MINUTES: On motion by Kaufman and seconded by Stang, the Minutes of the Huntington Beach Planning Commission of September 6th, 1961, as transcribed and mailed by the Secretary were accepted as mailed. J KkSTER PLAN OF HUNTINGTON HARBOUR: Mr. Lewis W. Douglas Jr., President of Huntington Harbour Corp., filed with the Commission the Master Land. Use Plan for the development of the proposed harbor in the .Sunset Bay area. He briefly explained that the plan had been prepared by William Pereira and Associates after several months of study. The plan is for a marina type community with eight islands and 18 miles of water front property. Of the 860 acres in the development approximately 30.10 will be in water area and the remainder in single family, multiple family, co=er- cial and school uses. Also proposed are several public beach areas. The Secretary explained that the purpose in filing the Master Plan is so that the City may adopt the plan as part of the overall Master Plan of Land Use for the City. After discussion by the Commission, the motion of Letson, Seconded by Worthy to hold a public hearing on the Master Land Use Plan of Huntington Harbour as an amendment to the Master Plan of Land Use of the City at the next meeting on September 19th, 1961, at 7:30 P.M., was carried by the-followin- vote: 360 Page #2 Minutes - H.'B. TENTATIVE TRACT MAP NO 4304 - REVISED Number of Lots: 126 Subdivider: K. W. Koll Construction Co. Total Acreage: 26.7± Engineer: Voorheis-Trindle-Nelson Located west of Bushard Street and south of Garfield Avenue, and legally described as being a proposed subdivision of a portion of the NE 4 of the N`vJ 4 of Section 6-6-10. The Secretary read a report which pointed out the subdivision problems in the Talbert Valley and the one major problem of irrigation of farm lands by the Talbert Irrigation District with undisinfected sewer effluent. The Health Department has reported that the irrigation presents a disease transmission hazard and they cannot recommend approval of a subdivision within the district. I:enneth Carlson, agent for the sub- divider, addressed the Commission, and stated that the amount of traffic in the area has increased already causing more and more people to travel thru the Water District and'that the proposed tract would not add to the problem that much. The City Attorney was asked the legality of approving only the layout and design of the tract and not give full approval. The Attorney stated that the tentative tract could be approved subject to any conditions required by the Planning Commission. The Secretary pointed out that majority of the area is being farmed at the present time, and using sewage effluent for irrigation. Dan Parton, of Vanguard Construction Co., addressed the Commission, and stated that it would be to the -2- 361 Page #3 Minutes - H. B. Plannin-- Commission Wednesday, September 6th, 1961 City's advantage to have the area developed residentially rather than being irrigated with undisinfected sewer effluents. Charles Cohan, representing Doll Construction Co., addressed the Commission, and stated that the Koll Construction Co. ownes other land in the area, and this parcel is further from the Talbert Water District their than any other parcels, under/ownership. ,Ivan Harper, 8341 Garfield Avenue, Huntington Beach, addressed the Commission and stated that there are other homes situated in the area, in addition to the Pacific Sands development. City Engineer, James R. Wheeler, pointed out that the subdivision known as the Pacific Sands was under construction before the Health Department found them to be within the district. Bill Tressler,,Orange County Health, Department representative, pointed out that no distance for homes from the irrigation by sewer effluent has been established by them, but prior to the occupancy of any homes in Pacific Sands, adjoining farm land,was irrigated up to 1200 ft. and one irrigation with 600 ft. of the development. Mr. Tressler stated, that it was questionable whether chloronation of the effluent would be totally effective, and other sources of water would be costly. The District does hold a permit issued by the County Agricultural Department, and was reviewed by other county agencies. The farmers did not intend to subdivide the land and at that time, rather keep it for farming purposes. The number of vehicles on Adams Avenue and Brookhurst Street has increased considerably and does impose a definite problem. Planning Commission Wednesday, September 6th, 1961 mentioned as living within the district were among those that had originally formed the district and would strongly oppose the County denying, them the right to farm the land. The Secretary read the report of the Subdivision Committee recommending that -the Planning Commission approve only the design and layout of the tract, and at such time as the health problem is•solved, the tract should be considered again to complete the tract approval. Commission discussion was held at length. A MOTION WAS MADE BY KAUFMAN AND SECONDED BY PRESSON TO APPROVE THE DESIGN AND LAYOUT OF TENTATIVE TRACT NO 4304 UPON THE FOLLOWING CONDITIONS: 1. The revised layout dated September 5th, 1961, shall be the approved design. 2. The dedication and improvement of Garfield Avenue and Bushard Street shall include the parcel designated as "not a part". 3. An additional 5 ft. of right of way shall be provided along the west boundary of the tract for flood control channel purposes. 4. No portion of this tract shall be recorded until such time as further approval by the Planning Commission is secured certifying that a solution has been found to the problem of a public health hazard due to irrigation of nearby farm lands with undisinfected sewer effluent. 5. TENTATIVE TRACT MAP NO 4350 - REVISED Number of Lots: 475 Subdivider: 'Vanguard Construction Co. Total Acreage: 105.6-F Engineer: Voorheis-Trindle-Nelson Located north of Adams Avenue, south of Yorktown west of Bushard and east of Cannery Street, and legally described as being a proposed subdivision of a portion of Section -4- 363 Pace ;f5 Minutes - H. B. Planning Commission Wednesday, September 6th, 1961 6-6-10. The Secretary read the report of the Subdivision Committee recommending conditions for approval of the tract. He also read a letter submitted by the Fire was proposed Department, stating a fire station site/to be located on lots 355 & 356 within the tract. - Frank Richardson, of Voorheis-Trindle- Nelson, Engineers, addressed the Commission, and objected to the change in the commercial corner that was requested by the Subdivision Committee. He also objected to the condition ' as recommended by the Subdivision Committee to construct a pedestrian bridge across the flood control channel in the vicinity of Lots 179 or 187 but had no objection to the require- ment of providing the walkways, leading to the pedestrian bridge wherever it might be constructed. The Secretary pointed, cut that the corner of Cannery and Adams was suggested for commercial development because it was a more logical location for business than at the half section corners. Mr. Parton representative of Vanguard Construction Co., addressed the Commission and stated they were dedicating the entire park site to the City which exceeded the amount required by the Subdivision Ordinance and would like relief from the requirement of the pedestrian foot bridl-e across the flood control channel. Commission discussion followed. A MOTION WAS MADE STANG AND SECONDED BY DOUTT TO APPROVE THE DESIGN AND LAYOUT OF TENTATIVE TRACT NO 4350 UPON THE FOLLOWING CONDITIONS: 1. The revised layout dated September 6th, 1961 shall be the approved map. 2. A fire station site shall be reserved meeting with the approval of the Fire Chief. 3. The subdivider shall construct a pedestrian bridge across the flood control channel in the vicinity of lots 179'or 187 and provide the necessary walkways in a manner meeting with the approval of the City Engineer and School District. 5. The proposed commercial site, lot 475, shall be revised or enlarged to provide more adequate protection to adjoining properties. 6. No portion of this tract shall be recorded until such time as further approval by the Planning Commission is secured certifying that a solution has been found to the problem of a public health hazard due to irrigation of nearby farm lands with undisinfected sewer effluent. 7. A revised tentative map showing necessary changes shall be submitted for approval by the Planning Commission. 8. All standard subdivision requirements shall be complied with. The Secretary read a letter submitted by Ray Mercado, representing Nat Neff Engineering Co., requesting withdrawal of Tentative Tract Map No 4328. The application shall be valid only for the applicant and present owners of -Coast Ambulance Service. 2. The approval of the application shall expire on January 1st, 1964. ' 3. The operation of the business shall be restricted'to the northeast portion of the property described in the application shown on the plot plan as the location of a'house and garage. 4. All buildings used in the business shall meet the requirements of Building and Fire Codes determined by the Bldg. Supt. and Fire Chief., ' 5. He also stated that most of the.classes would be in the day time classes and not over 10 students in each class. Mrs. Green, Vice -President of the Women's club, addressed the Commission, and stated she had investigated the applicants, and found everything satisfactory. The Secretary informed the Commission that the staff report was read at the previous meeting and has not been changed in any way, therefore it was not necessary to be read again. .The hearing was opened to the audience. Mrs. Arnold Gaunt, 12122 Ora Street, Garden Grove, addressed the Commission and opposed to the Change of Zone. Oscar Taylor, of Newport Beach;.Cali.fornia, addressed the Commission, and stated that he was -objecting -"to -the rezoning, because of the type,of uses in the area which.adjoins his property -and also stating that -due -to -the fact.that.the existing refinery is in the -vicinity, property values would be depreciated if the area were to be zoned for residential use. -14- E 0 373 Page #15 Minutes - H. Commission discussion was held. - RESOLUTION NO 201 A Resolution of the City Planning Commission Making Recommendation of Approval of.*Zone Case No 201 to_the City Council. A MOTION WAS MADE BY STANG AND SECONDED BY LETSON TO ADOPT RESOLUTION NO 201, BASED ON THE FOLLOWING FINDING OF FACTS. 1. A large portion of the area has been subdivided -into residential size lots that could not --be utilized properly for industrial use and under the present zoning residences ,.are not permitted. 2. Properties to the east, west and south of the proposed zone change are zoned for residential development and to allow the area -to remain in an industrial zone could be extremely detrimental to these properties. 3. Although the area is zoned for industrial use it is basically being used as an oil field and not industrially as such. 4.
