MINUTES: On mo.tion,by Presson and seconded by Letson, the Minutes of the Huntington Beach Planning Commission of September 7th, 1960, as transcribed and mailed by the Secretary were accepted as mailed. USE VARIANCE: UV 7#1224 To allow two sets of Applicant - Rebecca Sexton duplexes to be converted into rest home in the A-1 General Agricultural District. Located east of Oak Street on the north side of Sycamore Street, and legally described as Lots 13 and 15, Block "B", 'Tract 368. The hearing was opened to the public, there being no comment the hearing was closed. Commission discussion followed. Fire Chief Higgins addressed the Oommission and pointed out that the applicant could meet the fire safety code with a few minor revisions. Commissioner Bazil asked the Planning Director if there was sufficient land area for the required amount of parking based on one space per person housed. -The Planning report was in the affirmative. The applicant was asked if she objected to paving the parking areas for the required parking. The applicant had -no objections. -The applicant stated that she had no objections to limiting the capacity to 10 persons. 23 Page `=-2 Minutes - H. B. Planning Commission Tuesday, September 20th2 1960 A MOTION WAS MADE BY THOMPSON ADD SECONDED BY KAUFMAN TU APPROVE USE VARIANCE UV #224 WITH THE; FOLLOWING CONDITIONS: 1. Paved off street parking shall be provided at the rate of one 10 ft. by 20 ft. space for each bed. 2. The approved facility shall be limited in capacity to 10 persons. 3. No ambulatory patients shall be permitted on the premises longer than 24 hours. ROLL CALL VOTE: AYES: Presson, letson, Doutt, Thompson, Kaufman, Stang, Chairman Bazil. NOES: None. ABSENT:None. THE MOTION CARRIED. USE VARIANCE: UV 7J226 To allow a storage yard for heavy Applicant - General Telephone Co. construction equipment and materials in the C-3-0 District. Located at 605 Lake Street, and legally described as Lots 5 and 7, Block 605, Huntington Beach Tract. The hearing was opened to the audience. Warren 'leaver, Engineer for the applicant pre- sented the plans for the project. Donald J. Duckett, attorney for the applicant explained the telephone companys plan for temporary use of the yard. Mr Kenneth Howell, 605 Alabama, addressed the Commission and protested the yard, especially as a permanent installation. Charlie Reynolds, 701 Alabama Avenue, protested on the grounds that it would depreciate the value of surrounding property. Planning Commission Tuesday, September 20th, 1960 Upon questioning by the Chairman, Warren Weaver indicated that his company would only need the yard for temporary use for one year and probably less. It was explained that the Westminster installation would be completed within the year. Howell, when questioned, stated that he would not oppose the variance on a one year basis. Mr Reynolds, when questioned, stated that it would be better, but still opposed it. A MOTION WAS MADE BY STANG AND SECONDED BY DOUTT TO APPROVE USE VARIANCE UV #226 WITH THE FOLLOWING CONDITION. 1. The hearing was opened to the audience. CURBS AND GUTTERS: Unless this condition is other- wise exempted by the City Engineer, by a statement of declaration that this requirement is impractical or unfeasible from an engineering viewpoint, There shall be required the installation of curbs and gutters and the necessary apron approaches along the entire frontage of the applicant's property where it abuts Beach Blvd. ROLL CALL VOTE: AYES: Presson, Letson, Doutt, 'Thompson, Kaufman, Stang, Chairman Bazil. Located on approximately 60 acres lying 2640 ft. west of Bolsa Chica Street on the south side of Smeltzer Avenue, and legally described as the N 2 of SE 4 of NW 4 of Section 20; T.5.S.9 K.11.ti7., SBB & M and the NE 4 of NW 4 of Section 20, T.5.S., R.11.1a., 6BB & M. The Secretary read a letter from Alvin Graham recommending approval of the proposed trailer park. audience. The hearing was opened to the Vernon Houser, applicant, addressed the Commission.and presented elaborate and detailed plans 4. KII, Page #5 Minutes - H. B. Plaxuling Commission. Tuesday, September 20th, 1960 for a proposed combination of trailer park, nine hole golf course, and apartment housing. Clifford Houser, applicant, addressed the Commission and gave a resume of the proposed project. Idr LIcCrill, addressed the Commission and explained that the property involved had as much potential as any,that he had worked with. He submitted a study report prepared for the trailer coach association indicating.the sources of taxation which are derived from mobile trailer homes. Irir LIcCrill claimed on the basis of the submitted report that mobile home trailer parks pay their way as well as any single family subdivision. Jeff Millet, Engineer for Tract No 3670, addressed the Commission and explained that good FHA Financial commitments hinged upon the fact that the adjoining property would remained zoned for R-1. He also objected on his client's behalf to the use of a stubbed in street of the proposed subdivision for a secondary entrance to the trailer park. CJhen informed that it more likely be used for an emergency exit-, he stated that it would not be as objectionable along as the city were able to control the use of such an entrance. Attorney Dale Heinly, acting on behalf of his client,"Luxury Homes", addressed the Commission and vigorously protested the proposed R-5 Zoning as being undesirable to his client's proposed subdivision. When questioned in detail as to when the homes would be built and sold; Mr Heinly explained that the homes would probably be built and soldnthe developer long gone before the trailer park development ever got 5• 27 Page ;t6 Minutes - H. Planning Commission Tuesday, September 20th, 1960 started, but he explained that the idea of designating an area proposed for trailer parks and apartments adjacent to the subdivision tract would hurt the chances for financing and would further hamper the sales of the tract homes. Chairman Bazil asked the Engineering Department for a full report on the drainage situation. Henry Hartge, Senior Design Engineer explained in detail the problems of drainage for the property under consideration. He gave the opinion that from a drainage standpoint the installation of a trailer park would be logical. There being no further comment the hearing was closed. RESOLUTION NO 135 A Resolution of the 1lanning Commission raking Recommendation of Approval for `Lone Case No 135 to the City Council. A MOTION WAS MADE BY THOMPSON AND SECONDED BY PRESSON TO ADOPT RESOLUTION ITO 135. ROLL, CALL VOTE: AYES: Presson, Letson, Thompson, Kaufman, Stang. ITOES: Doutt, Chairman Bazil. ABSENT: None. THE RESOLUTION WAS ADOPTED. DISCUSSION AND REVIEW The Secretary reported to the OF LARD USE AND CITY COUNCIL REQUEST OF Commission that a presentation of ZONING ACTION IN THE EDISON GENERATING PLANTzoningmaps was being -'made inasmuch AREA. as the City Councilcon-;September 6th, 1960, made a motion and approved to the effect that the City Planning Commission was instructed to study, review ` and consider rezoning for an industrial area surrounding the Edison generating plant. 6. Tuesday, September 20th, 1960 The following areas were considered in the study: Sectional District Map 13-6-11 24-6-11 19-6-10 17-6-10 Discussion was held on general areas for proposed rezoning to R-5 P. I+I. T. and M-1-A. Commissioner Presson stated that in his opinion the area should be generally reserved for industrial -' development. The majority of the Commission concurred. Exact areas proposed for rezoning were then defined, as proposed zone cases 150, 151, 152, 156, and 157 Rezoning from R-1 and A-1-X to M-1-A. and Zone Cases No 154 and 158 Rezoning from R-1 to R-5 P. 11. T.. District. Planning Ccmmission Tuesday, September 20th, 1;60 FINDINGS BASED Oil THE AUGUST 2nd, 1960 REPORT TO THE C01;.7,1ISSION: FINDINGS ENiTMERATED -DISADVANTAGES OF RESIDENTIAL DEVELOP- T.IENT IN THE SOUTHERN CALIFORNIA EDISON CO. GENERATING PLANT AREA ARE: 1. There is a normal fire hazard existing from several large fuel oil tanks located on the generating station property which could endanger lives if residential development was located unreasonably close to the installation. 2. A noise factor within a localized area may be emanated from the steam generating plant since emmissions are kept at an absolute minimum level for an industrial unit of this type but most certainly existent from time to time which would be adverse to any potential residential development. 3. Existence of several well sites in the area, which cannot be completely controlled by zoning regulation. Neither zoning nor regulatory ordinances can be rectroactive except by reason of the health safety or welfare cause which could prove difficult or next to impossible to impose. 4. Existence of a forty acre rotary mud dump, which at various times past has been contaminated with hot acids. 5. Residential development will place a severe hardship on the school system which will not be allowed to locate within hazard areas or remote locations. 6. Street conditions in the area are deplorable - immediate residential development will cause severe change in the Arterial Highway program. - A costly item. 7. Farming operations will be curtailed since the lower Talbert Valley is dependent upon a cheap source of water as now furnished by partiallu treated affluents pumped from the Sanitation District treatment plant. Residential development will seriously restrict sewage irrigation water. 8. Close proximity to the existing 40 acres county refuse dump is also detrimental to residential development. 9. Any residential development in close proximity to the Wilshire Oil Tanks Mould be hazardous. 38 Page #9 Minutes — H. B. Planning Commission Tuesday, September 20th, 1960 10. Residential development adjoining the generating plant would preclude the development of compli— mentary industrial units which could jointly utilize steam and power facilities. -To establish residential adjoining the generating plant would most certainly handicap the generating plant operation, which currently is the greatest single asset the city pocesses. The generating plant should be given adequate protection. ON THE BASIS OF EXISTING CONDITIONS, THE AREAS UNDER STUDY HAVE THE GREATEST POTENTIAL AS INDUSTRIAL DEVELOPMENT. Planning Commission Tuesday, September 2011-h, 1960 PUBLIC HEARING - CONTINUED Copies of the proposed Proposed Pviarina Type Zoning; Marina Ordinance were pre- sented to all Commissioners. The copies presented covered only the Shoreline Develop - went Districts - General S-1 District R-Sl District R-S2 District R-S3 District The entire version of the Ordinance was reviewed section by section. Commissioner Stang requested a review of -the proposed front, side and rear setback provisions. Chairman Bazil requested that proposed Section 9604.33 be'slightly change to make clear the intent of the ordinance regarding setback of garages. The kianni,ng Director made the recommendation that all titles to all districts be dropped and all zoning district be referred to only their numerical designation such as S-R1 etc. The hearing was opened to the audience: William Gallienne made queries as to the sources of information used in developing the ordinance. Fire Chief Higgins suggested to the Commission that some provision be made in the ordinance to control hobbies that might occur. There being no"further comment the hearing was closed. The Secretary explained that it would take several volumes of ordinances to adequately describe hobbies and control of such. RESOLUTION NO 1038 A Resolution of the Planning Commission_ Recommending the Adoption of the Proposed Shoreline Development Districts. 10. 30 Page ;rll , Minutes - Huntington Beach Planning..Commission Tuesday, September 20th, 1960 A MOTION WAS MADE BY KAUFMAN AND SECONDED BY DOUTT TO ADOPT RESOLUTION NO 1038. ROLL CALL VOTE: AYES: Presson, Letson, Doutt, Thompson, Kaufman, Stang, Chairman Bazil. NOES: None. ABSENT: None. THE RESOLUTION WAS ADOPTED. TENTATIVE TRACT IAP NO 3903 Number of Lots: `295 Developer: William Lyon Total Acreage: 63.4 Engineer: Millet, King & Assoc Located south of Banning - Avenue and west of Bushard Street and legally described as the NE 4 of the NE 4 of Section 24, T.6.S., R.11.W., SBB & M. The hearing was opened to the public. Dale Heinly, 433 West 8th Street, Santa Ana, Attorney for the applicant, addressed the Commission, discussed the virtues of the case before the Commission, and gave arguments for approval. Attorney Heinly que- stioned the Planning Director in regards to whether the review committee had approved the tentative tract map. The Planning Director pointed out that a review committee meeting was held only to review the physical aspects of the proposed tentative tract and give the attending Commissioners a chance to discuss the problems of the tract with the staff and the developers on an informal basis. The Planning Director pointed out that the Review Committee is not impowered to act upon any tract map and serves no legal function. He stated that his client would take further legal action in the event the Tract Map was denied. There being no further comment the hearing was closed to the audience. Discussion of the case was held 31 Page ;r12 Tiinutes - H. B. Planning Commission Tuesday, September 20th, 1G60 by the Commission. The City Engineer was asked by the Secretary for an opinion from a flood control engineering view -point. The City Engineer indicated that the applicant had hired a consulting engineering firm to do the study for drainage of the tract area. He further stated that the area was one of the most critical in the lower Talbert Valley in regards to inundation, however he gave the opinion that it was definitely possible to provide drainage for the tract. He stated that the tract was designed for a 10 year storm interval and that the adjoining Huntington Beach Flood Control Channel - Talbert Flood Control Channel were designed for a 25 year storm. The City Administrator went on record as opposing the development of residential sub- divisions in that area. Commissioner Presson stated that he had lived in the Huntington Beach area since 1921 and that he fully remembered the many times that the area was inundated and that he had spent many hours installing electric utility equipment while aboard a rowboat in that exact vicinity. Commissioner Doutt stated that because of the approximity to the 40 acre mud dump, the Edison Generating Plant, the County Refuse Dump, the 10 acre industrial site across the street to the north, and the Sanitation plant, he questioned the advisibility of permitting the tract. Chairman Bazil pointed out that the area had been land used for agri- cultural use on the Piaster band Use Plan. He further explained that he had been under the impression that this particular 80 acres was to be included in the pre- vious rezoning case rezoning it to Tull-1-A, and that the '12. 32 Page #1.3 Minutes - H. B. Planning Commission Tuesday, September 20th, 1960 Planning Director had misunderstood the Commission in- structions to include this 80 acres with that of the Deeble property rezoning case. A MOTION WAS MADE BY DOUTT AND SECONDED BY THOMPSON TO DISAPPROVE THE MAP WITHOUT PREDJUDICE. The following findings were made: This action was based on the previous action of the Planning Commission which adopted Resolution of Intent 1037 which included that area known as Tentative Tract Map No 3903 as a rezoning case to be rezoned to 1.7-1-A District. Said Resolution of Intent was adopted on the findings of the Commission that the general area surround- ing the generating plant was not conducive towards good residential development because of the general drainage problem, the operational nuisances emanating from the. generating station, the hazards of the mud dump, the existence of the County refuse dump, the operational nuisance of the sanitation plant, and the condition of undeveloped arterial -highways in the lower Talbert Area. Note: Confusion existed on the first two vote counts, the balloting was not completed until the third vote count was sucessfully tabulated.and the motion was declared to be carried. AYES: Doutt, Letson, Presson, Bazil. NOES: Kaufman, Stang, Thompson. THE MOTION CARRIED. TENTATIVE TRACT MAP NO 3953 Number of hots: 76 Developer: Alfred A. A 1,11OTION WAS 15ADE BY STANG AND SECONDED BY PRESSON TO APPROVE TENTATIVE TRACT 1,1AP NO 3953 WITH THE FOLLOWING CONDITIONS: 1. The subject property shall participate financially on a proportionate basis in the development of the drainage district. 2. All subsurface water rights below 500 ft. shall be dedicated to the City prior to recordation of the Final TJap. 3. Applicant shall make application for R-1 Zoning. DISCUSSION OF The Planning Director advised that MASTER PLAN OF LAND USE - TO BE REVISED a rough draft of the Master Plan of Land Use is now being prepared for Commission study. He stated that the Commission should be gathering ideas and be ready to present then at the next Commission session. The Chairman indicated a desire to hold several study meetings before attempting a public hearing. A MOTION WAS MADE BY KAUFMAN AND SECONDED BY THOMPSON TO APPROVE USE PERMIT NO 109 WITH THE FOLLOudING CONDITIONS: 1. There shall be posted a $100.00 performance bond guaranteeing removal upon expiration of Use Permit #109. 2. Use Permit #109 shall expire -one year from date granted. 3. The subdivision directional sign shall be removed by the applicant upon expiration of Use Permit #109 the penalty for failure to do so shall be the for- feiture of the performance bond. DOG CLIPPING SERVICE: The Planning Director re- ported that he had called on the Costa Mesa Planning Director for a report of the pro- blems of permitting a dog clipping service within a central business area. The Costa Mesa Planning Director had in- dicated that their city had very good success with the permit for dog clipping within the City Business District. He was convinced that the existence of the Dog Clipping Service actually increased business of the surrounding stores by virtue of the higher purchase power of those persons patronizing the professional service of dog clipping. COi.iI.IISSIOIVTER JOHId THGIPSON Commissioner Thompson gave a FAR_E';iELL SPEECH farewell speech during which he ;thanked the Commission for their cooperation and for the chance of working with them as a group for the benefit of the Community. He expressed his appreciation for the opportunity to serve his community and told of the enjoyment, the education, and the battle scars he had ex- perienced by so participating. He wished the Commission the best of lock in the future. Planning Commission Tuesday, September 20th, 1960 COLH,iISSIOA?ER STANG - Commissioner Stang reported to AIRPORT STUDY REPORT the Commission that he had attended the presentation of the Qounty -Airf i.eld, Feasibility Study,as an invited guest of Supervisor Varner which was held at Phillips Hall, Santa Ana College in Santa Ana, September lgth, 1960. He outlined the details of the report which was presented as a joint project by - Quentin Engineering, Lookheed, and others. THERE BEING NO FURTHER BUSINESS, lif rd /E.
