Councilmen Present: Sork, Lambert, Terry, Waite, Irby. Councilmen Absent: None. Monthly Reports The Clerk read the reports of the Department Heads for the month of February, 1960. On motion by Waite seconded by Lambert the reports of the Department Heads for the month of February, 1960, as read by the City Clerk be received and ordered filed. Motion carried. Zane Case #110 The Clerk read transmittal and Resolution No. 92, A Resolution of the Planning Commission of the City of Huntington Beach making recommendations for Zone Case No. 110. Public Hearing set - On motion by Waite seconded by Zone Cased 110 Sork the City Clerk be instructed to publish in the Huntington Beach News a legal notice setting a public hearing for the hour of 8:00 o'clock P-.M., on Monday, March 21st, 1960, to consider Zone Case No. 110, as recommended for approval by the City Planning Commission. After legal public notice was properly given prior to the hearing and after consideration given to the Petitioner and the general public a motion was made by Letsori and seconded by Doutt to recommend to the City Council denial for the following reasons: 1. Continued hearing - At 8:00 o'clock P.M., Mayor Irby VP#175-E. R . Severin opened the continued hearing on Variance Permit No. 175. Petitioner being E. R. Severin of 98 Broadway Street, Chula Vista, California, requesting to allow relief from requirement to fully improve the street frontages along Huntington Avenue and Delaware Avenue as required under Orange County Land Use Ordinance No. 351, amended by Ordinance No. 916, and adopted by interim Ordin- anne No. 668. Location being the south side of Garfield Avenue between Huntington Avenue and Delaware Avenue. Legal description - Blocks 3203. 3204, 3103 and 3104, East Side Villa Tract. L. R. Severin Mr. E. R. Severin appeared before the'City Council and reported that according to the inform- ation that he has in discussing the matter with his engineer and the City Engineer, that Delaware Avenue cannot be develop- ed until certain storm drain program has been engineered and installed. City Engineer City Engineer James Wheeler reported James_ 'heeler to the City Council that he concured in the statement of E. R. Severin, relative to the storm drain problem on Delaware Avenue. Hearing closed There being no further oral or written protests filed for or against the Variance Permit #175, Mayor Irby declared the hearing closed. VPJJ 175 Zranted On motion by Terry seconded by Waite Variance Permit No. 175 be granted subject to conditions that Garfield Street be fully improved and subject to all requirements of the Huntington Beach Ordinance Code, but that Huntington Avenue and Delaware Avenue be eliminated from the improvements, provided Huntington Avenue is reduced to a local street level in the Master Plan of Streets and Highways, be approved. The Clerk read the legal notice published in the Huntington Beach News on February 18th, 1960, A notice of public hearing relative to amending the Hunting- ton Beach Ordinance Code by revising Article 939, and the addition of Article 940, both concerning the regulations of the multiple family hotel, motel and trailer park District. The Clerk reported no verbal or written protests filed for or against the proposed amendment of the Huntington Beach Ordinance Code, by revising Article 939 and addition of Article 940. Go. & Evans Building Co. from the Lowell Investment Company and Evans Building Company, deeding to the City the under- ground water lying beneath Tract No. 1813 and Tract No. 3573. Grant Deeds - accepted On motion by Waite seconded by Terry the City accept the Grant Deeds conveying to the City the underground water lying beneath Tract No. 1813 and Tract No. 3573, as deeded by the Lowell Investment Company and Evans building Co. and the City be instructed to record said deeds with the County Recorder, of the County of Orange, be approved. Proposed Agreement - The Clerk read the proposed Agree - Chamber of Commerce ment between the City of Huntington Beach and the Chamber of Commerce covering a proposed occup- ancy of certain areas of the Memorial Hall by the Chamber of Commerce for office purposes and for the conducting of the Chamber of Commerce business. City Administrator City Administrator, Doyle Miller, Loy1e Hiller reported to the City Council that it would be necessary to provide some storage space in Memorial Hall for the Chamber of Commerce and that they have requested that a glass door be installed at the entr- ance replacing the wooden doors and said work to be done by the City. 13. 86 Fade 1114 Minutes, Ntarch 7, 1960 Storage space - On motion by Sork seconded by Lambert Memorial .fall that the storage space be provided for the Chamber of Commerce in the Memorial Hall and Glass doors to replace the present entrance doors of the Memorial Hall, to be installed by the City, all subject to the approval of the proposed Agreement between the City and the Chamber of Commerce, be approved. Motion carried. On motion by Terry seconded by Waite that the rental of $100.00 per year be placed in the agreement between the City and the Chamber of Commerce for space at the Memorial Hall, and said rental to be effective on April the 1st, 1960, be approved. List Miller, informed the City Council #3 to #11 that there are fees established in the standard agreement for discharge industrial waste for Sanitary Districts #3 to #11, that over lap the City Code Section 2437.6, and that connection involved will not be served by City sewers, to consider modifying the City Code, that for inter -district waste water discharges involving no municipal owned suers, the fee may be waived. The matter came up when the City Engineer asked the District if they would be able to pay for the City Oilfield Inspector's time when a spill of oil is traced to one of those connections that might not be taxed by the City.
