MINUTES: On motion by Stand and seconded by Letson, the 'Minutes of the Huntiraton Beach Planning Commission meeting of September 6tn, 1961, and Minutes of Special Planning Commission meeting of September 13th, 1961, as transcribed and mailed by the Secretary were accepted as mailed. TENTATIVE TRACT MAP NO 4305 Number of Lots: 290 Subdivider: K. 14. Koll Construction Co. Total Acreage: 80± Engineer: Voorheis-Trindle-Nelson, Inc. Located at the northeast corner of Brookhurst Street and .orktown Avenue, and legally described as being a proposed subdivision of a portion of the to z of the M4 4 of Section 5-6-10 SBB c M. The Secretary read a report which pointed out the subdivision problems in the Talbert Valley and the one major problem of irritation of farm lands by the Talbert Irrigation District with undisinfected sewer effluent. The Health Department has reported that the irrigation presents a disease transmission hacard and they cannot recommend approval of a subdivision within or adjoining the district. Frank Richardson, of Voorheis- Trindle-Nelson, Inc., agent for the subdivider, addressed the Commission and questioned Note ;'3. He stated that Brookhurst Street will be improved by the subdivider only if the City will acquire the Edison Co. right-of-way. 383 Page #2 Minutes - H. B. Planning Commission Tuesday, September 19th, 1961 The Secretary pointed out that the Edison Co. in the past had gone along with the widening of Arterial'Highways. In case the Edison Co. did not agree, Note #3 could be modified. Frank Richardson further stated,'that he did not have any objections to the remaining• suggested conditions. Commission discussion was held. A MOTION WAS MADE BY LETS014 AND SECONDED BY WORTHY TO APPROVE THE DESIGN AND LAYOUT OF TENTATIVE TRACT NO 4305 UPON THE FOLLOWING CONDITIONS: 1. The revised layout dated September 17th, 1961 shall be the approved map. 2. A 6 ft. chain link type fence shall be constructed along both sides of the Edison Co. right of way. 3. Brookhurst Street shall be improved to City Standards across -the Edison Co. right of way. 4. The walkway to the school site shall be fully improved and a masonry wall 6 ft. high shall be constructed along each side of the walk except where abutting the front yards of adjoining lots where such wall shall not exceed 42 inches. 5. No portion of this tract shall be recorded until such time as further approval by the Planning Commission is secured certifying that a solution has been found to the problem of a public health hazard due to irrigation of nearby farm lands with undisinfected sewer effluent. 6. The revised tentative map received September 12th, 1961, shall be the approved map. 2. A drainage easement to the south or west from'the proposed commercial site shall be provided if necessary. 3. The dedication and improvement of Golden West Street and Edinger Avenue shall include that portion designated as proposed commercial site. 4. A soil test report by an approved soils engineer shall be submitted to the City Engineer prior to recordation of any portion of the tract and all portions of the land not satisfactory for building shall be excluded. 5-. Senior Design_ Engineer, Bill Hartge, pointed out that Lot "A" was not adequate for a pump station since it was only 3500 sq. ft. and that Lot No 79 or Lot No 80 should be designated as a pump station site, lot size being 6000 sq. ft. The Secretary read the report of the Subdivision Committee recommending that the Planninj Commission approve only the design and layout of the tract and such time as the health problem is solved, the tract should be -considered again to'complete the tract approval. Dan Parton, 9f Vanpuard.Construction Co.,,addressed the Commission, and .stated that he objects only to requirement of Note ,�4 regarding relocation of a school site. He stated that the.subdivider did have approval of a previous Pap with the school site -as indicated. He also stated that the company has entered into escrow, based on the approved map and does not feel that the school site should be changed after a tentative map has been approved. Commissioner Stand than requested the Secretary to read the.letter submitted by -the Fountain Valley School -District, statini- that the proposed school site of 6.8- acres, located west of the flood channel, was•not satis- factory for their needs.. Therefore the request is to locate a full 15 acres school site east of said channel. Planning Commission Tuesday, September 19th, 1961 Rev.•J. D. Andrews, pastor of the Baptist Church, 8312 Kiner Drive, Huntington Beach, addressed -the Commission, and stated that the church board surveyed the area and found that there will be a great need for a church site in the general area, since there are number of tracts under construc- tion, and he feels that the.proposed church location is favorably situated within the vast growing development. Richard V. Hearons, 18391 Patterson Way, Huntington Beach, addressed the %ommission, and questioned the access to the church, otherwise stated that he had no objections to the proposed church site. Mr. W. T. Agajanian of Los Angeles, addressed the Commission, and protested the proposed church site on the -rounds that it would be detrimental to his property, because in near future there will be a shopping center constructed, and that it would not be'a suitable location for a church site. Mrs. Martha Holt, real estate agent, addressed the Commission and stated that -she feels that the proposed church site would._be a great asset to the community. There being no further comment, the hearing was closed. Commission discussion was held at length. A MOTION WAS MADE BY MILLER AND SECONDED BY WORTHY TO APPROVE CONDITIONAL PERMIT CP # 110 WITH THE FOLLOW- ING CONDITIONS: 1. Ellis Avenue shall be dedicated to a width of 42 ft. from centerline in accordance with the Master Plan of Hi-hways. 2. Ellis Avenue shall be improved with sidewalk, curb, ;utter and paving in accordance with City Standards. 3. The south half of La Palma Avenue shall be dedicated and improved with a turn around meeting the approval of the City Engineer. 4. Planning Commission Tuesday, September 19th, 1961 Mr. Lewis Douglas, developer, addressed the Commission and stated that the Harbour Marina is only -a tentative plan and it is only a form of land use. The Secretary pointed out two proposed school sites within the proposed Huntington Harbour. Mr. Harold Pedersen, Superintendent of Ocean View School District, addressed the Commission and stated that they were studying the plans and that at least two school sites will be required. Mr. Wilson Felps, 1311 Raymond Avenue, Fullerton, addressed the Commission and questioned the location of the proposed school site and the distance of the flood con- trol channel. He further questione& tre street width south of Smeltzer Avenue and the traffic problem in the area. Mr. Douglas stated that the road will be brought off the boundary to allow better traffic circulation within the development and.would-discourage the traffic going thru the'M'ariha.— He also stated that better locations will be worked out for the proposed school sites. 'JEff Millet, addressed the Commission and asked if the adjacent property could be considered with the proposed land use of Huntington Harbour. Chairman Bazil stated that this was a study of the Marina only and adjacent property could not be considered as part of that study. Every consideration will be given for the reasonable location of shelters in front or side yards.' 2. The location of fallout shelters in required front or side yards to be considered by a variance application_; 3. Fallout shelters at reasonable lodations within required front or side yards will be favorably considered upon the following conditions: (a) All portions of the shelter shall be completely below the grade of the surrounding yard existing prior to construction of such shelter except for the access -way and the necessary vents. (b) A11•portions of the shelter in front of a building or in the exterior side yard of a corner lot shall, except for the access -way and vents, be covered with at least'12 inches' of earth and landscaped similar to the surrounding yard. (c) The access --way shall not exceed 42 inches in length or width and shall not project more than 18 inches above the surrounding grade. (d) Vents shall project not more than 36 inches above the surrounding -rade. - (e) Shelters"shall be designed, constructed and used only for emergency protection of life. AREA VARIANCE: AV #314 The Secretary read a communication Applicant Walter Corbin from the City Council referring AV #314 back to the Commission for further consideration. The Secretary read letter submitted by Pacific Sands Co., setting forth reasons for consideration of granting Area Varlance #314. The above mentioned variance was heard by the Commission=on August 15th, 1961, at which time it was unanimously denied-, since the ordinance requires that certain findings of fact must be made for approval of -an application and that no justification for approval was apparent. • An appeal by Mr. James F.
