A MOTION WAS MADE BY PRESSON AND SECONDED BY'LETSON TO APPROVE: TENTATIVE TRACT MAP NO 4326 WITH NOTES STIPULATED ON THE MAP AND NOTES TO BE REWORDED: 1. Sewer system to be constructed by the developer and dedicated to the City of Huntington Beach. 2. Water supply - Southern California Water Co. NOTES TO BE ADDED:' Vehicular access rights along 14th Street to be dedicated to the City of Huntington Beach except at street intersections. Retaining walls shall be required where there is a difference in elevation of 2 ft. between adjoining lots or property abutting City right-of-way within or adjoining the tract. CONSTRUCT NEW: 1. Curb and gutter and sidewalk along Loma Avenue. 2. Replace curb and gutter on 14th Street. 3. Obtain slope easement on the west side of the alley. The Secretary read -the staff report and the hearing was opened to the audience. Richard LaRue, speaking on behalf of the Industrial Committee - Chamber of Commerce, addressed the Commission, and stated that the property would not be -suitable for industrial development., because of the lot sizes. Commission discussion was held at length. RESOLUTION NO 200 A Resolution of the City Planning Commission Making Recommendation of Approval of Zone Case No 200 to the City Council. A MOTION WAS MADE BY PRESSON AND SECONDED BY WORTHY TO ADOPT RESOLUTION NO 200, BASED ON THE FOLLOWING FINDING OF FACTS: 1. A large portion of the area has been subdivided into residential size lots that could not be utilized properly for industrial use and under the present zoning residences are not.permitted. 2. Properties to the west of the proposed zone change are zoned for residential development and to allow the area to remain in an industrial zone could be extremely detrimental to these properties. 3. Although the area is zoned for industrial use it is basically being used as an oil field and not industrially as such. 4. The proposed rezoning is a vital step to insure the future of the area as an extremely desirable residential area, because of its proximity to the beaches. The hearing was opened to the audience. Lyndon A. Wells, 101 Walnut Street, Huntington Beach, addressed the Commission and objected to the proposed R-2-0 zone change. He stated, that he did not object to the elimination of the existing M-2-0 District, but felt that the area was best suitable for R-3 Limited Multiple Family Residence zone. He also stated that there was lack of public utilities in the area. Mr. James E. Rayle, 315 So. Pasadena Avenue, Pasadena 2, California, addressed the Commission, and stated that he was for the M-2-0 Heavy Industrial District, which should be left as it exists, because the certain property is not suitable for residential district. Don Jones, realtor, addressed the Commission, and stated that the area should remain in the M-2-0 a Heavy Industrial District, and be built into/nice manufacturing area. Mrs. Fox, owner of property, within the area, also protested the proposed zone•change. There being•no further comment, the hearing was closed. A MOTION WAS MADE BY STANG AND SECONDED BY PRESSON TO ADOPT RESOLUTION NO 201 BASED ON THE.FOLLOWING FINDINGS OF FACT: 1. The City Attorney pointed out the possible legal hazzard of approving one change of zone and then starting a new proceeding before the first is completed and adopted. Considerable discussion by the Commission followed. ZONE CASE NO 202 - CHANGE OF ZONE relative to proposed CONTINUED Applicant - change of district boundary and use Harry E. Riley classification from: R-4-X Suburban Residential District, as adopted by Interim Ordinance No. 668 TO R-3 Limited Multiple Family Residence District. Located on approximately 11.77 acres north of Slater Avenue and approximately 990.00 ft. west of Beach Blvd., and legally described as being the west 447.28 ft. of the north half of the SE 4 of the NE 4 of Section 26-5-11 SBB & M., and the W 4 of the S 2 of the SE 4 of the NE 4 of Section 26-5-11 SBB & M. The Secretary read the staff report. The hearing was reopened to the audience. Jerome L. Messatzzia, 17262 Ash Street, Huntington Beach, addressed the Commission, and questioned the widening Ash Street. It was explained that Tract No 4301 had been approved which would extend Ash Street to the south next to his residence. -7- 329 Page #8 Minutes - H. B. RESOLUTION NO 202 A Resolution of the City Planning Commission Making, Recommendation of Approval of Zone Case No 202 • to the City Council. A MOTION WAS MADE BY WORTHY'AND SECONDED BY PRESSON TO ADOPT RESOLUTION NO 202, BASED ON THE FOLLOWING FINDING OF FACTS: 1. There are two five acre parcels on either side of the subject property that have been zoned R-3. 2. It is abutting Slater Avenue a Secondary Arterial Highway. 3. It would be a good transitional zone between the industrially zoned property abutting the property on the northwest and properties to the east. 4. There is an approved subdivision within the proposed zone change that was designed to meet•the requirements of R-3 zoning. ROLL CALL VOTE: AYES: Presson, Letson, Worthy, Stang, Chairman Bazil. There shall be required the installation of curbs and gutters along all frontages of Division I and Division II abutting Elm Street in accordance with City Standards, or posting of a bond to guarantee such curb and gutter. 2. A MOTION WAS MADE BY LETSON AND SECONDED BY STANG TO APPROVE USE VARIANCE UV #306 WITH THE FOLLOWING CONDITIONS: 1. There shall be posted a $250.00 performance bond guaranteeing removal upon expiration of Use Variance. 2. Use Variance shall expire one year from date granted. 3. The subdivision directional sign shall be.removed by the applicant upon expiration of Use Variance - the penalty for failure to do so shall be the forfeiture of the perfor- mance bond. SECONDED BY LETSON TO APPROVE USE VARIANCE UV #308 WITH THE FOLLOWING CONDITIONS: . 1. Lots 152 and 153 not to be separated in ownership. 2.• That the three garages attached to the proposed tri-plex and the proposed new carport for the existing dwelling be fully enclosed garages equipped with doors to provide for their complete enclosure. Planning Commission Tuesday, August 1st, 1961 DISCUSSION: DRAFT OF PROPOSED RA ZONE: The Secretary submitted to the Commission a draft of proposed RA Zone which is intended to replace the County A-1 and R-4 Zones held over by interim ordinance. Discussion was held at length. Chairman Bazil pointed out the Commission will review the proposed ordinance and discussion to be held at a future Planning Com- mission meeting. A MOTION WAS MADE BY PRESSON AND SECONDED BY LETSON TO CONTINUE DISCUSSION OF THE PROPOSED RA ZONING ORDINANCE FOR THE AUGUST 15TH, 1961, MEETING. ROLL CALL VOTE: AYES: Presson, Letson, Worthy, Stang, Chairman Bazi1. NOES: None. ABSENT: Doutt, Kaufman. THE MOTION CARRIED. CEMETERY ZONING The City Administrator presented an inquiry from Roselawn Cemetery as to whether special zoning for cemetery uses could be established on their property at the corner of Talbert Avenue and Beach Blvd. The letter also indicated a willingness to provide an additional 10 ft. of land for widening Talbert Avenue along the cemetery. The Secretary mentioned that a special cemetery zone had been success- fully established in the City of Inglewood. The Commission discussed the matter at length and the resulting concensus was that the proposal was reasonable and would be considered further. DISCUSSION: ZONE CHANGE EXHIBITS MAPS FOR CHANGING COUNTY M-1 AND C-1 TO CITY M-1 AND C-4 The Secretary presented'to the ' Commission exhibits of certain Sectional District Maps covering areas of proposed change of the County zoning under the Interim Sw,l 334 Page #13 Minutes -- H. B. Planning Commission Tuesday, August 1st, 1961 Ordinance to the suggested comparable City Zone. In general, the County M-1 Zone was proposed for City M-1 except for a few adjustments where recent developments made it necessary. The County C-1 is proposed for City C-4 zone. The following Sectional District Maps were affected: 2-6-11, 23-5-119 24--5--11, 25-5-11, 26-5-11, 35-5-11. After considerable discussion, the Commission agreed that the proposal should be considered as soon as possible. A MOTION WAS MADE BY PRESSON AND SECONDED BY•LETSON TO INSTRUCT THE SECRETARY TO SET A PUBLIC HEARING AND GIVE NOTICE OF THE PROPOSED CHANGE FOR THE SEPTEMBER 6TH, 1961, REGULAR PLANNING COMMISSION MEETING. ROLL CALL VOTE: AYES: Presson, Letson, Worthy, Stang, Chairman Bazil. NOES: None. ABSENT: Doutt, Kaufman. THE MOTION CARRIED. EXPIRATION OF TERMS COMMISSIONERS BAZIL AND PRESSON Chairman Bazil mentioned that the terms of two Commissioners would expire in September. A check of the appointment dates indicated that the terms of Chairman Bazil would expire on September 14th, and Commissioner Presson on September 18th. After discussion, the motion of Stang Seconded by Letson to recommend to the Council that Commissioners Bazil and Presson be reappointed to four year terms on the Planning Commission, was carried by the following roll call vote: AYES: Worthy, Letson, Stang.
