4. A soil report by an approved soils engineer shall be sub
mitted to the City Engineer prior to recordation of any
portion of the tract and all portions of the land not
satisfactory for building shall be excluded.
5. None of the existing small lots shall be excluded from
within any portion of the tract to be recorded.

1. Drainage facilities within Edwards Street necessitate a wide
than standard dedication thus reducing the usable area within
the tract.
2. The width of paving will not be reduced.
3. The problem is local in character and will not affect adjoining
properties.

The Secretary read the report of the
Subdivision Committee recommending conditions for approval of
the tract.
Jeffrey Millet, of Millet, King &
Assoc., addressed the Commission, stating that he was represent-
ing the subdivider, questioned when the four acre parcel at the
southeast corner of Bolsa Avenue and Springdale Street will have
to be dedicated and 'improved.
The Secretary informed Mr. Millet,
that it will be necessary when that portion of the tract map
was recorded.
There being no further comment,
Commission discussion was held.

1. The property is fronting on Beach Blvd., a Major Arterial
Highway and approximately 450 ft. south of Ellis Street
a Secondary Arterial Highway and Main Street a Primary
Arterial Highway.
2. Its close proximity to the Five Points Shopping Center
now under construction.
3. The property abutting the subject property to the north
is zoned C-2 Community Business District.

SECONDED BY DOUTT TO ADOPT RESOLUTION NO 205 BASED ON THE
FOLLOWING FINDING OF FACTS:
1. The property is bounded on the north by Talbert Avenue
a Primary Arterial Highway and on the west by Beach Blvd.
a Major Arterial Highway.
2. The property is located at one mile intersections which
makes it a more logical location for commercial uses.
3. The northeast corner of Beach Blvd. and Talbert Avenue
is a cemetery and the southwest corner has been subdivided
into very small lots making both corners unusable for
commercial uses.
4. The northwest corner is presently zoned C-1 Neighborhood
Commercial District.

because of its proximity to the beach and the Arterial Highways.

BY PRESSON TO ADOPT RESOLUTION NO 208, BASED ON THE FOLLOWING
FINDING OF FACTS:
1. The property adjoining the subject property to the'north is
.zoned R-1 Single Family Residence District and is being used
as such.
2. There is an approved tentative subdivision on the subject
property that has been designed to meet the requirements
for the R-1 District.
3. Under the present zoning the property can'be subdivided
and dwellings constructed.
4. The rezoning of the area will eliminate any uses that are
not compatable with -single family residences within the tract
boundary.

addressed the Commission and opposed to the Change of Zone,
because of drainage problems. Bill Hartge, Senior Design
Engineer, pointed out the proposed drainage channel now being
constructed northeast of the area. The Secretary ngted that
the Tentative Map of Tract No 4328 covering the same property
had been continued to September 6th, 1961, as requested by
the subdividers agent because the drainage problems had not
yet been solved. It was suggested that the zone case be
continued to the same date as the proposed subdivision.
There being no further comment,

FINDING OF FACTS:

2. There are not any commercial developments proposed within
the -immediate area to serve the numerous homes proposed
and under construction in the vicinity of the proposed
zone change.
3. It is approximately one-half mile from the proposed San
Diego Freeway that will provide an on and off ramp at

The Secretary read a letter submitted
and signed by seven persons, stating no objections to granting
of the proposed variance. Also submitted and read by the
Secretary was a letter of protest sign by sixteen persons.

Sam Azzara, applicant, addressed the
Commission and explained the situation pointing out that
most of the property surrounding his lots are zoned C-3 and
R-3. He has spent considerable money developing the property
and he felt that the proposed units would enhance the area.
Dennis Double, 605 Frankfort Street,
Huntington Beach, addressed the Commission and stated, that
he was speaking on behalf of his parents who could not be
present. He stated, that he opposed the granting of the
proposed variance, because parking problems will be created
both on Frankfort Street and in the alley where the proposed
units will be constructed; that a considerable increase in
proper maintenance of the alley roadway will result; that
nearby property would be highly.depreciated in valve, if
multiple dwellings would be constructed in the R-2 Two Family
Residence District.
There being no further comment, the

FOLLOWING CONDITIONS:
1. There shall be posted a $250.00 performance bond guaran-
teeing removal of the sign permitted by Use Permit No 134.
2. Use Permit No 134 shall expire one year -from date granted.
3. The subdivision directional sign shall be removed by the
applicant upon expiration of Use Permit No 134-the penalty
for failure to do so shall be the forfeiture of the
performance bond. The City shall retain the right for
entry and removal of sion upon expiration of Use Permit
No. 134.
4. The sign shall be setback 35 ft. from Adams Street and

shelters can be located. Several contracting firms have sub-
mitted plans for his approval of the structures and he
anticipates that permit applications for construction of shelters
will soon be filed.
He pointed out that there are very few
lots in the City of adequate size or with buildings so located
that the shelters can be constructed and still observe the yard
requirements. He questioned if the Commission would consider
approving construction of below ground shelters in the front
yard area. The question was also raised as to just what the
shelters would be used for - storage, play rooms, sleeping
quarters, etc.
It was the concensus of the Commission
that the matter be held over until the next meeting and re-
quested the Building Supt., Planning Director and Fire Chief
to make a further report and recommendations.
DISCUSSION: The Secretary informed the Commission,
that the proposed chan4-e of zone from County M-1 and C-1 would
involve about 1800 property owners to be notified by mail and
therefore requested that the Commission approve posting and
publishin- legal notices only. The Code provides that notice
shall be published and that the property shall be posted or
notices shall be mailed to property owners, Since the Alternate
of posting or mailing notice is provided by law, the omission
of mailing will-reatly facilitate office work and expense.

DISCUSSION: Richard Hitchcock, realtor from Newport
Beach, addressed the Commission, and questioned the problem of
approving subdivisions on properties located in the Talbert
Water District.
Vice -Chairman Stang pointed out that
the County Health Department cannot approve developments in the
area where irrigation by sewer effluent is done because of the
serious health hazard. This was the basic reason for continuing
the two proposed subdivisions in the area for 60 days. It is
hoped that a solution to the problem will'be forthcoming in the
near future.
