HomeMy WebLinkAbout1960-11-21n MINUTES Council Chamber, City Hall Huntington Beach, California November 21, 1960 Mayor Gisler called the regular meeting of the City Council of the City of Huntington Beach to order at 7:30 o'clock P.M. Councilmen Present: Wells, Lambert, Stewart, Waite, Gisler Councilmen Absent: None The Pledge of Allegiance was given by all present in the Council Chamber. Invocation was offered by Reverend Walter Barnard of the First Church of God. Police Depart The report of the Police Department for Monthly Report October 1960 was presented by the.Clerk. On motion by Waite, seconded by Stewart, the report was ordered received and filed. Motion carried. Tax Collector of Communications from the Tax Collector of Orange County. Orange County, concerning T C Sales Nos. 895 and 910, of property situated in the City of Huntington Beach, were presented by the Clerk. The Clerk informed the Council that he had contacted the Tax Collected, and had been informed sale would not be made until February, 1961. This matter was deferred until item of Murdy proposition be discussed later in the meeting. Trustees Hunt. A communication from the Trustees of the Bch. Union High School Huntington Beach Union High School District, requesting that Utica Street, from the intersection of the exten- Sion of Goldenwest Street, easterly a total of 1135.89 feet, be closed and abondoned in order that the land may be used for school purposes. Mr. Edwin Mr. Edwin Anderson, Assistant of the High Anderson School, addressed the Council and -1- Pale #2 , Minutes, NoveTnber 21st, 1960 explained from a plan presented, the reasons for desiring the additional property. Mr. J. Sherman In answer to a question as to whether this Denny property would revert to previous owner (The Huntington Beach Company) upon such abandonment, Mr., J. Sherman Denny, Manager of the Huntington Beach Company, informed Council that his company was prepared to release the property to the school district. On motion by Stewart, seconded by Lambert, the request of the High School.District be referred to the City Administrator, Attorney and Engineer for study and report. Motion carried. Carp Bait A request for renewal of lease by Carls & Tackle Shoo -Bait and Tackle Shop was presented by the Clerk. On motion by Stewart, seconded by Waite, the request be received and filed. Motion carried. Petition of A petition of protest, signed by fourteen Protest residents of California and Huntington Streets, to the raising of the grade of an alley bound by Detroit Street on the South, Elmira Street on the North; and parallel to Huntington Avenue and California Avenue, was presented by Council- man Wells and read by the Clerk. 4n motion by Waite, seconded by Wells, the Engineer be instructed to contact all the property owners signing the petition, to explain the plans for the raising of the grade. Public Hearin;` Mayor Gisler announced that this is the Special Permit for Drilling date and time set for a public hearing on a petition for special permit for drilling an oil well, within IPAI R Page #3 - Minutes, November 21st, 1960 fifty feet of a railroad, requested by,Standard Oil Company of California, and instructed the Clerk to read the legal notice. The Clerk read notice of public hearing, published in the Huntington Beach News on November 3rd, 1960, setting the hour of 7:45 o'clock P.M., or as soon thereafter as possible, on Monday, the 21st day of November, 1960, as the time and date for hearing opinions for and against the granting of such special permit. Hearing Mayor Gisler then opened the hearing. Opened The Clerk stated that there had been no written protests filed in this matter. There being no protests filed, oral or written, the Mayor declared the hearing closed. On motion by Waite, seconded by Wells, a permit was granted to the Standard Oil Company for the drilling of this well. Motion carried. Public Hearing Mayor:Gisler announced that this is the Zone Case No. 152 date and time set for a public hearing on Zone Case No. 152, as recommended by the City Planning Commission, and requested the Clerk to read the legal notice. The Clerk read notice of public hearing as published in the Huntington Beach News on October 20th, 1960, setting the hour of 7:45 o'clock P.M., or as soon thereafter as possible, on Monday, the 21st day of November, 1960, as the time and date set for hearing opinions for_and against Zone Case No. 152. The hearing was declared open by Mayor Gisler. Planning Director City Planning Director Tripp pointed out Tripp on the map the area involved in this Zone Case. -3- 4 Page #4 - Minutes, November 21st, 1960 Mr. Roger Howell Mr. Roger Howell of Santa Ana, Attorney for Mr. William Lyon RCA Corporation, and Mr. William Lyon, owners of the property concerned, addressed the Council and requested that the hearing be continued to a later date, in order to allow his clients time to obtain reports of additional use for the property. On motion by Stewart, seconded by Wells, the hearing on Zone Case No. 152 be continued until Monday, December 19th, 1960, at 8:00 o'clock P.M., or as soon thereafter as possible. Motion carried. Public Hea rini; Mayor Gisler announced that this is the Zone Case No. 156 date and time set for a public hearing on Zone Case No. 156,- as recommended by the City Planning Commission, and requested the Clerk to read the legal notice. The Clerk read notice of Public Hearing published in the Huntington Beach News on October 20th, 1960, setting the hour of 745 o'clock P.M., or as soon thereafter as possible, on Monday, the 21st day of November, 1960, as the time and date for hearing opinions for and against Zone Case No. 156. The hearing was declared open by Mayor Gisler. City Planning City Planning Director Tripp pointed out Director. Tripp on the map the area involved in this Zone Case. Mr. Roger Howell Mr. Roger Howell of Santa Ana, Attorney for Mr. William Lyon Mr. the RCA Corporation and Mr. William Lyon, owners of the property concerned, addressed the Council and requested that the hearing be continued to a later date, in order to allow his clients time to obtain reports of additional use for the property. -4- M Page #5 - Minutes, November 21st, 1960 On motion by'Wells, seconded by Stewart, the hearing on Zone Case No. 156 be continued until Monday, December 19th, 1960, at 8:00 o'clock P.M., or as soon thereafter as possible. Motion carried. Public Hearing Mayor Gisler announced that this is the Zone Case No. 128 date and time set for a continuation of a public hearing on Zone Case No. 128, said hearing continued from the meeting of September 19th, 1960, to an indefinite date, and requested the Clerk to read the legal notice. The Clerk read notice of continuance of a public hearing on Zone Case No. 128, as published in the Huntington Beach News on November 10th, 1960, setting the hour of 8:00 o'clock P.M., or as soon thereafter as possible, on Monday, the 21st, day of November, 1960, as the date and time for hearing opinions for and against this Zone ease. Mayor Gisler declared the hearing reopened. Planning Director Planning Director Tripp pointed out on Tripp a map the area involved in this case. Mr. Robert W. Mr. Robert W. Long, Vice President of the Long Irvine Company, addressed the Council regarding the interest his company holds in the area adjacent to that covered in this Zone Case, and presented the Clerk with a communication in this regard. Conn. from The Clerk read the communication from Irvine Co. the Irvine Company, requesting a further postponement of -Council action in this matter until they might have an opportunity to review the case with City Planners. On motion by Wells, seconded by Stewart, the hearing on Zone Case No. 128 be further continued until December 19th, 1960, at 8:00 o'clock P.M., or as soon thereafter -5- 'M V Pare #6 - Minutes, November- 21st, 196.E as possible. Public Hearin; Mayor Gisler announced that this is the date Zone Case No. 131 and time set for a continuance of a public hearing on Zone Case No. 131, said hearing continued from the meeting of September 19th, 1960, to an indefinite date, and requested the Clerk to read the legal notice. The Clerk read notice of continuance of a public hearing on Zone Case No. 131, as published in the Hunt- ington Beach News on November loth, 1960, setting the hour of 8:00 o'clock P.M.`, or as soon thereafter as possible, on Monday, the 21st day of November, 1960, as the date and time for hearing opinions for and against this Zone Case. Planninc- Director Planning Director Tripp requested that Trion Area One be deleted from Council consid- eration at this time, due to the fact that the City Planning Commission had agreed, subject to the approval of Council, to give Mills Land and Water.Company, sixty days additional time in con- sideration of the property involved therein. On motion by Wells, seconded by Stewart, the hearing on Zone Case No. 131, excluding Area One of said case, be continued until December 19th, 1960, at 8:00 o'clock P.M., or as soon thereafter as possible. Motion carried. Public Hearinc, Mayor Gisler announced that this is the Zone Case No. 141 date and time set for a public hearing on Zone Case No. 141, and requested the Clerk to read the legal notice. Gisler. Planning Director Tripp The hearing was declared open by Mayor Planning Director Tripp pointed out the area involved in this Zone Case on a map. The Clerk stated there had been no written protests filed in connection with Zone Case No. 141. There being no protests filed, either oral or written, the hearing was closed by Mayor Gisler. On motion by Waite, seconded by Lambert, the City Attorney be instructed to prepare an Ordinance in connection with Zone Case No. 141. Motion carried. Public Hearing Mayor Gisler announced that this is the Zone Case No. 155 date and time set for a public hearing on Zone Case No. 155, and requested the Clerk to read the legal notice. The Clerk read notice of public hearing as published in the Huntington Beach News on November 10th, 1960, setting the hour of 8:00 o'clock P.M., or as soon thereafter as possible, on Monday, the 21st day of November, 1960, as the time and date for hearing opinions for or against Zone Case No. 155. Mayor Gisler declared the hearing open. Planning Director Planning Director Tripp pointed out on — Tripp the map the area involved in this Zone Case. Comm. from A communication addressed to the City Mr. Peter Karales Planning Commission from Mr. Peter Kareles, owner of the property involved in this Zone Case, protesting -7- Ir Page #8 - Minutm, November 21st, 1960 the proposed for change of zone, was read by the Planning Director. Mr. Robert. Mr. Robert F. Waldron, Attorney representing F. Waldron Mr. Peter Karales, addressed the Council and requested that this Zone Case be continued in order that he might have more time to study the case. On motion by Waite, seconded by Wells, the hearing on Zone Case No. 155 be continued until Monday, December 19th, 1960, at 8:00 o'clock P.M., or as soon thereafter as possible. Motion carried. Public Hearing Mayor Gisler announced that this is the Zone Case No. 158 date and time set for a public hearing on Zone Case No. 158, as recommended by the City Planning Commission, and requested the Clerk to read thelegal notice. The Clerk read notice of public hearing as published in the Huntington Beach News on November loth, 1960, setting the hour of 8:00 o'clock P.M., or as soon thereafter as possible on Monday, the 21st day of November, 1960, as the date and time for hearing opinions for and against Zone Case No.-158. The hearing was declared open by Mayor Gisler. Planning Director Planning Director Tripp pointed out the Tripe area involved in this Zone Case on a map. Attorney -Howell Attorney Howell again addressed the Council, stating that he was not representing Mrs. Thorpe, the owner of the property involved in this Zone Case, but that he knew this property was combined with the property of his client, the RCA Corporation, in a proposed development; and that he felt it might be reasonable for the Council b consider a postponement of this case along with the others previously acted upon. a Page #9 - Minutes, November 21st, 1960 On motion by Wells, seconded by Lambert, the hearing on Zone Case No. 158 be continued to December 19th, 1960, at 8:00 o'clock P.M., or as soon thereafter as possible. Motion carried. Public Hearing Mayor Gisler announced that this is the Zone Case No. 159 date and time set for a public hearing on`Zone Case No. 159 as recommended by the City Planning Commission, and requested the Clerk to read the legal notice. The Clerk read notice of public hearing as published in the Huntington Beach News on November Loth, 1960, setting the hour of 8:00 o'clock P.M., or as soon thereafter as possible, on Monday, the 21st day of November, 1960, as the date and time set for hearing opinions for and against Zone Case No. 159. Planning Director Tripp Mayor Gisler declared the hearing -open. Panning Director Tripp indicated on the map the area involved in this Zone Case, and again read a communication from Mr. Karales protesting the proposed change of zone. Mr. Waldron Mr. Waldron again addressed the Council on behalf of his client, Mr. Karales, and requested that, for reasons previously given, the hearing be continued. 4n motion by Lambert, seconded by Stewart, the hearing on Zone Case No. 159 be continued until December 19th, 1960, at 8:00 o'clock P.M., or as soon thereafter as possible, Motion carried. Public Hearing Mayor Gisler announced that this is the Reso. No. 1039 "date and time set for a public hearing on Resolution No. 1039 of the City Planning Commission, -and requested the Clerk to read the legal notice. WE JL0 Page # 10 - Minutes, November aLh, 1960 The Clerk read notice of public hearing as k published in the Huntington Beach News on November loth, 1960, setting the hour of 8:00 o'clock P.M., or as soon thereafter as possible, on Monday, the 21st day of November, 1960, as the date and time for hearing opinions for or against approving Resolution No. 1039 of the City Planning Commission. The hearing was opened by Mayor Gisler. The Clerk reported that there had been no written protests filed to this Resolution. There being no protests filed, oral or written, the Mayor declared the hearing closed. On motion by Lambert, seconded by Waite, the City Attorney be instructed to prepare an Ordinance on Planning Commission Resolution No. 1039 as recommended by that body. Motion e carried. Opening of Mayor Gisler announced that this is the Sealed Bids date and time set for the opening of sealed bids for the reconstruction, surfacing, and improvement of Huntington Avenue, between Pacific Coast Highway and Atlanta and requested the Clerk to read the legal notice. The Clerk read notice inviting sealed bids for the reconstruction, surfacing, and improvement of Huntington Avenue, between Pacific Coast Highway and Atlanta Avenue, as published in the Huntington Beach News on November loth and November 17th, 1960, setting the hour of 7:30 o'clock F.M., on Monday, the 21st day of November, 1960, as the dead- line for receiving bids, and the hour of 8:30 o'clock P.M., on the same day as the time for opening same. City Engr. City Engineer Wheeler informed the Council Wheeler that a letter had been received from the -10- :11 Page #11 - Minutes, November 21th, 1960 Huntington Beach Company agreeing to the terms of participation which had been presented to them. Bids opened The Clerk then opened bids which were checked by the City Engineer and City Attorney and were tabulated as follows: Total Bid W. W. Kemp Company.............$169520.50 R. J. Noble & Company ........... 16,458.52 Sully -Miller Contracting Co. ...15,894.60 On motion by Lambert, seconded by Waite, all bids were referred to the Engineer for checking and report back to the Council. Motion carried. Oral Comm Under Oral Communications, Mr. James Kuzins, 1229 Delaware Street, City, addressed the Council and complained of overhanging trees in the neighboring yard, and other animal conditions detrimental to general health conditions. Following considerable discussion by the Council with Mr. Kuzins, a motion was made by Stewart, seconded by Wells, that the matter be referred to the City Engineer and Administrator to handle, with instructions to have the trees trimmed. Motion carried. On motion by Waite, seconded by Lambert, the Police Chief be instructed to draw upa case against the health hazard to be found at this same location, and refer -.it to the County Health Department. Motion carried. Mr. lied Mr. Fred Hermann, Fifteenth Street, City, Hermann addressed the Council to inquire the status of the law suit between the City and himself. City Atty. City Attorney Bauer informed Mr. Hermann Bauer and the Council that the suit was in the process of preparation; various department heads were obtaining -11- 1 12 Page #12 - Minutes, November 21st, 1960 necessary data, and the suit would be filed in the near future. 1r. Melvin Mr. Melvin Jay, 2742 Elm Street, Long Beach, Jay California, addressed the Council regarding an annexation of five acres of his property, which had been pre- viously requested and which was rejected by the Council. Mr. Jay inquired whether he might be furnished water and sewer facilities for his proposed trailer park, pending the possible future annexa- tion of a larger area. On motion by Wells, action on the request of Mr. Jay be deferred until December 5th, 1960. After further discussion, Councilman Wells withdrew this motion before it received a second. Mr. Charles Mr. Charles Jay of Long Beach, addressed Jay y the Council, stating that the Council had indicated at a previous meeting that they would approve the trailer park. Following some discussion on this, Mr. Jay stated that it might have been the Planning Commission which indicated approval. Sunset Heights Council discussed the possibility of the Annexation entire Sunset Heights area being annexed, and dropped -the matter pending further development of this possi- bility. Recess of Mayor Gisler called a recess of the Council Council at 8:57 o'clock P.M. Coi.zncil Council was reconvened at 9:12 o'clock Reconvened P.M., by Mayor Gisler. The Mayor informed the Council that at this point he wished to move ahead in the Agenda to a discussion of the proposed towing contract. City L'nar. Before proceeding -in this matter, City Wheeler Engineer Wheeler reported that all bids on the Huntington Avenue job, referred to him for checking, were found -12- 1 3 Pale #1.3 - Minutes, November list, 1960 to be in order, and the low bid for the job was that of the Sully -Miller Contracting Company in the amount of $15,894.60. On motion by Stewart, seconded by Wells, the low bid of $15,894.60 of the Sully -Miller Contracting Company for the reconstruction of Huntington Avenue be accepted, all other bids be rejected, and the Mayor and City Clerk be authorized to sign the agreement. Motion carried. City Admin. The City Administrator presented a list of specifications for a proposed towing contract which had been formulated by the Police Chief, Purchasing Agent, and himself, after an extensive study of similar contracts used by neighboring communities. He suggested that the Council approve these specifications for submitting a towing contract to bid. Following some discussion by the Council, a motion was made by Stewart, that the City advertise for bids for a towing contract on the specifications presented by the City Administrator. 1Ir. Elmor Mr. Elmer Goetsch, 1206 Park Street, City, Goetsch addressed the Council to inquire whether this would permit towing firms from outside the City to bid for this contract. Councilman Councilman Waite, informed Mr. Goetsch Waite that this was a problem of putting items to bid --that bidding could not be restricted providing the bidder is qualified to give service. Mr. Goetsch Mr. Goetsch stated that he felt any procedure adopted would be an improvement on the present system of handling towing contracts. Considerable discussion was held on the proposal by the Council and Mr. Goetsch. -13- r 1 4 Page y"l - Minutes,November ° 1st, i.96�7 Councilman Councilman Stewart requested that his Stewart motion be restated --the City advertise for bids for a towing contract on the specifications presented by the City Administrator and.including the requirement for the bidder to maintain a storage yard within the City. Motion seconded by Councilman Wells. Motion carried. Ord. No. 801 The Clerk presented Ordinance No. 801-- "AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH AMENDING THE HUNT- INGTON BEACH ORDINANCE CODE AND ADDING A SECTION THERETO, RELATING TO HOLIDAYS; which had previously had a first reading, and asked whether it be the wish of the Council for it to be given a second reading at this time. Discussion was held by the Council on the uniformity of the proposed Ordinance and the omission of items might be properly included in it. Members of the Council indicated that they felt the proposed Ordinance should have further study and revision before its adoption. On motion by Lambert, seconded by Wells, action on Ordinance No. 801 be deferred until Monday, December 5th, 1960, and the City Attorney and Administrator made revisions as suggested. Motion carried. Ord. No. 802 The Clerk gave Ordinance No. 802 a second second Readin reading by title, "AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH APPROVING THE ANNEXATION OF CERTAIN UNINHABITED TERRITORY DESIGNATED AS "NEWLAND NO. 1" TO THE CITY OF HUNTINGTON BEACH." On motion by Lambert, seconded by Waite, Ordinance No. 802 was passed and adopted by the following roll call vote: -14- Page No. 15 - Minutes, November 21st, 1960 AYES: Councilmen Wells, Lambert, Stewart, Waite, Gisler NOES Councilmen: None ABSENT Councilmen: None Ord. No. 803 The Clerk gave Ordinance No. 803 a Second Reading second reading by title, "AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH AMENDING THE HUNTINGTON BEACH ORDINANCE CODE RELATING TO MEMBERSHIP OF THE RECREATION COMMISSION." On motion by Lambert, seconded by Stewart, Ordinance No. 803 was passed and adopted by the following roll call vote: AYES: Councilmen: Wells, Lambert, Stewart, Waite, Gisler NOES: Councilmen: None ABSENT: Councilmen: None Ord. No. 804 The Clerk gave Ordinance No. 804 a first First Reading reading in full, "AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH AMENDING THE HUNTINGTON BEACH ORDINANCE CODE BY RECLASSIFYING CERTAIN PROPERTY; AMENDING SECTIONS 9211.36 (SECTIONAL DISTRICT MAP 20-5-11), SECTION 9211.34 (SECTIONAL DISTRICT MAP 15-5-11), AND SECTION 9211.65 (SECTIONAL DISTRICT MAP 19-6-10)." Peso. No. 1320 A letter of transmittal on Resolution Letter of Trans. No. 1320 of the City Planning Commission recommending approval of Zone Case No. 132, was read by the Clerk. On motion by Lambert, seconded by Waite, a Public Hearing wascrdered for Monday evening, December 5th, 1960, at 7:45 o'clock P.M., or as soon thereafter as possible, on Zone Case No. 132, and the Clerk instructed to publish notice of said hearing. Motion carried. Trans. from The Clerk read a transmittal from the Plan. Com. City Planning Commission submitting final form of Tract Map No. 3908 for City Council consideration; Developer - CONGEBE Development Company, 925 South Gilbert Avenue, Anaheim, California; Engineer: John M. Toups, 1629 West 17th Street, Santa Ana, California; Location - South of Garfield Street, -15- 16 Pate #16 - Minutes, November 21st, 1960 and West of Newland Street; Legal Description.- Ek of the NW'k of Section 1, T. 6. S., R. 11. W., SBB & M; Number of Lots - 151; Total Acreage - 38.847; that the map had.been certified by the City Engineer and the Planning Director to be true and correct in accordance with provisions of the City Subdivision Code. The City Council may accept dedications as shown on the map, and in addition approve the final map sub- ject to the following conditions: The City Clerk's signature shall be withheld pending the submittal and completion on the enumerated requirements: 1. Deposit of fees for water, sewer, engineering and inspec- tions . 2. Bond for improvements. 3. Signature of agreement. 4. All subsurface water rights shall be deeded to the City of Huntington Beach. On motion by Lambert, seconded by Stewart, final Tract Map No: 3908 be approved, subject to the signature of the City Clerk being withheld pending the execution of the required subdivision agreements, the posting of all regtired fees, bonds for improvements, and deed for the underground water rights. Petition for A petition for annexation of certain Annexation uninhabited territory in accordance with the "Annexation of Uninhabited Territory' Act of 1939 of the State of California - said Annexation designated as "Northeast No. 3 Annexation", and signed by property owners representing 100% of the property by assessed valuation, was read by the Clerk. Reso, No. 1442 The Clerk read Resolution No. 1442, "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HLW INGTON BEACH GIVING NOTICE OF PROPOSED ANNEXATION TO CITY OF HUNTINGTON BEACH OF THAT CERTAIN UNINHABITED TERRITORY DESCRIBED HEREIN AND -17- f is Pale #18 - Minutes, November 21st, 1960 DESIGNATED AS "NORTHEAST NO. 3 ANNEXATION," AND GIVING NOTICE OF TIME AND PLACE FOR HEARING OF PROTESTS THERETO." Shoreline and Information on the Shoreline and Water Waterways con. ways Conference to be held at San Mateo, California, on December 2nd-3rd, 1960, was presented by the Administrator, with the recommendation that the Council authorize the Planning Director and the Chairman of the Plannkg Commission to represent the City; On motion by Lambert, seconded by Waite, the Planning Director and Chairman of the Planning Commission be authorized to attend this Conference with reasonable expenses allowed. Motion carried. City Admin. The Administrator presented a communication from the City Engineer, transmitting Bid Summary on the construction 1 of a Sanitary Sewer in Huntington Avenue and on property being developed by the Ferro Corporation, and recommending that the City enter into an agreement of reimbursement with Ferro Corpora- tion, on terms prepared by the Engineer's Office. On motion by Waite, seconded by Stewart, the Mayor and Clerk be authorized to execute an agreement with the Ferro Corporation on construction of sewer on Huntington Avenue. Motion carried. City Engr. The City Administrator presented a comm- unication from Land Acquisition Service on procurement of property for park site, in connection with property offered to the City by Senator Murdy. The letter indicated an overall cost of $120,000. for entire procurement of property by condemnation. On motion by Waite, seconded by Wells,_ the City Attorney be instructed to contact Senator Murdy, and inform him that the City is interested in his proposition of land for a park site, but are not financially able to accept his offer at this time. Motion carried. On motion by Lambert, seconded by Wells, that Council meet as a Committee of the Whole at a time to be specified. Before the motion was called for vote by the Mayor, the motion was withdrawn by Councilman Lambert and the second by Councilman Wells, Recess of Mayor Gisler called a recess of the Council Council at 10:32 P.M. Council. The meeting was reconvened at 10:35 P.M. Reconvened by the Mayor Renewal of Considerable discussion was held by the Beach Concessions Council on proposed leases for renewal on the Beach Concessions including the various items to be covered by the lease. On motion by Waite, seconded by Lambert, the leases of the six concessioners on the beach be renewed, stipulating a ten year lease with an optional review of terms for adjustment at the end of the 3rd year and 6th year; with the City !!VXIM 21 Page #21 - Mintes, November 21st, 1960 to receive 20% for equipment rentals and 5% on food sales; the existing minimum rental; concessionaire to furnish liability insurance in the amount of $100,000. for any one claimant and $300,000. for any one claim; with $5000. coverage for property damage; records maintained per recommendation of, and to the satisfaction of the City's Audit firm. On motion by Waite, seconded by Lambert, the Police Chief be authorized to employ two patrolmen. Motion carried. On motion by Waite, seconded by Lambert, the Police Chief transfer the present Parking Control Officer to duties as patrolmen, and that Mr. Roy D. Bryant be appointed as Parking Control Officer in Range 26-F. City Atty. Bauer City Attorney Bauer informed the Council that the statute does not permit the employ- ' ment of anyone in a step higher than C in any Range. Co"nci?man Councilman Waite, with the concurrence of Waite Councilman Lambert, changed the motion to Range 26-C. City Admin. Motion carried. vvai.ve Penalty The Clerk requested permission to waive on License the penalty on license for Mr. Harvey Pease, under Section 2102.5 of the Huntington -Beach Ordinance Code, because of lack of information concerning the license ordi- nance. On motion by Waite, seconded by Lambert, that the penalty be waived for Mr. Pease providing he pays the license fee. Motion carried. Road Ease. A Road Easement Deed from the Huntington Deed Beach Company to the City of Huntington Beach, was presented by the Clerk. On motion by Lambert, seconded by Waite, the deed be accepted and the Clerk authorized to record same with the Orange County Recorder. Motion carried. A discussion was held on the list of applicants to be considered in assigning concession rights on two new proposed concessions. On motion by Waite, seconded by Lambert, the Clerk be instructed to prepare a list of all applicants for beach concessions who had filed applications in the past eighteen months. Motion carried. Mr. Paul A request from Mr.. -Paul Doutt, of the Doutt Chamber of Commerce Annexation Committee, seeking the cooperation of the City Engineering Department, in the preparation of a boundaries description for a Sunset Heights Annexation, was presented by the Administrator. There was no action taken on the request. City Admin. The Administrator presented a request of the City Engineer, for authority to engage the services of Lowry and Associates of Santa Ana as Engineers, to develop the costs and necessary data in connection with the Ronald Road Improve- ment District (1911 Act), at a rate of 2% of the final contract cost. On motion by Lambert, seconded by Waite, the City Engineer be authorized to employ the services of Lowry and Associates as Engineers, for the Ronald Road Improvement District. Motion carried. City Admin. The Administrator presented a recommenda- tion from the City Engineer that the City participate in the paving of "B" Street, in conjunction with the Ocean View School District, at a cost for the City not to exceed $2000. On motion by Lambert, seconded by Waite, the Engineer be authorized to extend City Participation in the paving of "B" Street, together with the Ocean View School District in an amount not to exceed $2000.
