Doutt. On motion by Presson and seconded by Worthy, the Minutes of the Huntington Beach Planning Commission of April 18th, 1961, as transcribed and mailed by the Secretary were accepted as mailed. USE PERMIT: UP #125 To allow three double face 10 ft x 30 ft. Applicant - Columbia Outdoor Advertising Co_ subdivision directional signs within two subdivision Tracts No 3847 and Tract No 3848. Located at the SE corner of Bolsa Ave. and Springdale St., and at the NE dorner of Springdale and Smeltzer Ave. The hearing was opened to the audience, there being no comment the hearing was closed. Planning Commission Tuesday, May 2nd, 1961 _ The Secretary reported that the field investigation showed there to be no signs within 300' on either side of the proposed sign and that the setback would be suffi- cient. _ ` A MOTION WAS MADE BY PRESSON AND SECONDED BY DOUTT TO APPROVE UV #288 WITH THE FOLLOWING CONDITIONS: No map received showing signs within 3001. If approved standard conditions, and 22 feet setback from property line on Beach Blvd. ROLL CALL VOTE: AYES: Presson, Letson, Doutt, Worthy, Stang, Kaufman, Chairman Bazil. NOES: None. ABSENT: None. THE MOTION CARRIED. USE VARIANCE: UV -#1290 To allow the construction of a Mausoleum Applicant - Roselawn Gardens of Memory Assoc. in the R-4-X Suburban Residential District. Located north of Talbert Avenue and approximately 180 ft east of Beach Blvd., and legally described as the S z of the SW 4 of the SW 4 of Section 25, together with the SW 4 of the SE 4 of the SW 4 of Section 25-5-11 SBB & M. The Secretary read the proposed conditions outlined by the Planning Dept. The hearing was opened to the audience. Dr. David Payne, applicant, addressed the Commission and requested that variance be granted without conditions. There being no further comment, the hearing was closed. Commission discussion followed at length. The Commissioners questioned Dr. Payne as to why he felt the conditions should not be required. Dr. Payne pointed out that the land he would be required to dedicate -4- 9N; Page #5 Minutes - H. B. Planning Commission Tuesday, May 2nd, 1951 to the City for street purposes was land that had been dedicated for cemetery purposes. Chairman Bazil pointed out that these conditions have been required on all variances that are either of a commercial use or a commercial nature and they should be required on this variance as well as those in the past or those we will have in the future. Dr. Payne also stated that additional buildings would eventually be constructed on the property to conform to the normal operating of a cemetery and would be located along Talbert Ave. Dr. Payne read a statement -on behalf of Roselawn Gardens of Memory Assoc-. stating their position and that the regulations concerning the installation and operations of a cemetery are controlled by -the California Cemetery Assoc. as provided for by an act by the State Legislature. Dr. -Payne further stated that under the Act it is'not necessary to apply to the City Building Department for a permit or file for -a use variance through the Planning Department. A MOTION WAS MADE BY LETSON AND SECONDED BY WORTHY TO APPROVE UV #290 WITH THE FOLLOWING CONDITIONS: The dedications of an additional 20' of right-of-way along the - entire 1,749.20 feet of property fronting on Talbert Ave. Full improvements along the most westerly 293.04 feet of property fronting on Talbert Ave. lying east of the intersection of Talbert Ave. and Beach Blvd. Based on the following findings of fact.. A hardship would be imposed on the property on the south side of Talbert, Ave. if they were required to make up the 20' in addition to their 20' dedication. The use requested would increase the amount of traffic along the property of the applicant, fronting on Talbert Ave: -5- UE; 243 Page #6 Minutes - H. B. Planning Commission Tuesday, May 2nd, 1961 The street width is not adequate enough to accommodate the increase of traffic along Talbert Ave. which would be brought about by the proposed use of the property, if the dedication were not required. The entrance will be on Talbert Ave. approximately 800' east of Beach Blvd., which will cause an additional traffic burden in front of the applicants property. Present zoning is R-4-X Suburban Residential District as ,Adopted by Interim Ordinance 668. USE VARIANCE: UV #291 To allow the erection of a subdivision Applicant E. L. Byron directional sign 10 ft x 25 ft in the A-1-X General Agricultural District. Located at SE corner of Graham Street and'Heil Avenue and legally described as the W 2 of the NW 4 of the SE 4 of• Section 21-5-11. The Secretary informed the Commission, that the applicant asked for withdrawal of Use Variance #291. A MOTION WAS MADE BY STANG AND SECONDED BY PRESSON TO GRANT THE WITHDRAWAL OF UV #291. ROLL CALL VOTE: AYES: Vresson, Letson, Doutt, Worthy, Stang, Kaufman, Chairman Bazil. NOES: None. ABSENT: None. THE MOTION CARRIED. AREA VARIANCE: AV #293 To allow the construction of a screened Applicant - William H. Creed in aluminum patio cover to be added to existing dwelling in the R-1 Single Family Residence District. Located at 7662 Danube Drive, Huntington Beach, and legally described as Lot 146, Tract 3420. An encroachment of 9 ft :t into the required 20 ft rear yard setback. The hearing was opened to the audience. Jerry Kline, 7245 Harding Circle, City, a representative from the awnin01 g company addressed the Commission and explained that the patio cover would meet the side yard setbacks and showed pictures of the proposed patio. *-; I ROLL CALL VOTE: AYES: Presson, Letson, Dout-t, Worthy, Stang, Kaufman Chairman Bazil. Planning Commission Tuesday, May'2nd, 1961 Bud Higgins, Fire Chief, told`the Commission that they had no objections to the proposal as long as the required side yard was maintained. The Chief further pointed out that the screened in patios are becoming more popular and is being accepted by the public as a type of California living. A MOTION WAS MADE BY STANG AND SECONDED BY WORTHY TO APPROVE UV #293 WITH THE FOLLOWING CONDITIONS: That the side yard requirement be maintained. That the patio be inclosed with nothing more than screen. ZONE,CASE-NO 185 CHANGE OF ZONE relative to proposed change Applicant - Doyle & Shields of district boundary and use classification from: R-1 Single Family Residence District TO C-2 Community Business District. The following parcels of real property as submitted on the applicant's petition is described herewith: Located on approximately 4 acres bounded by Smeltzer Ave. on the south and approximately 800.00 ft west of Springdale St., and legally described as -the NE 4 of the NE 4 of Section 21-5-11 SBB & M. Further legal description on file in the Planning Dept. Office. The hearing was opened to the public. Frank Doyle, 831 So. Manchester, Anaheim, Calif., addressed the Commission, and pointed out that to have a good commercial center the additional zoning would be necessary. He also pointed - out that he has many potential tenants who have indicated they would move into the center but felt there should be a larger area. • There being no further comment, the hearing was closed. RESOLUTION NO 185 A Resolution of the City Planning Commission` Recommending Approval of Zone Case No 185 to the City Council. The following parcel of real property as submitted on the applicant's petition is described herewith: Located on approximately 11.8 acres bounded by Springdale St. on the east and Bolsa Ave. on the south, and legally described as the NW 4 of Section 15-5-11 SBB & M. Further legal description on file in the Planning Dept. Office. The hearing was opened to the audience. Jeff Millet, representing Millet, King & Assoc., addressed the Commission, and pointed out the proposal by the applicant, A. L. Gindling. He stated that A. L. Gindling was being advised by Coldwell Banker, a Real Estate from Los Angeles, and they felt the corner could be put to its best use as commercial. There being no further comment, the hearing was closed. RESOLUTION NO 186 A Resolution of the City Planning Commission Making Recommendation of Approval of Zone Case No 186 to the City Council. A MOTION WAS MADE BY STANG AND SECONDED BY PRESSON TO ADOPT RESOLUTION NO 186, BASED ON THE FOLLOWING FINDING OF FACT: �46 Page #9 Minutes - H. B. Planning Commission Tuesday, May 2nd, 1961 That the commercial area falls within the percentage of land use in relation to residential areas. The property lies adjacent to both a major arterial highway and a primary arterial highway. The commercial area will be needed to serve the new subdivisions now under construction in the area. There being no further comment, the hearing was closed. RESOLUTION NO 187 A Resolution of the City Plannin; Commission Making Recommendation of Approval of Zone Case No 187'to the City Council. Jeff Millet, Engineer of Millet, King & Assoc., addressed the Commission, and pointed out that the revision was suggested by the Federal*Housing Administration so that all of the houses along -Sugar Ave. would be fronting on Sugar Ave. rather than fronting, siding and backing on Sugar Ave. The Commission agreed that it would make a more orderly development. The Commission discussed the need for more stringent requirements because as the code stands now there exists a safety hazard. There being no further comment, the hearing was closed. RESOLUTION NO 1052 A Resolution of the City Plannin3 Commission Making Recommendation of Approval of Fencing Requirements of Swimming Pools to the City Council. A MOTION WAS*MADE BY DOUTT AND SECONDED BY LETSON TO ADOPT RESOLUTION NO 1052 BASED ON THE FOLL014ING FINDING OF,FACT: That the change would lead to better protection, and preserve the health, safety and welfare of the general public. -12- Page #13 Minutes - H. Fire Chief Higgins, addressed the Commission and stated that he was in favor of the change because it would enable the Fire Department to . determine locations, within the City, much faster and more efficiently. There being no further comment, the hearing was closed. RESOLUTION NO 1054 A Resolution of the City Planning Commis- sion Makin- Recommendation -of Approval of Change of Desi-nation of Streets and Avenues to the City Council. A MOTION WAS.MADE BY DOUTT AND SECONDED BY LETSON TO ADOPT RESOLUTION NO 1054, BASED ON THE FOLLOWING FINDING OF FACT: It would enable both governmental agencies and to the general public to better orient themselves within our City limits. Planning Cormission Tuesday, May 2nd, 1961 reported that after rezoning the use they felt that it was more of a commercial use than an agricultural use.
