' Reso.#86-H.B, The Clerk read letter of transmittal Planning Commission received from the Planning Commission transmitting their Resolution No. 86, A Resolution of the Plan - tying Commission of the City of Huntington Beach adopting Master Land Use Plan - Revised January, 1960, and recommending revisions of specific areas of the Master Land Use Plan. Notice of Hearing- On motion by Waite seconded by. Terry ."Master Land Use Plan" the City Clerk be instructed to place a legal notice in the Huntington Beach News setting a hearing for 8:30 o'clock P.I., on February the ist, 1960, on the pro- posed recommendations of the Planning Commission to revise specific areas of the adopted Master Land Use Plan, and that the hearing be held on the two specific areas described as. follows: (A) That area located between Ocean Avenue and Palm Avenue and between 15th Street and the alley lying between 16th Street and 17th Street. Chamber of Commerce - proposed business license ordinance The Clerk read a communication received from the Huntington Beach Chamber of Commerce advising the City Council that a special committee headed by Dr. David H. Payne, has studied and discussed the new proposed Business License Ordinance and requests -that the Board of Directors and the Committee fe6l that after a study of the Ordinance.there is need for,further study and needs further evaluation and would.be pleased to meet -with the City Attorney or.a Committee of the Cou44;ij in order to: clarify the intent. Dr,'David Payne Dr, David Payne, past president of the Chamber of Commerce addressed the City Council and stated that there are many aspects of the proposed licensing ordinance they would like to discuss with a committee of the Council, whenever the committee the Mayor appoints, to clafify certain conclusions that.the Chamber of Commerce Committee has arrived at. Martin Wierman Martin Wierman giving -his address as Box 285, Huntington Beach, California, appeared before the City Council and requested the City Council to take immediate action in the adoption of the proposed Business Licensing Ordinance that has been under study, in order to safe -guard further loss to the tax payers of the City of Huntington Beach. U.V.#180 The Clerk read a letter of transmittal Kenneth L. Clark from the Huntington Beach Planning Commission relative to Use Variance #180, Petitioner being, Kenneth L. Clark 1232 Conway Avenue, Costa Mesa, California, to allow two dingle family dwellings on one lot in variance to the A-1 General Agricultural District, location at 7932 Aldrich Street, City, legal description being Lot 51, Tract 417, and pursuant to the Conservation and Planning Law of the State Government Code, a public hearing was held on.January 5th, 1960, by the City Planning Commission to consider above petitioner's request. U.V. #185 - The Clerk read a letter of transmittal Hintz Construction from the Huntington Beach Planning Commission relative to Use Variance #185, petitioner being 'Hintz Construction, 1545 Katella Avenue, Anaheim, California, to allow to construct model homes for sale purposes and to be moved when tracts are sold out, location being the corner of Heil Avenue and east of Huntington Beach Blvd,,, Huntington Beach. Pursuant to the Conservation and Planning Law of the State Government Code, a:_.public hearing was held on January 5th, 1960, by the City Planning Commission to consider above petitioner's request. The required legal public notice was properly given prior to the hearing, and with due consideration given to the petitioner and the general public, the following recommendation was made by the Planning Commission. A motion was made by Stang and seconded by Kaufman to recommend approval with, the following conditions: BONDS: 1. A $1,000.00 bond for each model home shall be required to be posted guaranteeing removal of the four model homes within one year of the granting of this variance unless the City Council at the end of the one year agrees to extend the time, In the event that the model home or homes are not removed in accordance with this.variance stipula- tion, the applicant shall forfeit bond and shall permit the appointed agents of the City to remove all structures permitted under this variance. Motion carried. Agreement -Municipal The Clerk read the Agreement between Court Addition the City of Huntington Beach and the County of Oranges. California, modifying the lease to cover the Municipal Court Addition and said modification of lease requir- ing the additional payment of $9000 per month by the County for the additional area of approximately 1,118 square feet to be built by the City. On motion by Terry seconded by Waite the Mayor dnd the City Clerk be authorized to execute on be- half of the City the agreement modifying the lease between the City of Huntington Beach, a municipal corporation, and the County of Orange, California, be approved. Motion carried. Plans & Specifications Plans and specifications for the Municipal Court BIdA. construction of the addition of the Municipal Court Building as filed by the City Engineer was presented to the City Council for consideration, On motion by Terry seconded by Lambert the plans and specifications for the addition to the Municipal Court Building as presented by the City. Engineer, be approved. Motion carried. Reso.#1405-Wages- The Clerk read Resolution No 1405, Court S�Constr. A Resolution of the City of Huntington Beach establishing the General prevailing rate of per diem 7 2( Page #8 - Minutes, January 199.1960 wages for each craft or type of workman or mechanic needed in the construction'of an addition.to the Municipal Court Building, In the City of Huntington Beach. The Mayor asked if anyone present had any statement to make in regards to the per dies wages .for each craft or type of workman or mechanic needed in the construction of the addition to the Municipal Court Building, in the City of Huntington Beach. The City Engineer reported to-fhe City Council that he finds that the general prevailing wages in the Orange County area are as included in the Resolution 1405 as read by the City 'Clerk. On motion by Waite seconded by Terry Resolution No. 1405 was passed and adopted by the following roll call vote: AYES: Councilmen: Lambert, Terry, Waite, Irby. NOES: Councilmen: None. ABSENT: Councilmen: Sork. Notice inviting On motion by Waite seconded by Lambert bids to be published the City Clerk be instructed to publish in the Huntington Beach News, a notice inviting sealed bids for the construction of an addition to the Municipal Court Building, in accordance with plans and specifications and documents filed by the City Engineer and said bids to be opened at 8:00 o'clock P.M. on February the 15th, 1960, be approved. Wright, Chief of Police, Shirley Anne McBride, be appointed to the Police Department in the position of Clerk Dispatcher, in the appropriate salary range.and- bracket and said appointment to be effective immediately, be approved, Motion carried. Notice of Freeway The -Clerk read a commanicatien received Agreement recinded from the California Highway omission, acknowledging the receipt of the City Clerk's lettet of January 7th,'1960, transmitting a certified copy of Resolution No. 1403,' adopted by the City Council on December the 21st, 1959, res- cinding the freeway agreement executed on January 12, 1989, relating to Route 60 Freeway between the Santa Ana River and First Street in the City of Huntington Beach, -and that said Resolution will be presented to the California Highway Com- mission at its meeting to be held -in Sacramento -on January 27th and,28th, 1960. - City Administrator to Mayor Irby and members of.the Council meet with State Division of Highways requested that the Administrative Officer, Doyle Miller, arrange if possible an evening meeting with Mr. Telford, of the State Division of Highways,.Los Angeles Office, to d*.scuss the proposed Freeway construction as per plans of the State Highway Division covering the route between 1st Street and the Santa Ana River on Ocean Avenue. Final Tract Map The Clerk read a letter of transmittal No.. 3440_ -_ approved received from the Planning Commission, presenting for adoption the Final Tract Map No. 3440, and said Tract located south of Heil Avenue and East of Newland Street, containing 80 lots with a total acreage of 18.9 and that the map has been certified by the City Engineer and the Planning Director to be true and correct in accordance with the approved Tentative Tract Map and in accordance with all provisions of the City Subdivision Code. Tripp, covering.Fina1 Tract Map No. 3440, and said Final Tract.Map be approved, subject -to the execution of the required agreement and furkishing of bonds and the necessary deposits as required in the Subdivision Code provisions of the City of Huntington Beach and the City Clerk be authorized to place the certifi- cation upon the Map upon the filing of the agreement, bonds and..required deposits, be approved. Grant of right-of-way The Clerk read a proposed Grant to Standard Oil Co. of right-of-way fwom the City of Huntington Beach to the Standard Oil Company of California,. covering right-of-way affecting certain portions of. Lots 31012 31029 3201 and 3202, of the East Side Villa Tract, in the City of Huntington Beach. On motion by Waite seconded by Lambert the Mayor and the City Clerk be authorized to execute the Grant Deed to,the Standard Oil Company of California, of the right-of-way to permit from time to time to lay, construct, reconstruct., replace, renew, repair, maintain, operate, change the size of, increase the number of and remove pipe lines and appurtenances thereof, for the transportation of oil, petroleum, gas, gasoline, water or other substances, with the,right of ingress and egress to and from the same, over and through, under or along those certain parcels of land situated in.Orange County, State of California, and described as follows, to wit: PARCEL -ONE: The easterly:tan (10) feet of the northerly 234 feet of Block 3102 of the East Side Villa Tract, as -shown on a map recorded in Book 4, Page 65, of Miscellaneous Maps, records of said County. Grant Deed to Standard On motion by Waite seconded by Lambert Oil Co. -to construct p n4Z1es � _ in _ the Mayor and the ' City -Clerk -be authorized to execute on behalf of the City the Grant Deed to the Standard Oil Company of California, covering the right to maintain and construct pipelines in'the area described in the Grant Deed,.be approved. Lotion carried. Chamber of Commerce to The Clerk read a communication received study -"Districts" or "Wards" for elections from the Chamber of Commerce advising the City Council that a special committee appointed by the Huntington Beach Chamber of Commerce to study the advisability of creating "Districts" or "Wards" for future councilmanic elections was considered to be a favourable study. The committee feels that "Districting" would be generally beneficial to all and that it would equalize representation, and suggested that the City Council body appointea special committee to work with the Chamber of Commerce committee for the purpose of bringing about the results as suggested. City Engineer City Engineer, James R. Wheeler, James Wheeler infoarmed the City Council that they had reviewed the bids received for the construction and install- ation of -a water distribution main on Smeltzer Avenue between Huntington Beach Boulevard and Warren Street, in the City of Huntington Beach, and reported and recommended that.Garnier Construction Company, of La Puente, was the low bidder and a 12. 31 Page #13 - Minutes, January 18., 1960 responsible bidder and recommended the awarding of the contract to the Garnier Construction Company. Garnier-Construction On motion by Waite seconded by Company -water main nn Smeltzer Ave Terry the Garnier Construction Company be awarded the contract for the construction and installation of the water distribution main on Smeltzer Avenue in accordance with the findings of -the City Engineer and that all other bids received be rejected and the.bid bonds be returned to the respective bidders and the Mayor and the City Clerk be authorized to execute the contract agreement between the City of Huntington Beach and the Garnier Construction Company of La Puente, California, be approved. Motion carried. Agreement -Kunz Sign Co. an motion by Terry seconded by Waite billboard sign _ the Mayor and the City Clerk be authorized to execute the agreement between the City of Huntington Beach and the Kunz Sign Company, providing for the erection of a billboard sign to be located onthe island adjacent to the intersection of Highway 39 and Highway 101, for thenpurpose of advertising houses for sale in subdivisions being constructed. within the City of Huntington Beach and the. rental on said sign be $30.00 per month payable monthly in advance, and for each and every month during the Life of the agreement, and said agreement may be cancelled at anytime upon 30 days notice. to the other party, and the Mayor and the City Clerk be authorized to execute the agreement, on behalf of the City. Motion carried._ Martin Wierman-Re: The Clerk read a communication Chamber of Commerce movin& costs received from Martin Wierman, of the City of Huntington Beach, requesting the City Council mo consider charging the Chamber of Commerce for any moving costs or any improvements that the Chamber of Commerce requestsl the City to make on behalf of.the Chamber, and also made inquiry as to why the City had inserted several pages of a . 13. 32 Page #14 - Minutes, January -18, 1960 Financial Report in the last issue of the Huntington Beach News, and who allowed a report such as this to take so much space? The City Clerk answered the question of Martin Wierman, as to space in the Huntington -Beach News publish- ing the annual Financial Report. Annual report On motion by Terry seconded by Lambert Lifeguard Department the Annual Report of the Lifeguard Department for operations of the calendar year, 1959, and as filed by the Lifeguard Chief, Vincent Moorhouse, be received and ordered filed, Motion carried. Discussion on Chamber Councilman Lambert reported to the of Commerce to move . quarters to the City Council that in accordance with Memorial Hall the discussions by the City Council members at the last meeting and relative to the Chamber of Commerce moving and occupying a portion of the Memorial Hall, suggested that the City Attorney drawup an agreement covering the space provide&and felt that there should be some reimburse- ment to the City for the use of the quarters if occupied. Mayor Irby referred the discussion covering the moving of the Chamber of Commerce to the Memorial Hall, to the Administrative Officer, Doyle Miller, for further study and for Mr, Doyle Miller to discuss the matter with the Secretary of the Chamber of Commerce. Demands. On motion by Lambert seconded by Waite, the demands as approved by the Finance Committee be ordered paid. . Motion carried. Police Chief request Police Chief Clinton Vright, addressed for parking control. at Municipal._Court Bldg. the City Council and requested that Parking Control be instituted on the Magnolia.
