MINUTES: On motion by Stang and seconded by Presson, the Minutes of the Huntington Beach Planning Commission of December 20th, 1960, as trans- cribed and mailed by the Secretary were accepted as mailed. TENTATIVE TRACT ITAP Pro 4037 Continued Number of Lots: 96 Subdivider: Great Western Land Co. Total Acreage: 20 Engineer: Voorheis-Trindle-Nelson Located south of Heil Avenue and 660.00 ft west of Golden West Street, and legally described as the W J of the NEI of the SE4 of Section 22-5-11. The hearing was opened to the audience, Ken Carlson, representative of V-T-N., told the Commission he had no objections to the conditions. There being no further comment, the hearing was closed. A MOTION WAS MADE BY STANG AND SECONDED BY LETSON TO APPROVE TENTATIVE TRACT MAP NO 4037 WITH THE FOLLOWING CONDITIONS: 1. Vehicular access rights along Heil Avenue to be dedicated to the City of Huntington Beach. (Arterial Highways) 2. Joe Houlgate, representing South Bay Engineering, told the Commission he had no objections to proposed conditions. There being no further comment the hearing was closed. The Secretary requested Mr. Hartge, Senior Design Engineer, to give a report onIthe drainage problem. A MOTION WAS MADE BY STANG AND SECONDED BY LETSON TO APPROVE TENTATIVE TRACT MAP NO 4U64 WITH CONDITIONS OUTLINED ON THE TENTATIVE TRACT MAP AND SPECIFIED HEREIN: Revised to read as follows: Vehicular access rights along Smeltzer Ave. shall be dedicated to the City of Huntington Beach except at street intersections and Lot 8 which shall be restricted to two ingress -egress approach aprons not exceeding 33 ft each. Vehicular access rights along Gothard St, shall be dedicated to the City of Huntington Beach, except that Lots 1 thru 7 shall be permitted two ingress -egress approach aprons not exceeding 33 ft each. The hearing was opened to the audience, there being no comment it was closed. A MOTION WAS MADE BY PRESSON AND SECONDED BY STAND TO APPROVE USE PERMIT NO 111 WITH THE FOLLOWING CONDITIONS: 1. There shall be posted a ,$250.00 performance bond guaranteeing removal upon expiration of Use Permit No 111, 2. Use Permit shall expire one year from date granted. 3. The subdivision directional sign shall be removed by the applicant upon expiration of Use Permit No 111 - the penalty for failure to do so shall be the forfeiture of the performance bond. A MOTION WAS MADE BY KAUFMAN AND SECONDED BY DOUTT TO APPROVE USE PERMIT NO 112 WITH THE FOLLOWING CONDITIONS: 1. There shall be posted a $250.00 performance bond -5- 114 Page ##6 Minutes - H. B. The hearing was opened to the public, there being no comment it was closed. Commission discussion followed. A MOTION WAS MADE BY PRESSON AND SECONDED BY STANG TO APPROVE USE VARIANCE UV #247 WITH THE FOLLOWING CONDITIONS: ( $1,000 surety bond for each model, $250 surety bond for sign) 1. A surety performnce bond of $1000.00 shall be posted for each model home to assure removal of same at the end of two years from the date of approval. 2. Located north of Hartford Street and west of California Ave., and legally described as Lots 1, 2, 3, 4, and 5, Block 803, Vista Del Mar Tract. Except the E 87.50 ft of the S 95 ft of said lots 1, 2, 3, and 4, also except the N 13 ft of the E 65 ft of said Lot 4, also except the E 65 ft of said Lot 5• The Secretary read a report of conditions and recommendations. The hearing was opened to the public there being no comment it was closed. Discussion was held at length. It was decided to delay the case to give each Commissioner an opportunity to view the property personally. Planning Commission Wednesday, January 4th, 1961 Section 1-6-11 SBB & M. Excepting therefrom the N 50 ft. The Secretary read a report sub- mitted by the Planning Department. The hearing was opened.to the audience. Mr. & Mrs. H. G. Trabant, 8041 Yorktown, H. B. addressed the Commission and protested to the proposed restaurant and bar which surrounds the R-4 Suburban Residential District, Mr. Lawrence Diekoff, 2508 Beach Blvd., H. B., addressed the Commission and protested the proposed restaurant and bar. Mrs. Marion E. Sallade, 940 Yorktown, H. B., also protested the proposed variance. Mrs. Walter W. Johnson, 8081 Yorktown, H. B., protested proposed UV 252 to the Commission. Mr. Solon Johnson, 19362 Beach Blvd., H. B., signed a written protest to UV 252. Mr. James Dale, 2405 Beach Blvd., H. B., addressed the Commission signed a written protest to UV 252. A total of 12 property owners in the area (including the above) signed a petition protesting UV 252. The petition was described as follows: We the adjacent property owners and neighbors, believe the -proposed restaurant and bar depreciates the surrounding R-4 property and is an objectionable development f or residential property. There being no further comment the hearing was closed. Commission discussion followed. UV 25Z would be detrimental to surrounding property. . 2. The property is insufficient in area for the proposed use. 3. A bar would not be consistent with the neighborhood character. 4. CONDITIONAL EXCEPTION: UV #254 To allow a church and Applicant - First methodist Church appurtenant uses within the R-2 District. Located at the NW enrner of Delaware Street and Seventeenth St. on approximately 3.75 acres and legally described as Block 2704 and 2704-A East Side Villa Tract. The hearing was opened to the audience. Mr. Jake G. Steidinger, 811-13th Street, H. B., addressed the Commission and spoke in favor of the proposed church site. There being no further comment the hearing was closed. Commission discussion followed. A MOTION WAS MADE BY PRESSON AND SECONDED BY DOUTT TO APPROVE UV #254 WITH THE FOLLOWING CONDITIONS: 1. Parking requirements shall meet city code of one space f or each six seats. 2. Dedication along 17th Street frontage of applicant's property required as an additional 15 ft making a total of 50 ft to the centerline of the Arterial Highway. 3. Located on approximately 10 acres east of Beach Blvd., 660 ft south of Heil Avenue and legally described as the wily 607.00 ft of the S 2 of the NW i of the SW a of Section 24-5-11. The hearing was opened to the pbulic. John A. Murdy, the 3rd, addressed the Commission. He stated that they had promise of a bank locating in the proposed center, and that they were currently negotiating with a chain grocery mart. He stated that preliminary plans were drawn for the center. Roger Slates, representing the Coast Realty Co., addressed the Commission and was in favor of granting Zone Case No 146. Planning Commission Wednesday, January 4th, 1961 RESOLUTION NO 1460 A Resolution of the City Planning Commission Making Recommendation of Approval of Zone No 146 To the City Council. A MOTION WAS MADE BY STANG AND SECONDED BY PRESSON TO ADOPT RESOLUTION NO 146. ROLL CALL VOTE: AYES: Presson, Letson, Worthy, Kaufman, Stang, NOES: Doutt, Chairman Bazil, ABSENT: None, THE RESOLUTION WAS ADOPTED. PUBLIC HEARING - "C-4 District" .(Highway Commercial) The proposed ordinance was reviewed by the Secretary and explained in detail. audience. The hearing was opened to the Howard Trabant, 8041 Yorktown, H. B., explained to the Commission that he felt the district was a step in the right direction, but he suggested that there be even more stringent controls. John Felhoelter, 18371 Beach Blvd., H. B., suggested to the Commission the C-4 District utilize the basic limitations of the C-1 District. Commission discussion was held concerning the number of trailer spaces per acre. A decision was unanamou+sly made to change the maximum number of spaces to 12 per acre. A decision was also made to delete a requirement of distance between dwellings, because all units will be requiredtobeattached. Planning Commission Wednesday, Janu.Lry 4th, 1961 RESOLUTION NO 1041 A Resolution of the Planning Commission of the City of Huntington Beach Making Recom- mendation of Approval for Proposed Revision of Article 942 by Amending Existing Section 9421 and Adoption of 11C-4 District". A MOTION WAS MADE BY KAUFMAN AND SECONDED BY DOUTT TO ADOPT RESOLUTION NO 1041. ROLL CALL VOTE: AYES: Presson, Doutt, Letson, Worthy, Kaufman, Stang, Chairman Bazil. NOES: None. ABSENT: None. THE RESOLUTION WAS ADOPTED. ACTION ON USE VARIANCE NO 120 The Fire Chief reported on the fire hazard existing in an area located approximately in the southwest corner of Newland St. and Hamilton Ave. The Secretary reported that a variance had been granted as UV 120 for a trailer park on a specific plot plan which was fronting on Pacific Coast Highvay at a location approximately 1000 ft west of Newland St. But it was noted that the applicant had specified a vague 25 acre legal description area that for the most part had not been built upon. Since the variance was granted on June 3, 1958 and the Huntington Beach Ordinance Code provides that the City Council may revoke any uncompleted portion of the variance after six months from the date of granting, it was suggested that a recommendation be made to City Council asking them to revoke the uncompleted portion of the variance on the basis of the fire chiefs fire hazard report. Discussion was held at length. The Secretary read a letter submitted by the Huntington Beach Elementary School District, requesting site approval for School Site No 3, which lies north of Tentative Tract 3903• The hearing was opened to the audience, there being no comment it was closed, held by the Commission. Prior to physical development of Huntington Beach Elementary School Site No 3., the Huntington Beach Elementary School District shall financially part- icipate on a proportionate acreage basis in the local drainage assessment district as preliminarily established on the Master Plan of Drainage. 2.
