None. On motion by Presson, and seconded by Doutt, the Minutes of the Huntington Beach Planning Commission of April 5th, 1960, as transcribed and mailed by the Secretary were accepted as mailed. AREA VARIANCE: AV 203 • - To allow a rear yard set - Applicant - Moore Homes, Inc. back requirement deviation 'to the K-1 Single Family Residence"District. To permit a 5 ft. rear yard setback where it is replaced by a 20 ft. side yard setback. Located within a subdivision south of Heil Avenue"approximately 800 ft. east of Newland Street, and legally described as Lots 10, 11, 202 21, 309 519 409 and 50 of Tract 3506. The hearing was opened to the audience, there being no comment it was closed. The variance described as being identical in nature to AV #193 which had been granted previously. The request was to supplant equiv- alent side yard area for the required rear yard area. - There was no stated objection. The version of the Tentative Tract Map which is proposed for annexation to the City was submitted to the Commission. The Secretary read the Engineering report stipulation conditions governing the drainage problem. Ken Carlson, Engineer re- presenting the subdivider, addressed -the Commission and claimed that the blanket clause requiring participation of the area drainage costs on a per acre basis was not desirable from the subdividers point of view. 'tiJhen the Commission offered to postpone action, the Engineer stated that he would rather receive approval and perhaps amend the conditions later. On the basis of Commission study it was concluded that the commercial area re- quested was far premature and had no foundation on the basis of immediate potential population. It was ex- plained that 30,000 persons in the vicinity be necessary to support 10 acres of commercial development. It was felt that this type of development was far in the future. The Commission felt the request for R-5 P-M-T District was in order at this time. S. , R. 11. W., SBB & M. ZONE CASE NO 116 The hearing was reopened to the continued Applicant - John A. Murdy, Jr. audience. Mr. Moeller, Industrial Consultant, addressed the Comm- ission and submitted two Sectional District Maps showing the proposed industrial development areas. Mr. Moeller submitted a letter which he stated would be signed by the applicant to the effect that the required Arterial Highways would be dedicated and improved at the time of development. There being no further comment the hearing was closed. The Planning Director pointed out that the required dedication would be enforced at the time of either an issuance of a building permit or submittal of an in- dustrial tract map. The Planning Director pointed out the need for exclusive industrial zoning as requested by the applicant in the face of overwhelming subdivision activity. The Commission, having made a study of the area, concluded that that the pro- posed trailer park development was a vast improvement over the possibility of single family homes for which it was now zoned. The following parcels of real property as submitted,on the applicant's petition is described herewith: Located on approximately 25 acres north of Wintersburg Avenue, south of OCFCD Channel C-5, and easterly of Springdale Street, except for the southwesterly 1.5 acres. The hearing was reopened to the audience. Edward Ruoff, 13881 Cardillo Drive, Westminster, California, addressed the Commission and restated his protest as made at a previous meeting. There being no further comment, the hearing was closed. Commission study had brought out the problems of the land which fronted on a major Highway, had a shallow depth and backed on to a Flood Control Channel. For this reason it was concluded estates type development was not_a likely type of develop- ment. The following parcels of real property affected by the proposed change of zone are described herewith: Located on 220 subdivided resident- ial lots within three established and adjoining sub- divisions a portion of which adjoins the south side of Talbert Avenue approximately 1400 feet east of Beach Blvd., and also a portion of which lies on the east side of Beach Blvd., approximately 660 feet south of Talbert Avenue. The subdivisions are commonly known as Hunt- ington Crest and Roberta Rancheros Tracts. 2416, 2558, and 2699. The Planning,Department gave a report indicating the area had already been developed as single family units and thus should have adequate zoning to protect it from encroachment. A report of the area was given by the Planning Department. The area is currently being developed as single family dwellings. Legal description is as follows: BLOCKS: 2105, 2106, 22059 2206, 2305, 2306, 24059 2406, 2505, 2506, 2605, 2606, 2705, 2706, 28059 2806, 2503, 2504, 2603-B, 2603-B, 2604, 2704-A, 2704-B, 2805, 28049 21079 2207, 2307, the W. 135 ft. of Block 2407, and the W. 200 ft. of Block 2507 of East Side Villa Tract as recorded in Ti.ili. 4-65. The boundaries as laid out in the zoning proposal were the result of a Committee study on the part of the Planning Director, Commissioners Thompson and Letson. The area was singled out for a first hearing which could possibly be amended by ne- cessity. RESOLUTIONd NO 109 A Resolution of Intent of the Planning Commission in- itiating action for re- zoning legally described as Zone Case No 123. THE RESOLUTION WAS ADOPTED. STUDY OF BUILDING LINE The Secretary pointed out SETBACK ORDINA110E: to the Commission that the City would be required to adopt a setback ordinance in order to qualify for par- ticipation in the County in Lieu Gas Tax Funds. The Commission reviewed the Ordinance as adopted by the County. Only few changes were proposed. Sight angle protection at the intersections which were zoned commercial or industrial was proposed. The Planning Director was instructed to prepare the ordinance for hearing. B. Planning Commission Tuesday, April 19th, 1960 1. Location shall be at least 200 ft. south of Tract 2558 and shall maintain a minimum setback of 30 ft. 2. There shall be required a $100.00 performance bond guaranteeing removal upon expiration of UP #103. 3. Use Permit #103 shall expire one year from date granted. 4. The subdivision directional sign shall be removed by the applicant upon expiration of UP #103; The penalty for failure to comply shall -be the for- feiture of the permormance bond. TENTATIVE TRACT i-�0 3736 The hearing was continued from Applicant - George Holstein & Sons_ the previous meeting at which time the Secretary reported his belief that the Ocean View School District had enacted Imminent Domain proceedings on portions of the property being subdivided. The Secretary reaffirmed the statement upon conversation with the district super- intendent that notice had bt-en filed on the first of April this year. Dale Sheinholtz, representing the developer, asked the Commission to deny the tract without pre1judice in the event they voted to the negative. THE MOTION CARRIED. ADDITIONAL PERSONNEL The Planning Director brought to attention of the Commission, the vast work load confronting the Planning Department and the fact that work is slowly backlogging to an ab- normal extent. The tremendous siege of subdivision activity plus the sudden deluge of zoning cases has hit the Planning Office which has been smothered under by administrative work. And it was further pointed out that the office traffic such as zoning inquiries via telephone calls etc., has further reduced the time for administrat- ive functions. The Commissions as a whole agreed the proposed additional held was absolutely essential.
