Councilmen Present: Wells, Lambert, Stewart, Waite, Gisler Councilmen Absent: None The Pledge of Allegiance was - given by all present in'the Council Chamber. The invocation was given by Reverend Harry V. Leland of the Wintersburg Methodist.Church. Police Depart.- The report of the Police Department _,,'_�onthly Reno rt for the month of August was presented by the Clerk. On motion by Stewart, seconded by Waite, the report of the Police Department be received and filed.. Motion carried. H. B, :otar5- Club- A communication from the Huntington Peauest use of .ernorial Hall Beach Rotary Club requesting use of Memorial Hall for their annual ICids Halloween Party on October 31, 1960, with fees waived., was read by the Clerk. On motion by Waite, seconded by Stewart, the Huntington Beach Rotary Club was granted the use of Memorial Hall with fees waived. Motion carried. 11.r. Ruebenoc.I;in- A communication from Mr. Rueben 'r'urchase of ,Aatc:r Dodkin, 18211 Newland Avenue, County of Grange, requesting permission to purchase water from the City of Huntington Beach, was read by the Clerk. Councilman .Fells Councilman Wells asked to be l xeus ec f rc�r Discussion excused from eiscussion of this matter due to relationship with the petitioner. The request was granted.. 11r. Dock{ in - Mr. Dodkin addressed the Council and stated that he desired water through a one and a half or two -1- Pale #2 - ��iniites, September 19th, 1960 407 inch water line on a temporary basis for household use only. On motion by Stewart, seconded - by Waite, the request of Mr. Dodkin be referred to the City Engineer, City, attorney and City Administrator to work out an agreement which would be equitable to all 1a rties concerned, and report back to Council at its next meeting. Motion carried. ftiequest of A written request by the State of Galif. Division of-Ighwys State of California, Division of Highways for permission to file a friendly suit on property being acquired for the Freeway from Huntington Beach to the Santa Ana. Rimier, was presented by the Clerk. City Attorney City Attorney Bauer informed Bauer the Council that the State was seeking to file the suit at this time in order to figs the valuation of the property as of the date of the suit. On motion by Stewart, seconded by Waite, the Administrator be instructed to write the Division of Highways, informing them that the City has hired an appraiser who is in the process of making an appraisal of the property involved. Motion carried. Ir. 'Mzrtin A request from Martin Weirman, V:eirman- 909 Delaware, City, asking that the City Recreation use a registration form for contes- tants which not not contain a waiver of damages for injuries, was read by the Clerk. i°Ir. .:icharO Mr. Richard Copeland, Supervisor Conclane of the Recreation Department, addressed the Council and explained that the form being used by his Department is similar to that used by 75% of the public agencies in California. Sch.- A communication from the Huntington 73oarc'-Protest Beach.Elementary School Board, filing a protest against permitting Tracts No. 3903 and No. 3898 to be developed, was read by the Clerk. C'ity At.torl ev City Attorney Bauer suggested that Lauer - consideration of this communi- cation should be withheld until the hearing on the Zone Case involving this area. The Clerk read the legal notice published in The Huntington Beach News and in The Westminster Herald on August llth, and August 18th, 1960, on Resolution No. 14292 'T A RESOLUTION DECLARING THAT PROCEEDINGS HAVE BEEN INITIATED BY THE COUNCIL BY THE CITY OF HUNTINGTON BEACH TO ANNEX TO SAID CITY CERTAIN UNINHABITED TERRITORY DESCRIBED HEREIN AND DESIGNATED "SUNSET HARBOUR ANNEXATION" AND GIVING NOTICE OF THE PROPOSED ANNEXATION AND SET A HEARING ON THE 19th DAY OF SEPTEMBER, 1960, AT THE HOUR OF 8:00 O'CLOCK P.M." The Clerk read the list of property owners and lessee's to whom notices of the Public Hearing had been mailed and including all other interested parties and agencies. Letter of Protest- A letter of protest from Mr. Fulton W. Hodge, Attorney of Los Angeles, representing Sunset Land and Water Company, IS11 409 Page A - I'linutes, Sentember ]_Sth, 1960 protesting the annexation of a small parcel belonging to his clients, and requesting that the City Council take action to exclude the parcel, was -read by the Clerk. Vr. Burton Tooker., A communication from Burton Lana Agent for State. of Calif. Tooker, Land Agent for the State of California, State Lands Commission, informing the Council that there are approximately 27.7 acres of State Sovereign Lands in the proposed annexation which must be appraised by the State Lands Commission for fixation of value on same in accordance with Section 35313.1 of the Government Code, and requesting that the City Council defer final action on the Sunset Harbour Annexation until after October 1st, 1960, was.read by the Clerk. io Cral Protests When oral protests were called for by Mayor Gisler there were none presented. On motion by Stewart, seconded by Waite, Council ordered the hearing on the Sunset Harbour Annexation continued until October 17th, 1960, at 5:00 o'clock P.M. to comply with the request of the, State Lands Commission for continuance, and to check the valuation of the land under protest. Motion carried. ;request from Orange Referring back to written Co. Street Naming Comm. communications, the Clerk read a communication from the Orange County Street Naming Committee, requesting Mayor Gisler to appoint a representative to meet with the Orange County Street Naming Committee to discuss,the problem of multiple names on Street and Roads within the County. Ma,vor Gisler- Mayor Gisler then named Member of Or. Co. Street naming Comm. himself as a member of the Orange County Street Naming Committee. :r. Nanuel Allen Under oral communications, Mr. Manuel E. Allen of Westminster, on behalf of his client, Mr. William Lyon, addressed the Council and stated that he had brought to the meeting a minute copy of the -4- 410 Farz{.. ",r5 --..InutLIs, September 11'tll, Lc'60 proceedings of the Orange County Boundary Commission, certifying the boundaries filed in connection with the "Newland No. 1 Annexation" as definite and certain. Mr. Allen requested the Council to proceed with whatever steps followed this such filing. 0 uooy ci. The City Clerk read a copy of the Minute action of the Orange County Boundary Commission, and presented the petition for annexation. City .ttorney City Attorney Bauer informed the Iaac^ r Council that the next step in proceeding with the "Newland No. 1 Annexation" would be the request for his office to prepare a Resolution in connection therewith. On motion by Lambert, seconded by Stewart, City Attorney be instructed to prepare a Resolution of Intent -to Annex, and present it at the regular adjourned meeting to be held on September 26th. Fred Hermann, 15th Street, City, addressed the Council and asked whether the City Attorney was going to proceed in filing the suit to clear titles on property being used by him. Cit,7i�,r_torney City Attorney Bauer informed the Bauer. Council that he is waiting for an appraisal of the property from the company authorized to make same before proceeding with the suit. Mr. Bauer further stated that the press of City business had been so great that it had interferred also in the filing of the suit. i`_r. Tony auer Mr. Tony Dauer, 2609 Florida Avenue, City, addressed the Council, reminding them that several months ago a petition had been circulated in the area involving Florida Avenue and Williams Street, in an effort to obtain curbs, gutters, and ornamental street lighting. Mr. Dauer stated that the petition had been presented to Council, and up to this time they had received no word either pro or con, as to whether any -5- 4 1 1 Page #6 - `inutes, September 19th, 1960 action had been inaugurated by the Council. Cit Er► rineer ',Wheeler City Engineer Wheeler informed the Council that the petition had been referred back to the City Administrator or Clerk by his Department because it requested the installation of these items but did not request the formation of an Improvement District for the accomplish- ment of the same. City Administrator The City Administrator informed the Council that the portion of the petition which would refer to the formation of an Improvement District had been crossed out before the petition was presented, and there was no indication given as to how such improvements would be financed. Recess of Council Mayor Gisler called a recess of the Council at 8:25 o'clock P.M. Council Reconvenes Council was recalled to order by the Mayor at 8:37 o'clock P.M. City Administrator The City Administrator read the petition for improvements under the Florida Assessment District in its entirety, and exhibited same to the Council, showing that any portion having to do with the establishment of an Improvement District, under the 1911 Act, had been lined out on the petition. He, recommended that, since the Council could not act on the petition as presented,that Mr. Dauer proceed with the recirculation of a new petition allowing this Improvement District to be set up under the 1911 Act. `r. Dauer Mr. Dauer addressed the Council again, and stated that this would be satisfactory with him and he would begin circulation of such petition immediately. He raised the question however, of whether the improvements desired by the property owners signing the petition, were sufficient to allow the Improvement District 'to be -formed, 4 1 2 -1 � =a ;, - inutos, 7epte=r_e:r 1�?th, 1C or whether it would be necessary to include additional improvements under such petition. ,:ity KRLiiiccr ..heeler City Engineer Wheeler, in answer to Mr. Dauer's question, stated that he felt that it would be advisable for the petitioners to'include the installation of sewer laterals from the sewer in the Street to the property Line in each case, and that he felt that paving would be very desirable in this case. r . Dauer Mr. Dauer informed the Council that he had been informed by a previous Council that if the curbs and gutters were installed, a serviceable road bed could be made by mixing the dirt with an oil solution in the area; but if this were not the case he felt that the petitioners would be willing to go along with full paving. �:ouric 1.Itrar, J'aite Councilman Waite informed the Council that he remembered the incident being brought up before, and that the petitioners had been informed that if they would put in the curbs, and gutters andlighting, that the City would put in a serviceable road by mixing the dirt with an oil solution. On motion by Stewart, seconded by Waite, the matter of the Florida Assessment District and the procedures for formation thereof be referred to the City Admin- istrator and Engineer for report back to Council. Public Hearing- Chairman Waite announced Zone Case No. 128 that this was the time and date set for a continuation of the Public Hearing on Zone Case No: 128 from the City Planning Commission, and declared the Hearing reopened. P1anninrL L,irector Tripp- Planning Director Tripp pointed out on a map the area involved in this Zone Case. He stated that the City Planning Commission had recommended the Zone Case for various reasons, including the fact that they ha6 fount' no fire hazard existing in the area. Hunt. Ech. Elem. A communication from the Sch. Board- Brotestincof Tracts Huntington Beach Elementary School Hoard stating that they were protesting the allowance of Tracts No. 3903 and 3898 becuase they believe the area should be zoned industrial, and the installation of homes in that area would create a school problem which could only be solved by a tax override. Fir. 'cry 2ronstein Mr. Jerry Bronstein, 864 S. Janes R. :r'heeler- A communication from James R. ;itv Engineer Wheeler, City Engineer recommending the final acceptance of the work done by Rosecrans Construction Company on installation of O"' water main and appurtenances in Talbert Avenue, and verifying that all materials have been furnished and'all work completed in accordance with plans and specifications, was read by the Clerk. On motion by Wells, seconded by Lambert, the Talbert Avenue water main job be accepted, and the Clerk instructed to file a notice of completion. Motion carried. E;.rree. Railway Com any Huntington Beach and the Pacific Electric Railway Company for condemnation of property in which both parties are interested, was presented by the Clerk. 1esolution 'No. 1436 The Clerk read Resolution No. 1436, "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH AUTHORIZING THE EXECUTION OF AN AGREEMENT WITH THE PACIFIC ELECTRIC RAILWAY COMPANY." On motion by Lambert, seconded by Stewart, Resolution No. 1436 was passed and adopted by the following roll call vote: AYES: Wells, Lambert, Stewart, Waite, Gisler NOES: None ABSENT: None City i%6ministrator The City Administrator presented a recommendation from City Engineer Wheeler that an addition'to the Ocean View Channel be approved by the Council as a change order. On motion by Lambert, seconded by Stewart, the Council approve the change as recommended by the Orange County Flood District to the Ocean View Channel Bond Project C-6, -13- r 4.19 Page #14 - Minutes, September 19th, 19601 from Beach Boulevard. through Tract No. 3430 - work to be performed through a change order. L'ieeting can Pers01111ei At the request of the City Ailotmcnts Set Administrator a meeting of the Council for the -purpose of discussing proposed personnel allotments for the coming year, was arranged for Monday evening, September 26th, 196n, Recues t for Suspension The City Administrator informed of C rdinance the Council that the Annual Surfing Contest would be held -on September 24th and 26th, and that the Ordinance on Surfing provides that it may be suspended for a certain period of time and for a certain distance for such cases as this. On motion by Wells, seconded by Lambert, that the Ordinance be suspended for September 24th and 25th in an area not to exceed 300 yards on either side of the pier to permit the Annual Surfing Contest to take place. Motion carried. H. 13. Am. Legion Post- The City Administrator Apl2roval of Pro sect presented a communication from The Huntington Beach American Leggon Post requesting approval of a project on holding a Boys Town in Huntington Beach. Mr. Miller explained that this program would involve having a day of City activities, where each official would have a student counterpart to assume his duties for this day, for the educational value which might be evolved therefrom. On motion by Lambert, seconded by Stewart, the American Legion Boys Town Program was approved by the Council. Motion carried. ifr.aymundo A communication from Mr. Pei dra Raymundo Peidra, of the First Assembly of God Church, requesting permission to hold a Fund Raising Program, was presented to the Council by the -14- F27e ).A5 - :".mutes, ;September 19th, 1960 Administrator. On motion by Waite, seconded by Wells, the First Assembly of God Church was granted permission to hold their Fund Raising Program, with the condition that they clear with the Police Chief before starting. Motion carried. Pcruest from The City Administrator presented Euilc' ink Inspector a request from Building Inspector Cleveland that Mr. .lames Sommerville, Structural Inspector and Charles M. Smith, Plumbing Inspector, be placedon a permanent basis effective October 1st, 1960. On motion by Lambert, seconded by Waite, James Sommerville and Charles M. Smith were ordered to be placed on a permanent basis, effective October lst, 1960. Motion carried. Lequ.est of A communication from Police Pol_icc Chief Chief Clinton Wright, requesting that Clerk Dispatchers Gary Davis and Barbara Brown be changed from an hourly rate in Range 26, to a monthly rate in the same Range, was presented by the City Administrator. On motion by Waite, seconded by Stewart, Clerk Dispatchers Gary Davis and Barbara Brown of the Police Department, were changed to a monthly rate in Range 26. Motion carried. Gantain John Seltzer The City Administrator presented a request from Captain John Seltzer of the Police Department that he be permitted to attend the Western States and Burgulary Conference to be held at Las Vegas, Nevada, on September 19th, through the 21st. On motion by Stewart, seconded. by Waite, Captain Seltzer was authorized to attend the Conference at Las Vegas, with reasonable expenses allowed. Motion carried. City Ac�.ministrator City Administrator hiller informed the Council that they had two requests from Churches for permission -15- Page #16 - i.finutes, September 19th, 1960 to install directional sign's within the City's right-of- way on various streets. He stated that, inasmuch as'this would establish a. precedent, he requested more time be given to consider the matter. On motion by Stewart, seconded by Waite, the City Administrator was granted additional time in the consideration of these requests. Motion carried. Planning ' rcctcr A request from Planning Tripta w' Director Tripp for permission to attend a class given by the University of California, Extension Program, with the City paying the tuition fee of twenty five dollars ($25.00), was presented by the City Administrator. Can motion by Stewart, seconded by Wells, Planning Director Tripp was authorized to enroll in said course, and to be reimbursed in the amount of twenty five dollars ($25.00) on completion of a successful course. `'lotion carried. I"ity Pucitor City Aduitor Paul Jones Paul Jones requested Council authorization for him to place the money received from the sale, of the 1.18 acres of property to the Huntington Beach Company, in Capital Outlay Fund. On motion by Lambert, seconded by Steuart, the City Auditor was authorized to receive the money for this sale in the Capital Outlay Fund. Motion carried. Agreement 3twn. The City Clerk presented an Ltoore Homes No . 5 agreement between Moore Homes No. 5 and the City of Huntington Beach, covering 'Tract No. 3430, for Council approval. On motion by Lambert, seconded by Waite, the Mayor and City Clerk be authorized to sign the agreement with Moore Homes. Motion carried. He stated that the Code indicates the City shall have a Resolution or Ordinance giving the time and method of payment of personnel. On motion by Waite, seconded by Wells, the City Attorney was instructed to draw up a Resolution establishing a time anck method of payment of personnel in accor- dance with the same procedure which is presently being followed. T°lotion carried. City attorney The City Attorney requested the Council to instruct him if there were any particular provisions which they might want incorporated. in this Resolution. It was suggested by members of the Council that paydays be made on the 10th and 25th of each month, and the method of payment to be by check; also, in case any payday should fall on a non -working day, the employees be paid on the last working c'ay 1r..nE6iatejy preceeding such day. Majx consider.the appointment of a Citizen's Committee to take action on placing on the ballot certain things previously recommended by the Tax- payers League. He suggested that such a group would be able to get these amendments preparee for study by the people at large before presentation to the voters.
