach, California. The Planning Director repor-ted that a subdivision review committee had held a long study session on the foregoing maps on December 18th, 1959, and that the basic requirements had been satis- factorily complied with. The Planning Director gave the Commission a report on the Flood Control problem*, and read a letter from Orange County Flood Control re- questing a chain link fence along the existing channels to -be built to Flood Cotrol standards by the subdivider. Commissioner Stang asked the subdivider if he objected to paving the alley which was required at the rear of the school site. Ken Carlson, Engineer for the tract, addressed the Commission and stated that he had no objections to the paving requirement nor the fencing of the existing channels. There was no further comment from the subdivider. Existing Westminster Channel of the Orange County Flood Control District which lies west of and parallel to Graham Street shall be chain link fenced according to Flood Control Standards. Planning; Commission Tuesday, January 5th, 1960 A MOTION WAS ?BADE BY THOI,IPSON AND SECONDED BY STUNG TO APPROVE OF TENTATIVE TRACT MALP NO 3657 i7ITH THE FOLLOWING CONDITION: 1. Existing Westminster Channel located at the east and south end of the tract shall be chain link _fenced in accordance with Orange County Flood Control Standards. ROLL CALL VOTE: AYES: Letson, Thompson, Doutt, Kaufman, Stang, Chairman Bazil. NOES: None. ABSENT: Presson. THE IyIOTION CARRIED. FIRST PUBLIC HEARING: Fire Chief Higgins gave a PIASTER PLANT OF FIRE STATION SITES presentation of the city's long range plan for fire pro- ;tection. Various facets as outlined in the Master Plan of Fire Station Sites were discussed in detail. Chief Higgins was commended for the exceptionally comprehensive and detailed report. The hearing was opened to the audience, there being no comment the hearing was closed. Commissioner Thompson questioned Chief Higgins in regards to specific relocations of sites of a plan that was previously submitted. Chief Higgins pointed out that the plan was a Plaster Plan and that the plan was pri- marily to establish two battalions and ten station districts, and that it was of no consequence to the report if the precise location of a site was relocated a general area within an established district. BASIC OUTLINE OF THE REPORT SUBMITTED: The Study is made up of the following items: 1. Number and area of battalions. 2. Number of Fire Stations and roll area of each station. 6. 300 Page #r7. Costs of Capital Outlay for Sites, Stations, Apparatus, and Equipment. One of the purposes of submitting this plan at this time is to have the City Council approve it that we may require subdividers donate sites at the right locations or make the lots available to the City at low cost and before housing is built on them. This plan is carefully worked out using planning and zoning studies of Public Utility Corporations, The Underwriters Grading Schedule of the Board of Underwriters of the Pacific, Master Plan of Highways and trends in growth of mercantile, in- dustrial or residential areas. MOTION WAS MADE BY KAUFMN AND SECONDED BY DOUTT TO SET THE DATE FOR THE REQUIRED SECOND PUBLIC HEARING FOR JANUARY 19th, 1960. THE PVZOTION CARRIED. PUBLIC HEARING: Legal notice was given MASTER LAND USE PLAN - REVISION OF PROPOSED for a public hearing SPECIFIED AREAS. for the following areas: (a) That area located between Ocean Avenue and Palm Avenue and between 15th Street and the alley lying between 16th Street and 17th Street. The area would be legally described as the easterly 2 of Blocks 116, 216, 3169 416, 516, 616, and all of hlocks 115, 215, 315, 515, and 615, Huntington Beach Tract. Concerns proposedindustrial or residential use. (b) That area located on the 10 acres at the NVJ corner of Talbert Avenue and Huntington Beach Blvd., legally described as a portion of the SE 4 of the SE 4 of the SE 4 of Section 26, T. 5. S. , R.11. d1. , _ SBB & M. Concerns commercial use. 7. 301 Page 7#8. Minutes - H. B. Planning Oommission ' Tuesday, January 5th, 1960 The Planning Department report was given stating that if public interest and sentiment would support the project, then it would be feasible for the community to retain the area for future apartment housing areas near to the beach. To do this, it was pointed out that it would be necessary to change the land use proposal on the Master Plan of Land Use back to R-3 Development, and then it would be up to the property owners involved to instigate rezoning to remove the existing oil zoning. It was pointed out that with- drawal of the oil zoning would be a big factor in re- developing the area. A motion was made and seconded by the Commission to waive any zoning fee required normally in connection with the proposed removal of oil zoning. The motion carried. The hearing was opened to the public: Mrs Louise Jenkins - advocated residential and removal of oil. Jessie C. Jensen, 305 - 14th Street, Huntington Beach, favored residential and abandonment of all oil. Alfred Cusolito, 828 - 14th Street,,Huntington Beach, has property in the affected area - proposes R-3 land use without drilling. Ray Megli, 1520 P,Zagnolia Street, Huntington Beach, resides in the area, wants everything done which would make possible the complete rehabilitation of the area for residential use without oil drilling. Mrs Sylvia Shandrick, Clark Hotel, Huntington Beach, ovens property in the area, wishes to retain for re- sidential development, and wishes city to force abandon- ment of non producing wells. (NOTE: It was pointed out'by the City Attorney, that until such time as the oil zoning is removed, this type of action would be impossible.) Jack O'Brien, Representative of Taxpayers League, went.on record as being a Taxpayer League Committee of zoning which was in the majority in favor of high density residential and the removal of oil drilling from the affected area. Planning Commission Tuesday, January 5th, 1960 Alice,Herman, 416 - 15th Street, Huntington Beach, advocated residential use and the abandonment of all oil drilling. the hearing was closed. There being no further comment Commissioner Thompson advocated that the area be used for Commercial or Industrial use until such time as it could be cleaned up for residential use. Chairman Bazil lead the primary discussion in which it was concluded that the encouragement of industrial intermingling with the residential should be eliminated and that no development at all would be better than blighted development. It was pointed out that substandard and undesirable housing would not be of benefit to the community and not conduci-r_e to good city planning. Discussion was opened for area (b) that area which is now being rezoned to C-1 Neighborhood Commercial District. The hearing was opened to the audience, there being no comment, it was closed. Commissioner Stang questioned the advisability of changing the land use for''the proposed shopping center until it was actually under construction. The Commission acknowledged the merits of the contention as submitted: however it was deemed advisable to support the advoc- ated zoning until such time as it was concluded the proposed shopping center failed to materialize. At this time it was argued, the Land -Use and zoning could both be changed back. USE VARIANCE: UV 180 To allow two single family Applicant - Ken Clark dwellings on one lot in variance A-1 General Agricultural District. Located at 7932 Aldrich Street, Huntington Beach, and legally described as Lot 51, Tract 417. A report was given by the Planning Department. It was pointed out that the extreme depth 50 ft. by 200 ft. would easily facilitate two separate dwellings without being incompatible with the surrounding neighborhood. It was pointed out also the many other instances where such a request was granted under identical circumstances. T The hearing was opened to the audience, there being no comment, the hearing was closed. Discussion followed, there was no contention. ABSENT: Presson. THE MOTION CARRIED. 10. 304 Page #11 11inutes - H. B. Planning Commission Tuesday, January 5th, 1960 CONDITIONAL EXCEPTION:. UV 7-T181 To alloy three "single Applicant - Francis A. Gallo - Located at the Nally corner family" dwelling units, of 15th St., and Magnolia Ave. one of which will be a garage apartment, to be constructed in the R-2 District in variance to the Huntington Beach,Ordinance Code. Legal description Lots 1 & 3, B1k.515, 17th St. Sec., H.B.Tract. The Planning Department made a report recommending -denial without prejudice until final action of the proposed land use was known. The hearing was opened to the audience. John Felhoelter, representing George Construction Co., addressed the Commission and stated that the applicant was their client and that.they were requesting deviation from the existing zoning. There being no other comment the hearing was_closed. Discussion was entered into by the Commission. The Commission appeared to be divided in the opinion that the land use change proposed would by R-3.and that the area would become rezoned shortly to R-3 without oil. Chairman Bazil pointed out that while the Commission has gone on record supporting a change of the land use plan to R-3, there are too many contingencies involved to specify that the area would soon be rezoned. It was further pointed out that it has been the basic policy of the Commission in the past that there would be no variance for higher until/ density granted such time as the area was actually rezoned or where there was a proven case of unique or unusually shaped land which could be justified for the granting of a variance. Chairman Bazil recommended continuance of the case to the next meeting;* the Commission held in favor of -that motion. The case was continued to the 11. 305 Page #12 I;Tinutes - H. B. CONDITIONAL EXCEPTION: UV 182 To allow 4 apartment Applicant - Ida Lay Wells units to be built on a single lot in the R-4 District. Legally described as Lot 24, Block 110, Huntington Beach Tract, and located at the southwest corner of llth Street and Walnut Avenue, Huntington Beach. The Planning Department gave a report recommending denial on the grounds that the applicant had only a 25 feet frontage lot and that the existing zoning of R-4 which establishes a maximum of one unit per 750 sq. ft. of land area is considered the most lenient in the county area. to the audience. The hearing was opened Everett Gust, re- presentative of the apartment development diagonally across the street from the applicants property, addressed the Commission and complained that the pro- posed apartments to be built.on a 25 foot lot would be detrimental to his property and devaluate the neigh- borhood. He contended that the R-4 zoning being as liberal as it is, should be upheld to the letter of the law. 1 Leroy Paxson, 505 12th Street, property owner in the vicinity, addressed the Commission and protested the proposed variance on the grounds that such a development would be detrimental and an eyesore to the neighborhood. It was pointed out by both Protestants"that in order for the applicant to meet the required parking ordinance, the curb break 12. 300 Page ytl3 Minutes- H. B.-Planning Commission Tuesday, January 5th, 1960 would have to be made the major length of the surrounding curb thus eliminating all but one on street parking space and thus creating parking problems for the rest of the neighborhood. USE VARIANCE: UV 185 To construct model homes Applicant - Hintz Construction for sales purposes and to be moved when tracts are sold out. Located at the corner of Heil Avenue and east of Huntington Beach Blvd., and legally described as portion of the N 2 of the 10 4 of the SW 4 of Section 24, T.5.S., R.11.W-9 SBB & M., EXCEPTING the E'ly 2334.00 ft.,the N'ly 190.00 ft., the the S' ly 147.60 ft., and the Ti l ly 102.00 ft. The hearing was opened to the audience, there being no comment it was closed. Discussion followed. There was no contention, it being a rehash of a previous division of land. A $1000.00 bond for each model home shall be required to be posted guaranteeing removal of.the four model homes within one year of the granting of this variance unless the City Council at the end of the one year agrees to extend the time. In the event that the model home or homes are not removed in accordance with this variance stipulation, the applicant shall forfeit bond and shall permit the appointed agents of the City to remove all structures permitted under this variance. PUBLIC HEARING: The Planning Director gave CREATION OF USE PER1,1ITS a department report on the proposal to establish an ordinance allowing use permits to be issued for the erection of subdivision directional signs within the zoning district along an arterial highway. Use permits would also be issued for the temporary use of sub- division houses as model homes, or construction offices. In any such event in conjunction with the use permit, a surety bond would be required to guarantee compliance with the conditions of the use permit. A Use Permit would require only the approval of the Planning Comm- ission. The directional subdivision signs would be limited to 200 'sq. ft. and would be restricted by a time limitation of one year or complete sales of the tract which ever occurred first. Under no cir- cumstances would a use permit be granted for more than one year. Filing fee proposed would be $25.00 The hearing was opened to the audience, there being no comment it was closed. The Planning Director was instructed to present the proposal in formal form of an ordinance at the next meeting for further action. PUBLIC HEARING The written version of the R-5 REVISIOU OF R-5 District .ARTICLE 939 proposal submitted by the Planning Department for study by the Commission. The new R-5 Zone District would be lossened up to allow professional offices, trailer parks, hotels, motels, and multiple unit housing only. The hearing was opened to the audience, there being no comment it was closed. Commissioners Kaufman, Doutt, and Thompson questioned various facets of the proposal to better analyze what was trying to be accomplished. Doutt's query was pertaining to the sufficiency of the proposed 1000 sq. ft. minimum trailer space requirement already established in the trailer park regulations. It was agreed that the Planning Director would attempt to gather more back- ground material on trailer parks within neighboring cities. Dr. Kaufman was interested in the professional office aspect and why it was envolved. Thompson questioned the requirement of 10,000 sq. ft. and 70 ft. of frontage for a motel.
