Monday, March 6th, 1961
Mayor Gisler called the regular meeting of the City
Council of the City of Huntington Beach to order at 7:30 o'clock P.M.
The Pledge of Allegiance was given by all present
in the Council Chamber.
The Invocation was given by City Administrator
Doyle Miller.
Councilmen Present: Wells, Lambert, Stewart, Waite, Gisler
Councilmen Absent: None
Reports of Reports of the City Treasurer, Collector, Building
Denart. Heads
Director, Engineer, Fire Chief, Lifeguard Chief,
Recreation Director, and Trailer Park Manager, which had been mailed to the
Councilmen, were presented by the Clerk.
Reports Received On motion by Lambert, seconded by Waite, all

Department Head reports were ordered received and
filed. Motion carried.
Mr. Oscar Stricklin - Under oral communications, Mr. Oscar Stricklin,
Protest
Goldenwest Street, City, addressed the Council to
protest the nearness of a new tract to his property.
Mr. Stricklin stated that he believed the Planning
Ordinance should provide for fencing by the subdivider between their tract
and surrounding properties.
On motion by Waite, seconded by Wells, the
matter protested by Mr. Stricklin was referred to the City Administra-
tor and Planning Director for study and report at the next meeting.
Motion carried.
V. H. & K. M. A communication from V. H. and K. M. Nitzkowski,
Nitzkowski -
Corrmun. submitting cost and depreciation information which
had been requested by the Council in connection with their concession lease,
was presented by the Clerk.

So. Coast Child On motion by Lambert, seconded by Waite,
Guidance Clinic
Solicit Funds a request from the South Coast Child
Guidance Clinic for permission to solicit funds from -April 15th
to May 15th, 1961, was granted with the stipulation that all
solicitors register with the Police Department. Motion carried.
Mr. Edward H. A communication from Mr. Edward H.
Schoerner -
Le Schoerner, Schoerner, 16522 Elbe Circle, City, and a
petition from 47 residents from Sol Vista Tract, requesting
amendment of the Planning Code to prohibit business establishments
in areas zoned Residential within the City and discontinue
licensing of such businesses as home occupations, was presented by
the Clerk.
On motion by Lambert, seconded by Waite,
the matter of amending the Planning Code to prohibit such
business establishments was referred to the Planning Commission
for study and report at the next meeting of the Council; and
the Clerk directed to cease the issuance of licenses for home
occupations until such report had been.made. Motion carried.
Petition Reca_ivied On motion by Lambert, seconded by Waite,

the petition of the residents of the
Sol Vista Tract was received and filed. Motion carried.
Censer Sign Co. On motion by Stewart, seconded by Waite,
Renuest Denied
a request from the Ganser Sign Company
for sign space within the City owned triangle at the intersection
of Highways 39 and 101 was denied. Motion carried.

request of the Clerk when.he informed the Council that a check by the
Police Department had shown that the truck did not belong to the licensee.
Request for ':waiver - A request for a waiver of restriction contained in

an old deed, by Gladys Z. Popp, was presented by
the Clerk.
Planning 'Dir. Tripn' Planning Director Tripp reported that he had

made an investigation of the area in which this
property was located, and that other properties on the same side with the
applicant were setback about 17 feet, while on the other side of the
street they were setback 15 feet.
On motion by Wells, seconded by Waite, the Council
waived any right of enforcement of the covenant requiring buildings to be
setback at least 20 feet from the front line of the lots in Block 1202
Vista Del Mar Tract, Section 1, as contained in that certain deed dated
June 5th, 1911, and recorded June 25th, 1911, in Book 13, Page 141 of
Deed, Records of Orange County, California. Motion carried.
Health Denart. On motion by Waite, seconded by Lambert,
Special Conference
a communication from the Health Department of
the County of Orange regarding a special conference for all Pound
Masters, Animal Control Officers, and other regulatory personnel, was
received and ordered filed. Motion carried.
Cr. Co. Boxer On motion by Lambert, seconded by Wells,
Club Re uest
a request from the Orange County Boxer Club for
permission to use Lake Park on May 14th, 1961, for a Boxer Speciality
Puppy Match was granted. Motion carried.
Petition for Sewer On motion by Lambert, seconded by Waite, the
F lcrie,,a to Main
petition from Mr. and Mrs. William F. Cardinal
and ten other residents of the area of Main Street and Florida Avenue,
requesting a sewer line from 18732 Florida Avenue to Main Street, thence
down Main Street to Beach Boulevard, was ordered received and filed and
the matter referred tothe City Engineer and Administm.tor for study and
report. Motion carried.

a public hearing on Resolution No. 143 of the City Planning
Commission, recommending denial without prejudice on Zone Case
No. 143.
The hearing was reopened by Mayor Gisler.
The Clerk stated that he had received no
written protests in connection with this Zone Case.
There being no protests received, either
written or oral, Mayor Gisler declared the hearing closed.

Use Variance Mayor Gisler announced that this was the

Variance No. 120, or his representative, to appear before the
Council and show cause, if any, why a portion of such Use Variance
should not be revoked - this hearing having been continued from
the meeting of February 6th, 1961.
Planning Director Planning Director Tripp informed the

would superceed the one being considered at this time, and that

authorized to proceed with fill on their leased site, subject
to their notification of the City prior to commencing fill

Mrs. Lois Gulu was placedon a perm-
anent status as Intermediate Account Clerk in the City Clerk's
Department, effective March lst, 1961. Motion carried.

Mr. Uilbur L. Mr. Kenneth R. Goodwin, Structural

Perrraanent Status Inspector, and Mr. Wilbur L. Wrather,
Plumbing inspector, were placed on a permanent status in those
positions "in the -Building Department, effective March 1st,
1961. Motion carried.
City of Alestm. ' A communication from the City of
Reso. No. 280
Westminster transmitting their Resolution
No. 280 re: Policy stand taken in an effort to establish more
comprehensive territorial boundaries, was presented by the Clerk.
On motion by Stewart, seconded by Waite,
the Administrator was directed to work out a time and place for
the Councils of the two cities to get together to discuss
boundary problems. Motion carried.
John J. Gastlin - A communication from John J. Gastlin,

Los Angeles, presenting proposal to
appraise and study the offer made by Orange County Flood Control
District for property owned by the City, was presented by the
City Administrator.

Mr. Miller informed the Council that he
felt that the fee asked was excessive, and suggested that the Land
Acquisition Service which has been doing appraisal work for the
City might be considerably less.
Mr. Robert lv alder - Mr. Robert Walder of the Orange County

Right -of -Way Department, addressed the
Council and stated.that he must get the information from the
City or.make a service on the City to which the City must respond
in ten days.
Mr. Walder stated that the County had
offered the City seventeen thousand two hundred seventy seven
dollars and fifty cents ($17,277.50) for the property involved
in the right-of-way condemnation for the Flood Control District
Channel.

arrange a meeting of the committee which had been appointed for
this purpose to meet with Mr. Ed Pate, of the Land Acquisition

Atlanta Avenue, at the northeasterly entrance to Pacific
Trailer Park was approved, and the Purchasing Agent directed to
contact.. the Southern California Edison Company and request them

Corporation - George Buccoli, was accepted, and the Clerk directed

Mr. Robert Olson Mr. Robert Olson, Attorney for the

addressed the Council and requested that the Council defer
action until the. Public Utilities Commission had made a decision
in -this matter.
Atty. Samuel Barnes Attorney Samuel Barnes, for the California

them to set the hearing in this matter.

a study of protest by National Coin Laundry Company to fees
required for City license.
Mr. Miller stated that at the time the
application for license was made, the applicant did have the
number of machines installed which he had shown on the applica-
tion, and maintained them for a period of two or three months.
