COMMISSIONERS'ABSENT: None. MINUTES: On motion by Presson and seconded by Letson, the Minutes of the Huntington Beach Planning Commission of April 4th', 1961, with correction of Resolution No 1048 to read Resolution No 1050, as transcribed and mailed'by the Secretary were accepted as mailed. CONSIDERATION: HUNTINGTON BEACH UNION HIGH SCHOOL SITE NO 115C" (Continued) ' LOCATION: Bounded by Gothard Street on the west, Golden West Street on the east, Wintersburg'Ave. on the north - 60 gross acres LEGAL'DESCRIPTION: The west 60 acres of the N 2 of the NW 4 of Sec. 26-5-11 The hearing was reopened to the public. Gerald Lance, District Superintendent, addressed the Commission, and explained the reason they had.abandoned their original site location was because of the numerous property owners they would have to deal with and many of the titles were clouded with oil leases. Under the advisement of the County Council and their appraisers they abandoned the location. The reason for deciding on this particular site location was that on many of their alternate sites their was either an excessive amount of peat in the soil area, or the drainage problem would be to costly to solve. A MOTION WAS MADE BY KAUFMAN AND SECONDED BY STANG TO APPROVE SCHOOL SITE NO 115C" WITH THE FOLLOWING CONDITIONS: Page #2 Minutes - H. B. Planning Commission Tuesday, April 18, 1961 1. Rights -of -way for street widening shall be required along all property fronting Warner Ave., Goldenwest St., and Gothard St. in accordance to street widths as specified by the Master Plan of Streets and Highways. 2. All property frontage on the Arterial Highways as specified in Condition No 1 shall be improved to the appropriate Arterial - Highway status in accordance to City specifications. 3. Dedication of Vehicular Access shall be required along Warner Ave. property frontage and along Golden West St. 4. Adequate paved parking shall be provided for a minimum of 300 automobiles. 5. All drainage problems to be solved in a manner approved by the City Engineer prior to construction of the school facilities plant; 6. Said property to participate in the special drainage assessment district now being formed by said City. 7. There shall be one 10 foot locked gate on the property front- ing on Golden West Street. USE VARIANCE: UV #289 To allow two subdivision Applicant - Luxury Homes, Inc. directional signs 12 ft x 36 ft in the A-1-X General Agricultural District. Located at the SE corner of Smeltzer Avenue and Springdale Street and legally described as portion of the NW 4 of the -NW 4 of Section 22-5-,ll. The hearing was opened to the audience, there being no comment it was closed. A MOTION WAS MADE BY PRESSON AND SECONDED BY DOUTT TO APPROVE USE VARIANCE UV #289 WITH THE FOLLOWING CONDITIONS: 1. There shall be posted a $250.00 performance bond guarantee- ing removal upon expiration of UV #289. 2. UV #289 shall expire one year from date granted. -2- Page #3. Minutes - H. B. The subdivision directional sign shall be removed by the applicant upon.expiration of UV #289 - penalty for failure to do so shall be the forfeiture of the performance bond. The City shall retain the right for entry and removal of sign upon expiration of UV #289. 4. Setback 55 ft from the centerline of Springdale Street and 55 ft from the centerline of Smeltzer Avenue. USE VARIANCE: UV #290 Applicant - Frank Cleland Residential District. To allow the construction of a Mausoleum in the R-4-X Suburban Located north of Talbert Avenue and approximately 180 ft. east of Beach Blvd. and legally described as the S z of the SW 4 of the SW 4 of Section 25, together with the SW 4 of the SE 4 of the SW 4 of Section 25-5-11 SBB & M. The hearing was opened to the public. Dr.'Payne, addressed the Commission, and questioned the require- ment of additional right-of-way along Talbert Avenue and the improvements along Beach Blvd. Robert Lambert, 1116 Huntington Ave., - City, addressed the Commission, and pointed out that the pavement was not down the center of the right-of-way and that additional right-of-way would be in order along the north side of Talbert Avenue as well as to the south. Dr. Payne requested withdrawal of the application and asked that the filing fees for resubmitting of a neia application be waived. There being no further comment the hearing was closed. USE VARIANCE: UV #291 To allow the erection of a subdivision Applicant E. L. Byron directional sign 10 ft x 25 ft in the A-1-X General Agricultural District. -Located at the SE corner of Graham Street and Heil Avenue and legally described as the W 2 of the NW 4 of the SE 4 of Section 21-5-11. The hearing was opened to the audience. Leroy Star, adjacent property owner, addressed the Commission and objected to the sight structure. Mrs. Russel Turner, 16551 Graham Street, City-, addressed the Commission also opposing the sign. There being no further comment, the 1 hearing was closed. Commission discussion followed. A MOTION WAS MADE BY DOUTT AND SECONDED BY STANG' TO CONTINUE.'THE"HEARING TO THE NEXT REGULAR MEETING OF MAY 2ND, 1961. THAT THE APPLICANT BE REQUIRED TO SUBMIT - • - A PLOT PLAN SHOWING ANY EXISTING SIGNS WITHIN 300.FEET OF THE PROPOSED SIGN ON BOTH SIDES ON THE SAME SIDE OF THE STREET. THE MOTION CARRIED. USE VARIANCE: UV #292 To allow the construction of seven Applicant - David Zaiser office buildings for professional use in the R-2 two family residence district. Located at the NE corner of Magnolia and 17th St. Legally described as block 516, lots 2 and 4, Huntington Beach, Seventeenth St. Section. The hearing was opened to the audience. David Zaiser, applicant, addressed the Commission and explained the circumstances under which he felt the need for this type of structure. -4- 233 Page #5 Minutes - H. B. A MOTION WAS MADE BY STANG AND SECONDED BY WORTHY TO APPROVE UV #292 WITH THE FOLLOWING CONDITIONS: 1. Dedication and improvement of an additional 5 ft along 17th Street. 2. A 6 ft masonry wall along the interior side of the property lines as per City Engineer Specifications. 3. One paved parking space per every 300 sq. ft. of gross floor area. 4. Concrete aprons shall be constructed on all driveways. 5. Sidewalks along gagnolia Street. ROLL CALL VOTE: AYES:: Presson, Letson, Doutt, Worthy, Kaufman, Stang, Chairman Bazil. NOES: None. ABSENT: None. THE MOTION CARRIED. REQUEST FROM ORANGE COUNTY A lengthy discussion was held by the PLANNING COMMISSION RE: REZONING OF THE Plannin; Commission. All the Com- SUNSET HEIGHTS AREA missioners were in agreement that the rezoning was along the same line of thinking they had for the area when preparing a Master Plan for the City.. The Secretary was instructed to notify Orange County Planning Commission of the approval of rezoning the Sunset Heights Area. ABSENT: None. THE MOTION CARRIED. -5- 234 Page #6 Minutes - H. B. Planning Commission Tuesday, April 18, 1961 - USES PERMITTED IN THE Discussion was held by the Commission. A-1-X ZONE Mr. James Fant addressed the Commission and stated that he would be raising these Turbifex Worms and Shrimp and then distributing them to his various customers. He also pointed out that there was no odor from them and invited the Commission to look at the business he was now operating before they come to a decision. • The Chairman appointed Commissioner Worthy, and Commissioner Presson to submit a report for the next regular meeting whether or not raising of shrimp and turbifex worms should be permitted in the A-1-X Zone. THE MOTION CARRIED. ISSUANCE OF BUILDING PERMITS ON LOTS NOT ACCESSABLE TO PUBLIC R/W The Secretary pointed out the situation that now existed in many of the subdivisions where the only access to many of these lots were by lots designated as lot A, B. or C, and were shown on the recorded map as being for access purposes to -the lots within the subdivisions, but these lots were shown on the accessors books as having an accessor parcel number and were owned by either private individuals or oil companies., Under the advisement of the City Engineer and the City Attorney, the Planning Commission decided that because these lots were under a private ownership, a building permit could not be issued. CONSIDERATION: FENCING OF TRACT NO 3908 Senior Design Engineer, Bill Hartge, pointed out that the Planning Commission had required block walls along all lots either siding or backing on Garfield St. and Newland Ave., and that it would not be practical to require 10 235 Page #7 Minutes - H. B. Planning Commission Tuesday, April 18, 1961 the wall along lots 64, 71, 72, 73, and 74, because of the difference in elevations that exist on these lots. There is a variation of 2 feet to 10 feet between the sidewalk and the pad elevation. DIVISION OF LAND: DV #148 The Secretary informed the Commission Applicant - Jacob E. Winters of the withdrawal request of DV #148 by Mr. Jay Tucker, the realtor representing the applicant who had passed away during the previous week. REQUEST FOR UV'290 Dr. David Payne addressed the Commission and requested that the Use Variance application UV 290 be read- vertised for publid hearing and said hearing be set for May 2nd meeting IRB 237 Page #9 Minutes - H. Planning Commission Tuesday, April 18, 1961 A MOTION WAS MADE BY STANG AND SECONDED BY PRESSON THAT AT.THE REQUEST OF THE APPLICANT THE SECRETARY BE INSTRUCTED TO READVERTISE UV #290 AND SET THE HEARING FOR THE MAY 2ND MEETING. THE MOTION CARRIED. STUDY OF TRAILER PARK ORDINANCE The Secretary informed the Planning Commission that the City Council had referred the new trailer park ordinance back to the Planning Commission for further study to consider the requirements placed on the camping trailers. Jack Cleveland, the Building Director, stated that they were not asking for anything out of the ordinary and felt that the reason there were so many complaints was that the people were not well enough informed of the ordinance. The City Attorney stated that he felt the City Council would like the Planning Commission to consider further the restrictions placed on trailers that are not being lived in and that a decision should not be agreed on at this meeting but should be studied further before any decision should be made.
