TENTATIVE TRACT MAP NO 3849 - REVISED - Number of Lots: 569 Subdivider: A. L. Gindling Total Acreage: 116.8 Engineer: Millet, King & Assoc. Located at the northwest corner of Dolsa avenue and Edwards Street, and east of.Sprin dale Street, and le -ally described as bein- a proposed subdivision of a portion of the W z of Section 10-5-11 SBB & M. The Secretary read the report of the Subdivision Committee recommending conditions for.approval of the revised'tract. Commission discussion was held. A MOTION WAS MADE BY WORTHY AND SECONDED BY STt-.1`TG TO APPROVE TENTATIVE TRACT MAP NO 3849 UPON THE FOLLOWING CONDITFIONS 1. The revised Tentative Map dated October 17th, 1961, shall be the approved tentative map. 2. Located approximately 330 ft. north of Utica Street, east of Florida Avenue, and approximately 660 ft. south of Yorktown Street. Legally described as beinG a proposed subdivision of a portion of ;lock 2207 of the East Side.Villa Tract. The Secretary read the report of the Subdivision Committee recommending condition for approval of the tract. A letter submitted by the Oran;e County Health Department was read by the Secretary, that this tract lies approximately 132.0 ft. west of farm lands of the Talbert Irrigation District upon which settled, undisinfected sewa-e can be distributed for irri-ation and soil leaching purposes. It was noted however that several businesses and Beach Blvd. are intervening and there should be no hazard to the tract. Commission discussion was held. Located at the northwest corner of Slater Avenue and Newland Street, and legally described as being a proposed• subdivision ofa portion of the S 2 of \the N14 4 of Section 25-5-11, and a-lso being a revision of• a portion of approved Tract No 3862. The Secretary read a letter submitted by Millet, King & Assoc., representing the -subdivider, requesting one year extension -of time for recording the final map. The Subdivision Committee report was read by the Secretary recommending conditions for approval of the revised tentative map. Attorney Dale Heinly questioned the condition, that the proposed school site shall be included as a numbered lot in the tract and after explanation agreed that the conditions were acceptable. • Commission discussion was held at length. A MOTION WAS MADE BY STANG AND SECONDED BY MILLER TO APPROVE -THE REVISED TENTATIVE TRACT MAP NO 4 009 UPON THE FOLL014ING CONDITIONS: 1. The proposed school site shall be included as a numbered -lot in the tract.. 2. The dedication and improvement of -Highway V39 and Holland Drive shall be included in the tract within the proposed Commercial area. 3. A soil -test report by an approved soils engineer shall be submitted to the City En-ineer prior to recordation of any portion of the tract and all portions of the land not satisfactory for building shall be excluded. -3- 427 Pave #4 Minutes - H. Lyon Total Acreage: 73.4 Engineer: r1i11et, King & Assoc. The Secretary read letter submitted by Millet, King Assoc., representing the subdivider, request- ing an extension of one :year fbr.recording Tract No 3903, located at the southwest corner of Banning Avenue and Bushard Street. The Secretary pointed out -that there were no thanes in circumstances in the area which woul3 Justify any different action by the Commission than that taken by the'Commission in disapprovan.- the original tentative map on September 20, 1960. Ccmmissioner Kaufman asked that the original findings for disapproval of the tract be read. The Secretary read the findings and letters submitted by the Health Department dated January 11, 1961, and February 21, 1961, which pointed out the pro- ximity of the tract to open fields subject to irrigation with settled, undisinfected sr=wage and to the open slud e dryin- beds of the treatment' plant. Also noted was the location of the tract in relation to the ;;eneratin- slant, a lar-c• rotary mud dump and County Disposal Station. Attorney Dale Heinly, representing the subdivider, stated that they have been endeavorin-; to solve -4- Page #5 Minuted - H. B. Planning Commission Tuesday, October 17, 1961 the drainage problem with the Engineerin-.Department and the Flood Control District, and in addition the engineers have been designing a pump which would take care of the runnof water. Attorney Heinly further stated that it is a matter of right to -approve the time extension since the' proposed tract lies within an R-1 Zone. Mr. Heinly was informed that at the time the original tentative map'was filed the area was included in a change of zone proceeding for an M-1-Zone. The Secretary noted that since the time the tentative map was approved by the Council conditions have changed in the area by further indtistrial•development and zoning and requests for additional industrial'zone requests. Commission•.di'scussion was held at length. A MOTION WAS MADE BY WELCH AND SECONDED BY KAUF,tAN TO RECOMMEND DENIAL OF EnTENSION OF TII,,r TO THE CITY COUNCIL BASED ON THE FOLLOWING FINDINGS: 1. The area had been proposed for industrial zoning. 2. The general area is not condusive toward good residential development because of the general drainage problem. . 3. The operational nuisances emanating from the generating station. ' 4. The hazards of.the nearby mud dump. 5. The•existance of the County refuse dump. 6. The operational nuisances of the Sanitation District treat- ment plant. 7. The condition of undeveloped arterial highways in the lower Talbert Valley. I ,8. The tract lies within 660 ft. of fields irritated with undisinfected sewer effluent. 9. The tract is less than 1000 ft. from open sludge drying beds of the treatment plant.' 10. The area is rapidly changing to more industrial in character due to industrial development and industrial zoning. Mr. Fred i:auldin, 408 llth Street, 1luntirgton Beach, addressed the Coriwnission and stated that he had no objections to granting; of the proposed dance studio. A,rs. Elisabeth J. Bushaw, 1624 W. Washinston Avenue, 1:ortebello, California, addressed the Commission and stated that she was opposing the proposed -variance, because the area was zoned residential and she felt, that a dance studio is a commercial use which shauld not be allowed. Mrs. Lai:genbeck, president of the Woman's Club, addressed the Commission and stated that it was the police of the Woaian's Club to rent their buildinj to different 3roups and organizations only under very strict contract, that the building will be ':-lept in order and not be detrimental to the neighborhood. There being no further comment the hearing was closed. The hearing was opened to the audience, Mr. King, 8152 Brush Avenue, Huntington Beach, addressed the Commission and stated that the 15 ft. rear yard setback was not sufficient, because it would put the structure practically into the neighbors back yard. He -further stated that the trenches have been already dug and they are only 10 ft. from the rear -property line. He stated that this was all done prior to applyinl- for variance. Mr. Dale Scheinost, representin- the applicant stated that he was not aware of the fact that the foundation trenches had been duo -and that he will personally inspect the foundation and correct any errors made without the knowledge of the applicant. Mrs. Ding, 8152 Brash Avenue, Huntin-ton Beachf addressed the Commission and stated that the two story buildin;s which are constructed in the area are practically looking into the neighbors yards. Mr. Dale Scheiriost stated that there are no windows on the back of the second story portion of the building. There being no further comment, the hearing was closed. Commission discussion was held. The Secretary read letter of protest submitted by Mr. and Mrs. A. H. Korb, 12727 Sherman Way, North Hollywood, California. The hearing was opened to the audience. Mr. Wm. Guilliams, 406 W. Olive Avenue, Monrovia, California, addressed the Commission and -13- I 437 Page #14 Minutes - H. B. Planning Commission ' Tuesday, October 17, 1961 protested the proposed variance. He stated -that he now lives within one quarter mile of an animal hospital in Irionrovi= and stated the noise of barking dogs is very disturbin- especially thru-the night hours. He further stated that he has built 8 units for rental purposes near to the proposed animal hospital , and that he will have a difficult time rentin- the buildin;s. Mr. Carlos Reeves, 213 Main Street, Huntington Teach, addressed the Commission and stated that he was in escrow to buy -property north of the proposed animal hospital and he was protesting on grounds that the surrounding property would devalue. Mr. R. B. Yarrow, 605 Bluff Road, Montebello, California, addressed the Commission and stated that he ownes three lots to the south of the proposed animal hospital and also obiected to the application. Dr. F. H.•Meisin-er, applicant, addressed the Commission, and stated that he ownes an animal hospital in Orange, situated within residential area and has never had any objections from the surrounding nei;hborhood. tie stated that the proposed animal•hospital would be sound -proof and no dogs would,be kept outside over -night. Mr. Theodore Cooper, 7916 Stark Street, Huntin-ton Beach, addressed the Commission and protested to the proposed variance. Mr. llexander Teliszcza?:, 16221 Beach Blvd.; addressed the Commission, and also protested to the proposed variance, because of the noise of the barking dots. There being no further comment, the hearing was closed. Commission discussion was held at length.
