Pursuant to adjournment of the meeting
April the 4th, 1960, Mayor Irby called the regular adjourned
meeting of the City Council of the City of Huntington Beach to
order at 6:00 o'clock P.M.
Councilmen present: Lambert, Waite, Irby.
Councilmen absent: Sork, Terry.
Councilman Terry arrived at 6:05 o'clock P.M.
Councilman Sork arrived at 6:12 o'clock P.M.

Ord. No. 759 - Adopted On motion by Lambert seconded by Waite

second reading by title, An Ordinance of the City of Huntington

ing Section 8720.1 relating to Trailers.

Ordinance No. 763 was passed and adopted by the following

second reading by title, An Ordinance of the City of Huntington
Beach declaring an emergency to exist amending the Huntington
Beach Ordinance Code by adding a new Article No. 533, entitled,
"Pool and Billiard Halls" and adding new Sections to said Article.

second reading by title, An Ordinance of the City of Huntington
Beach recodifying certain Sections, amending sections, repealing
and adding sections to the Huntington Beach Ordinance Code re-
lating to Licensing of the transaction and carrying on of certain
businesses, trades, professions, callings and occupations in the
City of Huntington Beach.

Planning Commission to the Honorable City Council, relative
to Final Adoption of Tract Map No. 3622, submitting final
form of Tract Map No. 3622, Developer, Alco Pacific Construct-
ion Company of 13822 Beach Blvd., Westminster, California,
Engineer, Voorheis-Trindle-Nilson, of 9358 Westminster Avenue,
Westminster, California., location of tract, South of Heil
Avenue and West of Beach Blvd., legal description, portion of
the N� of the SE,� of Section 23, T.5.S., R.11.W., SBB & M.$
in the Rancho Las Bolsas, Number of Lots 40, total acreage,
9.871, and that the map has been certified by the City Engineer I
and the Planning Director to be true and correct in accordance
with the approved Tentative Tract Map and in accordance with
all provisions of the City Subdivision Code. The City Council
may accept dedications as shown on the map and in addition
approve the final map subject to the following conditions;
The City Clerk's signature shall be

Tract_Map #3506 The Clerk read letter of transmittal
received from the Huntington Beach Planning Commission to the
Honorable City Council, relative to the Final Adoption of
Tract Map No. 3506. Submitting final form of Tract Map 3506,
Developer being Moore Homes, Inc., of 1250 So. Main Street,

Santa Ana, California, Engineer being Millett Surveying of
201 So. Pomona Avenue, Fullerton, California. Location being
South of Heil Avenue, and East of Newland Street, Legal des-
cription, portion of the E' of the NWT of the SEA of Section
24, T.S.S., R.11.W., in Rancho Las Bolsas. Number of Lots 70.
Total acreage, 15.3., and the Map has been certified by the City
Engineer and the Planning Director to be true and correct in
accordance with the approved Tentative Tract Map and in accord-

Reso. 09 -Interpret- The Clerk read letter of transmittal

i� to the Honorable City Council, sub-
mitting Resolution No. 99, A Resolution covering a recommendation
for Interpretation of M-2-0 District. I.
The Clerk read Resolution No. 99, A
Resolution of the Planning Commission of the City of Huntington
Beach making recommendation for interpretation of Article 944,
M-2-0 District, and said Resolution by the Planning Commission
as a result of study and consideration concludes because of the
close proximity of various residential developments to the M-2-0
District, and the many residential developments which lie within
the M-2-0 District, the Planning Commission should therefore

declare under the provisions of Section 9445.6. "Similar Use"
(prohibited) that the operations of a ready mix concrete plant
should be prohibited, and recommends to the City Council, of
the City of Huntington Beach, that -as a legislative body: the
City Council substantiate the ruling as declared by the Planning 1
Commission under subsection 1 of the Resolution.
Petition - Re: The Clerk read a petition signed by
M-2-0 District
11 residents residing along Yorktown
Street and Beach Blvd., requesting that the City Council con-
sider re -zoning the M-2-0 Area, to a type of commercial zoning
that would conform with the existing surrounding homes, and
that the present M-2-0 zoning will allow heavy industry that
will prove a detriment to the entire surrounding vicinity.
Clifford Tripp Planning Director, Clifford Tripp,
pointed out that the City Council denial for the application
for the construction of a concrete mix plant on Yorktown east
of Beach Blvd., would be based on the interpretation of the
paragraph covering M-2-0 zoning, wherein the use similar to
those prohibited, the Council could deny.
R. E. Russell, F...T. The following parties interested in
Shiley, Robert Devins
the installation of the concrete mix
plant appeared before the City Council: R. E. Russell, realtor,
E. J. Shipley, Manufacturer of concrete blocks; Robert M.
Devins, Attorney at law, they reported to the City Council that
the property is in escrow and escrow has been executed and the
conditions are that there can be no variance attached to the
condition of sale and that the applicants have on three occas-
sions contacted the City Planning Director and were informed
that present M-2-0 zoning dicAiot prohibit such an installation
and that they had proceeded on that condition.
Withhold permit - On motion by Lambert seconded by Waite
Plant 'Mix Plant
in as much as the City Attorney of the
City of Huntington Beach is absent that the Building Department
be instructed to withhold the permit for installation of the
ready mix concrete plant until a legal interpretation of the

City zoning regulation is made by the City Attorney, was approved
by the following roll call vote:
AYES: Councilmen: Sork, Lambert, Waite.
NOES: Councilmen: None.
ABSENT: Councilmen: None.
Councilman Terry and Councilman Irby refrained from voting.
Motion carried.
Renuest of Police Chief- The City Administrator, Doyle Miller,
P.-mend Job Descr:iotion -
Ca6et Patrolman limit reported that a study has been made
on the request of the Chief of Police to amend the job description
for Cadet Patrolman, whereby the requirements of the age limit
would be lowered from 21 to 18 years, however, consultation with
the Chief of Police, recommend that a temporary setup be made for
employment of personnel in the Cadet program instead of placing
them on a permanent basis for employment.
Gary Davis - employed On notion by Waite seconded by Sork
as Clerk Dispatcher
in accordance with the request of the
Police Chief and recommendation of the Administrative Officer,
that Gary E. Davis, be employed in the classification of Clerk
Dispatcher, in Bracket "A", Range 26, effective date, April the
9th, 1960, be approved. Motion carried.
Dema.ncs On motion by Lambert seconded by
Waite the demands as approved by the Finance Committee be ordered
paid. Motion carried.
On motion by Lambert seconded by
Terry the City Council of the City of Huntington Beach adjourn
to 7:30 o'clock P.M., Friday, April 15, 1960. Motion carried.
