MINUTES: On motion -by -Stang and seconded by Doutt, the Minutes of the Huntington Beach Planning Commission of May 3rd:, 1960, as transcribed,and mailed by the Secretary were accepted as mailed. ZONE CASE NO 123 Initiated by Resolution No 109 (continued) To consider- a petition for a CHANGE OF ZONE relative to proposed change of district boundary and use -class- ification from: 11-2-0 District TO R-2 District. B. Planning Commission Tuesday, May 17th, 1960 The hearing was reopened to the audience. Mrs Verda Orrel, 2713 Beach Blvd., Huntington Beach, requested that the one half of her lot be eliminated from the border area. Otherwise she favored the re- zoning. Mr Tony Dauer, 2609 Florida Street, Huntington Beach, favored the proposed rezoning. Mr Don Gilbach, 2605 Florida Street, Huntington Beach, favored the proposed rezoning to protect the established residential areas. Mr Glenn Hyepock, 721 E. Utica Street, Huntington Beach, favored the proposed rezoning to help upgrade an established residential area. Mr Phill Murphy, 615 Yorktown, Huntington Beach, favored the proposed rezoning. Mrs Carl Christiansen, 633 Hartford Avenue, Huntington Beach, advocated that she is the owner of 8 lots and favored the rezoning. Mr Vernon Vallercamp, 2509 England Avenue, Huntington Beach, stated that he had built in good faith in an area which had been represented as soon to be rezoned residential. He favored the proposed rezoning. Mr Lawrence Mollica, 302 Hartford Avenue, Huntington Beach, favored the rezoning. Mr James Daily, 2615 Florida Street, Huntington Beach, favored the proposed rezoning. Mr Les Potts, 602 Yorktown Street, Huntington Beach, favored the proposed rezoning stating that he had built several units in the area and that the area was predominately residential. Mr Lloyd Arthington, 2315 Florida Street, Huntington Beach, favored the proposed rezoning. There being no further comment the hearing was closed. Commissioner Thompson abstained from participation in Zone Case No 123, giving the reason that he had property in the area. USE VARIANCE: UV 204 To allow the present Applicant - Kiyoko Asari operation of wholesale fish hatchery and related horti- cultural uses in variance to the R-1 Single Family District. Located approximately 660 ft. west of Cannery Street on the north side of Wintersburg Avenue, and legally described as the 71 2 of the SE 4 of the SE 4 of Sec. 24-5-11. The hearing was opened to the audience, there being no comment it was closed. Commissioner Doutt abstained from further deliberations due to conflict of interest. Discussion was held by the Commission during which it was pointed out that the fish hatchery operation was long time established operation with a profitable tax base for the City. There being no further comment. A MOTION WAS MADE BY LET S ON AND SECONDED BY THOMPSON TO APPROVE USE VARIANCE UV #204 WITHOUT CONDITIONS. USE VARIANCE: UV 205 To allow construction of Applicant - Latimer Electric industrial building to be used for operation of machine shop and electrical constractors shop in variance to A-1 General Agricultural District as adopted by Interim Ordinance No 672. Located approximately 1200 ft. east of Beach Blvd on the south side of Atlanta Avenue and legally described as the W 2 of Lot 1, Tract 811. The Secretary read report recommendation. The hearing was opened to the audience. George Latimer, applicant, addressed the Commission and explained what type of buildings he proposes to construct. There being no further comment the hearing was closed. Commission discussion followed. Chairman'Bazil asked if a zoning study were not in order rather than granting a variance. Other opinion expressed that both might be considered. A MOTION WAS 1,1ADE BY THOMPSON AND SECONDED BY STANG TO APPROVE UV #205 WITH THE FOLLOWING CONDITIONS: 1. Prior to the issuance of a building permit there shall be required the full dedication and improvement of Atlanta Avenue to the specifications of the Master Plan of Streets and Highways along the entire front- age of the applicant's property. THE MOTION CARRIED. USE VARIANCE: W 71r'206 Applicant - So. Counties Gas Co. Gas Line in Newland Street. To allow a Gas Pressure Limiting (Regulating) Station for existing 30" Located approximately 90 ft. south of Hamilton Street on the east side of Newland Street and legally described as the S. 50 ft. of N. 160 ft. of W. 86 ft., of N z of the Nil 4 of the SE 4 of Sec. 13-5-11, SBB & M. The Secretary read report recommendation. The hearing was opened to the audience, there being no comment the hearing was closed. Commission discussion followed. A MOTION WAS MADE BY KAUFMAN AND SECONDED BY DOUTT TO APPROVE UV #206 WITH THE FOLLOWING CONDITIONS: 1. Applicant shall be required to dedicate and improve Newland Street to a width of 42 feet to the center- line of the street and shall be improved to city specifications in accordance with the Master Plan of Streets and Highways. There shall be required two places if ingress with maximum opening width of 22 feet. 2. All displays, structures, plants, or merchandise shall not be allowed within the front setback requirement of 50 ft. which area shall be reserved to parking purposes. 3. Eleven offstreet parking spaces in front of existing structure shall be maintained. 4. One double faced sign will be allowed with a max- imum area of 60 sq. ft. and may not be located closer than 26.4 ft. to the front property line. 5. ABSENT: None. THE MOTION. CARRIED. PUBLIC HEARING UNIFORM SETBACK ORDIPIIL?CE The submitted version of the proposed Uniform Setback Ordinance -is a portion of the 6. 410 Page #7 Minutes — H. B. Planning Commission Tuesday, May 17th, 1960 Orange County Arterial Highway Financing Program re— quirements. The County of Orange has previously adopted a version of the Uniform Setback Ordinance; the City of Huntington Beach is required likewise to adopt a uniform setback ordinance in order to become eligible for joint participation in the financing program. The Planning Director presented the proposed ordinance in written form to the audience. A sketch was displayed describing the required triangular setbacks where it was zoned an industrial or commercial use at the intersection of an Arterial Highway. audience. The hearing was opened to the Mrs Art Webb, 18575 Beach Blvd., requested information for commercial setbacks along Beach Blvd. It was explained that this setback Ordinance would impose no setback requirements along the State Highway, however it was pointed out_ that the Planning Commission as a policy matter has established 50 ft. setbacks along Beach Blvd as a part of the zoning case. There being no further comment the hearing was closed. Commission discussion was held for study of the ordinance for the fourth consecultive meeting. Note this case was continued until such time as the outcome -of the revision of the blaster Land Use Plan. The Master Land Use Plan has since been revised designating the area under consideration as potential R-3 Residential usage. To consider a petition for a Conditional Exception to regulations of the Districting Ordinance. To allow the operation of Construction Equipment Yard and rental in the R-4 Zoning District. Located approximately 85 ft. S'ly of Olive Avenue on the 1,711y side of 15th Street, Huntington Beach, and legally described as Lots 159 17, 19, and the S'ly 16 ft. of Lot 21, Block 215, Huntington Beach Tract. The hearing was opened to the audience. Carl Robinson, applicant, addressed the Commission and stated that the people who had turned out in numbers of protest the granting of the variance had in turn done nothing whatsoever to improve the blighted area. He requested that his variance be granted in spite of the revision of the Master Land Use Plan. There being no further comment the hearing was closed. The Commission was reminded of the large turnout in protest of the proposed variance when it was originally presented. All aspects of the case were discussed. 412 Page #9 Minutes - H. B. The Secretary read the report of the Planning Department and the Engineering Depart- ment which recommended denial without prejudice pending submittal of satisfactory drainage reports and a drainage solution for the tract.
