Monday, October 9, 1961
The regular adjourned meeting of the City
Council of the City of Huntington Beach was called to order at 7:30
o'clock A.M. by Mayor Ernest H. Gisler.
The Pledge of Allegiance was -given by all
present in the Council Chamber.
Councilmen Present: Wells, Lambert, Stewart, Waite, Gisler
Councilmen Absent: None
City Attorney A letter.which had been handed to the City
Terminates Duties
Administrator by Charles A Bauer, was read
to the Council, stating his intention to terminate his duties -as City
Attorney on Friday, October 20th, 1961 at 2:00 o'clock P.M.
Possible Attorneys Communications from Mr. James D. Plunkett,
Considered
Mr- Ralph Highsmith, and Mr. John Brunner
requesting consideration by the Council in their selection of a City
Attorney to fill the unexpired term of Mr. Bauer, were presented for
Council consideration by the Clerk.
Attorneys The Clerk informed the Council that he had

contacted all attorneys residing within the
City Limits of Huntington Beach regarding the position to be filled.
He stated that Mr. Ray Overacker had informed him that he -would be
willing to accept the position for the unexpired term, if Council felt
the need of his services, but that he would not be a candidate for
re-election at the next City election.
Mrs. Sperry Not The Clerk stated that he had talked with

Mrs. Sperry, who also resides within the
City, and that she had informed him that she was not eligible for
consideration for the position, inasmuch as she has not practiced
law for the time required by the City Charter..

past two years, and the backlog of work accumulated for the legal
department.
James D. Plunkett On motion by Stewart, seconded by Waite,
Appointed City Atty.
Mr. James D. Plunkett be appointed to fill
the unexpired term of City Attorney vacated by termination of
Charles A. Bauer, to be effective October 20th, 1961 at 2:00 o'cloct
P.M.
The motion was passed by the following
roll call vote:
Ayes: Councilmen: Wells, Lambert, Stewart, Waite, Gisler
Noes: Councilmen: None
Absent: Councilmen: None
Mayor Gisler declared the motion carried.
Legal Secretary The Council then held some discussion
No Action Taken
concerning the position of Legal Secretary.
The fact was brought out that she is a full time City employee. No
action was taken.
Asst. City Atty - On motion by Stewart, seconded by Lambert,
Referred to City Aamin.
the City Administrator was authorized to
proceed in the matter of procuring an Assistant City Attorney.
Motion carried.

Planning Dept. City Administrator Miller read a communication
Personnel deeds
from the City Planning Director regarding per-
sonnel needs in the Planning Department. Mr. Miller then discussed
with the Council the volume of work being handled by that department,
and informed them that it was impossible for them to give proper con-
sideration to the various details coming before them. He stated that
this inability to give proper consideration to items of Planning would
eventually have a detrimental effect on the future of the City.
Ord. #874 The Clerk gave Ordinance No. 874 a first
First Reading
reading in full - "AN ORDINANCE OF THE CITY
OF.HUNTINGTON BEACH RELATING TO SALARY CLASSIFICATIONS AND ALLOCATIONS:
AMENDING SECTIONS OF THE HUNTINGTON BEACH ORDINANCE CODE."
Huntington Driftwood The City Administrator informed the Council
Corp. - Ext. of Time
that the extension of time granted the
Huntington Driftwood Corporation for the filing of plans, specifications,
and performance bond with the City, expired on October Sth, 1961. He
stated that they were still unable to proceed with their construction
because the State Highway Department had not approved final plans for
the change in the proposed freeway.
Right -of -Way Meeting Mr. Miller stated that a meeting had been

arranged with the Right -of -Way Representatives
of the State Highway Department for Friday, October 13th, and that if
negotiations are completed at this meeting, the State Highway Depart-
ment may approve the amended Freeway Agreement.
Huntington Driftwood On motion by Waite, seconded by Stewart,
Corp. - 60 Day Ext.
Granted the Huntington Driftwood Corporation were
granted a. sixty day extension for the filing of plans, specifications,
and performance bond with the City. Motion carried.
Aleetin. Adjourned On motion by Waite, seconded by Wells, the
regular adjourned meeting of the City Council of the City of Hunting-
ton Beach adjourned.
