On motion by Presson and seconded by
Stang the Minutes of the Huntington
Beach Planning Commission of May 2nd, 1961, as transcribed
and mailed by the Secretary were accepted as mailed.
USE VARIANCE: UV #294 To allow continued use for communi-
Applicant -
Clifford C. Houser cations testing for research and deve-
lopment activities in the R-5 District. (Variance previously
secured from Orange County Planning Commission). Located south
of Edinger Avenue (Smeltzer Ave.) and 2640 feet west of Bolsa
Chica Ave., and legally described as the Northerly 15 acres
of the NE 4 of the NW 4 of Section 20, T.5. S. , R.11.W. , SBB & M.
The Secretary read a letter submitted
by the Space Technology Laboratories, requesting the approval
of UV #294, which was originally granted by County Board of
Supervisors, Orange County, California, which recently expired.
The hearing was opened to 'the audience,
there being no comment the hearing was closed.
Commission discussion followed. The
Commission discussed the operation of the proposed Use Variance
and decided that it would not be detrimental to the area at
_the present time. A three year time limit should be imposed.
Due to the proposed development, the surrounding area would
take at least three years before completion.

Applicant - two individual parcels as follows:

Be -inning at the SW corner of the
NW 4 of Section 1, T.6.S., R.11.S., SBB c: M, thence north
822.00 feet to the point of beginning; thence east 442 feet
to a point; thence north 50 feet; thence west 442 feet; thence
south 50 feet to the point of beginning. DIVISION I: The
west 192 feet of the above described property. DIVISION II:
The east 250 feet of the above -described property.
The hearing was opened to the audience,
there being no comment the hearing was closed.
Chairman Bazil questioned the appli-
cant why he wanted to divide the property. Mr. Edward W.
Tuck, petitioner, pointed that he wants to purchase the front
half of the lot to -join the property he presently owns to the
south and that a dwelling was located on the rear portion
of the lot to which he would -rant a 10 foot easement for
access.
After further discussion the Chairman
asked Mr. Tuck if he would consider amending his plot plan
to have the dividing property line, line up with that of the
property to the north.
Mr. Tuck agreed to a continuance
asked for by the Commission to consider the change.
Commission discussion was held at
length.

Applicant - two individual parcels as follows:

DIVISION I: The north 55 feet of the
north 110 feet of Blcok 2504 of East Side Villa Tract. DIVISION
II: The south 55 feet of the north 110 feet of Block 2504 of
East Side Villa Tract. Located north of Yorktown Street and
west of Delaware Avenue.
The nearing was opened to the
audience, there bein; no comment it was closed.
During a discussion held by the Com-
mission, it was decided that the lot had sufficient depth
and width to allow the division.
A MOTION WAS MADE BY STANG AND
SECONDED BY DOUTT TO RECOMMEND APPROVAL OF DV #151 TO THE CITY
COUNCIL, WITH THE FOLLOWING CONDITIONS:
1. There shall be required the installation of curbs and
gutters along all frontages of Division I. and Division
II where it abutts Delaware Street.

ZONE CASE NO 188 CHANGE OF ZONE relative to proposed
Applicant -
Star Dust Lands, Inc. change of district boundary and use
Robert H. Grant
classification from: R-1 Single
Family Residence District TO C-2 Community Business District.
The following parcels of real property as submitted on the
applicant's petition is described herewith: 'Located on
approximately 2.55 acres at the Southwest corner of Bolsa
Avenue and Edwards Street and legally described as that por-
tion of the easterly 1,295.06 feet of the NLd - of Section
15, T.5.S., R.11.t•J., SBB & M. Further legal description on
file in the Planning Dept. Office.
The hearing was opened to the audience.
Mr. John Prins, representative for Robert H. Grant, addressed
the Commission and displayed various sketches of the proposed
shopping center development; He pointed out that there would
be a modern suburban shopping center that would replace the
corner markets that were popular in the past.
The Chairman pointed out to Mr. Prins
that Section 15-5-11 was.:about saturated as to commercial zoning
and if he desired to have his property zoned commercial he
should change his'petition to C-4 rather than C-2.
The Chairman then pointed out that
C-4 permitted all R-5 uses and any C-2 use by use permit.
Mr. Prins agreed to the change.
There being no further comment the hear-
ing was closed.

as submitted on the applicant's petition is described herewith:
Located 1320 feet south of Edinjer Ave. (Smeltzer) and east

The Secretary pointed out that the Ocean
View School District had a proposed school site on the property
owned by the applicants to the east where there is a 10 acres
parcel zoned for R-3 and this change would allow the applicants
to develop their property for multiple family residences as
proposed in their overall plan.

BY PRESSON TO ADOPT RESOLUTION NO 190 BASED ON THE FOLLOWING

1. It would be a good transitional zone between the proposed
commercial development presently zoned M-1 and the single
family residence district abutting the property on the south.

The Secretary pointed out the reasons for
the revision was because of the soil conditions. There is
a considerable amount of peat in the area, and the developer
felt that rather than pay the parr; and recreation fee he would
deed to the City that portion of the park site that would
meet his park and recreation requirement fee, and the remainder
of the park site would be open for negotiation.

Notes to' be reworded.
1. Sub -surface water rights to be deeded to the City of
Huntington Beach.
2. Vehicular access rights along Smeltzer Ave. and Bolsa
Chica Street to be dedicated to the City Of Huntington
Beach.
3. Deed restrictions to be recorded against surface oil

DISCUSSION: M-2-0 Heavy Industrial District - Residential
Uses Permitted.
The Secretary' informed^ the Commissioners
that the City Council had approved the changing of the M-2
District and asked if it was the Commissioners intent to
rezone some of'these areas that are presently zoned M-2
to the use proposed on the Master Plan of Land Use.
The Commission discussed the possibility
at ten-th and instructed the Secretary tq prepare studies
of some of these areas to be presented to them for consideration.
There being no further business,
the meeting adjourned.
