Monday, November 7th, 1960
Mayor Gisler called the regular meeting
of the City Council of the City of Huntington Beach to order
at 7:30 o'clock P.M.
Councilmen Present: Wells, Lambert, Stewart, Waite, Gisler
CouncilmenAbsent: None
The Pledge of Allegiance was given by
all present in the Council Chambert.
Invocation was given by Reverend Gayland
Anderson, of the Weslyan Methodist Church, of Huntington Beach.
Reports of Dept. Reports of the Department Heads of the
Heads - Received
and Filed City for the month of October, 1960,
were presented by the Clerk.
On motion by Waite, seconded by Stewart,
the Reports of the Department Heads be received and filed.
Motion carried.
Roger J. Hosmer A communication from Mr. Roger J. Hosmer,
Tree Removal
1836 Park Street, City, requesting
permission to remove a tree from the parkway in front of his
residence and replace it with a more desi.reable tree at his
expense, was read by the Clerk.
On motion by Waite, seconded by Lambert,
Mr. Hosmer be granted permission to remove the tree from the,
parkway in front of his residence to be replaced by another
tree. Motion carried.
Dvron L. Thorton A communication from Mr. Byron L.
Reim. for Lwo
Io�:ofl Fish Lines Thorton, 743 Main Street, City,
requesting reimbursement for two monofil fish lines in the
amount of five dollars ($5.00), was read by the Clerk.
Mr. Thorton claimed that the lines had
been cut be a Lifeguard's truck through negligence.

Chief Lifeguard Chief Lifeguard Moorhouse reported on the

incident and stated that the Lifeguard
Department had not been responsible for the cutting of the line.
On motion by Stewart, seconded by Waite,
the request of Mr. Thorton be denied. Motion carried.
City of Westminster- A communication from the City of West-
Reso. No. 268
minster submitting their Resolution No.
268, "A Resolution of the City Council of the City of West-
minster calling upon the Department of Public Works Division of
Highways, to expedite the Construction of San Diego Freeway in
Orange County", was presented by the Clerk.
On motion by Waite, seconded by Lambert,
the letter and resolution from the City of Westminster be received
and filed. Motion carried.
H. 13. Elem. - ' d. of. A communication from the Board of Education
Eki. C:ommun.
of the Huntington Beach City Elementary
School District, expressing thanks to the City Council for voting
to uphold the recommendation of the Planning Commission on
Tracts 3903 and 3898, was read by the Clerk.
No action was required on this communica-
tion.
Thomas +:s. Crawford- A communication from Mr. Thomas G. Craw-
lmnr. of Alley .
ford, 510 Fifteenth Street, City, requesting
improvement of the alley between Fourteenth and Fifteenth Streets,
between Magnolia and Acacia Streets, was read by the Clerk.
City Engr..- The City Engineer informed the Council
that he would investigate the condition and report back to Council
at the next, meeting.

Manuel L. Allan Mr. Manuel Lee Allan of Westminster,
Annex. of Territory
representing William Lyon, Developer,
who was requesting annexation of territory covered by Newland
No. 1 Annexation, addressed the Council and requested that this
matter be moved forward on the Agenda.
Mr. Allan was informed by the Clerk, that
the hearing was set for 8:00 P.M., and could not be held prior
to that.
Robert F. Waldron- Mr. Robert F. Waldron, Attorney for
Zone Case 155 & 1.59
Peter Kareles, addressed the Council and
informed them that he was representing Mr. Kareles on Zone Cases
155 and 159, and asked if there could be a continuance on those
inasmuch as he was required to be away from the City for a time.
Mr. Waldron was informed by Mr. Tripp,
that these two Zone Cases were not set for hearing tonight, but
that the action of the Council regarding them would be to set the
date for a public hearing.
Public Hearing - Mayor Gisler announced that this was the
S. H. A. oil Co.
Term. of Drilling date and time set for a public hearing on
Bonds
a request for termination and cancellation
of drilling bonds, made by the S. H. A. Oil Company on their
Well No. 1 located on Lot 17 and 19, Lot 518, 17th Street section,
and requested the Clerk to read the legal notice.
The Clerk read notice of public hearing
as published in the Huntington Beach News, October 13th, 19600
setting the hour of 7:45 o'clock P.M., or as soon thereafter as
possible, on Monday, November 7th, 1960, for the purpose of
considering the request for the termination and cancellation of
drilling bonds.
Mayor Gisler then declared the hearing open.
The Clerk notified the Council that there
had been no written protests filed in connection with this public
hearing.

There being no protests filed, either
oral or written, Mayor Gisler declared the hearing closed.
On motion by Lambert, seconded by Wells,
the request of the S. H. A. Oil Company for termination of
drilling bonds be granted and the owner notified. The motion
was passed by the following roil call vote:

NOES: Councilmen: None
ABSENT: Councilmen: None

Resolution No. 140 of the City Planning Commission, recommending
approval of Zone Case No. 140, and instructed the Clerk to read
the legal notice.
The Clerk read notice of public hearing
as published in the Huntington Beach News, October 20th, 1960,
setting the hour of 7:45 o'clock P.M., or as soon thereafter as
possible, on Monday, the 7th day of November, 1960, for the
purpose of considering a petition for change of zone relative
to proposed change of district boundary and use classification
from Rwl Single Family Residence District, to R-5 P M T District.
The hearing was declared open by Mayor
Gisler.
The Clerk read transmittal from the
City Planning Commission of Resolution No. 140, together
with the Resolution and reported that he had received no
protests against the approval of Zone Case No. 140.

Stewart, the City Attorney be directed to prepare an Ordinance
covering Zone Case No. 140 as recommended. Motion carried.
Public Hearing Mayor Gisler announced that this was

the date and time set for a public
hearing on Resolution No. 154 of the City Planning Commission,
recommending approval of Zone Case No. 154, and instructed the
Clerk to read the legal notice.
The Clerk read notice of public
hearing as published in the Huntington Beach News, October 20th,
1960, setting the hour of 7:45 o'clock P.M., or as soon thereafter
as possible, on Monday, the 7th day of November, 1960, for the
purpose of considering a Resolution of.Intent, as adopted by
the City Planning Commission for change of zone relative to
proposed change of district boundary and use classification from:
R-1 Single Family Residence District, to R-5 P M. T District,
together with the location and legal description of the property
involved.
The hearing was then declared open

The Clerk read a transmittal from

Mayor Gisler.
On motion by Waite, seconded by
Wells, the City Attorney be directed to prepare an Ordinance in
connection with Zone Case No. 154. Motion carried.

Public Nearing Mayor Gisler announced that this was
"New and No.
L Annexation" the date and time set for a public
hearing on the annexation of certain uninhabited territory, to the
City of Huntington Beach known as "Newland No. 1 Annexation",
and instructed the Clerk to read the legal notice.
The Clerk read notice of public
hearing on Resolution No. 1437, "A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF HUNTINGTON BEACH GIVING NOTICE OF PROPOSED ANNEXA-
TION TO CITY OF HUNTINGTON BEACH OF THAT CERTAIN UNINHABITED
TERRITORY DESCRIBED HEREIN AND DESIGNATED AS "NEWLAND NO. 1
ANNEXATION" AND GIVING NOTICE OF TIME AND PLACE FOR HEARING OF
PROTESTS THERETO", as published in the Huntington Beach News on
September 29th, 1960, and October 6th, 1960, and in the Westminster
Herald on September 29th, 1960, and October 6th, 1960, per instruct-
ions contained in the Resolution, setting the hour of 8:00 o'clock
P.M., on Monday, the 7th day of November, 1960, in the Council
Chambers of the City Hall, in the City of Huntington Beach, County
of Orange, California, as the time and place, when and where,
any person owning property within the uninhabited territory above
described and proposed to be annexed to the City of Huntington
Beach, and having any objections to the proposed annexation, may
appear before the Council, of the City of Huntington Beach, and
show cause why such uninhabited territory should not be so annexed
to said City of Huntington Beach.
Such protests must be in writing,
may be filed at any time before the hour set for hearing object-
ions to the proposed annexation, and shall state the name or
names of the owner or owners of property affected, and.the
description and area of such property in general terms.
Mayor Gisler then declared the
hearing open.

The Clerk reported that he had received no
written protests filed against the Newland No. I Annexation. He
informed the Council that all notifications of government bodies
and anyone concerned in the matter of this annexation, had been
made within the time prescribed for such notice.
The Clerk further informed the Council
.that -he had checked with the Assessor's office, and the petition
represented signers owning more than two thirds of the land area
and the assessed valuation covered by the annexation.
There being no protests filed, either oral
or written, the Mayor declared the hearing closed.
On motion by Stewart, seconded by Lambert,
the Clerk be instructed to read Ordinance No. 802 in connection
with this annexation. Motion carried.

they were anticipating for the area if the approval were granted.

On motion by Lambert, seconded by Stewart,
the City Attorney be directed to prepare an Ordinance covering

the second reading on all Ordinances on the Agenda, except No.

Mr. Alban. Holtz - Mr. Alban Holtz, 534 West Lovita Street,
Protest
Orange, California, addressed the Council,
stating that he farmed land South of Adams along Bushard Street,
and if the Ordinance presented would prohibit the piling of manure
to be used for agricultural purposes, he wished to protest the
passage of the Ordinance.
City Attorney City Attorney Bauer stated that the Ordi-

nance was broad in scope, and the various
things which might tend to attract flies would only be declared a
nuisance if they were permitted to breed flies.
On motion by Waite, seconded by Stewart,

Since the passage of the Ordinance did not

Zone Case No, 128 On motion by Stewart, seconded by Wells,
Continued
Zone Case No. 128 of the City Planning
Commission, which had been continued from a previous meeting, be
continued until Monday evening, November 21st, 1960, at 8:00
o-'clock P.M., or as soon thereafter as possible, and the Clerk
instructed to publish notice of the continuation of such hearing.

Zone Case No. 131. - On motion by Stewart, seconded by Wells,
Continued
Zone Case No. 131 of the City Planning
Commission, which had been continued from a previous meeting,
be continued until Monday evening, November 21st, 1960, at the
hour of 8:00 o'clock P.M., or as soon thereafter as possible,
and the Clerk instructed to publish notice of the continuation
of such hearing. Motion carried.
Central Surety A request for termination of Central
Request for Term.
Surety, an Insurance Corporation Bond
No. 314669 , issued for cleanup purposes to the Utex Oil Company
for thdr"Little No. 3 Well, was presented by the Clerk, together
with a recommendation that the bond should be terminated and the
owner notified because the company had complied with the require-
ments of the Cleanup Ordinance.
On motion by Waite, seconded by Stewart,
Central Surety, an Insurance Corporation Bond No. 314669, issued
to the Utex Oil Company for their well Little No. 3 be term-
inated, and the owners notified of the action. Motion carried.
Kunz Si-n Co. A communication fromthe Kunz Sign Company
Subdivision Sign
increasing their offer from thirty dollars
($30.00) per month, to fifty dollars ($50.00) per month, for
rental of a space to install a subdivision sign in the triangle
owned by the City at the intersection of Highways 39 and 101,
was presented by the Clerk.
On motion by Waite, seconded by Stewart,
the City accept the offer of Kunz Sign Company, for fifty dollars
($50.00) per month, and instruct the Attorney to draw an agree -
went on a month to month basis. Motion carried.
The Clerk informed the Council that Kunz
Sign Company also had an existing contract for a subdivision sign
in the same area for Doyle and Shields, on which they were paying

a rental of thirty dollars ($30.00) a month presently, and Evans
Building Company. (Lowell Investment Company) of Santa Ana, have
a subdivision sign advertising Starlight Homes Tract, on which they
pay a twenty five dollar ($25.00) per month rental without contract.
On motion by Stewart, seconded by Waite,
the Evans Building Company and the Kunz Sign Company agreements
for existing signs, be terminated at the end of thirty days and
the companies notified of this action; and that Knotts Berry
Farm or any other companies having signs on City property, be
notified to remove the signs at the end of thirty days. Motion
carried.
Chamber of Con. A communication from the Huntington Beach
Christmas Decor.
Chamber of Commerce, requesting Council to
set aside the budgeted items for the Chirstmas Street Decoration
projects listed as follows:
1. 2611M Christmas Street Decorations and Electricity --twelve
hundred dollars. ($1200)
2. 2611M Christmas Supplies --one hundred fifty dollars. ($150)
3. 2659M Christmas Shrine --two hundred fifty dollars. ($250)
4. 2600M Labor for Celebrations --no amount.
was read by the Clerk. -
On motion by Waite, seconded by Stewart, the
Council approve the grant of funds to the Huntington Beach Chamber
of Commerce for Christmas Street Decoration Projects. Motion
carried.
City Collector A communication from City Collector W. M.
Unpaid Licenses
Clegg, regarding unpaid license fees, and
presenting a list of same, was read by the Clerk.
On motion by Waite, seconded by Stewart, the
Clerk and the City Administrator be instructed to notify those
firms with unpaid license fees; that fees must be paid within

ten days or action would be filed. Motion carried.
On motion by Lambert, seconded by Stewart,
the Clerk be instructed to proceed with the estimation of license
fees due for those firms which have not filed an application with
the City Clerk. Motion carried.
Accept work of A communication from Mr, James R. Wheeler,
Sully -Miller
Contracting Co, City Engineer, recommending -that final
acceptance of the work done by the Sully -Miller. Contra.eting'.
Company, onlhe improvement of Goldenwes.t Street between Summit
Avenue and Talbert Avenue, and stating that all materials had
been furnished and work completed in accordance with plans and
specifications, was read by the Clerk.
On motion by Stewart, seconded by Waite,
the work of the Sully -Miller Contracting Company on the improve-
ment of Goldenwest Street between Summit Avenue and Talbert Avenue,
be accepted and the Clerk instructed to file notice of completion.
Motion carried.
Renewal of Communications from V. H. and K. M. Nitt-
Leases on,
Beach Concessions kowski, Jack Clapp, Charles A. and Joyce
M. Derigo, Dwight Clapp, and William M. Poore, requesting renewal
of leases on their beach concessions, and suggesting in each case
that the renewal be for a period of ten years, were read by the
Clerk.
Meeting of Council. Mayor Gisler called for an informal

the Whole, in the Council Chambers on Monday evening, November

Boundary Cori. Minute Action of the Boundary Commission of
of Or. County -
Minute Action Orange County, California, at their meeting
of October 31st, 1960, regarding the proposed annexation of terri-
tory to the City of Huntington Beach, (Northeast No. 3 Annexation -
revised) indicating that the Boundary Commission find the boundaries
of the proposed annexation reasonably definite and certain, was
presented by the Clerk.
This matter was presented for information
only and no action was necessary.
,lames R. Wheeler A communication from Mr. James R. Wheeler,
ECCQ Extension of
Contract recommending that a verbal request by
ECCQ, Contractors on the construction of the Harry A. Overmyer
Reservoir, for an extension of their contracts for thirty cal-
endar days be approved, was presented by the Clerk.
On motion by Waite, seconded by Stewart, the
ECCO Company was granted a thirty day extension of their contract.
Motion carried.
Sewer at A communication from the City Engineer,
Hunt. and
Garfield Ave.. requesting Council to consider construction
of a sewer in Huntington Avenue, from Garfield Avenue northerly to
a point opposite the buildings of the Ferro Company, was presented
by the Clerk.

from the City Engineer that his -Depart-
ment be authorized to proceed with the preparation of plans and
specifications for the improvement of Smeltzer Avenue fto m
Highway 39 westerly to Goldenwest Street, with the stipulation
that this improvement is on a street of major City importance,
and the improvement could be accompli's_hed by the expenditure of
Gas Tax Funds.
On motion by Waite, seconded by.Lambert,
the Engineer be instructed to proceed with the improvement of
Smeltzer Avenue to be financed by Gas Tax Funds. Motion carried.
Fill Vacancies The City Administrator presented a request
of Patrolmen
from the Chief of Police for authorization
to fill the vacancies of three existing patrolmen in the depart-
ment, by selecting recruits from the current eligbiiity list.
Request for A request from the Police Chi.!f for
Patrol Cars
two additional police cars and a panel
truck with four wheel drive, was also presented by the Adminis-
trator.
On motion by Wells, seconded by Lambert,
the request of the Police Chief for additional personnel and
patrol cars be deferred'untii the next regular meeting of the
Council, and to be considered at the meeting of the Council as
the Committee of the Whole, set for November 14th. Motion carried.1
Simonne Coltrin The City Administrator presented a request

that Miss Simonne Coltrin, an employee in his department, be

State Div. of Highwy. A communication from the State Division of
Appraisal. of Property
Highways, stating that they were agree-
able to waiting a reasonable period of time for an appraisal of
the property which they.propose to acquire for the freeway from
Huntington Beach to the Santa Ana River, was presented by the City
Administrator.
This was for information only and required
no action.
Sewers on. The City Administrator presented a comm-

unication from the City Engineer, giving
figures for the installation of sewers on England Avenue north
of Yorktown, which had been requested by the Council at a previous
meeting.
Engineer Wheeler stated that he would make
further study of this matter before making a recommendation to
the Council.
Mayor Gisler Mayor Gisler asked the Administrator
Sewers on.
Garfield St. whether any action had been taken on the
petition of Mrs. Dabney and other Garfield Street residents,
requesting sewer on Garfield Street.
The matter was discussed at some length
in the Council, but no action was taken.
Fred C. Hermann The Clerk read a communication from Mr.
Offer for Lots
Six and Eight Fred C. Hermann, 408 15th Street, City,
offering the sum of one thousand dollars ($1,000) for title
to Lot 6 and a portion of Lot 8 in Block 314.
In his offer, Mr. Hermann agreed to have the

well on this property abandoned and the lots bulldozed and
leveled if the offer were accepted.
On motion by Stewart, seconded by Lambert,
the communication from Mr. Hermann be received and filed. Motion
carried.
On motion by Stewart, seconded by Lambert,
the City Attorney be instructed to secure a title report on
Lot 6 and a portion of Lot 8 in Block 314. Motion carried.

Anpraisal. on The City Administrator presented an
Lots 2 & 4
appraisal on Lots 2 and 4 in the three
hundred block on Fifteenth Street, which Mr. Hermann had been
endeavoring to purchase as follows: Lot 2, thirty five hundred
dollars ($3500); Lot 4, twenty five hundred dollars ($2500);
this appraisal was from Land Acquisition Service.
The City Attorney informed the Council
of the alternative procedures they could take ugarding these
lots, which Mr. Hermann has offered to purchase.
On motion by Stewart, seconded by Lambert,
the City Attorney be instructed to file suit against Mr. Fred
Hermann to acquire title on Lots 2 and 4; to remove the encroach-
ment or damages; and to abate the nuisance relative to encroach-
ment of the buildings on Lots 6 and 81, on the alleys and on the
sidewalks. Motion carried.
Warrants On motion by Stewart, seconded by Lambert,

Finance Committee, were ordered paid. Motion carried.
Reconstruction of The City Administrator presented a
Hunt. Avenue communication from the City Engineer
submitting plans and specifications, notice inviting sealed bids,

and a prevailing wage resolution for the reconstruction of Hunt-
ington Avenue from Atlanta Street to Pacific Coast Highway, and
stating that funds for this project were available in the Street
Construction Account.
On motion by Lambert, seconded by Stewart,
the plans and specifications for the paving of Huntington Avenue
from Atlanta Street to Ocean Boulevard be approved, and November
21st, -1960, at the hour -of 8:30 o'clock P.M., be set as the time
for opening bids for the project. Motion carried.
Reno. o. 144L The Clerk read Resolution No. 1441, "A
RESOLUTION OF THE CITY OF HUNTINGTON BEACH ESTABLISHING THE GENERAL
PREVAILING RATES OF HOURLY WAGES FOR EACH CRAFT OR TYPE OF WORK-
MAN OR MECHANIC NEEDED FOR THE RECONSTRUCTION, SURFACING, AND
IMPROVEMENTS OF HUNTINGTON AVENUE, BETWEEN PACIFIC COAST HIGHWAY
AND ATLANTA AVENUE, IN THE CITY OF HUNTINGTON BEACH, CALIFORNIA."
On motion by Waite, seconded -by Stewart,
Resolution No. 1441 was passed and adopted by the following roll
