HomeMy WebLinkAbout1961-09-18Minutes 0 Council Chambers, City Hall Huntington Beach, California Monday, September 18, 1961 Mayor Gisler called the regular meeting of the City Council, of the City of Huntington Beach to order at 7:30 o'clock F.M. The Pledge of Allegiance was given by all present in the Council Chambers. Councilmen Present: Wells, Lambert, Stewart, Waite, Gisler Councilmen Absent: None Police Dept. Reports - On motion by Stewart, seconded by Lambert, Received & Filed the report of the Police Department for the month of August, 1961, was received and ordered filed. Motion carried. Dr. Hutchinson - On motion by Stewart, seconded by Lambert, Offer to Purchase Property a letter from Mr. Leonard D. Moody, Attorney, representing Doctor Richard Hutchinson, of Huntington Beach, making an offer to purchase Lot 21, Block 418, now owned by the City, was referred to the City Administrator for study and report back to the Council. Motion carried. Mrs. Lula E. Deering - A letter from Mrs. Lula E. Deering, Ope- New Lease Request rator of the Pier Tram, requesting a new lease for a period of five years, was presented for Council consid- eration. City Attorney to. On motion by Lambert, seconded by Waite, Prepare New Lease the City Attorney was directed to prepare a new lease between the City and Mrs. Deering for a period of five years, with other considerations to be the same as in the previous contract. Motion carried. H.B. Board of Realtors - On motion by Waite, seconded by Stewart, Survey Request a letter from the Huntington Beach Board of Realtors, Inc., requesting that a survey of all properties owned by the City be made, was referred to the Administrator for study and report. Motion carried. -1- (9-18-61) e•1 Page #2 - Minutes, September 18, 1961 Request to Conduct A letter from the Democratic Party request - "Dollars for Democrats" Drive ing permission to conduct a "Dollars for Democrats" drive, in the City, from September 19th to October 2nd, 1961, was presented by the Clerk. Permission Granted On motion by Lambert,'seconded by Stewart, the Democratic Party were granted permission to conduct the "Dollars for Democrats" drive in the City,'from September 19th to October 2nd, 1961, with the condition that solicitors be required to register with the Police Department. Motion carried. Assoc. Chambers of A letter from the Associated Chambers of Commerce Reso. Commerce of Orange County, transmitting their Resolution requesting the Public Utilities Commission of the State of California to require installation of water meters by all Utility companies, was presented for Council consideration. City Attorney to Pre- On motion by Lambert, seconded by Stewart, pare Similar Reso. the City Attorney was directed to prepare a similar Resolution for presentation to the Council. Motion carried. Public Hearing Mayor Gisler announced that this was the Continuation AV #314 day and hour'set for a continuation of a public hearing on a denial by the City Planning Commission of AV #314, regarding 8392 Munster Drive, Lot #33, Tract #3595, which was con- tinued from the meeting of September 5, 1961. Hearing Opened The hearing was declared open by Mayor Gisler. Hearing Closed Their being no comments made by those present in the Council Chambers, the hearing was closed by the Mayor. AV #314 Referred to On motion by Waite, seconded by Wells, the Planning Comm. appeal by Mr. James F. Deane, to a denial by the City Planning Commission of Area Variance #314, was referred back to the Planning Commission for further consideration and review because of extenuating circumstances in connection therewith. Motion carried. Public Hearing On motion by Lambert, seconded by Waite, Zone Case #201 the Council ordered a public hearing for Monday, October 2, 1961, at 7:30 o'clock P.M., or as soon thereafter as possible on Zone Case #201, and directed the Clerk to publish notice of same. -2- (9-18-61) 491 Page #3 - Minutes, September 18, 1961 Councilman {Tells Before this motion came to vote, Coun•cil- Abstained from Voting man Wells requested permission to abstain from voting due to an interest in property within the area covered by the Zone Case, and vacated his seat at the Council table. Councilman Wells Resumed Seat Public Hearing Zone Case #212 When put to vote, the motion carried. Councilman Wells then resumed his seat at the Council table. On motion by Waite, seconded by Stewart, Council ordered a public hearing for Monday, October 2, 1961, at 7:30 o'clock P.M., or as soon thereafter as -possible, on Zone Case #212, and directed the Clerk to publish notice of same. Motion carried. Public Hearing On motion by Lambert, seconded by Wells, DV #156 the Council ordered a public hearing for Monday, October 2, 1961, at 7:30 o'clock P.M., or as soon thereafte as possible, on Division of Land DV #156. Motion carried. Tract Map #4051 The Clerk presented a transmittal from the City Planning Director submitting final form of Tract Map #4051 for adoption; Developer: Charter Homes - S.V. Hunsaker & Sons, Covina, California; Engineer: A. Richard Brown, Jr., Buena Park, California; Location: 1320 feet South of Heil Avenue and West of Golden West Street; Legal Description: being a subdivision of a portion of the SE k of the SE k of Section 22-5-11; Number of Lots: 82; Total Acreage: 17.112; that the map had been certified by the City Engineer and the Planning Director to be true and correct in accordance with the approved Tentative Tract Map and in accordance with provisions of the City Subdivision Code. The City Council may accept dedications as shown on the map and in addition approve the final map subject to the following conditions: The City Clerks signature shall be with- held pending submittal and completion on the enumerated requirement; -3- (9-18-61) 492 Page #4 - Minutes, September 18, 1961 1. Tract Map #4051 On motion by Lambert, seconded by Wells, Adopted Final Tract Map #4051 was adopted, subject to compliance with conditions stipulated by the Planning Commission.. Motion carried. "Sunset Heights Annex." The Clerk presented a ,transmittal from the City Planning Director submitting a recommendation from the City Planning Commission to the Council, that they consent to the commence- ment of proceedings for annexation to the City of Huntington Beach of certain inhabited territory designated as "Sunset Heights Annexation", and to the filing of,the boundary description with the County Boundary Commission. P.C. Recommendation On motion by Stewart, seconded by Waite, Apvroved the recommendation of the City Planning Commission be approved in accordance with the petition on file, and the City Council does hereby giverits consent to the commencement of proceedings to annex the inhabited territory described in said petition to the City of Huntington Beach. Motion carried. Subdivision Bond On motion by Lambert, seconded by Wells, Accepted - Tract #4026 the Council accepted a subdivision bond for Tract #4026 - Huntington Builders, and ordered it filed. Motion carried. Subdivision Bond On motion by Waite, seconded by Stewart, Accepted - Tract #4114 Council accepted a subdivision bond for Tract #4114 - Pacific Sands (James F. Deane) and ordered filed, and accepted a subdivision agreement for the same, which they directed the Mayor and City Clerk to execute on behalf of the City. Motion carried. -4- (9-18-61) 493 Page #5 - Minutes, September 18, 1961 Bonds Accepted for On motion by Wells, seconded by Stewart, Tracts 3815, 4192, 4193 and 4194 subdivision bonds for Tracts #3815, #4192, #4193 and #4194 (R. C. Werbel) were accepted and ordered filed, and subdivision agreements for the same tracts were accepted and the Mayor and City Clerk directed to execute same on behalf of the City. Motion carried. Subdivision Agreement On motion by Stewart, seconded by Wells, Accepted for Tract 4326 the subdivision agreement for Tract #4326 (Fernhill Homes) was accepted by the Council and the Mayor and City Clerk were directed to execute same on behalf of the City. Motion carried. Water Right Deeds On motion by Lambert, seconded by Stewart, Accepted for Tracts 4139 thru 4145 Water Right Deeds for Tracts #4139, #4140, #4141, #4142, #4143, #4144 and #4145, were accepted by the Council and the Clerk was directed to record same with the County Recorder of Orange County. Motion carried. Deeds for Alley On motion by Waite, seconded by Stewart, Right -of -Way Accepted for Tract deeds for additional right-of-way for #4026 alley purposes in Tract #4026 - Huntington Builders, were accepted by the Council and the Clerk was directed to record same with the County Recorder of Orange County. Motion carried.p Sewer Contracts - On motion by Lambert, seconded by Wells, Garfield & Yorktown Accepted contracts and bonds from the Leo Weiler Company for the construction of sewers on Garfield and Yorktown Streets were accepted by the Council, the bonds ordered filed, and the Mayor and City Clerk were directed to execute the contracts on behalf of the City. Motion carried. Slater Ave. Sewer On motion by Lambert, seconded by Stewart, Line Plans & Specs. Approved plans, specifications, special provisions, and an estimate of cost for sewer line in Slater Avenue at the intersection with Beach Boulevard, were approved, and the Clerk directed to read Resolution #1517. Reso. #1517 The Clerk read Resolution #1517 - "A RESO- LUTION OF THE CITY OF HUNTI NGTON BEACH ESTABLISHING THE GENERAL PRE- VAILING HOURLY WAGES FOR EACH CRAFT OR TYPE OF WORKMAN OR MECHANIC NEEDED FOR THE CONSTRUCTION AND INSTALLATION OF SANITARY SEWERS IN SLATER AVENUE, AT THE INTERSECTION WITH BEACH BOULEVARD, IN THE CITY OF HUNTINGTON BEACH." A transmittal from the City Engineer advis- ing Council of the activities of the Rainbow Disposal Company as of September 8, 1961, was presented for Council information. Comm. Received On motion by Waite, seconded by Lambert, and Filed the communication from the City Engineer was received and ordered filed. Motion carried. Truck, Cab & Chassis Informal bids for a truck, cab and chassis Bids Presented for the Fire Department were presented by the Purchasing Agent as follows: Mark -Downey Ford $4,316.06 Incl. sales tax Mel Burns Ford, Long Beach $3,991.74 Incl. sales tax Main St. Garage - International Truck $3,540.72 not incl. sales tax The Purchasing Agent advised the Council that the Main Street Garage had submitted specifications varying from those issued for the bidding. Bids Referred to Purch. A motion was made by Lambert, seconded by Agent. & Fire Chief Waite, that the bids as presented, together with the specifications, be referred to the Purchasing Agent and Fire Chief for study and report at the next meeting. Johnson as Intermediate Typist Clerk, Range 26, Step 'C', effective September 18, 1961, was presented for Council consideration. Employment Approved On motion by Waite, seconded by Stewart, Council approved the employment of Mrs. Johnson, and directed the Clerk to read Resolution #1518. Motion carried. Reso . #1518 The Clerk read Resolution #1518 - "A RESOLUTION OF THE CITY OF HUNTINGTON BEACH EMPLOYING VIRGINIA L. JOHNSON AS INTERMEDIATE TYPIST CLERK IN RANGE 26, STEP 'C', EFFECTIVE SEPTEMBER 18, 1961." Reso. #1518 Adopted On motion by Waite, seconded by Stewart, Resolution #1518 was passed and adopted by the following roll call vote: Ayes: Councilmen: Wells, Lambert, Stewart, Waite, Gisler. Noes: Councilmen: None Absent: Councilmen: None Property Sale for Taxes A communication from the County Tax Collector stating the intention of the County to sell property within the City of Huntington Beach for taxes, and inquiring whether the City objects to the sale was presented for Council consideration. No objections On motion by Lambert, seconded by Waite, the Clerk was directed to notify the County Tax Collector that the City had no objection to their proceeding with the sale of the property within the City. Motion carried. Lifeguard Services An agreement between the City and the County of Orange covering Lifeguard Services for the fiscal year 1961-1962 was presented for Council consideration. Lifeguard Services On motion by Lambert, seconded by Stewart; Accepted .� Council accepted the agreement between the City and the County covering Lifeguard Services for the fiscal year 1961-1962 as presented, and directed the Mayor and City Clerk to execute same on behalf of the City. Motion carried. -7- (9-18-61) Page #8 - Minutes, September 18, 1961 Opening of Mayor Gisler announced that this Sealed Bids was the date and time set for the opening of sealed bids for the construction of Edinger Avenue from Highway 39 to 400 feet East of Golden West Street, and directed the Clerk to proceed with the opening. Bids Opened Bids were opened by the Clerk and tabulated by the City Engineer and City Attorney as follows: Sulley Miller, Orange, Calif. $421441.65 R. J. Noble, Orange, Calif. $41,113.00 Warren - Southwest, Torrance, Calif. $50,481.08 Cox Bros., Stanton, Calif. $443,571.45 Fred Crody, Santa Ana, Calif. $44,769.75 Bids Referred to On motion by Stewart, seconded City Engineer and City Attorney by Waite, the bids as tabulated by the City Clerk were referred to the City Engineer and the City Attorney for checking as to form, amount, and compliance with specifications. Motion carried. Civilian Defense The City Administrator read a Activities communication from Fire Chief Higgins, presenting a report on Civilian Defense activities from the Huntington Village area. He informed the Council that a meeting had been held by a group from Huntington Village on the previous Sunday afternoon; that several Councilmen and City Officials were in attendence, and that they had been questioned at length about policies of the City regarding Civilian Defense. Fire Chief Higgins addressed the Council and informed them that as Assistant Director of Civilian Defense, he was interested in ascertaining whether Council wished to enter into a stronger Civilian Defense Program, or to continue on the same basis as they had been. He discussed what funds the Council uDuld need to appro- priate to obtain certain preliminary supplies, literature, etc. if the tempo of the Civilian Defense Program were to be stepped up. -8- (9-18-61) 497 Page #9 - Minutes, September 18, 1961 Councilman Waite asked Chief Higgins for a recommendation on the amount of money necessary to start this program, and questioned the City Administrator on the availability of funds for supplies and research. Mr. Miller stated that he thought three hundred dollars would be sufficient to start the program, and that this amount was available for use. Referred to City Admin. On motion by Lambert, seconded by Wells, and. Fire Chief the City Administrator and the Fire Chief were directed to study the amount of money needed to get the pro- gram into operation and prepare an Ordinance appropriating funds for this project; and the Planning Commission be directed to make a study.of requirements and regulations necessary for the installa- tion of Fall -out Shelters. Motion carried. Mr. Allen Miller Mr. Allen Miller, 16372 Saratoga Lane, City, addressed the Council and commended them for taking prelimi- nary steps in this matter. Salary Survey The City Administrator reported on a salary survey which he had been directed to make by the Council, and stated that with a few exceptions, a one range increase for all employees was required to bring the City's classifications on a par with those of other communities in Orange County. Mr. Miller informed the Council that a one range increase for all employees would amount to approximately fifty thousand dollars, and a two range increase would be approximately ninty-nine thousand dollars. Ord. #871 Ordered A motion was made by Lambert, seconded by Read Wells, that the pay increases, as recommended by the City Administrator, be granted to all City employees, and directed the Administrator to read Ordinance #871. Motion carried. Intermediate Account The Clerk informed the Council that there Clerk had been an inequity existing since the last general salary increase in the classification of Intermediate Account Clerk, which was presently being carried in a Class 26, the -9- (9-18-61) 498 Page #10 - Minutes, September 18, 1961 same as an Intermediate Typist Clerk. He stated that the duties and requirements for an Intermediate Account Clerk would merit a one step higher range than the Intermediate Typist Clerk. Int. Acct. Clerk On motion by Lambert, seconded by Wells, the Range Increased Clerk was directed to increase the range of the Intermediate Account Clerk to Range 28 in the salary Ordinance before the same was read. Motion carried. Ord. #871 The Administrator gave Ordinance #871 a First Reading first reading in full - "AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH AMENDING SECTIONS OF ARTICLE 159 OF THE HUNTINGTON BEACH ORDINANCE CODE RELATING TO SALARY RANGE AND CLASS TITLES." On motion by Waite, seconded by Lambert, Promotions Mr. Samuel E. Ferguson be promoted to Assistant Building Inspector, Range 42, and that based on his quali- fications and experience it is to the public interest that he be assigned the third step in the Range; that Mr. Thomas Bushard be promoted to Park Maintenance Supervisor, Range 34, Step C; that Mr. Henry Hartge be promoted to Assistant City Engineer, Range 48, Step B; that Mrs. Helen R. Axton be promoted to Principal Clerk, Range 30, Step F; that Mr. Donald W. Kiser be promoted to Senior Civil Engineer- ing Assistant, Range 40, Step C; that Mr. Millard Plate be promoted to Senior Construction Inspector, Range 38, Step B; and that Mr. Charles Stafford be promoted to Construction and Maintenance Super- visor, Range 38, Step C; all promotions to be effective October 1, 1961. Motion carried. -12- (9-18-61) 01 Page #13 - Minutes, September 18, 1961 Service Pins The City Administrator presented to the Suggested Council the matter of purchasing and awarding service pins for the employees of the City based on five, ten, twenty and thirty year periods. Purchase of Service On motion by Wells, seconded by Waite, Pins Authorized Council authorized the purchase of service pins by the Administrator and Purchasing Agent, the same to be dis- tributed according to seniority and also to be given upon retirement of employee. Motion carried. Temp. Housing for The City Administrator asked the Council Municipal Court whether they were in agreement on the pro- posal to use a room at the Public Library as a temporary housing for the new Municipal Court. A motion was made by Lambert, seconded by Wells, that the Administrator and City Attorney be authorized to negotiate an agreement with the County of Orange for the use of rooms in the Public Library as a temporary Municipal Court. Motion carried Howard Robidoux On motion by Wells, seconded by Lambert, action on a letter from Mr. Leonard D. Moody, Attorney for Howard Robidoux be continued until the next meeting, and referred -to the Administrator, Attorney, and Chief of Police for study. Motion carried. City of Seal Beach The City Engineer presented a request from Request the City of Seal Beach for the use of the City's sewer routing equipment for a test. Engineer Wheeler informed the Council that they were anticipating purchasing equipment, and would like to -try that which Huntington Beach has. He stated that it would be agreeable with his department for use on a Saturday, providing it was operated by our City Personnel who would be paid by the City of Seal Beach. -13- (9-18-61) 2 Page #14 - Minutes, September 18, 1_961 City of Seal Beach On motion by Stewart, seconded by Wells, Request Granted the City of Seal Beach was granted use of the City's sewer routing equipment on a Saturday agreeable to both Cities; the same to be operated by Huntington Beach personnel with reimbursement for salary to be made by the City of Seal Beach; and R the transaction to be subject to the Engineer's approval. Motion carried. Adjourned Meeting The City Engineer informed the Council that Requested for Sealed Bids he had checked the bids which had been pre- sented for the construction of Edinger Avenue from Highway 39 to 400 feet East of Golden West Street, and had found that the bond of the low bidder lacked one signature, and that he felt this would be straightened out by a phone call the next day. He recommended to the Council that they should not wait until the next regular meeting for the award of the bid, but hold an adjourned meeting for this purpose. Payroll Register for On motion by Wells, seconded by Waite, September 8, 1961 Approved the Payroll Register for September 8, 1961 was approved on recommendation of the Finance Committee. Motion carried. Warrant Register On motion by Waite, seconded by Wells, Approved the Warrant Register was approved on re- commendation of the Finance Committee. Motion carried. Meeting Called for Mayor Gisler called a meeting of the Council October 2. 1961 as a committee of the whole for Monday, October 2, 1961 at 7:00 o'clock A.M., for discussion purposes.
