None. On motion by Presson and seconded by Letson, the Minutes of the Huntington Beach Planning Commission of February 21st, 1961, as transcribed ,and mailed by -the Secretary were accepted as mailed. CONDITIONAL EXCEPTION: To allow the reduction of street rights — TENTATIVE TRACT MAP 3862 RE: 50 ft Right—of—way of -way from 56 ft to 50 ft on Kampen Lane and Utrecht Lane - Tentative Tract.Map 3862. Relocation of sidewalks to adjoin the curbs. Proposed exceptions would be in deviation to Section 9741.4 Huntington Beach Ordinance Code. The exceptions as requested would result in significant savings in cost Of required drainage ditch which in turn will measurably decrease the drainage costs for the drainage assessment district. Legal description is as follows: Portion of Tentative Tract 3862 lying within the HE of NW of Section 25, T.5.S., R.11.14.,_ SBB & M. The Secretary read a.letter submitted by the Engineering Department. City Engineer, James 11heeler, addressed the Commission and pointed out.the cost savings to be obtained by the granting of the requested deviation. It was pointed out that the savings would benefit all property owners who would participate in this particular drainage, district area, including the Ocean View School District. Engineer Wheeler answered several questions asked by members of the Commission. Page #2 Minutes - H. B. NOES: None. ABSENT: None. THE MOTION CARRIED. USE VARIANCE: UV #267 Continued Applicant - Laura Harper To allow a Go Kart type -race track operation in the A-1-Y General Agricultural District. Located on approximately 24 acres at the SW corner of Brookhurst St., and Garfield Ave., and legally described as follows: The S. 24 acres of the N. 48 acres of the E 2 of the NE 4 of Section 6-6-10 SBB & L-1.9 EXCEPTING THEREFROM that portion contained within a strip of land, 200 ft wide, the S'ly line of said strip of 1:and being the-E'ly prolongation of the S. line of the NW 4 of the NE s of said Section 6. The Secretary requested commissioner Doutt and Worthy to give a report on the existing conditions of the Azusa Go -Kart Track, which Commissioners Doutt and Worthy, and Planning Director visited on Sunday, February 26, 1961. The hearing was opened -to the audience. The applicant addressed the Commission and asked that several conditions be eliminated. He described the proposed plan for parking. There being no further comment, the hearing was closed. A MOTION WAS MADE BY PRESSON AND SECONDED BY LETSON TO APPROVE UV #267 WITH THE FOLLO77ING CONDITIONS: 1. No building permit shall be issued unless and until the right-of-way the entire -length of frontage of Brook- hurst Street as described by this variance has been dedicated to the City of Huntington Beach to the width of the faster Planned Highway. (60 ft to the centerline of the street). 2. ' There shall be required the installation of curbs and gutters and paveout to the existing pavement along the entire Brookhurst Street frontage as described in condition No 1. Subject to waver by the City Engineer. 3. Use Variance No 267 shall expire 26 months from the date of approval. 4. Restricted hours: Go -Karts or other activities shall be permitted to operate on the premises between the hours of 9:00 A.M. to 9:00 P.M. each day. 5. All Go -Kart track activity areas shall be contained by a surrounding 6 ft chain link fence or the equivalent. 6. Use Variance #267 shall be limited to the use of Go -Karts and their activity, and no other type of vehicles shall be permitted to operate. 7. Off-street parking shall be required as follows: One acre of parking area for each acre of track operation. Oil mix for parking and driveways, as required by City standadrs. 8. The setbacks of any structures erected shall conform to the requirements of the A-1-Y District. 9. . There shall be a limitation on the size of engines permitted to operate on the Go -Kart Track. The maximum pubic inches per Go -Kart shall be 40 cubic inches - regardless of the number of engines installed on a Go -Kart. 10. Violation of any of the above stated conditions shall be grounds for revocation of UV #267. 3. 187- Page #4 Minutes— H.--B. USE VARIANCE: UV #274 To allow a trailer park development Applicant - Rowan Adams on 25 acres in the R-1 Single Family Residence District. Located on the 171ly 25 acres of the Mills Land & "later Co., property at the.NE corner of Beach Blvd. and Pacific Coast Highway 101-A. (Further description on file in the Planning Department Office). The hearing was opened to the audience. Rowan Adams, applicant, addressed the Commission and. ex- plained the proposed expansion of the existing trailer park. He stated that he had also requested simultaneously that a variance be granted for a proposed restaurant and motel facility. It was pointed out to the applicant, that before the Commission could consider action on the motel or re- lated facilities, he would have to submit plans and in- dicate location of proposed improvements. Carol 'Fynn, representing Mills Land & Water Co., addressed the Commission to explain the new lease arrangements his firm had made with the developers. He further elaborated on the problems the Mills Land & Water Co. has experienced with the Division of'Highways concerning a Coast Freeway Route. Chairman Bazil questioned Assistant Fire Chief Bill Rardin concerning the trailer park plans. William Rardin, Assistant Fire Chief, reported that his department had reviewed the first preliminary plans and found them satisfactory. 4. Page #5 Minutes - H.-B. There being no further comment, A MOTION WAS MADE BY STANG AND SECONDED BY PRESSON TO APPROVE UV #274 FOR TRAILER PARK DEVELOPMENT, ONLY WITH THE FOLLOWING CONDITIONS: 1. All trailer park development, shall be subject to all restrictions for trailer parks, as outlined in the R-5 District. ROLL CALL VOTE: AYES: Presson, Letson, Doutt, Worthy, Kaufman, Stang, Chairman Bazil. NOES: None. ABSENT: None. THE MOTION CARRIED. USE PERMIT: UP ,#123 Applicant - T. A. Moss Family Residence District. on back of a Lot No 20. To allow the erection of a subdivision directional sign 13 ft x 30 ft in the R-1 Single Located within a Tract No 3933 The hearing was opened to_ the public,- there being no comment it was closed. A MOTION WAS MADE BY LETSON AND SECONDED BY STANG TO APPROVE UP #123 WITH THE FOLLOWING CONDITIONS: 1. There shall be posted a $250.00 performance bond guaranteeing removal upon expiration of UP #123. 2. UP #123 shall expire one year from date granted. 3. The subdivision directional sign shall be removed by the applicant upon expiration of UP #123 - the penalty for failure to do so shall be the forfeiture of the performance bond. A MOTION NAS MADE BY PRESSON AND SECONDED BY LETSON TO APPROVE UP #124 WITH THE FOLLOWING CONDITIONS: 1. Planning Commission Tuesday, March 7th, 1961 ACTION OF THE CITY COUNCIL The Secretary read a letter REQUESTING PLANNING COM1tiIISSION = HOLD A PUBLIC HEARING - of protest submitted by RE: REPEAL OF HOME OCCUPATIONS property owners in the Sol Vista Tract, pro- testing home occupations, withirL,.the--tract. The Secretary reported on the action of the City Council: refusing to license any new home occupations. The Council further instructed the Commission to hold a public hearing on the proposed repeal of home occupations from the planning code. The hearing was opened to the audience. Frank Larkin,.7642 Rhine Drive, Huntington Beach, stated to the Commission the problem caused in the new Sol Vista Tract by allowing home occupations. He pointed out the traffic hazards, the asethetics, and the demoralizing influance the home occupations were creating in the tract neighborhood. He stated there was no end or limit to which home occupations might expand. Richard LaRue, Rhine Drive, Huntington Beach, addressed the Commission and re- iterated the statements made by Larkin: He pointed out the dangers arising from the continued use of home occu- pations. There being no further comment, the hearing was closed. A discussion at length was held. A MOTION -WAS MADE BY STANG AND SECONDED BY PRESSON TO SET A PUBLIC HEARING FOR POSSIBLE REPEAL OF HOME OCCUPATIONS AT THE MEETING OF MARCH 21ST, 1961. THE MOTION CARRIED. PUBLIC HEARING: Continued The Secretary read the proposed H-2-0 DISTRICT CLASS- IPICATION AMENDMENT revisions to the M-2-0 Code to be reentitled "M-2" District. The hearing was opened to the public, there being no comment, it was closed. The Commission asked that fat rendering and fertilizer, other than chemical fertilizer manufacture be eliminated as conditional uses. The proposed revision is described as follows: S 9441. Industrial District: Provisions Applicable. The following provisions shall apply'in the M-2 District. S 9442. Uses Permitted: General manufacturing, industrial uses, commercial uses, and buildings and structures designed and intended for such uses, which are permitted in the M-1-A, M-1, and C-2 Districts and shall be under the respective provisions of the appropriate district. Steam Electrical Generating Stations. S 9443. 'Conditional Uses: Where Use Permits are granted, any of the following manufacturing uses are conditional uses permitted in the M-2 District subject to review in accordance with the per- formance standards procedure; provided that such uses are located not less than two thousand (2000) ft from the nearest "R" District, or "A" District designated for future residential development on the Adopted Master Land Use Plan. 1. Acetylene gas manufacture or storage. 2. Acid manufacture. 3. Alcohol manufacture. 4. Asphalt refining or asphalt mixing plants. 5. Blast furnaces or coke ovens. 6. Parking Requirements: The parking provisions of Section 9470.1 shall be applicable. Height Limitations: No building or structure in the M-2 District shall exceed a height of forty (40) feet. RESOLUTION NO 1049 A Resolution of the Planni.ng'Commission Recommending Approval 'for revision to Article" 944- conceniLang 1114-2" District, to the City Council. THE RESOLUTION WAS ADOPTED. ZONE CASE NO 143 The Secretary.reported that Zone Applicant - Richard Deam Case No 143 was referred back to the Planning Commission for further study. Commission discussion was held at lengtYi. The Commission agreed that the zoning proposed would be more suitable as C-4 Zoning. REQUESTED FENCING POLICY STUDY REFERRED TO PLANNING DIRECTOR AND CITY ADMINISTRATOR BY CITY COUNCIL. The Secretary reported that the City Council had received protest of several property owners who adjoin subdivisions. The protestants objected to having subdivisions adjoining their property without fencing requirements. A discussion at length was held. The problems created by re- quired fencing were reviewed: 1. The added cost of fencing appreciably adds to the sales price of the home - forcing the subdivider to compete in the higher price bracket. 2. The legality of requiring the subdivider to provide fencing to protect adjoining property owners engaged in agricultural pursuits was questioned. 3. Dead-end streets or alleys will permit access to adjoining properties regardless of rear property fencing. 4. Many potential property owners desire a choice of fencing materials+. 5. General policy in the past for Southern California cities has been to permit the home buyer to build the fence on a v9luntary basis. Alternatives to the problem were: 1. Initiate exclusive agricultural or industrial zoning. 2. Require the subdivider to pay half the cost of rear property walls or fences. 3. Require the subdivider to build rear walls or fences where there are unusual cases preventing a potential subdivision on the adjoining property. 4. Require -the subdivider to build walls or fencing on all rear property lines adjoining agricultural pro- perties and face possible threat of litigation. 12. 196 0 Page #13 Minutes— - H'.- • B. Planning Commission Tuesday, :earth 7th, 1961 Discussion on the topic pointed out the fencing problem. -as only one of numerous problems occuring where a city is in a state of transition from agricultural to residential type development. It was stated that invariably during a_transition period some property'owners will benefit while others face a handicap. Inasmuch as the city policy has been to encourage sub- division activity in the midst of current agricultural areas, hardships are bound to result for those property owners continuing their agricultural production. PROPOSED STREET NAME The Secretary reported that CHANGES: the Planning Department had submitted a report on proposed street name changes where such street--names-were dupli- cations of street established in other parts of the city. It was stated that the proposed new street names were only suggestions and could be altered at the request of anyone concerned. Commissioner Worthy requested that Palm Avenue, in the Town of Wintersburg be renamed to Letson Avenue. The change was agreed upon by the Commission.
