FRIDAY, APRIL 8th, 1960_
COMMISSIONERS PRESENT: Presson, Doutt, Letson, Kaufman,
Thompson, Chairman Bazil.
COMIJISSIONERS ABSENT: Stang.
MINUTES: As was requested by Commissioner
Thompson, a Special Meeting
was called this date by the Chairman at the hour of
6:00 o'clock P. M.
Subject of the meeting was to
discuss the petition of 11 citizens who objected to the
issuance of a building permit to a ready mix concrete
batch plant in the M-2-0 Zoning District where the
installation would abut upon residential housing. The
majority of the petitioners were present in audience to
discuss the problem.
Mayor Irby was present as a
guest to lend his support to the petitioners.
A preliminary discussion was
held by the Commission. The hearing was opened to the
audience.
Howard Trabant, 8041 Yorktown
Avenue, Huntington Beach, one of the petitioners
addressed the Commission and told how the proposed ready
mix plant would devaluate the surrounding area. He
asked the Commission to do everything in their power to
deny a building permit. Trabant's neighbors joined in
the discussion and asked for immediate action to rezone

the b7-2-0 District area. There being no further comment
the hearing was closed.
Commission opinion believed
that the denial of a building permit to the ready mix
on the basis of Section 9445.6 which gives the Planning
Commission the power to make exceptions to the permitted
uses on the grounds that they were similar to prohibited
uses was a possibility but would be on very shaky ground.
It was felt that the area should be rezoned out of
LI-2-0 as soon as possible.
City Attorney Bauer, upon
request of the Commission ruled that any exclusion of
uses or denial of building permits should be by authority
of the City Council only. He indicated that Section
9445.6 had the inherent weakness of being both vague
and unapplied in the past. It was pointed out that
there has already been one ready mix batch plant permit
issued in the M-2-0 District in the past. Attorney
Bauer recommended that the invoking of Section 9445.6
should be by City Council action at the recommendation
of the Planning Commission.
Commissioner Thompson sub-
mitted a proposed resolution recommending denial of the
building permit to the City Council.
RESOLUTION NO 99 A Recommendation for Interpretation
of LT-2-0 District Made To City Council.
Resolution No 99 recommends
to the City Council that their honorable body under
Section 9445.6 establish a policy ruling to prohibit
ready mix batch plants from operation within the
TYT-2-0 District.
