Councilmen Present: Wells, Lambert, Stewart, Gisler Councilmen Absent: Waite The Pledge of Allegiance was given by all present in the Council Chamber. Reverend Walter Barnard of the First Assembly of God Church gave the invocation. Police Sept.- The report of the Police '.iont.hLv ',•eDort Department for the month of July was presented by the Clerk. On motion by Stewart, seconded by Lambert, the report of the Police Department be received and filed. The City Administrator informed the Council that this matter had been brought to the attention of the Street Department and the work was already under way, possibly having been completed. On motion by Lambert, seconded b y Stewart, the City Administrator was instructed to follow up this work and report its completion. Motion carried. Motion carried. Finance Committee- Mayor Gisler appointed Council- man Stewart to serve as a member of the Finance Committee for this meeting, due to the absence of Councilman Waite. Grant =c ec'.- A grant deed from the Hunt- `ater ='i" hts- I.% ington Beach Plaza, Incor- porated, to the City of Huntington Beach, for water rights was presented by the Clerk. On motion by Lambert, seconded by ,dells, the deed from Huntington Beach Plaza, Incorporated was accepted, and the Clerk authorized to record same with the County Recorder. Motion carried. o. aIif. (Iison- The City Administrator informed �e-a�7pr�ry s�nL of the Council that he had received a copy of a letter, together with an appraisal, to the Southern California Edison Company, regarding a 1.99 acre parcel of land adjacent to the Edison Company Steam Plant, owned by the City. He stated that the Edison Company District Manager was in the audience prepared to make an offer for this parcel, based on the appraisal. 7-in', "is er- Mr. Ralph Kiser, General _So'n Go . Manager for the Southern California Edison Company in Huntington Beach, addressed the Council, stating that there was a necessity and urgency for his company to obtain this parcel of land as soon as possible to expedite construction within the plant. The City Attorney informed the Council that he had checked the deed requested in this negotiation, and that it affected only surface rights, while oil and mineral rights would be retained by the City. 3. 364 15, 1�'60 c�unciLm�nii r 1_I.s- Councilman Wells, stated that he felt the appraisal of approximately twenty five hundred dollars an acre was far too low and that similar land was selling for much more. He said that he thought the City should have its own appraisal made in this matter. ouncilm n :3`ewart- Councilman Stewart asked whether the City had retained this parcel of land to provide access to their mineral rights under the Edison Company holdings. City Attorney Bauer explained to Council that the operators had quit, claimed their right of entry through the property occupied by the Edison Company, for a strip of land approximately 200 x 300 feet north of the Edison Company's present holdings and a 100 foot strip on the easterly side of the property. He explained that, in the meantime, the Flood Control District had taken part of the 100 foot strip, and the property desired by the Edison Company was the balance of this strip. AnTrai sa l-- When requested by the Council, the Clerk read the communication from Bowdle Company to the Southern California Edison Company giving the appraisals and conlusions. ic-ry to After considerable discussion by the Council in which it was gener- ally agreed that the amount offered by the Edison Company for the 1.99 acre parcel was too low, a motion was made by Lambert, seconded by Wells, that the City Administrator obtain an appraisal from a reliable firm. Motion carried. Mr. Sol Deeble addressed the Council and asked what steps the City would take to protect adja- cent property owners from the fire hazard created by the proximity of the Edison Company tanks. -.ayor Mayor Gisler stated that in his 4. 36-5 F- c i,�5 - Z,`inutes, August 15, 1960 opinion, if homes were allowed in that area, the City would be faced with continuing problems from the home owners -not only the fire hazard, but the problem of odors, Counci.lmar, :;ells At this point, Councilman Wells asked for a clarification of the location of Mr. Deeble's property. Fire Chief Hi2p-ins Fire Chief Higgins read a Fire Protection Report which he had prepared for the Southern California Edison Company Steam Plant, in an effort to develop better fire protection for that area, and recommended the following procedures be adopted: (1) Creation of a buffer zone around the Edison Company property to be zoned indus- trial, to keep residential growth at a distance. (2) That the Edison Company install both permanent and portable foam equipment or enter into a mutual aid agreement with the oil industry to share in use of their equipment and supplies. (3) That the Edison Company have one of their Safety men trained to be an expert on oil fires . (4) That the Edison Company adopt and enforce strict fire safety ''rules in connection with storage, handling, and use of flammable liquids. (5) That Edison Company representatives meet with City Fire Department to prepare for fires within their plant. (6) That Edison Company have regular fire inspections made by their Fire Safety Man and the City Fire Marshall. (7) That proposed altera- tions in the plant be Presented for consideration by the City Fire Department before being made. 5. 366 15, (8) That all installations and operations at the Edison Company plant be in accordance with the Fire Prevention Code of the National Board of Fire Underwriters. Mr. Deeble again addressed the Council, asking whether there had been a subdivision in this area presented to the City Planning Commission. rninr 'ArFctor Tri]2p Planning Director Tripp informed Mr. Deeble that no such subdivision had been submitted up to this time. There was no action taken by the Council regarding Mr. Deeble's request and the matter was left at this point. Gran,- '�ti.c- A grant deed for street and highway �; lvn I1. T?ocker purposes from Ivan H. Hooker, Sr:, and Ruth S. Hooker, was presented by the Clerk. On motion by Lambert, seconded by Stewart, the deed from Ivan H. Hooker, Sr., and Ruth S. Hooker was accepted, and the Clerk authorizedto record same with the County Recorder. Motion carried. L Ct;'trti� 1 A communication from City Engineer, James Wheeler, recommending approval of an attached statement from ECCO for a partial payment for work completed on the Harry A. Overmyer Reservoir contract in the amount of $13,581,90, was read by the Clerk. On motion by Lambert, seconded by ylells, a partial payment to ECCO in the amount of $13,581.90, for work completed to date on the Overmyer Reservoir contract, was ordered paid. Motion carried. Tet-r.., r'_r: , bonc s- Mayor Gisler announced that at 8:00 o'clock P.M., or as soon thereafter as possible, was the time and date set for a public hearing on the request of the E.C.S. Gil Company for termination (-,-f drilling bonds on the following wells: Newroy No. 4, Newroy 2 36 ` 1 Page #7 - `inutes, i= gust 15, 1960 No. 5 and Estella No. 3, and instructed the Clerk to read the regal notice. The City Clerk read notice that a public hearing would be held by the City Council of the City of Huntington beach, California, at the hour of 8:00 o'clock P.M., or as soon thereafter as possible on Monday, August 15, 1960, for the purpose of considering the request for the termination and cancellation of drilling bonds as provided for in Section 2427.4 of the Huntington Beach Ordinance Code, as published in The Huntington Beach News on august 4th, 1960. There being no protests, oral or written, filed against the request, the hearing was closed by Mayor Gisler. Can motion by Lambert, seconded by Wells, the bonds were ordered terminated and the City Clerk instructed to notify the owner. Tile Co. 8:00 o'clock P.M., or as soon thereafter as possible, was the time and date set for a public hearing on an appeal by the Orange County Tile Company to a license classification assigned them. -a_Sm,- th Mr. Ray Smith, Sales Manager for the Orange County Tile Company, addressed the Council and protested the classifying of their business as two dis- tinct operations. The Clerk read a request for consideration for annexation of a five acre tract located adja- cent to the City of Huntington Beach, on the south side of Heil Avenue, one thousand yards east of Bolsa Chica Street; Legal Description -Lot 2 in Block 2 of Tract No. 86 as per map recorded in Book 10, Pages 35 and 36 of Miscellaneous Maps in the office of the County Recorder of Orange County, California; signed by Melvin A. Jay, Owner, and Richard M. Deam and Emma P. Dean, Owner -Lessor, On motion by Lambert, seconded by Stewart, the request of Mr. ,day and Mr. and PIrs. H.B.-Auto The Clerk read a communication Service - Towing Service from the Huntington Auto Service making application for a three year contract for towing service within the City of Huntington Beach and submitting a certified check in the amount of five hundred dollars as tentative payment. On motion by Stewart, seconded by Lambert, the application was referred to the City Admin- istrator, the City Attorney, and the Chief of Police, with instructions to study the matter and prepare specifications for bid for towing service in the City of Huntington Beach. Motion carried. Recess The Mayor called a recess of the Council at 8:47 o'clock P.M. Reconvened Council was reconvened by the tear at 9:03 0' clock P.M. James Kuzins Mr. James Kuzins, 1229 Dela- ware Avenue, City, addressed the Council to complain about trees on the property adjoining his which continually caused debris to fall in his yard creating quite a nuisance. He stated that the owner of the adjoining property would not have the trees trimmed, nor would she consent to the City's performing the work. Mr. Kuzins also complained about the rabbits and chickens in the neighbors yard being a nuisance. On motion by Stewart, seconded by Wells, the complaint of Mr. Kuzins was referred to the City Administrator and the City Engineer to handle. Motion carried. On motion by Lambert, seconded by Stewart, the City Clerk be instructed to publish in The Huntington Beach News a.legal notice setting a public hearing for the hour of 8:00 o'clock P.M., or as soon thereafter as possible, on Tuesday, September 6th, 1960, to consider Zone Case No. 126, as recommended for approval by the City Planning Commission. Exception The Clerk read transmittal Tract #3862 and petition for conditional exception - Tract No. 3862, to allow-56 feet right-of-way instead of 60 feet as required by the City Subdivision Code, on two streets in said tract, as recommended for app- roval by the City Planning Commission. On motion by Lambert, seconded by Stewart, the Council consented to the City Planning Commission's approval of the tentative tract map on Tract No.. 3862 with the condition stipulated. No. 790 1st reading The Clerk gave the first reading of Ordinance No. 790 in full, "AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH AMENDING THE HUNTINGTON BEACH ORDINANCE CODE BY AMENDING SECTIONS 9211.33, 9211.37 and 9211.46, RELATING TO SECTIONAL DISTRICT MAPS". Ord. Box 324, City, requesting the termination of a drilling bond on their Boyvey-Draper #1 well, together with a recommendation from the City Engineer that the termination be granted. On motion by Lambert, seconded by Wells, Pacific Indemnity Company, Bond No. 126649 be terminated and oil well permit No. 315 be cancelled in accordance with Section 24271 of the Huntington Beach Ordinance Code, and the owner notified. Sale of Lake Ave. A communication from County and Ocean Ave. Trunk Sewers Sanitation District No. 11 transmitting copies of the agreement for sale and purchase of Lake Avenue and Ocean Avenue Trunk Sewers for Council approval, was read by the Clerk. Motion carried. Safety Award. -Fire Dept. The City Administrator informed the Council of a plaque received by the Huntington Beach Fire Department from the State Compensation Insurance fund for a safety achievement award for working nine years without a last time accident. Sale of Lots- The matter of the sale of two Knoxville Street 27 feet lots at the corner of California, and Knoxville Streets was presented by the City Administrator with a request that an up to date appraisal be authorized. Annraisal-City On motion by Lambert, seconded Owned Lots by Wells, the Administrator was instructed to obtain an appraisal on the two City owned lots at the corner of California and Knoxville Streets. Permits The City Administrator presented & Valuations a report from the Building August t, 1959 to Director showing building, valuation for the ye#r/�U st i% 9609`=' to be $21,838,826.00 which represents 1,644 home units with a potential of 5754 people. Building permits covering this acti- vity amounted to $109,337.33. {C-4 '.Vwestm. The plans and specifications for Flood Channel the construction of the C-4 Westminster Flood Channel were presented by the City Engineer, with his recommendation that they be approved. On motion by Lambert, seconded by Stewart, the plans and specifications for the construction of 14. 375 1 Page #15 - Minutes, August 15, 1960 Westminster Channel, Bolsa Chica to Graham Street, as presented and recommended by the City Engineer, be approved. Motion carried. Tracts 3508, 3752, The City Administrator presented 3753-Agreements a subdivision agreements with Doyle and Shields covering Tracts No. 3508, 3752 and 3753, for Council consideration. On motion by Lambert, seconded by Stewart, the Council accepted the subdivision agreements with Doyle and Shields covering Tracts No's. 3508, 3752 and 3753, and authorized the Mayor and Clerk to execute same on behalf of the City. Motion carried. Bids -Pavement The City Administrator informed ,SRreader Box the Council that bids had been received for a Pavement Spreader Box, as follows: Jack Fingland Engineering Company Rola Paver.........................................$19500.00 Dearth Machinery Company Littleford True -Lay Spreader ............... ........19614.08 Larson Equipment Company Burch Simplex Spreader .............. ...............19783.60 All bids including sales tax. Purchase Spreader- On motion by Stewart, seconded Fingland En rs Co,� by Wells, the low bid of $1,500.00 by Jack Fingland Engineering Company be accepted, and the Purchasing Agent instructed to purchase the spreader. Motion carried. Appraisal -Lots A communication from the Claimed by Fred Hermann _ Claimed City ,attorney regarding the two lots requested to be purchased by Mr. Fred Hermann, was presented by the City Administrator.with the suggestion that an appraisal of the lots be obtained. Fred Hermann Mr. Fred Hermann, City, add- ressed the Council stating that he had encroached on City owned lots and had informed the Council to that effect. 15. 376 Page 146 -- Ninutes, August 15, 1960 Appraisal -Land On motion by Stewart, seconded by Acquisition Co. Wells, the City Administrator was instructed to get an appraisal from the Land Acquisition Company on the two City owned lots occupied by Mr. Hermann. Motion carried. City Attorney The City Attorney requested clar- ification of the action desired by Council in this matter, and was informed that any action necessary for the City to obtain clear title to this property, including reimbursement for any damages incurred by the City through the filing of the homestead by Mr. Hermann, was to be followed by the Attorney. Collection Delinquent The City Administrator requested Rentals-Mun. Trailer Pk. Council to authorize him to obtain assistance for Mr. Lem Berry, the Mm ager of the Municipal Trailer Park, in the collection of any delinquent rentals which might accrue. On motion by Stewart, seconded by Lambert, the City Administrator and the City Attorney were instru- cted to work with Mr. Berry in the collection of delinquent ren- tals, and the City Administrator be authorized to appoint any City employee to assist him. Motion carried. C t Limits Sign The City Administrator reported that only one proposal under three hundred dollars had been received for the relocation of the neon City limits sign. He explained to Council that Pacific Neon Lite of Costa Mesa pro- posed to move the sign from Beach Boulevard and Ellis Street to the intersection of Beach Boulevard and Smeltzer Avenue, repainting sign and pole, add extra length to pole with two crossarms under the sign, for the sum of two hundred forty five dollars ($245.00). Pacific Neon Lite- On motion by Stewart, seconded by propasal_Accepted Wells, the proposal of the Pac- ific Neon Lite in the amount of two hundred forty five dollars ($245.00) for the relocation of the neon City sign be accepted. 16. 377 1 Page #17 - Minutes, August 15, 1960 Motion carried. Request for Trimming A request from property owners of Trees that the Street Department trim two trees at 1112 Orange Street and one.tree at the S.E. corner of 12th and Orange Streets, was presented by the Administrator. Girl Scouts expressing their appreciation to Ralph St. Clair and members of his Department for the assistance rendered in the conduct of their annual Day Camp, was read by the Administrator. Ambulance.Services- Chief of Police, Clinton Lifeguard & Fire Dept. Wright, advised the Council of the problems created by various ambulance services refusing to answer calls placed by City, County, and State Law Enforcement Agencies, and asked Council to consider granting use of lifeguard and Fire Department ambulances in cases of extreme emergancy. T Council on a meeting of the Orange County Freeway Committee -Technical Committee, and suggested that the City Engineer be appointed as a member of that committee.
