On motion by Presson and
seconded by stang, the Minutes
of the Huntington Beach Planning Commission of January 19th,
1960, as transcribed and mailed by the Secretary were
accepted as mailed.
CONDITIONAL EXCEPTION: UV 190To allow the conversion of
Applicant - Francis Herrera
present structure - six units
to a motel, together with four
new units and managers apartment to be constructed with
swimming pool added.
Located at the south side of
Eleventh Street, and legally described as Lots 16, 18, 209
and 22, Block 110, Huntington Beach Tract.
The hearing was opened to the
audience. Tim Talbert, 219 Main Street, Huntington Beach,
addressed the Commission and requested favorable reco-
mmendation.
Francis Herrera, applicant,
addressed the Commission and requested favorable action.
There being no further comment the hearing was closed.
A controversial discussion was
held by the Commission. Chairman Bazil stated he was in
favor of the proposed project, but that the applicant's
property should be rezoned rather than given a variance.

The City Attorney advised that a use variance should not
be used to supplement zoning except for hardship
reasons being unique from the surrounding properties.
The Planning Director was in accord with the reason-
ing. He pointed out however that the backlog of
cases was continuing to pile up and that the ones
currently under consideration have yet to be completed
due to the inability of the department to keep up with
the mapping required for each zoning case. The Chairman
pointed out that the problem of these new zoning cases
was a throe back to the recent past referendum which
eliminated the new ordinance. He argued therefore
even if the zoning was delayd a few months it was not
the Commission at fault but rather city policy pre-
viously established by the voters. Commissioner Kaufman
stated that he favored approval due to existing cir-
cumstances but would advocate that the entire block
be rezoned as soon as possible.

an oral report. Chairman Bazil opened the hearing to
the audience, there being no comment, the hearing was
closed. It was pointed out in the Commission discussion
that there was an undeveloped parkway along Lake Avenue
of 13.66 feet.

Applicant -
Dr Adian Hubbell at the NE corner of Heil Avenue
and Bolsa Chica Road.
To consider a petition for a
CHANGE OF ZONE TO: C-1 3.8 acres
R-5 15.6 acres
R-1 60.6 acres
The hearing was opened to the
audience. Dr Hubbell, applicant, addressed the Commission
and stated that he vias planning on building a trailer
park with 40 ft. x 70 ft. trailer spaces to be spaced
at the ratio of 10 spaces per acre. Dr Hubbell an-
swered various questions concerning his proposed de-
velopments.
There being no further comment,
the hearing was closed.
Discussion was held by the Comm-
ission. Natural boundaries consisting of a flood
control channel, Major arterial highway were noted.

The Planning Director made
an oral report in which he recommended the adoption of
a Resolution of Intention in order to consider the
entire 40 acres as a whole. It was explained that in
order utilize maximum surface area for surface develop-
ment, became necessary for the City to regulate the
surface use by zoning which would provide sufficient
area to continue oil operations and yet reserve other
areas for more promising development.

Mrs Ethel Miller, 1403 Dela-
ware Street, Huntington Beach, addressed the Commission
and stated that she was completely in accord with the
plans to zone the acres out of M-2-0. She indicated
she was interested in initiating a similar action on
property she held interest in across the street.
John L. Henricksen, 618
Quincy Street, Huntington Beach, addressed the Commission
and stated that he was one of the property owners in the
40 acres under consideration. He noted that he had
not signed the petition for requested rezoning, but
endorsed the idea. He was of the opinion that the present
major oil company lease -holder was a good operator and
should be accounted for in the rezoning plans. He
indicated that the map as submitted would allow the
oil operators to continue their operations without
serious curtailment.

Discussion was held by the
Commission. Commissioner Thompson requested that the
area for rezoning be extended to the surrounding
properties. It was declared by the Planning Director
that the extension of the proposed area mould not be
feasible because of the complicated legal descriptions
and the unknov;n desires of some of the property o�mers.
It was concluded that the first area should remain as
planned and that any new cases would be considered
separately.

A full study was held by
the Commission during which the Planning Director ex-
plained that the primary purpose for the Use Permits
mould be for the control of subdivision directional
signs and model homes. The use of Use Permits would
alleviate much paper work and reduce the council's
work load recently caused by increased subdivision
activity. It was noted that the required public hearing
had been held at a previous meeting.

Harry Tancredi, applicant,
addressed the Commission and stated that he desired to
comply with the wishes of the neighborhood as much as
possible. He stated his willingness to keep the struct-
ures single story.
Edward Vlatry, 616 Hartford Street,
Huntington Beach, addressed the Commission and expressed
his opinion that he would withdraw his previous object-
ions so long as the applicant kept the structure single
story as submitted on the plans and adhered to the re-
quirement of one garage or carport per dwelling unit.
There being no further comment the hearing was closed.

Commission. Commissioner Kaufman suggested that the

in the future deliberations. Commissioner Doutt wanted
some factual information on the status of the P. E.
Railroad right-of-way.

that the exact status of the freeway proposal to First
Street was still undecided.

The Chairman requested a drain up form of the ordinance
be presented at the next meeting.
