Councilmen Present: Wells, Stewart, Waite, Gisler. Councilmen Absent: Lambert (Arrived 7:35 P.M.) The Pledge of Allegiance was given by all present in the Council Chamber. The invocation was offered by Rev. Arleigh B. Starn, Minister of the Huntington Beach Church of God. Minutes On motion by Stewart, seconded by Waite, the Council approved the minutes of meetings of May 2nd, 16th and 23rd, 1960 as transcribed and mailed. Nation carried, Councilman Wells Councilman Wells rose to a point of order ` and upon permission by the Mayor, stated that at the last meet- ing of the Council on June 6th, 1960, on the matter of the grant- ing of a five year variance to Inez Underhill and Company, that in the confusion and misunderstanding during the vote an the motion a negative vote was not called for. He asked that the Council declare the action on that motion null and void and have it stricken from the records. City Attry Bauer City Attorney Bauer, when called upon by Mayor Gisler, informed the Council that according to Roberts Rules of Order which is often used as a guide for parliamentary procedure in the conduct of meetings, in many instances it is not required of the Chair to ask for a negative vote. He stated that, at the time of the putting the motion to vote, any Council- man could have requested a Roll Call, vote or other visible method, but that this was not requested. He further stated that when the Chair declares the motion carried, the action is.complete at that time, unless at that meeting, action is taken to reconsider. The City Attorney quoted sections from the MRoberts Rules of Order" to substantiate his opinion. He said tbbttait might have been within reason to question the motion at any time during that meeting, but after the meeting was adjourned, in his opinion, the i. 2471 Page #2 - Minutes, June 20, 1960 action was definitely and finally complete. Councilman Waite Councilman Waite stated that, while a negative vote had not been called for, that he had register- ed a no vote and was the only one to do so. He said that he felt the}:action was carried. Councilman Wells Councilman Wells stated that the point he was trying to establish was that people opposed to the granting of the variance had not been sufficiently notified that the matter was to be considered. The Clerk informed Mr. Wells that due publication of the Public Hearing on the matter had been .made in compliance with the manner prescribed by law. Councilman Lambert Councilman Lambert informed the Council that when the matter of Uri#177 was presented to -the City Planning Commission the first time, it was nigher granted nor, -:denied, but was deferred. On being brought before the Commission a second time, it was denied, but the proposer kad the right of appeal to the City Council. Councilman Waite Councilman Waite stated that the members of Cot;ndil had three or four weeks in which to make up their.minds on the granting or denial of the variance, and that there was no doubt on his part as to how he felt about it. Police - Monthly Renort The report of the Police Department for the Month of May, 1960, was read by the Clerk. On a motion by Waite, seconded by Lambert, the report of the Police Department was reeieived and filed. Motion carried. HB Safety Council - A communication from the Huntington Ord. Swimming Pools__ Beach,Safety Council requesting a revision of the City Ordihance gover*&4 safety measures in connection with swimming pools within the City, was read by the Clerk. On a motion by Waite,seconded by Stewart, the request was referred to the City Administrator A. for study. Motion carried. 2. 48 Page #3 - Minutes, June 20, 1960 Amer. Legion Post A communication from American Legion #133 - Re; Mayors RecevtioM_ Post No. 133 offering the use of the American Legion Hall and its facilities for the Mayor's reception on July 4th, 1960, was read by the Clerk. Letter re. Copies of a form letter3equesfing Beautification of Main Street Council to take steps to have trees planted for the beautification of Main Street, from Dr. H.S. Kaufman, Oscar Myhre and James Farquhar, was read by the Clerk. On a motion by Waite,secanded by Stewart, the letters•were received and filed. Motion carried. Petition re:. Y 177 A communication petitioning Council to reconsider their action in the granting of Use Variance No. 177 which was allowed at the meeting of June 6th, 1960, signed by Mr. Raymond M. Elliott and twenty-five other property owners, was read by the Clerk. City Attl Bauer City Attorney Bauer informed the Council that the action of their body -in regard to this matter was final, however if the•Council should feel that there is some reason why the variance should be denied, or some other action.taken,it becomes a matter of policy with the Council. He stated that if t any vested rights have interfered in the meantime, and action is taksa which would in any way prejudice those rights, the City might be liable so far as these vested tights are concerned, providing the applicant was not in violation of any law, rule, or regulation, or order of the Council. He stated that it was ttIb(VVGr0g&tJVG of the Council to reconsider this matter; to hear anything further, and then decide whether they wish to take any further or different action in the matter, with the possibility of incurring damages in the process. Sr R 27ond M. E1 iott Mr. Raymond M. Elliott addressed the Council and asked that the matter be reconsidered in light of the petition which had been presented. He gave reasons for his belidf that the Council was in error in overriding the action of the City Planning Commission and granting the variance. Also, he stated that he did not feel that sufficient publicity had been given to the hearing in this matter. 3. 249 Page #4 - Minutes, June 20, 1960 Mr. Fred Hermann Mr. Fred Hermann, 408 Fifteenth St., addressed the Council and requested that the City Attorney inform him just when the Title report concerning the property he was endeavoring to acquire was dated, and by what Company it was made. City Attorney The City Attorney stated that the report was made by the Orange Counter":.Title Company, dated May 18th, 1955, and the title officer was Ruby Sullin, Title No. 295276-8. The letter from the Vice President of the Title Company accompanying the report was dated December 3, 1957. Mr. Bauer also informed Council that the seeming difference between the title reports from the two companies making title search on the property, was that Mr.] Hermann's Title Company would insure the title on an extra hazard basis for additional premium, which is standard proced- ure which Title Companies follow, and the City has been sell- ing tax title lots on this basis for many years. Mr. Bauer told the Council th$t the City has title to the property under discussion, and that the only cloud on that title is the homestead of Mr. & Mrs. Hermann He advised the Council that it was within their prerogative to sell the property.or retain it, and to file suit to get the title cleared if they so desire. He suggested that if they decide to sell the property it would be advisable to get an up to date appraisal . After more discussion on the.matter, a motion was made by Stewart, seconded by Waite, that the City Attorney be instructed to file suit to clear title on Lots 2 and 4, Block 414, on Fifteenth Street, in the City of Hunting- ton Beach, Motion carried. Business License The Clerk presented applications for licenses to'conduct business in the City of Huntington Beach. On a motion by Waite, seconded by Wells, the applications for license to conduct business in the City of Huntington Beach, as presented by the Clerk, were as follows: approved, /Motion carried. 4. Eastern Avenue, Los Angeles 22, California. 4- a. 1 2,50 Page #5 - Minutes, June 20, 1960 Temporary License - The Clerk then presented an application Fireworks for a temporary license for the sale of fireworks at Huntington Avenue and Ocean Boulevard, from the Veterans of Foreign Wars, and informed Council the application had received the necessary approval from all Department Heads concerned. On a motion by Wells, seconded by Stewart, the temporary license was granted to the Veterans of Foreign Wars for the sale of fireworks at the corner of Huntington Avenue and Ocean Boulevard. Motion carried. Recess The Mayor called a recess of the Council at 8:37 o'clock P.M. Reconvened Council meeting was reconvened at 8:45 o'clock P.M. by Mayor Gisler. Renewal damage insurance The Clerk presented the matter of re - City Pier, Gangplank and Landiniz�Platform. newal of the damage insurance on the City Pier, Gangplank and Landing Platform. He informed the Council that in view of rising costs, he had taken this matter up with the City Engineer for a recommendation as to any increase in the amount of coverage; and that the Engineer had recommended that the insured amount on the pier be continued at one hundred thousand dollars, but the amount on the Gang Plank and Landing Platform be increased from Four to Six Thousand Dollars. On a motion by Lambert,seconded by Waite, the Clerk was authorized to negotiate the renewal of the insurance on the Pier and Gang Plank and Landing Platform with the increased amount as recommended by the City Engineer. Motion carried. Western Kennel and Pet A communication from the Western Kennel Supply Cc* - New License and Pet Supply Company appealing the provisions of the new Licensing Oi-dinance as applicable to their business was read by the Clerk. On a motion by Lambert seconded by Waite, the appeal of the Western Kennel and Pet Supply Company was denied. Motion carried. 5. Page #6 - Minutes, June 20, 1960 Petition - Public A petition for Public Improvement I.mnrovement including the installation of curbs, gutters and Lighting, from the Florida Assessment District, composed of residents of Williams Street between Highway 39 and Florida Avenue and Florida-.�Avenue/ between Williams Street and Yorktown Street, was read by the Clerk. On a motion by Stewart, seconded by Lambert, the petition was referred to the City Administrator and the City Engineer for study. ib tion carried. Public Hearin gg - Mayor Gisler announded that 8:00 Zone Case #123 o'clock P.M. or as soon thereafter as possible on this day was the date det for the Public Hearing on Zone Case No. 123,-and requested the City Clerk to read the Legal notice. The Clerk read notice of Hearing Use District Zone Case No. 123 as published in the Huntington Bea News June 16th, 1960, setting a hearing for 8:00 o'clock P.M. or as soon thereafter as possible on Monday, the 20th day of June, 1960, for the purpose of considering a petition for a change of zone relative to proposed change of district zoning in use classification from M-2-0 Industrial District to R-2 Residential District on the forty acre parcel bounded by Beach Boulevard, Huntington Avenue, Utica Street and Clay Street. Leslie W. Potts - Zone_.Change ,. ._.... A communication from Leslie W. Potts,j 602 Yorktown Street, Huntington Beach, endorsing the proposed zone change, was read by the Clerk. Sherman E. Cole & A communication from Aherman E. Edith A: Cole, Ma garet Pontius, & Peter . C&le and Edith A. Cole, 2402 Florida Canas, Ophelia Canas - Street, Margaret Pontius, 704 York- town Street, and Peter M. Ausijig Mr. Frank A. Ausing of La Mirada, a property owner in the affected area, addressed the Council and protested the proposed zone change as not benefiting the area in any way. Mrs Adam Ausi.n2 Mr. Adam Ausing of Las Angeles, co- owner with his brother Frank, addressed the Council and pro- tested the proposed zone change because of the amount which would be required to be expended to drain this area. Mri,Donaid L. Gelbach Mr. Donald L. Gelbach, 2605 Florida Avenue, Huntington Beach, addressed the Council and stated that he was in favor 9f the proposed Zone change because he had already built.a home within this area. Mr�Anthonyr.J. Dauer Mr. Anthony J. Dauer, 2609 Florida Avenue, Huntington Beach addressed the Council and stated that he was definitely in favor of rezoning the area between Williams Street and Yorktaen Street on, -.Florida Avenue, but didn't feel the area covered by the Zone change whould take in so much territory. Mr. Adam AusanR Mr. Adam Ausing again addressed the Council and stated that he wanted it understood that he and his brother did not object to the Zone change as a Whole, but only that portion covering the property at the Northeast corner of Delaware and Utica Avenues. Mrs_, Cara Bailey Mrs. Cora Bailey, 2615 Florida Street, Huntington Beach, addressed the Council, stating that her husband was. the circulator of the petition requetting change of zone, and that it was their intention to request the change for only a portion of that presented by the City Planning Commission. There b+.ing no further opinions ex -- pressed either for or against the proposed Zone change, the Mayor declared the Public Hearing closed. Planning Director Tripp Planning Director Tripp informed the Council that the Planning Commission had submitted a plan to encompass the whole area in the change of zone requested. He said it would be entirely within the prepogative of Council to approve the change in all or any part of that proposed. 7. 253 Page #8 - Minutes, June 20, 1960 After further discussion, a motion was made by Lambert, seconded by Waite, that the City Attorney be instructed to draw up an Ordinance adopting Zone Case No. 123. On a motion by Lambert seconded by Waite, the deed was accepted by the City and the Clerk instruc-1 ted to record same with the County Recorder. Motion carried. Water rights - A Water Rights deed from Henry C. Henry C.^Griswold Griswold to the City of Huntington Beach was read by the Clerk. On a motion by Weds, seconded by Waite, the deed was accepted by the City and the Clerk instructed to record same with the County Retarder. Motion carried. St. Right of Way - A Street Right of Way deed from E . _ L . Mc Ire E. L. McIntyre to the City of Hunt- ington Beach was read by the Clerk. On a motion by Lambert, seconded by Wells, the deed was accepted by the City and the Clerk instru- cted to record same with the. County Recorder. Motion carried. City Engr & City On a motion by Lambert seconded by Admin. right of way procurement Wells, the City Engineer and the City Administrator were authorized and instructed to proceed with the procurement of right of way on Memphis firom a point 102 feet east of Huntington Avenue to Highway 39 (Beach Boulevard). Motion carried. Land Acquisition Ser. -A-report from Land Acquisition Service _appraisal - 3 parcels of.Santa Ana giving appraisal values and recommendations for three parcels of kind in the Winters - burg area for a proposed maintenance station and a possible future fire station, was presented by the Clerk. . .. 254 Page #9 - Minutes, June 20, 1960 On a motion by Lambert, seconded by Wells, this report was referred to the City Administrator and the Council as a whole for further study. Motion carried. Councilman Wells Councilman Wells commented that the report from the Land Acquisition Service cost the City three hundred dollars, and suggested that a sizeable amount could be saved by the City in making such surveys themselves. The matter was discussed by theCouncil without action. Offering for sale - The Clerk presented the matter of offer- trtink sewers ing fb.r sale the trunk sewers within the City of Huntington Beach, to Sanitation'aistri.ct. No. 11, which was recommended by theCity Engineer. On a motion by Waite, seconded by Stewart, an offer to setl the trunk sewers within the City of Huntington Beach was ordered to be re -submitted to Sanitation District No. 11, and the Clerk instructed to submit a certified copy of the Minute Order of the Council, together with a cert- ified copy of the letter of James R. Wheeler, City Engineer to the Mayor, dated May ll, .1959, and a certified copy c f 'Resolution No. 1379 o f ,the City Council, to Sanitation District No. 11. Motion carried. Extension of Water The Clerk read a transmittal from the Main on Talbert Ave. k Pasgineering- Department covering plans, specifications, and bid invitations for an extension of the water main on Talbert Avenue. On a motion by Lambert, seconded by Stewart, the plans and specifications for the water main exten- sion on Talbert Avenue were approved, with sealed bids to be received until 7:30 o'clock P.M. on Tuesday, July 5th, 1960, to be opened at 8:00 o'clock P.M. or as soon thereafter as possible on Tuesday, July 5th, 1960, and the Clerk instructed to publish Notice of Invitation to Bid twice in the Huntington Beach News. Resa.No._1424 On a motion by Lambert, seconded by Stewart, Resolution No. 1424, "A Resolution of the City of Huntington Beach establishing the General Prevailing Hourly 9. 255 1 Page #10 - Minutes, June 20, 1960 Wages for each craft or type of workman or mechanic needed for the construction and installation of a water distribution main on Talbert Avenue from 1990 feet West of Beach Boulevard to 1328 feet East of Beach Boulevard, in the City of Huntington Beach, California," as read by the City Clerk, was adopted by the following roll call vote: AYES: Councilmen: Wells, Lambert, Stewart, Waite, Gisler. NOES: Councilmen: None. ABSENT: Councilmen: None. Representatiues of both Companies addressed the Council, pointing out the types and sizes of the.shells they would furnish the the quantities of each. Following considerable discussion by the Council, a motion iy Stewart, seconded by Wells, that the bid of the Atlas Fireworks Company be accepted, was approved by the following roll call vote: AYES: Councilmen: Wells, Lambert, Stewart, Gisler. NOES: Councilmen: Waite. ABSENT: Councilmen: None. On a motion by Stewart, seconded -by Lambert, all purchases of materials, or agreements in connec- tion with the Fourth of.July celebration, be cleared in advance with the City Administrator. Agreem't City & The matter of an agreement between Con -Tech Bldg...Co. the City of Huntington Beach and Con -Tech Building Company, a subdivider, concerning their Tract No. 3788 was presented by theClerk. On a motion by Lambert, .seconded by Stewart, the Mayor and Clerk were authorized to execute the agreement with the Con-Tech_Building Company on Tract_Nol 3788, Motion carried. Tri-Engineering Ser. - A communication from Tri-Eggineering Street abandonment, 10. 2� Page 4111 - Minutes, June 20, 1960 Service, 11922 Westminster Avenue, Garden Grove, California, requesting initiation of street abandonment action by the City of Huntington Beach on a portion of an alley in Block "A*, Tract 445, per M.M. 17-7, Records of Orange County, California, adjoin- ing and lying Westerly of Lots 57 and 77; being bordered on the North by the Westerly prolongation of the Northerly line of Lot 57; and on the South b* the Westerly prolongation of the south- erly line ofLot 77, was read by,the Clerk. An endorsement. from the City Engineer recommending approval of the action was also read. On a motion by Waite, seconded by Stewart, the City Attorney was instructed to prepare a Resolution of Intent to Vacate, with no expense to be incurred by the City. Motion carried. Calif. Div— of Highways - A report from the California Division ills._ is VTI - Traffic Survey of Highways, District VII, concerning a traffic survey prepared by their department at the request of the City of Huntington Beach, with a view of installing traffic control lights and a traffic island at the intersection of Adams - Quincy Street and -Beach Boulevard, was presented by the Clerk, along with a letter from the City.Engineer to the City Administra- tor, recommending a method of accomplishing said installation. On a motion by Stewart, seconded by Lambert, the recommendation of the State Division of Highways regarding installation of traffic lights and a traffic island at the intersection of Ada.ns-Quincy Street and Beach Boulevard, as endorsed and modified by the City Engineer, be adopted in principal and referred to the bity Engineer for study and develop- ment of costs. Motion carried. Reso. No. 115 - Resolution No. 115 of the City Planning Plann. Comm Commission, "A Resolution of the Plann- ing Commission making recommendation for relocation and acquisi- tion of City Identification Signs" was read by the Cleric. Mrs. Eleanor Gibbs Mrs. Eleanor Gibbs, 18451 Beach Boule- vard, Huntington Beach addressed the Council, who stated that the City had a sign on her property at the corner of Main Street 11. 257 1 Page #12 - Minutes, June 20, 1960 and Beach Boulevard, and asked whether the City.of Huntington Beach or the Huntington Beach Chamber of Commerce was to pay rent for the property on which the sign was located. Councilman Wells Councilman Wells asked Mrs. Gibbs whether any agreement had e7er been made with anyone regarding the rental of the property the sign was,on, and was informed that the Chamber of Commerce extended a free membership to Mr. & Mrs. Gibbs as recompense for the permission to have the sign on the property. Mrs. Gibbs stated that there had been no written agreement signed, and that she and her mother-1 in law felt they should receive a rental for the property. Building Inspector - Cleveland Building Inspector Cleveland informed Council that there were plans to relocate signs in the City, including the one in question, and that if :this were done there would no longer be one located at Main Street and Beach Boulevard. A motion.: was ,ode-1 by Wells that the sign at the intersection of Main Street and Beach Boulevard be removed forthwith. After some furhher discussion the foregoing motion was withdrawn by Councilman Wells, On a motion by Waite, seconded by Stewart, the matter of renting the sign space or removing the sign was referred to the City Administrator for study. Motion carried. City Engr. to. cooperate On a motion by Waite, seconded by with Committee in study of cost & placement of Wells, the Cjtty Engineer was author- ized to cooperate with the Committee from the various Fraternal and Civic Organizations in the study of cost and placement of City signs at variaxs loca- tions. Motion carried. Recesses The Mayor called for a recess of the Council at 10:15 o'clock P.M. Reconvened Council was again called to order at.10:20 o'clock P.M. 12. 258 Page #13 - Minutes, June 20, 1960 Zone -Case. -No,. 103 A letter of transmittal from the City Planning Commission regarding Zone Case No. 103 - "Reactivation of M-i-A District Zoning requested by applicant" was read by the Clerk. This transmittal referred to Resolution No. 78 of the City Planning Commission which was transmitted to the Council on December 7th, 1959 and made a favorable recommendation for approval. Reso, #78 - P1ann. Resolution No. 78 - "A Resolution of Comm. _ the Planning Commission of the City,6f Huntington Beach making recommendations for Zone Case No. 103" was read by the Clerk. On motion by Waite, seconded by Stewart, the Clerk was ordered to give Ordinances No. 778 and 779 a first reading. Motion carried. Michael Savage - A transmittal fromthe City Planning DM45 Commission regarding a Division of Land -- DV #145; Petitioner - Michael Savage, 1330 Santanella, Corona Del Mar, California; to allow the division of 100 foot frontage lot into two separate lots in -deviation to Section 9741.4 which requires 60 foot minimum frontage and 6000 square foot of lot area minimum; location 200 feet North of Spring- field on East side of Pine Street; legal description - Division I: The N. 50 ft. of Lot 6, Block 1801, Tract 12, total area pro- posed lot 5875 - 50 ft. frontage - Division II: the S. 50 ft. of Lot 6, Block 1801, Tract 12, total area proposed lot 5875 - 50 ft. frontage; recommending approval without -conditions, was read by the City Clerk. Boy Scout Troop #1 - A request from Boy Scout Troop No. 1 Sell Firewood to the Police Department to sell fire- wood on the beach on Friday and Saturday evenings and on the Fourth of July, from 6:00 P.M. to 10:00 P.M. was presented by - the City Administrator. 17. 263 1 Page #18 - Minutes, June 20, 1960 Police Chief Wright Police Chief Wright informed the City Council that permission to do this would put the Scouts in direct competition with local merchants who are licensed by the City for this purpose. Councilman Wells Councilman Wells asked who handled firewood for the beach, and was informed that a number of service stations and liquor stores had been granted this permission with their license, but that none was actually sold on the beach. On a motion by Waite seconded, by Stewart, the request of ,Boy Scout Troop .No. 1 to sell fire- wood on the beach was denied. Motion carried. Mr. Don 1-4innie - An additional communication from a beautify Main St. local merchant,. Mr. Don Minnie, requesting the City to take steps to.beautify Main Street by planting trees, was read by the City .Administrator. on motion by Stewart, seconded by Waite, the letter_was.received and filed. A communication from Mr. and Mrs. Brawn - Street Light Fred I Brown, 811 Memphis Street, Huntington Beach, requesting installation of a street light in front of their home and another at the intersection of Beach Boulevard and Memphis Street, was read by the City Administrator. on motion by Lambert, seconded by Wells, the request.was referred to.the City Administrator and the City Engineer for study and report. City Lifeguard Chief - A communication from the City seasonal lifeguards y Lifeguard Chief, requesting appoint - went of seasonal lifeguards as per attached schedule, was read by the City Administrator. Motion carried. - 18. 264 Page #19 - Minutes, June 20, 1960 Mr. Raymond Beem - A communication from Mr. Walter Johnson reappointed - Bd. of Trustees City Librarian, requesting the aeappo int- went of Mr. Raymond Beem, Goldenwest Road, Huntington Beach, to the Board of Trustees of the Huntington Beach Public Library, was presented by the City Administrator. On a motion by Wells, seconded by Waite, Mr. Raymond Beem was reappointed to the Board of Trustees of the Huntington Beach Public Library. Motion carried. Reconstruction - The City Administrator presented a Goldenwest Street communication from the City Engineer submitting plans, specifications, special provisions and notice inviting bids, prevailing wage resolution, and estimated cost for the reconstruction of Goldenwest Street from Summit Avenue to Talbert Avenue, as a joint project with the County of Orange on a fifty-fifty basis. He also read a Right of Way Certification from the City of Huntington Beach, certifying that all right of way has been acquired and that no building or utility exists within the right of way area, and agreeing to hold.the County harmless from any liability which might result from the County's reliance upon the -certification. Mr. Miller stated that it would be necessary for the City to authorize the Clerk to execute the certification before any action could be taken in the matter. On motion by Lambert, seconded by Stewart, the City Clerk was authorized to execute the Right of Way certification on behalf of the Citty of Huntington Beach, to the County of Orange. Chief of Police - A notice of a combined meeting of the Sheriffs of Zones 5 & 6 June 21 &_22, 1960 Chiefs of Police and Sheriffs of Zones 5 and 6 to be held at San Diego on June 21 and 22, 1960, under authority of Section 12524 of the Goverment Code of the State of California, was read by the City Administrator. On motion by Waite seconded by Stewart, the Chief of Police be granted permission to attend the meeting of Zones 5 and 6 at San Diego on June 21 and 22, 1960, with reasonable expenses allowed and use of City vehicle permitted.. Renewal AgreemI t A renewal agreeme= between the City of Home Service Cam Huntington Beach and Lambert Russ, doing business as the HomesService Company, for the operation of coin - operated laundry machines in the Municipal Trailer Park, with a termination clause included, was presented by the City Administrator. On motion by Utewart, seconded by Lambert, the Mayor and Clerk were authorized to execute the renewal agreement between the Ciyy of Huntington Beach and Lambert Ross, dba the V"' Home Service Company. 21. 267 Page #22 - Minutes, June 20, 1960 City Treasuret - A bill from the City Treasurer presents bill_ __ against Mr. David E. Fiddyment, P.C. Box 849, Roseville, California, for a Waste Water Disposal fee in the amount of thirty dollars, together with - a final notice l of Bankruptcy against the debtor showing no assets and priority claims in the amount of one thousand six hundred seventy-two and 19/100 dollars, was presented by the City Administrator. On motion by Stewart, seconded by Lambert, the City Treasurer was authorized to write off as an uncollectable debt the bill of Mr. David E. Fiddyment. Motion carried. Bill - Huntington The City Administrator presented a Beach News_ bill from the Huntington -Beach News for advertising on October 8, 1959, a sixty-three inch fire prevention advertisement in the amount of sixty-three dollars, and and eighty-four inch Christmas display -advertisement in the amount of eight -four dollars. On motnon by Wells, seconded by Stewart, the bill for advertising be referred to the Huntington 'Beach Chamber of Commerce. Motion carried. Councilman Waite Councilman Waite, referring to the foregoing matter, informed the Council that this was not a Chamber of'Commerce bill, but was an obligation against the City to be paid from the Chamber of Commerce budgeted allowance. After further discussion of the matter, the City Administrator and the City Clerk were requested by Council to check this matter in previous. minutes of .the Coun- cil and report to the Council. There was no motion on this request. Firemen to assist The City Administrator presented withfire works a request from the Fire Chief for firemen to be authorized to assist in setting up the fire works display on July 4th, 1960, which action was necessary in order that the men be covered by State Compensation Insurance. - 22. 268 Page #23 - Minutes, June 20, 1960 On motion by Stewart, seconded by Wells, men of the.Fire Department were authorized to assist in the preparation and shooting of the fireworks display on July 4th, 1960. Agreem't City & An agreement between the City of County of Grange - soil tests. — — Huntington Beach and the County of Orange in which the County agrees to make soil tests for the City when needed during the fiscal year 1960-61, and bill the city for any tests mdde, was presented by the City Administrator. A membrandum. of endorsement by the City Engineer recommending approval of the agreement, was also read. On motion by Stewart, seconded by Lambert, the Mayor and Clerk were quthorized-to execute the agreement between the City and the County for the performance of soil tests. Motion carried. Revenue discussion A discussion of the revenue derived by the City from the Huntington Beach Country Club golf course was held, but there was no action by the Council. Mr. Robert Allen - Mayor Gisler requested information removal of tree on the status of the request of Mr. Robert Allen of Fullerton for removal of a tree from the parkway of his property on Crest Avenue, which had been referred to the City Administrator at the meeting of May 23, 1960. The Adminiktrato r informed the Mayor that he would look into the matter to see what action was need- ed and follow up on it and report to Council. Demands On mot&on by Waite, seconded by Wells, the demands as approved by the Finance Committee, be paid, with payment of Warrant No. 1656 to be held in abeyance until merchandise covered by it had been received.
