MINUTES: On motion by Presson and seconded by
Stang, the Minutes of the Huntington
Beach Planning Commission, of February 7th, 1961, as transcribed
and mailed by the Secretary were accepted as mailed.

The hearing was opened to the public.
Bill Hartge, Senior Design Engineer, pointed out that the sub-
division will not alter natural flow of water, but will slightly
increase the amount of water. It was pointed out that the
developer would be required to contribute to the drainage
assessment district now being established, but that the funds
would not be utilized until additional development occurs in
sufficient amount to recuire construction of added drainage
facilities.

Sections 27 and 28 T.5.S., R.11.W,, SBB & M.
The hearing was opened to the
audience. The Secretary read list of conditions submitted
by the Planning Department.
Milo Keith, Engineer, representing
the developer, addressed the Commission. He discussed the
conditions which were proposed concerning the development
of water resources. He suggested that the conditions should
be reworded in several instances to indicate the jurisdiction
of the State of California, Division of water Resources.
James Wheeler, City Engineer,
interjected several proposed revisions to specify approval
by the governing jurisdiction. He further questioned Mr.
Keith as to the planned source of water development.
George Buccola, applicant developer,

addressed the Commission and requested that some sort of
compromise be worked out for the condition requiring the
dedication of Lot "A".
Discussion was held by the Commission
with the City Engineer. The City Engineer expressed his
concern with developing the properties to the east in an
identical manner as the applicant. It was suggested that the
wording of the Condition be revised to read as follows: Lot
"All may be omitted from this condition provided a potential
east channel opening of 160 ft to 220 ft is alloted, subject
to approval by the City Engineer. Further discussion was held
with the subdivider concerning other proposed conditions.
Harold Pedersen, Supt. of Ocean View
School District addressed the Commission and stated that
Mr. Buccola had agreed on the school site location and had
signed an agreement enabling the proposed site to be cleared
for this purpose. He stated that his School District would
need site approval by the City. It was explained that this
could easily be accomplised, but that the City would recuire
a formal application for same.
Morgan Noble, Harbor Development Engineer,
addressed the Commission and explained that he was a consulting
engineer for the subdivider. He spoke in favor of reducing
the east channel opening as was proposed in the compromise
condition.
Kenneth Thompson, member of the Noble
Engineering Firm, addressed the Commission and explained the
proposed bulkhead system which the developer intended to use.
He displayed the rendering prepared to illustrate the results
which the proposed bulkheads would accomplish.

Commissioner Dr. Kaufman stated
that he personally would like an additional, two weeks to
review the conditions and proposal submitted at this meeting.
Commissioner Presson stated that he did not care to prolong
the action further, since the conditions imposed were strict
and extensive.

SECONDED BY DOUTT TO APPROVE TENTATIVE TRACT NO 4039 WITH
ALL CONDITIONS STATED THEREIN AND WITH ADDITIONAL CONDITIONS
STATED BELOW:
1. WATER APPROVAL:. Prior to adoption of the final map
there shall.be required a written and signed statement
from the Appropriate Agencies indicating that in their
opinion the following requirements have been met:
(a) The planned source of water for the proposed.water-
ways meets with approved standards, State of California,
Division of Water Resources.
(b) The planned mixture content of water for the proposed
waterways meets with approved standards, State of
California - Division of ?dater Resources.
(c) The hazard to the underground ?cater supply due to
operation of waterways as planned is considered remote,
as approved by Orange County dater District.
2. SPECIAL ASSESSMENT DISTRICT: Prior to adoption of the
final map there shall be -required City Council approval
by resolution that an appropriate special assessment
district has been officially established and designed
to effectively meet the needs created by the inland type
of marina designated as Tentative Tract 4039•
"Special Harbor Assessment District" shall be res-
ponsible f or the f ollowing:
Management - Operation.- Maintenance
(Includes)

Water pollution and scouring action.
Safety of water infiltration to the underground.
Trash and debris removal.
Lifeguard and marine fire protection.
Liability coverage.
Water pumping system.
Chemicals for treatment of water.

3. POSTING OF OPERATIONAL FUNDS: Prior to the adoption
of the final map there shall be required the posting
of a cash monetary fund, subject to approval by City
Council, the sum of which shall be deemed sufficient
to maintain one year of operation of the Special Assess-
ment District. The stated operation fund may be expended
at the discretion of the Assessment District Board.
4. DEDICATION OF WATERWAYS: All waterways within Tentative
Tract 4039 shall be irrevocably offered for dedication
to the City. (It is not the intent of the City to accept
dedication in the foreseeable future). Ownership of
all waterways shall be assumed by the stipulated public
agency and currently designated as the "Special Harbor
Assessment District."
5. DEDICATION OF ADDITIONAL LOTS: There shall be required
the dedication of the following described lots to the
City:
Lots 323, 324, 325, 326 and Lot "A", and "C" all of
Tentative Tract 4039, Re: Lot "All - Lot "A" may be
omitted from this condition provided a potential east
channel opening of 160 ft. to 220 ft. is allotted,
subject to approval by the City Engineer.
(It is the intent of the City to arrange a leaseback
agreement to the developer in advance, for a nominal
sum.)
6. VEHICULAR ACCESS RIGHTS: Vehicular access rights along
all Arterial.Highways shall be dedicated to the City
except street openings.
7. DEPTH OF CHANNELS: The depth and design of all channels
within all waterways shall be subject to approval b.,T the
City Engineer.
g. WALLS AND FENCES: There stall be required as a standard
condition, the installation of a six (6) ft. chain link
fence or equivalent, bordering all arterial highways .
except street intersections. Except the rear lot lines
of Lots 555 thru 562 shall be required to have a six (6)
ft. concrete wall or equivalent installed.
9. PU1,1P INSTALLATIONS: All pump design and installations
shall be subject to approval by the City Engineer.
10. DRAINAGE: All drainage problems to be solved in a manner
approved by the City Engineer prior to final recordation
of any part thereof.
11. RESTRICTED AGAINST OIL DRILLING: Deed restrictions shall
be recorded against surface oil drilling.
-12. CONDITIONS OF CONDITIONAL EXCEPTION: All conditions
required for Conditional Exception as granted for Tentative
Tract-4039 are herein reinstated and required.
13. EASEMENTS: All dwellings on lots abutting a City Ease-
ment shall be set back five (5) ft. from the edge of the
easement.

14. RETAINING Z•;ALLS: Retaining walls shall be required
where there is a difference in Qlevation of two ft.

16. WATER SURFACE LEVEL: Maintenance of the appropriate

therefrom that portion contained within a strip of land,
200 ft. wide, the S' ly line of said strip of land being the

The Secretary read a letter of
protest submitted by City of Fountain Valley protesting
for the following reasons:
1. The proposed use would cause traffic congestion.
2. The noise and dust would create a problem for residents
and landowners in the City of Fountain Valley.
3. This use of land would tend to depress the value of
adjoining land in Fountain Valley.
The hearing was opened to the
audience. Ivan Harper, applicant, addressed the Commission,
and pointed out that his proposed development of the Go
Kart race track is 790 ft. north of the Fountain Valley.

Applicant -

and two bachelor apts on lots with a total land area of 12,650 sq. ft.
Present zoning is R-2 District which allows existing five units.
Property is located approximately 150 ft
east of Delaware St. on the north side of Frankfort St., and
legally described as follows: Lot "A", Block 605, Section 2,

The Secretary read a petition of protest
submitted by the adjoining property owners. The petition
contained 21 signatures.

Mrs. Orpha H. Double, 605 Frankfort Ave., H. B., addressed the
Commission and opposed to the granting of variance on the grounds,
that there was not sufficient off-street parking.
Pearl V. Conklin, 501 Frankfort Ave.,
H. B., addressed the Commission and opposed the variance,
stating that parking in the street would be detrimental to the
neighborhood.

Property fronting on Beach Blvd. from

in regards to rezoning. The Commission declared their intent
to remove the M-2-0 Districts in favor of C-22 0-4, R-3, and

FENCE POLICY STUDIED
Don Carter, 8331 Yorktown.Ave.,
H. B., addressed the Commission and submitted a petition
requesting a change of policy in fence enforcement. Carter
requested permission to place a,six ft high fence high up
on an' -embankment. Building Director Jack Cleveland, explained
to the Commission that Carterls adjoining neighbor could be
issued a permit for the fence along the embankment because
it was equal to the -height or below the grade of the neighbors
house pad elevation. Likewise, it was explained, that
Carter's fence could only be six feet high above the pad
elevation'of his house regardless of the height of the
' surrounding embankment. Cleveland pointed out that there
were good reasons for this code, inasmuch as an owner
usually buys a home on a bluff.or embankment site for the
view. It would not be reasonable to allow the neighbor
below to fence off his view without his permission. Chairman
Bazil stated a parallel case in Laguna Beac4 - which he
described as a moral that you cannot buy hillside property
and expect to fence the yard for privacy by screening out
the upside neighbor.
The problem was taken under submission.

meeting was adjourned.
