Councilmen Present: Wells, Lambert, Stewart, Wa-�e, Gisler. Councilmen Absent: None. The Pledge of Allegiance was given by all present in the chamber. The invocation was given by Rev. Robertson of the Feur Square Church of Huntington Beach. Minutes On motion by Stewart seconded by Lambert, the council approved the minutes of the meetings of June 6, June 20, and June 28, 1960 as transcribed and mailed. Motion carried. Police Dep_ . Report The report of the Police Department was read by the Clerk. On motion by Lambert seconded by Stewart, the Police Department Report be received and filed. Motion carried. Mr. Lawrence Boudreaux.- A communication from Mr. Lawrence Removal of Tree Boudreaux of 314 Loma Avenue, Huntington Beach, requesting council permission to remove a tree from the parkway in front of his home and replace same with two blooming pear trees, was read by the Clerk. On motion by Lambert seconded by Wells the request of Mr. Boudreaux to remove the tree from the parkway of his home be granted. Motion carried. Recreation Dent. -Land A communication from the Recreation for Park & recreation Use. y„� __�_ Department of the City of Huntington Beach requesting that money received from sub -dividers for use in purchasing land for park and recreation use be applied to land in the vicinity of the proposed Elementary Schools, was read by the Clerk. City Administrator - A communication from the International International City �! na rs Associ,c,tion City Managers Association, extending an invitation to the City of Huntington Beach to send their City Manager to the 46th Congress of the City Managers Association, to be held at San Francisco from October 16th to 20th, 1960. On motion by Stewart, seconded by Lambert, the City Administrator be authorized to attend the 46th Congress of the International City Managers Association in San Francisco from October 16th to 20th, with reasonable expenses allowed. Motion carried. Huntington Beach A communication from the Huntington Safety Council- ge-1clenwest St. Beach Safety Council recommending that the curve on Goldenwest Street at Circle Drive be eli- minated, and Goldenwest Street be cut straight through that portion, was read by the Clerk. J._Sherman Deem A communication from the Huntington Beach Company, J. Sherman Denny, Manager, concerning the same subject, and making recommendation for the same procedure, was read by the Clerk. On motion by Lambert seconded by Waite, the matter of straightning Goldenwest Street at Circle Drive be referred to the City Administrator and the City Engineer for study and report back to Council. Motion carried. Mr. Bill Payne- Mr. Bill Payne, 5172 Smeltzer Street Santitation District Punp. Huntington Beach addressed the Council and stated that the Sanitation District pump which is located across from his residence constituted a hazard, and asked Council what could be done about it. Councilman Stewart informed Mr. Payne that at the last Sanitation District Meeting, the matter had been presented and had been referred to the Sanitation District Engineers for study and action on their part. Bleed & P.ubbish Mayor Gisler Opened the public Abatement-rublis Hearing hearing at 7:45 o'clock P.M. for the City Council to hear objections of property owners shown on the final partial list of.Weed and Rubbish Abatement charges for the year 1960 as posted at the outside entrance to the Council Chambers, in accordance with the Government Code, Chapter 13, of Article 3, State of California, to the Weed Abatement charges listed thereon. There being no ob- jections filed either orally or verbally, the Mayor declared the hearing closed. On motion by Waite seconded by Stewart, the Weed and Rubbish Abatement charges covering the final partial list as posted at the entrance of the Council Chamber be confirmed, and any charges listed thereon not paid by August 1, 1960 be certified.to the County Auditor for in- clusion on the 1960-1961 Tax Roll. Motion carried. Ilunta.ngton Beach A grant deed for water rights to the Plaza Inc. -later City of Huntington Beach from the Huntington Beach Plaza Inc., Irving Soloman, President; Albert Soloman, Secretary, was read by the Clerk. On motion by Lambert seconded by Wells, the deed from the Huntington Beach Plaza Inc. was accepted by the city, and the Clerk authorized to record same with the'County Recorder of Orange County. Ordinance No. 784- The Clerk gave Ordinance No. 784 a Second Reading second reading by title *'AN ORDI- NANCE OF THE CITY OF HUNTINGTON BEACH APPROVING THE ANNEX- ATION OF CERTAIN UNINHABITED TERRITORY DESIGNATED NORTHEAST NO. 2 TO THE CITY OF HUNTINGTON BEACH." 11r. Reuben Dobkin Mr. Reuben Dobkin, 18211 Newland Street, County of Orange, addressed the Council and protested the Annexation because of drainage problems involved affecting people to the South. Following some discussion by the Council, on motion by Lambert seconded by Waite, Ordinance No. 784 was passed and adopted by the following roll call vo to : 0 AYES: Councilmen: Lambert, Stewart, Waite, Gisler. 4. 31 Pape #5 - Minutes, July 18, 1960 NOES: Councilmen: None. ABSENT: Councilmen: None. NOT VOTING: Councilmen: Wells. Councilman Wells had requested and received permission to abstain'fram voting because of interest in the subject due to relationship. Ecco-Partial Payment The Clerk read a communication from -Harry Overmyer Reservoir Ecco, the contractor for the Harry A. 'Overmyer reservoir, requesting a partial payment in the amount of $13,255.20 for the work already completed. An endorsement from James W. Wheeler, the City Engineer, recommending the approval of the partial payment, was also presented. On motion by Waite seconded by f Stewart, the request for partial payment in the amount of $13,255.20 by Ecco for work completed on Harry A. Overmyer Reservoir was granted. Motion carried. D. C. Cunningham -RCA #1 A request by D. C. Cunningham Termination drilling Sons, for the termination of Hartford Accident and Indemity Co. Drilling Bond No. 3049587 on his RCA No. #1 Well, was read by the Clerk. An endorsement by the City Engineer recommending termination of said bond, was also presented. On motion by Lambert seconded by Stewart, Hartford Accident and Indemity Company Drilling Bond No. 3049587 be terminated and the owner notified. Motion carried. Bids -Reconstruction Mayor Gisler announced that the bids G Improvement of Goldenwest St. for the reconstruction, servicing, and-, improvement of Goldenwest Street between Summit Avenue and Talbert Avenue, which had been received, would be opened at this time in accordance with the time and date as per notice of bids, and instructed the Clerk to open the bids. The affidavit of publication of notice inviting sealed bids, 5. 318 Page 6 - Minutes, ,lu1713,1960 published in the "Huntington Beach News" in the issues of June 23rd and June 30th, 1960, was read by the Clerk.- The Clerk opened and read the bids in total which were tabulated as follows: Griffith .Company .................. ..............$54$778.26 R. Motion carried. Use -Variance ado. Mayor Gisler announced that at 8:00 1.7/-Public Hearing o'clock P.M. or as soon thereafter as possible, on this day was the time and date set for a public hearing for reconsideration of Council action on the matter of Use Variance No. 177 relating to the operation of a construction and rental yard in R-4 zoning district, and requested the Clerk to read the legal notice. The Clerk read the legal notice published in the "Huntington Beach News" on July 7, 1960, notice of public hearing for the purpose of reconsideration of Council action on a matter of Use Variance No. 177 relating to the operation of a construction and rental yard in an R-4 Zoning district. Mr. & : Irs . F.L. The Clerk read a communication Thomas from Mr. & Mrs. F . L . Thomas, P.O. Box 150, Huntington Beach, protesting the granting of the Variance in this case, and requesting that the Council reconsider their action in this matter. `-fr. Curtin i ierman- A communication from Mr. Martin Case Variance No. 177 Wierman, Box 285, Huntington Beach, California, informing the Council that he had been included in a list published in the paper protesting the granting of Use Variance No. 177. Mr. Wierman requested it be noted for �I 6. 3191 Pape #7 - 'Min u,!s, July 18, 1960 public record that at no time had he ever protested the granting of this Variance. Mr. Ray Elliott- Mr. Ray Elliott, 404 Ninth Street, Protests Variance No. 177 Huntington Beach, addressed the Council, stating that he represented a group, many of whom were present, who protested the granting of this Variance for the reason that the people who owned property in the area concerned are trying to make this section of town again into a residental district. L'r. Otis C. Robertson- Mr. Otis C. Robertson, 534 Catalina Inez i., Underh_ 11 Co._ Drive, Costa Mesa, representing the Inez I. Underhill Company to whom the Variance had been granted,1 addressed the Council, stating at that no time had he made an effort to influence the Council on this matter. Mr Robertson also presented photographs which he had taken of lots in the immediate area to show the condition of property in the im- mediate vicinity. Mr. Robertson informed the Council that he believed their proposed use of the land in question would make a desired improvement in the neighborhood. Firs. �j1y a Shandrick Mrs. Sylvia Shandrick, 299k Main Street, Huntington Beach, who owns property in the immediate vicinity of the property under discussion, addressed the Council) stating that she would protest the granting of this Variance because the property owners in the neighborhood were endeavori to make it into a first class residental district. Mrs. Regina Brown Mrs. Regina 0. Brown, 1128 Crestview Drive, Fullerton, who owns property at the corner of 14th and Walnut Street, addressed the Council and stated that she would protest the granting of the variance because they wish to improve their property in that neighborhood. Mrs. Louise Jenkins Mrs. Louise Jenkins, 320 14th Street Huntington Beach addressed the Council, stating that she felt that the variance should be denied and property 7. 320 Page #8 - Minutes, July 18,1960 remain entirely residental. �:Lrs. Jeff.;cf.y Mrs. Jeffrey, 305 14th Street, Huntington Beach, addressed the Council to protest the granting of the variance and change of zone. Mrs. Jeffrey stated that a lot in the immediate vicinity owned by the City with an oil well on it, was pretty much of a mess. There being no further oral or written protests filed, Mayor Gisler declared the hearing closed. Recess Mayor Gisler called a recess°of the City Council at 8:35 o'clock P.M. leconvened The meeting of the Council was reconvened by the Mayor at 8:50 o'clock P.M. ' ifforc '�rirn- The city Planning Director, Clifford i?_ 3 Zoning Tripp, informed the Council and Mr. Elliott that the confusion that seemed to exist between the R-4 and R-3 Zoning was brought about by -the Zoning which would have been given by the Master Land Use.Plan, which had previously been rejected by the voters, and the zoning as it actually is at present. Mr. Tripp gave a short resume of the case as presented before the City Planning Commission in it's deliberations. City Attorney Bauer- The City Attorney informed the Council Investigation of Public Hearin s that he had made an investigation into the matter of public hearings as required on actions of the Planning Commission and City Council. Mr.'Bauer stated that it was his interpretation that a public hearing must be held where an exceptional variance is granted; however, that the meeting of the Planning Commission for which no notice of public hearing was given, did not grant, but rather denied, a conditional exception Variance. Mr. Bauer further -stated that he believed the city had followed the Huntington Beach 3211 Page #9 - Minutes, July 18, 1960 Ordinance Code in meeting the requirements for public hearing, as established by the code. He again reminded the Council that if any action were taken to reverse their previous action, and any vested rights intervened, the City would probably be held liable for any damage sustained by the applicant, by reason of the vesting of any rights in that period of time. Councilman Waite- Rescine Council_ Action on Variance 177 Councilman Waite asked if it would be possible for the Council to rescind their action, with the stipulation that the area be cleaned up. The City Attorney informed Councilman Waite that he did not believe conditions for cleaning up could legally be put in any action of the Council, requiring per- formance of said conditions by anyone other than the recipient of a variance. Councilmen Waite stated that he would like some guarantee that the citizens of the area involved would get together and make an effort to clean up their property within the area. On motion by Wells seconded by Waite, the action of Council in the granting of Variance No. 177 be revoked, and the Building Department be instructed to issue no permit based upon that Variance. Motion carried by the following roll call vote: AYES: Councilmen: Wells, Waite, Gisler. NOES: Councilmen: Lambert, Stewart. ABSENT: Councilmen: Lifeguard Service- Apreement between Citab- Or. Co. None An agreement between the City of Huntington Beach and the County of Orange covering Lifeguard Services for the fiscal year 1960- 1961 was read by the City Clerk. On motion by Lambert seconded by Stewart, that the City enter into the agreement with the County of Orange for Lifeguard sorvices, and the Mayor and Clerk be authorized to sign said agreement. On motion by Waite seconded by Lambert, a public hearing was ordered for Monday evening, August 1, 1960, at 8:00 o'clock P.M., or as soon thereafter as possible, and the Clerk was instructed to publish notice of said hearing. Motion carried. Resolution No. 123- Resolution No. 123 of the City .Notice of Public `iearin Planning Commission, recommending of Zone case No. 117, was read by the Clerk. On motion by Wells seconded by Stewart, a public hearing was ordered for Monday evening, August 1, 1960 at 8:00 o'clock P.M., or as soon thereafter as possible, and the Clerk was instructed to publish notice of said hearing. Motion carried. Resolution No. L24 Resolution No. 124 of the City Notice of Public Hearing Planning Commission, recommending denial of Zone case 125, was read by the Clerk. On motion by Lambert seconded by Stewart, a public hearing was ordered for Monday evening, August 1, 1960, at 8:00 o'clock P.M., or as soon thereafter as possible, and the Clerk was instructed to publish notice of said hearing. On motion by Lambert seconded by Stewart, a public hearing was ordered for Monday evening, August 1, 1960, at 8:00 o'clock P.M., or as soon thereafter as possible, and the Clerk was instructed to publish notice of said hearing. On motion by Stewart seconded by Waite, a Public Hearing was ordered for Monday evening August 1, 1960, at 8:00 o'clock P.M., or as soon thereafter as possible,, and the Clerk was instructed to publish notice of said hearing. Motion carried. D. V. 143-Recommend A division of Land presented by the Approval with certain conditions City Planning Commission, recommending Approval of D.V: 143 with certain conditions, was read by the Clerk. On motion by Waite seconded by Wells, D.V. No. 143 be approved with the condition stipulated. Motion carried, with councilman Lambert abstaining because of relation- ship in the matter. Huntington Beach Planning The Clerk read a transmittal from the Commission -Abandonment of Portion of Calif. Ave. Lx Huntington Beach Planning Commission, Baltimore St,. recommending approval of request for proposed abandonment of portion of California Avenue and Baltimore' Street; applicant-T. B. Talbert, 219 Main Street, Huntington Beach l location - most southerly portion of California Avenue and most easterly portion of Baltimore Street; Legal description - that portion of California Avenue and Baltimofe_'Street abutting E'ly of Block 203, Vista Del Mar Tract, City of Huntington Beach. Ordinance No. 786- The Clerk read a letter of trans - First Reading correcting wording in Section 9406.2 mittal from the City Planning of Huntington '}each ord- inance Coee Commission, regarding a revision of technical error Section 9406.2 Huntington Beach Ordinance Code, correcting the wording in Section 9406.2 and submitting therewith, an Ordinance covering such change in wording. Ordinance No. 786, "AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH AMENDING THE HUNTINGTON BEACH ORDINANCE CODE BY MAKING MINOR REVISION OF SECTION 9406.2", was then given a first reading in full by the Clerk. Resolution No. 1428 The Clerk read resolution No. 1428, "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH RELATING TO, PARALLEL PARKING ON A PORTION OF MAIN STREET." Jay- A communication from Mr. Melvin A. rronased annexation Jay, 2742 Elm Avenue, Long Beach, Califgrnia, requesting an indication of Council as to their consideration,of the,possible.annexation of five acres Zoned• R-5, adjacent to the City of Huntington Beach; located on the south side of Heil Avenue, approximately 1000 feet east of Bolsa Chica, was read by the Clerk. , 13. ra�-c 'f14' Nrinutcs, Julv 18, 1960 Mr. Charles Jay, 2742 Elm Avenue, Long Beach, a brother of the writer of the letter, addressed the Council and answered questions of the various Councilmen regarding the parcel of land under discussion. When asked his reason for wanting to be annexed to the City, Mr. Jay informed the Council that it was because he needed the sewers. ,On motion by Wells seconded by Stewart, Council postponed action on the request of Mr. Jay until next regular meeting on August 1, 1960 in order to be given an opportunity to investigate and study the matter. Motion carried. Sully L Miller Co. The City Administrator presented Bic: accenteu a memorandum from City Engineer, James R. Wheeler recommending that the low bid of Sully Miller Contracting Company in the amount of $46,845.15 for the re- construction,surfacing, and improvement of Goldenwest Street, between Summit Avenue and Talbert Avenue,, be accepted. On motion by Stewart seconded by Lambert, the bid of Sully Miller Contracting Comppny in the amount of Forty Six Thousand, Eight Hundred:, Forty Five dollars and fifteen cents ($46,845.15) for the reconstruction, between Summit Street surfacing and improvement of Goldenwest Street/and Talbert Avenue, be accepted; the Mayor and City Clerk be authorized to execute a contract with this company; and all other bids declared rejected and bonds to be returned. Motion carried. Bids -Truck for Beach The City Administrator presented. `ai_ntenance bids for a truck for Beach Maintenance as follows: Main Street Garage International ..................$2,751.65 L. D. Coffing, Santa Ana, Dodge..............App. $3,100.00 On motion by Wells seconded by Lambert. action on these bids be postponed until regular meeting on August 1, 1960. Motion carried. 14. 327 Page #15, Minutes, July 1.3, 1960 Mr. John Gisler Mr. John Gisler, a representative of International Har- vester Co. the International Harvester Company addressed the Council and explained the proposition on the Inter- national truck which was being bid. Planting trees along The City Administrator presented the Mai_ n St. - - -- matter of planting trees along Main Street in boxes for the beautification of the City. It was .pointed out that Council had authorized action in this respect some time ago. Considerable discussion was held by the Council in the matter, but no action was taken. Carol Cully-Tynist. Clerk . A request was made by the City Admin- istrator that Miss Carol Cully be hired on a permanent basis as an Intermediate Typist Clerk and allotted a range of 26-A with a salary of $304.00 per month, On motion by Lambert seconded by Waite,I the Council approved the hiring of Miss Carol Cully as Inter- mediate Typist Clerk in bracket 26 A. with starting salary of $304.00 per month. Motion carried. Diehl Evans Co.- A renewal agreement between the City Auditing Service for 1.960-1.961 of Huntington Beach and Diehl Evans Company of Santa Ana, for auditing services, was presented by - the City Administrator. He informed the Council that we had been under contract with this auditing firm for the past few years and that their services seemed to be quite satisfactory. On motion by Stewart seconded by Waite,1 the City enter into the agreement with,Diehl Evans Company for auditing services for the year 1960-1961, and the Mayor and City Clerk be authorized to sign the agreement. Motion carried. Position of Senior Planning Director, Clifford Tripp, Clerk created in Plaxring Department I presented a request to upgrade a clerk in his department from Intermediate Typist Clerk to Senior Clerk. On motion by Lambert seconded by Waite, the City Attorney be instructed to prepare an Ordinance creating position of Senior Clerk in the Planning Department. Motion carried. Marilyn Guy -Promoted The -City Attorney presented a request to Senior Clerk from Mr. Cleveland, the Building In- spector, that Marilyn Guy, an employee of the Building Depart- ment be promoted from Intermediate Typist Clerk to Senior Clerk. On motion by Lambert seconded by Waite, Marilyn Guy promoted from Intermediate Typist Clerk to Senior Clerk in the appropriate range and bracket. Motion carried. Trash an 'Iemoval" Councilman Lambert informed the Council Yo roc to wn. wi i l l i ants , Floriia St, that people from Yorktown, Williams, and Flordia Street area had asked him to present the matter of trash cans being left on the front lawns all week long. They would be put out for pick up and then -never returned and it makes an unsightly condition in the area. He said that he understood the same condition existed in some of the newer outlying areas also. Considerable discussion was held on the matter by the Council. The City Administrator informed the Council of a pile of trash, - approximately 3 truck loads waiting in the alley in his vicinity to be picked up by the trash collection, -and he wandered if the City were going to make that pick up. Mr. Miller said he was going to try to get some pictures of it, because he couldn't believe that the City could provide the kind of service necessary to accomplish this sort of thing. 16.: 329 Page #17 - Minutes, July l8, 1960 Mr. .John►. Thompson Mr. John Thompson, 727 Williams, addressed the Council and stated that there hadn't been much satisfaction given in regards to the matter of removal of the empty cans, and asked whether some means of enforcing this removal could be made. He requested Council to prepare an Ordinance to stipulate that trash cans could only be placed in front of the house for a 24 hour period on the day of the pick-up. On motion by Wells seconded by Stewart, the request of Mr. Thompson was referred to the' Administrator and Police Department. Motion carried. Mr. J. S. Denny- Mr. J. S. Denny,2110 Main Street, 21. Beach clean-up Planned Huntington Beach, representing the Huntington Beach Company, informed the.Council that the Hunting Beach Company was planning a general beach clean-up from 12th Street to the City Limtts. Discussion of Industrial Mayor Gisler announced that Council Developement for 1960- 1961 scheduled would meet as a Committee of the Whole on Wednesday July 20, 1960, at 7:00 o'clock A.M. in the Council Chambers, together with the Board. of Directors of the Chamber of Commerce, to discuss the contract between the City and the Chamber of Commerce for Industrial development for the year 1960-1961. Committee of the Whole The Mayor called a meeting of Council scheduled to meet for Discussions as a Committee of the Whole for Monday morning, August 1, 1960 at 7:00 o'clock A.M. for a discussion session.
