HomeMy WebLinkAbout1961-02-20MINUTES Council Chamber, City Hall Huntington Beach, California Monday, February 3D, 1961 The regular meeting of the City Council of the City of Huntington Beach was called to order by Mayor Gisler at 7:30 o'clock P.M: The Pledge of Allegiance was given by all present in the Council Chamber. Invocation was given by Reverend LaGrow, Assistant Minister, Huntington Beach First Church of Christ.. Councilmen Present: Wells, Lambert, Stewart, Gisler Councilmen Absent: Waite Report of Report of the Police Department for the Police Denart. month of January, 1961, was presented by the Clerk. Report Received On motion by Stewart, seconded by Lambert, ane riled the report of the Police Department was ordered received and filed. Motion carried. Mayor Gisler Mayor Gisler informed the Council that he Attend_ Meet-im had attended the meeting of the Chamber of Commerce Industrial Committee the previous week, and highly com- mended the committee for their plans and activities for promoting industrial growth in the City. Mr. Clifford Tuxel W Under oral communications Mr. Clifford Cutting Roots Tuxel, 715 Huntington Avenue, City, addressed the Council and stated that he had been reported by the Police Department for cutting roots in the parkway in front of his home by Officer'DeWitt. Mr. Tuxel stated that he was not aware that he was violating an Ordinance of the City in so doing. -1- 12i) Page #2 - Minutes, February 20, 1961 Mayor Gisler - Mayor Gisler addressed the Council at Councilman Wells - Checks Property some length, stating that, together with Councilman Wells, he had checked the property at 715 Huntington Avenue and was entirely in support of Mr. Tuxel in the trimming of the trees. Chief of Police Chief of Police Wright reported that the police had made the report on Mr. Tuxel in their line of duty, and that no citation had been issued. 'fir, Tuxel, Mr. Tuxel stated that any relations with City Employees had always been of the best and the employees had been very courteous. On motion by Stewart, seconded by Lambert, the matter of root trimming was referred to the Engineer for remedial action. Motion carried. Mr. Richard Sinclair Mr. Richard Sinclair of the Driftwood Reports Pro ress Inn Corporation, reported that they were progressing with plans for the hotel and trailer park but would not get the hotel operating until next year.- Mr: Sinclair requested Council permission to begin to fill the site in . i preparation for the construction to follow. City Clerk - Ex.cerpt of ' finute Action The Clerk informed Mr. Sinclair that he was sure the Council had, by minute action, granted them permission at a previous meeting, and stated that he would send an excerpt of the minute action and a request that the City be notified when they were starting the fil Ltr. of Protest On motion by Lambert, seconded by Stewart, National Coin & Launery Company a letter of protest to the license fees charged the National Coin and Laundry Company for operating laundry machines at the Huntington Shores Motel was referred to the Administrator and Clerk for study and report back to Council.. Hall the Huntington Beach City Employees Associa- tion were granted the use of Memorial Hall for their installation of officers, with fees waived. Motion carried. H. B. Church of A communication from the Huntington Beach Christ Request__ Church of Christ requesting permission to blacktop portions of Loma and 16th Streets adajacent to the church was considered by the Council. Mr. T. A. Worthy Mr. T. A. Worthy, 613 13th Street, City, a member of the Church Board, addressed the Council on behalf of the Church, informing them of their desire to proceed with black - topping the area with all costs to be born by the Church. On motion by Lambert, seconded by Stewart, the request of the Church of Christ was referred to the Adminis- trator and the City Engineer for study and report. Motion carried. Public Hearing Mayor Gisler announced that this was the P. C. Reso. No. 14-60 date and hour set for a public hearing on Resolution No. 1460 of the City Planning Commission, recommending approval of Zone Case No. 146, and requested the Clerk to read the legal notice. The Clerk read notice of public hearing on Zone Case No. 146 as published in the Huntington Beach News on February 2nd, 1961, setting the hour of 8:00 P.M., or as soon thereafter as possible, on Monday, the 20th day of February, 1961, in the Council Chambers of the City Hall of the City of. Beach Huntington / as the time and place for hearing protests on Zone Case No. 146 relative to a proposed change of district boundary and use classification from: R-1 Single Family Residence District to C-2 Community Business District. The Clerk then read the letter of transmittal from the City Planning Director together with Resolution No. 1460 -3- Page #4 Minutes, February 20, 1961 of the Planning Commission. Mayor Gisler then declared the hearing open. City Planning Director Tripp indicated on a map the area involved in the Zone Case. There being no protests filedfor or against Zone Case No. 146, Mayor Gisler declared the`h earing closed. Motion carried.. Public Hearing Mayor Gisler announced that this was P. Reso. Nvn. 1550 the date and hour set for a public hearing on Resolution No. 1550 of the City Planning Commission, recommending approval of Zone Case No. 155, and requested the Clerk to read the legal notice. The Clerk read notice of public hearing on Zone Case No. 155 as published in the Huntington Beach News on -February 9th, 1961, setting the hour of 8:00 o'clock P.M., or as soon thereafter as possible on Monday, the 20th day of February, 1961, in the Council Chambers of the City Hall, Huntington Beach, California, as the time and place for hearing protests on Zone Case No. 155 relative to proposed change of district boundary and use classification from: R-1 Single Family Residence District to M-1-A Restricted Manufacturing District. The hearing was declared open by Mayor - 4- 132 Papme 05 - '-fin��tes, February 20, 1961 The Clerk then read letter of transmittal from the City Planning Director together with Resolution No. 1550 of the Planning Commission. Planning Director Tripp pointed out the area involved in this Zone Case on a map. Mr. Robert F. ialdron Mr. Robert F. Waldron, Attorney, 811 North Owner of ProT)erty Protest Broadway, Santa Ana, representing Mr. Peter Karales owner of the property involved in this Zone Case, addressed the Council, stating that he was representing his client in this Zone Case and in Zone Case No. 159 on which a hearing was scheduled a little later in the meeting. Attorney Waldron requested that any remarks made in connection with the hearing on this Zone Case be also applied to the hearing on Zone Case No. 159. Mr. Waldron stated that he would like to protest the rezoning involved in this Zone Case and in Zone Case No. 159 because he felt the Planning Commission were somewhat premature in making a zone change at this time. He stated further that he believed that time would show that this property might be more logically evolved as an R-5 zoning rather than the zoning projected by the Planning Commission. The Clerk informed the Council that he had received no written protests regarding this Zone Case. There being no written protests nor further oral protests filed, the hearing was closed by Mayor Gisler. Zone Case No. On motion by Stewart, seconded by Lambert, 15.5 AP -Droved Council approved the recommendation of the Planning Commission in recommending approval of Zone Case No. 155 and directed the City Attorney to -prepare an Ordinance covering the same. The Clerk read notice of public hearing on Zone Case No. 156 as published in the Huntington Beach News February 2nd, 1961, setting the hour of 8:00 o'clock P.M., or as soon thereafter as possible, on Monday, the 20th day of February, 1961, in the Council Chambers of the City Hall, Huntington Beach, California, as the time and place for hearing protests to a change of zone relative to proposed change of district boundary and use classification from: R-1 Single Family Residence District to M-1-A Restricted Manufacturing District. The Clerk read notice of public hearing on Zone Case No. 158 of the City Planning Commission as published in the Huntington Beach News on February 9th, 1961, setting the hour of 8:00 o'clock P.M., or as soon thereafter as possible, on Monday, the 20th day of February, 1961, in the Council Chambers of the City Hall, Huntington Beach, California, as the time and place for hearing protests on Zone Case No. 158 relative to proposed. change of district boundary and use classification from: R-1 Single Family Residence District to M-1-A Restricted Manufacturing District. The hearing was declared open by Mayor Gisler. The Clerk then read letter of transmittal, together with Resolution No. 1580 of the Planning Commission. The Clerk read notice of public hearing as published in the Huntington Beach News February 2nd, 1961, setting the hour of 8:00 o'clock P.M., or as soon thereafter as possible, on Monday, the 20th day of February, 1961, in the Council Chambers of the City Hall, Huntington Beach, California, as the time and place for hearing protests on Resolution No. 1043, recommending approval of a Master Land Use Plan - Revised 1961. Gisler. The hearing was declared open by Mayor The Clerk then read the letter of transmittal, together with Resolution No. 1043 of the Planning Commission. Planning ;director Planning Director Tripp addressed the Tripe Council and informed them of the reasons given by the Planning Commission in recommending the approval and adoption of this master land use plan. The Clerk stated that he had received no written protests in connection with the hearing on Resolution No. 1043. There being no protests filed, oral or written, the hearing was declared closed by Mayor Gisler. On motion by Lambert, seconded by Stewart, the Council accepted the recommendation of the Planning Commission and directed the City Attorney to prepare an Ordinance covering Resolution No. 1043. Tvith_ crni-,-, t on Resolution No. 1456 of the City Council of the City of Huntington Beach, which was scheduled for 8.30 o'clock P.M., had been withdrawn because of a discrepancy in posting notice for such hearing. V. H. K- �Y. A communication from V. H. and K. M. Nizkowski Recuest_Postpone_ Nitzkowski, requesting postpone- ment in furnishing cost schedule, or referral to a qualified individual or group to prepare an estimated value, in connection with their concession lease agreement, was presented by the Administrator. On motion by Lambert, the Council allow the postponement in furnishing cost schedule. Following some discussion in the matter by the Council the motion was withdrawn by Councilman Lambert. Renviest On motion by Stewart, seconded by Lambert, Denied the request of Mr. and Mrs. Nitzkowski be denied, and the lease covering their operation of the -concession be withheld until the cost schedule could be furnished. Motion carried. Assist. Fire Chief On motion by Lambert, seconded by Stewart, Purchase Site a request from the Assistant Fire Chief for Council to proceed with the purchase of one of two sites for future fire station No. 5, was approved and referred to the Administrator and Purchasing Agent to secure information and quotations regarding the proposed sites. Motion carried. Police Depart. On motion by Wells, seconded by Lambert, Car No. 4220 Reirlaced the Ford Patrol Car No. 4220 in the Police Department be replaced, and the Purchasing Agent was directed to deliver sealed bids to the Council at the next meeting. Service On motion by Lambert, seconded Purchase of Property by Stewart, the City Adminis- trator was authorized to request the Land Acquisition Service to proceed with the purchase of property in Block B. Tract No. 196. Motion carried. Tract No. 3595 On motion by Lambert, seconded Refund of Water Fees by Wells, authorization for refund cE water fees for Tract No. 3595 was made, with a warrant to be issued in the amount of two thousand hundred seven ninety one dollars and eighty cents ($2,791.80), payable to Pacific Sands Corporation. Motion carried. Vacation of Street On motion by Stewart, seconded by Tract No. 5522 _ Lambert, the City Attorney be directed to proceed with the necessary legal work to effect the vacation of street right-of-way on Huntington Avenue adjacent to Tract No. 3522. Motion carried. Reimburse. of On motion by Stewart, seconded by Sewer & Water Fees Lambert, Council authorize the reimbursement of nine thousand five hundred fifty dollars and thirty five cents ($9,550.35) from sewer fees, and four thousand five hundred ninety four dollars and seventy seven cents ($4,594.77) from water fees - and directed the City Auditor to transfer these amounts from respective fees accounts (Revenue) to expense accounts, with payment to be made to the developer on request by the City Engineer. McCracken, be received and ordered filed; and a 'subdivision agreement for the same tract be approved and the Mayor and City Clerk authorized to execute same on behalf of the City. Motion carried. Accepted Tract No. 3478 a subdivision bond for Tract No. 3478 - f-Clarose Corporation, be received and filed; and a subdivision agreement on the same tract be approved and the Mayor and City Clerk be authorized;to execute same on behalf of the City. Accepted On motion by Stewart, seconded by Tract No. 3977 Wells, a subdivision agreement for Tract No. 3977 - Pacific Sands, be approved and the Mayor and City Clerk authorized to execute same on behalf of the City. City of �a.r-dle-a The City Administrator presented a Grove eso, No. 3 communication from the City of Garden Grove transmitting a reprint of Senate Resolution No. 3 and requesting Council consideration of a Resolution of Approval. Request A. roved On motion by Stewart, seconded by Wells, Council approved the request, and directed the City Attorney to prepare a Resolution of Endorsement for Se-n&e Resolution No. 3. Motion carried. Trans. of P.C. A transmittal from the City Planning Rego No. 1044 Commission of their Resolution No. 1044, recommending approval, for proposed revision to the Outdoor Advertising Code, was presented by the Clerk. Reso. No. 1044 On motion by Stewart, seconded by Denied Gisler, the recommendation of the Planning Commission recommending approval of Resolution No. 1044 of the Planning Commission for proposed revision to the Outdoor Advertising Code was denied. Motion carried. -13- Page #14 - 14inutes, February 20, 1961 Tract Map No. The Clerk presented transmittal from 4064 Adopted the City Planning Director submitting final form of Tract Map No. 4064 for adoption; Developer: Freeway Industrial Park, Incorporated, Huntington Beach, California; Engineer: South Bay Engineering Company, Palos Verdes Estates, California; Location: South of Smeltzer Avenue and east of Goldenwest Street; Legal Description: Portion of the EZ of the NWx1 of Section 23, T.S.S., R.11.W., SBB & M; Number of Lots: 8; Total Acreage: 37.383; that the reap had been certified by the City Engineer and the Planning Director to be true and correct in accordance with the approved Tentative Tract Map and in accordance with provisions of the City Subdivision Code. The City Council may accept dedica- tions as shown on the map and in addition approve the final map subject to the following conditions: The City Clerk's signature shall be withheld pending the submittal and completion on the enumerated requirements: 1. Deposit of fees for water, sewer, engineering and inspections. 2. Bond for improvements. 3. Signature of agreement. 4. That all subsurface water rights shall be deeded to the City of Huntington Beach. Easement Deed On motion by Wells, seconded by Manthei Indust. Bldg. Accepted'! Stewart, a Road Easement Deed from Manthei Industrial Building to the City of Huntington Beach was accepted and the Clerk directed to record same with the County Recorder of Orange County. A budget for the Lifeguard Department Budget PResented for the .fiscal year 1961--62, was presented by the City Administrator. Lifeguard Budget Approved On motion by Lambert,seconded by Gisler, the Lifeguard budget was approved as presented in final form, to be -included in the final adopting Ordinance for the entire budget.
