MINUTES: On motion by Stang and seconded by Presson, the Minutes of the Huntington Beach Planning Commission of March 15th, 1960, as transcribed and mailed by the Secretary were accepted as mailed. USE VARIANCE: UV #127 To allow amendment to UV 127 Applicant - A. D. Sellers by removing the time limitation of three years. Variance was granted to allow poultry production in variance to R-4 Suburban Residential as adopted by Interim Ordinance No 668. Located qn approximately one acre 500 feet south of Slater. Avenue on the west side of Newland Street and legally described as the W. 265.98 feet of E. 511.84 feet of S. 160 feet of NE J of NE 4 of SW 4 of Section 25-5-11, SBB & M. The hearing was opened to the audience. A. D. Sellers, applicant, addressed the Commission and requested 5 year extension of his present variance. There being no further comment the hearing was closed. The Commission was informed that the expiration date of the present variance was October 20, 1961. The Commission held that because of the po- tential subdivision growth in the area, it was better planning to grant poultry farm operations a variance for no more than three years at a time. A MOTION WAS MADE BY STANG AND SECONDED BY PRESSON TO RECOMMEND DENIAL WITH THE NOTATION THAT A 3 YEAR EXTENSION SHOULD BE CONSIDERED UPON EX- PIRATION OF THE PRESENT VARIANCE. ROLL CALL VOTE: AYES: Presson, Letson, Doutt, Thompson, Kaufman, Stang, Chairman Bazil. NOES: None. ABSENT: None. THE MOTION CARRIED. VARIANCE PERL:IT: VP 201 To allow the following described Applicant - Lowell Evans lots to remain in excess of maximum lot requirement for extreme slopes by permitting 15% to 20% of the lot area to remain in excess of 25Jo grade. Application pertains to: Lots 41 to 60 inclusive within Tract 1813; Application request is'for deviation of Huntington Beach Ordinance Code Section No 9741.4 and location of the subdivision tract is approximately 1200 feet east of Beach Blvd., on the north side of Yorktown Avenue. The hearing was opened to the public. Forest Blair, Engineer for the subdivision, addressed the Commission and answered various questions. He then exibited two drawings demonstrating the proposed slopes and how the entire lot would look. Lowell Evans, the applicant, addressed the Commission and explained how the slope 2. 359 0 Page 3 Minutes - H. B. He stated that he would plant the slopes with ground cover to keep them in good condition. There being no further comment, the hearing was closed. A MOTION WAS MADE BY KAUFMAN AND SECONDED BY DOUTT TO RECOMT.ZEND APPROVAL WITH THE FOLLOW- ING CONDITIONS: 1. The basic flat pad area of the subdivision lot shall not be less than 5,100 sq. ft. 2. The slope areas of the lots included within this variance shall be planted with adequate ground cover. ROLL CALL VOTE: AYES: Presson, Letson, Doutt, Thompson, Kaufman, Stang, Chairman Bazil. NOES: None. ABSENT: None. THE MOTION CARRIED. USE VARIANCE: UV 200 To allow a hardware store and Applicant - Richard Deam lumber yard in the R-¢ Suburban Residential District. Located 600 feet south of Garfield Avenue, and on the west side of Beach Blvd:., and legally described as Block 3008 of the East Side Villa Tract. The Planning Department made a recommendation of denial with stated reasons that the area was not Land Used for M-1 uses nor was the ultimate use enhanced by the proposed lumber yard. It was pointed out that "'it-. would be the difficulty of controlling a lumber. yard operation. 3. 260 Page T¢ Minutes- H. B. Planning Commission Tuesday, April 5th, 1960 A letter of protest from M. M. McCallen, 19071 - 17th Street, Huntington Beach, was read stating that as an adjoining land owner of large parcels, he was vehemently protesting the proposed variance UV #200. Lewis A. Perkins, 19111 Beach Blvd., Huntington Beach, addressed the Commission and stated that he was an adjoining property owner and did not wish to have a lumber yard operation adjoining his residence. There being no further comment the hearing was closed. Commission discussion was held, that the lumber yard operation would considerably de- valuate the surrounding property and hold back higher type uses. It was noted that the applicant had previously been granted a variance for a motel. A MOTION WAS MADE BY STANG AND SECONDED BY PRESSON TO RECOMMEND DENIAL. USE VARI10CE: UV 202 Applicant - Morris Guy To allow the establishment and conduct of a ready mix concrete plant in the M-1 Light Industrial District. Located at the northeast corner of Talbert Avenue and Gothard Street in addition to an existing ready mix conrete plant. Legally described as the E 2 of SE 4 of SW 4 of Section 26, T. 5. S. , R.11.71. , SBB & M. 4. 361 Page #5 Minutes - H. B. Planning Commission Tuesday, April.5th, 1960 Estimated to contain 20 acres subject to reservation of the south 30 feet, the west 20 feet, and the east 20 feet of said premises for road, railroad, and drain- age purposes. The hearing was opened'to the audience. Morris Guy, applicant, addressed the Comm- ission and explained that his proposed ready mix plant would be located next to an existing ready mix plant at the same location. There being no further comment the hearing was closed. It was pointed out in Commission discussion that the location of the proposed batch plant was generally in an appropriate site. A MOTION 17AS MADE BY LETSON AND SECONDED BY DOUTT TO NE) RECOMMEND APPROVAL WITH THE FOLLOWING CONDITIONS: 1. The site shall be fenced with a 6 foot high chain link fence. 2. The Planning Department re- ported that the area had been previously accepted on, tentative maps and that the developer was in the process of beginning actual construction. Majority opinion of the Commission favored the proposed zoning action. Discussion was held by the Commission in which it was pointed out that the area was being cleaned up and that the tract would be a boost to the area. The hearing was opened to the audience. Wm. Gallienne, Chmaber of Commerce Secretary addressed the Commission and pointed out the need for industrial development for this City. E. W. Moeller, Industrial Consultant and Representative of the applicant, addressed the Comm- ission•end explained -preliminary plans for development of the area. There being no further comment, the hearing was closed. Several problems such as drainage and the location of the future extension of Gothard Street were discussed by the Commission. The Commission declared the need for further study - of the problems, and asked Mr Moeller to present if possible some type of preliminary plans of the proposed developments. ZONE CASE, NO 118 TO CONSIDER A PETITION for a Applicant Peter Karales CHANGE OF ZONE, relative to proposed change of district boundary and use classification from: R-1 Single Family Residence District TO R-5 P-M-T District. Legal description on file in the Planning Department Office. The hearing was opened to the audience. Bob Waldron, Attorney for the applicant, addressed the Commission and asked for approval of the case'on the grounds that R-1 was not the logical usage of the property. When confronted by the statement of Lee Nelson, Sanitation Districts Mgr, that the trailer park development should not be located in such close proximity because of the future reperoussions which might be attributed to the sanitation treatment plant; Waldron stated that the plant would not have an adverse effect on the development because it is downwind from the pre- vailing breezes. He further stated that the developer accepts the responsibility of having to live with the treatment plant located in close proximity. Paul R. Caruso, 9964 Bellfast Drive, Garden Grove, addressed the Commission and stated that he was the broker in the proposed transaction. He argued that R-1 usage would be more undesirable than an R-5 usage, while he argued that a trailer park would have the most merit for the acreage. He pointed out that the applicant, has already been damaged by the taking of his • land both for sanitation district purposes and the flood control channel. Lee Nelson, Sanitation District Mgr, addressed the Commission and requested denial of the proposed zoning for reasons as stated in a submitted letter. The letter was read to the Commission. The letter pointed out the danger of letting residential uses encroach 13. 370 Page #14 Minutes — H. B. Planning Commission Tuesday, April 5th, 1960 too close to the treatment plant. It would eventually neccesitate ultra expensive equipment. There being no further comment, the hearing was closed. The Commission debated on the issue of whether a property owner should not utilize the highest and best use of his property regardless of the existing treatment plant. ZONE CASE NO 120 TO CONSIDER A PETITION for a Applicant — Alvin Graham CHANGE OF ZONE, relative to proposed change of district boundary and use classification from: A-1 General Agricultural District as adopted by Interim Ordinance No 668 TO R-5 P—M—T District. The following parcels of real property as submitted on the applicant's petition is described herewith: Located on approximately 25 acres north of Wintersburg Avenue, south of OCFCD Channel C-59 and easterly of Springdale Street, except for the southwesterly 1.5 acres. Legally described as: PARCEL I. The SVI a of SE 4 of Sec. 22-5-11, SBB & M. PARCEL II. The S 2 of SW 4 of SN 4 of Sec. 22-5-11, SBB & M., EXCEPT the S 251.06 ft. of W. 251 ft. thereof. PlaniiinC Commission Tuesday, April 5th, 1960 audience. The hearing was opened to the Edward Ruoff, 13881 Cardillo Drive, Westminster, California, addressed the Commission and made an appeal for denial on the grounds that the neighborhood was too Valuable and precious to degrade with a trailer park. He advocated estates type lots development. Ir1r Ruoff stated that he wanted a copy of a letter of protest read from his mother which had been sent but not received by the Planning Department. The letter was read. A letter from Mrs Goldie B. Cleaver, 4237 - 4th Street, Riverside, a neighboring property owner, was read by -the Secretary. She advocated denial of the zone case. 1Jr Ruoff stated to the Commission that the following persons had -sent in letters.of protest even though the Planning Department had failed to re- ceive them: Leonard D. Tubach, 17355 Golden Vest, Huntington Beach. Lon E. Peek, 16461 Goldenwest Avenue, Huntington Beach. Mrs Emily Ruoff - special delivery. (It should be noted that the Planning Office received the described letters the following day). Alvin Graham, applicant, addressed the Commission and stated that the Flood Control Channel had cut his land in two and he was thus left with a lot of frontage and only 560 feet of depth. He maintained that a trailer park could be an attractive and desirable asset to the area. He described the property as fronting on a major arterial highway and backing up on a flood control channel. 15. 372 Page #16 Minutes - H. B. Planning Commission Tuesday, April 5th, 1960 He pointed out that the Country Day School was located on the property to the west and that it was actually an R-5 use. Tom Welch, operator and owner of the historical Country Day School addressed the Commission and protested that a trailer park would de- valuate an otherwise exclusive residential area. He advocated denial. Cecil B. Hollingsworth, partner and owner of the Meadowlark Country Club in- dicated that he was opposed to the trailer park and small lot subdivisions also. He declared the area to valuable to be used for that type of activity. He advocated estates type of lots for subdivisions. Commission debate followed with the conclusion that more time was necessary for a decision. The hearing was opened to the audience, there being no further comment, the hearing was closed. The Secretary pointed out the several minor changes which included the dropping of Huntington Avenue down from a secondary highway status to a local collector street status. Elements of con- troversy centered around the idea of making Ellis Avenue a primary highway and the dropping of Yorktown Avenue as an arterial highway west of Beach Blvd. 16. 373 Page m17 Minutes - H. RESOLU`1'ION NO 95 A Resolution of the Planning Commission To Amend the Master Plan of Streets and Highways 1957 - 1958 A MOTION WAS -MADE BY KAUFMAN AND SECONDED BY DOUTT TO ADOPT RESOLUTION NO 95. ROLL CALL VOTE: AYES: Presson, Letson, Doutt, Thompson, Kaufman, Stang, Chairman Bazil. NOES: None. ABSENT: None. THE RESOLUTION WAS ADOPTED. TENTATIVE TRACT 1,L�P a70 3643 - REVISED Subdivider - Doyle & Shields Engineer - Voorheis- No of Lots - 117 Trir_dle Nelson A revision of Tentative Tract No 3643 was submitted showing the revision which was the extension of Littler Drive to Fairway Lane and a 40 foot alley into the potential commercial shopping area. A MOTION WAS MADE BY STANG AND SECONDED BY LETSON TO APPROVE TENTATIVE TRACT MAP NO 3643 SUBJECT TO THE FOLLOWING CONDIZIONS: 1. All conditions applicable on the original approval shall be applicable on the revision. 2. Final Map shall be subject to all provisions of the subdivision code. SETBACK ORDINANCE The Secretary read a letter from the Road Commissioner backed by recommendations from the City Engineer to the effect it will be necessary for the City to adopt an.. adequate building setback line ordinance in conjunction with the Master Plan of Streets and Highways. It was pointed out that the building setback ordinance was a necessary requirement for participation of Cooperative City -County highway funds. As pointed out in the letter, the deadline for adoption was set as July 1st, 1960. The Chairman requested the Planning Director to prepare a proposed ordinance for discussion before setting a public hearing. STUDY SESSION ORDERED Because of the necessity of continuing action on seven zoning cases, the Chairman, with the approval of the Commission ordered.a special study session to be held Thursday night at 6:30 P.
