Kiwanis Club - A communication from the Kiwanis Club of °aivcr of License Pee - Vencin Machines Huntington Beach requesting waiver of vend- ing machine license fees for gum ball machines to be placed in various business locations, was presented to the Council. Mr. Danny Eichberg Mr. Danny Eichberg, President of the Kiwanis Club, addressed the Council and informed them of the procedures followed in many adjacent communities in this regard. A communication from the "Committee for of Stfiset Heights" -- Assistance Request Annexation of Sunset Heights" requesting assistance from the City in a study and preparation of boundaries for the proposed annexation area, was presented for Council con- sideration. Engineering Dept. to Assist On motion by Lambert, seconded by Stewart, Council approved the request of the "Committee for Annexation of Sunset Heights", and directed the Engineering Department to assist the committee in the preparation of such boundaries. Motion carried. Oceanview School .A communication from Oceanview School District - Request to use Sound Truck District requesting permission to use a sound truck in their area during August for the purpose of notifying parents to register new school children, was presented for consid- eration by the Council. Request_Approvea On motion by Lambert, seconded by Wells, Council authorized the Oceanview School District to use a mobile public address system on August 14, 13, 21 and 22, 1961 between the hours of 10:00 A.M. and 6:00 P.M. for the purpose of notifying parents to register all new school children in the school district. Motion carried. Communication A communication from the City and County ItiG�c`lrGn°" T`].iGS Health Officer citing a violation of the Huntington Beach Ordinance Code relating to flies, and recommending action by the Council, was presented for Council consideration. The Council held considerable discussion in this matter, particularly pertaining to the areas in which these violations were charged. 1-jr.- Sakioha On motion by Lambert, seconded by Stewart, _requested to Appear Before Council the Clerk was directed to send a comimmi- cation to Mr. Sakioka, requesting him to appear before the Council on August 21, 1961 at 8:00 o*clock P.M. On motion by Wells, seconded by Lambert, the Council ordered public hearings for August 21, 1961, at 7:30 o'clock P.M., or as soon thereafter as possible, in the Council Chambers of the City Hall, Huntington Beach, California on Divisions of Land DV-152 and DV-153, and directed the Clerk to publish notice of same. (7) (8-7-61) After some discussion by -the Council, a motion was made by Stewart, seconded by Lambert, that the matter be referred to the Engineer to notify the Subdivider to make the necessary changes regarding the power control. Yorktown Streets as presented by the City Engineer, and directed the Clerk to read Resolution #1500. (9) (8-7-61) 430 Planning Director W. C. Warner pointed out the area involved in this Zone Case on a map. The Clerk informed the Council that he had received no written protest to Zone Case #194. There being no protest filed, either oral or written, against Zone Case #194, Mayor Gisler declared the hear- ing closed. White, 208 Geneva Street, City, <" c( ceressedl Gof'inci l the appellant, addressed the Council and informed them,of the steps,they were taking to make the property involved acceptable for a Use Variance. He stated that they had started to fireproof the east wall of the building as required by the Building Department. Mrs. J. B. White addressed the Council and stated that the property was arranged the way they would like to have it, and that they felt it was unnecessary to take down the small plastic roof between the house and the garage. Building Director 0. C. Cleveland informed the Council that other properties within the immediate vicinity of this property were ,in violation of the Building Code, but such violations had been accomplished before the Ordinance covering same was passed. Building Director Cleveland then, for the record, stated that the garage was used as a sleeping room and also had a stove, refrigerator, toilet and bathtub installed therein. Following some discussion by the Council the hearing was closed by the Mayor. Mayor Gisler announced that this was the rd. #859 day and hour set for a public hearing on proposed Ordinance #859, adopting the "Orange Empire Plumbing Code, 1961 Edition" by reference, and directed the Clerk to read the legal notice. The Clerk read notice of public hearing on proposed Ordinance #859 entitled "AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH ADOPTING THE ORANGE EMPIRE PLUMBING CODE, 1961 EDITION" by'reference as published in the Huntington Beach News, July 20th and 27th, 1961, setting the hour of 8,00 o'clock P.M., in the Council Chambers of the City Hall of the City of Huntington Beach, as the time and place for a public hearing at which time any and all persons interested might appear and be heard thereon. f earin Openve. The Clerk informed the Council that he had received no written protest to the adoption of Ordinance #859 as published. There being no protest filed, either oral or written, the hearing was closed by Mayor Gisler. On motion by Stewart, seconded by Waite, Section 73.159 of the Orange Empire Plumbing Code, 1961 Edition, be changed to conform with the recommendation of the Building Department, and so included in the proposed Ordinance. C' :- r i Under all communications, Mr. W. D. OtBrien, Counc-JA Real Estate Broker, addressed the Council and protested the fact that the Building Department would not issue a building permit for a dwelling to be built on Lots 1 and 2, Block 102, Vista Del Mar Tract, at the Northwest corner of Atlanta and Huntington Avenues, which had been requested by a client of his. Mr. O'Brien stated that they had been informed that due to the future widening of Atlanta Street under the Arterial Highways System, it would be required to forfeit 20 feet of these lots abutting Atlanta Street, either through sale or condemnation. Building Director Cleveland and Planning Director Warner explained to the Council the requirements set up by the Master Plan of Arterial Highways which had been adopted by the Council by Ordinance some time previous. (12) (8-7-61) 4331 P;;i e ,r13 - rug test ;, 1.961 The City Attorney informed the Council, that if they decided to allow this building permit, the Ordinance covering the Master Plan of Arterial Highways would have to be repealed. Considerable discussion was held by members of the Council on this matter. Gap =krc'YrS th.c. Mr. Cap Blackburn, a Realtor of Huntingtoni Beach addressed the Council, stating that he had 18 pieces of property in escrow within the City, and the standard procedure on their part was to attempt to find out the setback lines and observe same. Mayor Gisler stated that the Ordinance adopting the Master Plan of Arterial Highways within the City set up -a presidence regarding setback on certain streets and that it was his feeling that the Ordinance should not be repealed. Permission On motion by Wells, seconded by Waite, Huntington Beach Elks Lodge #1959 were granted permission to barricade Lake Street at Lake Park on Saturday August 19th, from 6:00 to 11:00 A.M. to conduct their breakfast. Motion carried. Lesuwe of Service Mr. George Goodwin of the Coast Ambulance Service addressed the Council and gave a resume of the service his company had performed to date. Mr. Goodwin informed the Council that he had purchased an additional ambulance for use within the City, as the business to date warranted same. MacKerron as Typist -Clerk, Range 23-C effective August 8, 1961. Motion carried. The Clerk presented a communication from r i7 the Orange County Tax Collector regarding tax title lots in the City covered by Tax Collector's Sale #918. to On motion by Stewart, seconded by Lambert, the Clerk was instructed to inform the Tax Collector of their objection to this sale and their agreement to purchase these lots at the price set by the -Board of Supervisors. Motion carried. Irvine The City Administrator presented a com- munication from the Irvine Ranch Water District making proposals for City participation in a high level reservoir which they plan to construct in the vicinity of Corona Del Mar. Motion carried. The Administrator presented a report from Land Acquisition Service on appraisal of property East of Gothard Street and South of Edinger Street, pro- posed as Fire Station Site No. 9. Mr, Miller informed the Council that he had discussed the matter with the Health Officer and they had personally investigated the situation; and the Health Officer felt that he could not find a complaint. There was some discussion on this matter by the Council, but no action was taken. The Administrator reported that he had ��cti r� ��- l �x investigated the complaint from Mrs. O'Dowd regarding dust in the area in which she lived, purported to be coming from an aggregate stock pile owned by the City. He stated that there had been some dust apparent, but prevailing winds were generally in the other direction.
