I.TINUTES: On motion by Letson and seconded by Presson, the Minutes of the Huntington Beach Planning Commission meeting of August 2nd, 1960, as transcribed and mailed by the Secretary were accepted as mailed. 2ND PUBLIC HEARING: MASTER PLAN OF DRAINAGE 11196011 The City Engineer gave a presentation of the proposed Master Plan of Drainage 1960. He explained how the several districts as outlined were established on the basis of natural drainage basin areas. He pointed further that areas not included in the plan were to be slated for future districts which could not be established until more comprehensive studies were made. , The hearing was opened to the audience, there being no comment, it was closed. Further discussion study was held on the plan concerning such problems as financial participation, off -site improvements, and reimbursement clauses. RESOLUTION NO 1035 OF DRAINAGE, 1960. Hugh Halderman, Engineer for the subdivider, addressed the Commission and requested the condition of the 6 ft. block wall adjoining the Flood Control Channel be lowered to five ft. in•height. The request was favor- able to the Commission. the hearing was closed. There being no further comment, A MOTION WAS TRADE BY THOMPSON AND SECONDED BY PRESSON TO APPROVE TENTATIVE TRACT MAP NO 3595 WITH THE FOLLOWING CONDITIONS: 1. A 5 ft. conrete block wall shall be erected along the easterly line of the proposed storm drain right- of-way adjacent to all residential lots, and along Newland Street, except Lots 171 to 178 inclusive lying northerly of Indianapolis. 2. Riparian water rights to be dedicated to the City of Huntington Beach. 3. All drainage problems to be solved in a manner approved by the City Engineer prior to the final recordation of any part of Tentative Tract 3595• 4. Ted Bentley, present owner of the property, addressed the Commission and stated he had not been notified of the Imminent Domain proceedings initiated by the Ocean View School District. He considered such secrecy unfair and asked that the tract be approved anyway. There being no further comment the hearing was closed. The Secretary read the letter from Ocean View School District informing the Planning Commission that Imminent Domain proceedings had been filed. The hearing was opened to the Lyle Dunn,. 901 Alabama Avenue, addressed the Commission and explained the good.the church had done in improving various persons lives and that such a minor deviation should be most favorably considered. Mrs Marion Speer, 7862 Speer Avenue, addressed the Commission and explained that she had long ,been .a supporter of the applicant church and that she felt the church should receive favorable con- sideration. Rev. Robinson, representing the applicant, addressed the Commission and answered several questions. He explained that expansion to the rear of the church was ruled out temporarily due to the fin- ancing factor. A MOTION WAS MADE BY LETSON AND SECONDED.BY PRESSON TO APPROVE AREA•VARIANCE AV 215 WITH THE FOLLOWING CONDITIONS: 1. THE MOTION CARRIED. - USE VARIANCE: UV 216 To permit the expansion of Applicant - Artesia Growers Assoc a Farm Labor Camp for Mexican Nationals under the auspices of Artesia Growers Assoc by a•variance to A-1 Zoning. Located at the north 165 ft. portion of a 300 ft. depth property at the northeast corner of Ellis Avenue and Golden West Street, and legally described as the N. 165 ft. of the SE 4 of'SW 4 of SW 4 of NW 4 of Section 35, T. 5. S. , R.11.W. , SBB' & M. , with additional easement of 20 ft. along the west bound-- ' ary. The hearing was opened to the audience, there being no comment.it was closed. The Secretary read a letter of protest submitted by Mrs Anabelle Cresswell, acting as representative for Mr and Mrs Ed Russell.' - The proposed conditions -as submitted by the Planning Department were read. Planning Commission Tuesday,August 16th, 1960 Paul Schilling, applicant's re- presentative, stated that such a limitation was satisfactory. He further stated that he did not object to any of the conditions which were recommended. The Secretary also read another submitted letter from James T. Hudson, stating that he had no objections to the proposed variance. A MOTION WAS MADE BY PRESSON AND SECONDED BY LETSON TO APPROVE USE VARIANCE UV #216 WITH THE FOLLOWING CONDITIONS: I. The granting of UV 216 shall extend for only three years from the date of final approval by the Planning Commission; that the permitted UV 216 shall become null and void after this specified period except that the applicant shall have • the right to reapply. II. That the capacity of the present Nationals camp shall be virtue of UV 216 be expanded to 500 persons capacity. III.- All conditions as were applicable at the granting of the Use Variance for Artesia Growers Assoc: September 30, 1957, shall also be applicable for UV 216.- 1. That it shall be mandatory for the applicant to design proper sewage disposal facilities which shall be submitted by application to the Orange County Water Pollution Control Board for con- sideration and approval prior to the issuance of a building permit. That the Building Inspector shall be notified by the Orange County Water Pollution Control Board.of their approval before it becomes ` permissible for him to issue a building permit for the described labor camp. That the sewage dis- posal facilities shall also meet all State and City requirements, whichever in case of conflict being the most stringent, -shall prevail. 2. Delete. 3. That the maximum number of men allowed to be housed and otherwise cared for at this labor camp shall not exceed 300; except that this number shall not in- clude other personnel not classified as farm labor and who are otherwise required for the operation and maintenance of this labor camp. A provision shall be included within this condition to permit camp capacity to be increased to 450 men during this three years period by formal application to the City Council demonstrating actual need. f 490 Page #9 Minutes - H. That the parking lot area shall be a minimum area ' asshown on submitted drawings, and that all parking areas shall be paved with either two inches•(211) of decomposed granite and two inches (211) of asphalt blacktopping or three inches (3") of asphalt black - topping. The parking areas shall also'be marked with white lines into spaces enough for 10 cars, with provision for a turnaround and loading zone at the East end of the parking lot. 5. That a five hundred dollars ($500.00) performance bond be posted with the City Clerk and that said bond or a portion thereof shall be forfeited by the action of a majority vote of the City Council in the event that any extraordinary services are rendered by the City beyond reasonably normal requirements. Examples of abnormal requirements being: Necessity by the City to clean adjacent streets littered with refuse or beer cans, or police action to quell riots, etc. 6. That the entire labor camp excluding the 20' x 40' alley easement used as an entrande shall be fenced with a chain link fence to a height of 6 ft. That said fence shall be topped with two stands of barbed wire supported by stanchions placed oblique to the fence post. That -there shall be two 20' gates provided in said fenced enclosure; one of which shall be at the entrance alley to the camp enclosure, and the other shall be located at the management's discretion. The 2nd gate shall be utilized for emergencies only and shall be locked at all times except in event of em- ergencies. The Fire Chief shall have at least one key for the emergency gate. 7. That all workers enroute to their place of work shall be transported by vehicles. 8. That all laundry facilities as shown on submitted drawings shall be provided. And that there shall be a minimum of 250' of clothes line provided and further that the hanging of clothes upon the en- closure fence shall be prohibited. 9. That the entire entrance alley easement of 20' x 40' shall be paved with either two inches (211) of -de- composed granite and two (211) of asphalt black - topping or three (311) inches of asphalt black - topping, and that paved gutters shall be provided at east side of the alley. 10. That the entire yard area of the premises excepting that area upon which buildings are located'shall be paved with two (211) of asphalt blacktopping and that there shall be provisions to exclude the East 110' of the described premises from this requirement until construction of building or buildings is undertaken. 11. That a lighted sign will be permitted with a max- imum area of 80 sq. ft. and that there shall be a minimum requirement of an unlighted sign of at least 20 sq. ft. 9. 491 Page ;r10 Minutes"- H.-B. Planning Commission Tuesday, August 16th, 1960 12. That the described labor camp shall pio vide a recreation hall with a minimum area of 800 sq. ft. Said recreation hall shall have at least three tables, four feet in length, and twelve chairs. Vending machines are to be permissible in this room. 13. The following requirements shall be adhered to unless otherwise authorized by City Council. a. That no hard liquor shall be allowed on the premises. b. That there shall be a deputized guard stationed at the entrance gate between the hours of 4:30 P.M. Friday and 4:30 A.M. Monday. c. That there shall be a deputized guard stationed at the entrance gate during holiday hours if the Chief of Police shall so order. d. That the grounds in and -around the described premise shall'be kept in a reasonably neat and sanitary condition. e. That loitering about the camp by unauthor- ized persons shall be prohibited and this rule shall be reasonably enforced by the management. 14. That all structures shall be constructed in accordance with the submitted plans except as otherwise specified within these conditions. It shall be at the discretion of the Building Inspector to permit minor changes in the speci- fied plans and conditions. 15. That this permitted labor camp establishment shall for the purposes of this Use Vra.riance, remain under original ownership and management. Any act of sub -leasing or renting the described pre- mises or any attempt to transfer management control from the auspices of the Artesia Growers Assoc. ,shall constitute a violation of this specified condition. 16. That the Building Inspector shall not be author- ized to place final approval upon the construction and that he recommend the denial of a business license until all the previously stated conditions are satisfactorily complied with. 17. That any violations of these specified conditions shall be grounds for immediate and automatic revocation by the City Council, for the granting of this Use Variance. STUDY OF PROPOSED MARINA ZONING: The Planning Director re- ported that he had completed the rough draft on the residential portion of the proposed Marina Type Ordinance, and that he would like to mail it out to the Commissioners for their review and study. He forewarned them that the proposed ordinance was designed to be very strict in detail. RESOLUTION NO 1036 A Resolution of the City Planning Commission Acknowledging Excellent Job done by Commissioners Stang and Thompson and the Recommended Re- appointment of Same by City Council. CONSIDERATION OF PROPOSED The Secretary reported the FIVE ACRE ANNEXATION SOUTH OF HEIL AVENUE - proposal for annexation of SUNSET HEIGHTS five acres of a proposed trailer park in the Sunset Heights area which was located south of Heil Avenue and approximately 660 ft. east of Bolsa Chica. Discussion centered around the county variance which was report- edly granted by the county and which required connected sewers. Acting Chairman Stang, upon consultation with the Commission instructed the Secretary to investigate the county granted variance and instructed the Secretary to present the findings at the earliest opportunity. DISCUSSION OF REVISION Commissioner Thompson in - OF M-2-0 troduced the subject of future revision of M-2-0 District pointing out that as it is presently con- stituted it is too lax and that it adversely affects many property, owners whom own residences within the zone. The Secretary reported that the M-2-0 District was,scheduled to be rewritten, but that due to priorities and lack of time a new rough draft had not been accomplished.
