Letson, the Minutes of the Hunting- �
ton Beach Planning Commission of October 17, 1961, and October
18, 1961, as transcribed and mailed by the Secretary were
accepted as mailed.
TENTATIVE TRACT MAP NO 4027
No of Lots: 13 Subdivider:" Tim Talbert
Total Acreage: 2.96 1Engineer: John Toups
Located north of Ellis Avenue and
660 ft east of Beach Blvd., and legally described as a
portion of the SE 4 of the SW 4 of the NW 4 of Section 36-5-11.
The Secretary read a letter submitted
by John Toups, Consulting Civil Engineer, representing the
subdivider, requesting a one year extension of time for
recording the final map.
The staff report was read by the
Secretary which recommended that if the requested one year
extension is approved, such approval be subject to the
following condition:
1. Sewage disposal shall be through a public sewerage system.
Chairman Bazil asked if there was a representative of the
subdivider in the audience. There being no one present,
Commission discussion was held. It was noted that the
tentative map had been originally approved with_dry sewers
to be installed since there was no sewer connection in the .
area. The Assistant City Engineer advised that plans are
underway for extension of a sewer line on Beach Blvd.

The Secretary read the report of the
Subdivision Committee recommending conditions for approval of
the tract.
Commission discussion was held. It
was noted that due to location of this tract adjacent to the
Talbert Irrigation District and the irrigation of the
adjoining property with undisinfected sewer effluent which
creates a hazard to the public health, complete approval of
this tract is not recommended. At such time as the health
problem is solved, the tract should be considered again to
complete the tract approval.
Mr. -Wally Freeman, subdivider,
addressed the Commission and stated that he did not have ob-
jection to the proposed conditions.

Located at the southwest corner of
Garfield Avenue and Bushard Street and legally described as
portion of the NE 4 of the NW 4 of Section 6-6-10.
The Secretary read the report of the
Subdivision Committee recommending conditions for approval of
the tract.
The -County Health Department, by letter
dated November 3, 1961, reports: "We -would like -to amplify our
letter of August 16, 1961, concerning Tentative Tract No 4304,
Huntington Beach, being a proposed subdivision consisting of
126 lots, located on the south-westerly corner of Bushard
Street and Garfield Avenue. Our prior letter stated that this
lies approximately a quarter of a mile north of farm lands of
the Talbert Irrigation District, upon which settled undisinfected
sewage is distributed for irrigation and soil leaching purposes.
On the basis of our experience with the irrigation project, it
is our opinion that the distance involved here will provide an
adequate degree of protection to residents of the proposed sub-
division under the irrigation methods to be practiced by the
members of the Talbert Water District."
Commission discussion was held at length.
A MOTION WAS MADE BY WELCH AND SECONDED
BY MILLER TO APPROVE TENTATIVE TRACT MAP NO 4304 UPON THE
FOLLOWING CONDITIONS:
1. This approval shall supercede the partial approval of the
Tentative Map by the Commission dated September 6, 1961.
2. The revised layout dated September 5th, 1961, shall be the
approved design,
3. The dedication and improvement of Garfield Avenue and Bushard
Street shall include the parcel designated as "not a part".
4. An additional 5 ft of right of way shall be provided along
the west boundary of the tract for flood control channel
purposes.
5. All standard subdivision requirements shall be complied with.

ZONE CASE NO 207 - Continued CHANGE OF ZONE, relative to pro -
Applicant - Teddy Oka
posed change of district boundary
and use classification from: A-1-Y General Agricultural District
as adopted by Interim Ordinance No 672 to M-2 Heavy Industrial
District.
The following parcels of real
property as submitted on the applicant's petition are described
herewith: Approximately 20 acres located on the east side of
Bushard Street, approximately 660 ft south of Hamilton.Avenue,
and legally described as the S 2 of the NW 4 of the SE 4 of
Section 18, T.6.S.1, R.10.W., SBB & M.
The hearing was reopened to the
audience; there being no comment, the hearing was closed.
Commission discussion was held
at length. It was noted that the Planning Commission held a
public hearing on the matter on August 15, 1961, at which time
there was one person who was opposed to the change. After con-
siderable discussion the hearing was continued to September 19,
1961.
On September 19, 1961, it was
pointed out to the Commission that the property was better
suited for M-1 zoning rather than M-2. The Commission then con-
tinued the hearing to October 3, 1961, for further study.
On October 3, 1961, a written
communication was received from a representative of the applicant
requesting another continuance to November 7, 1961. On November
7, 1961, the public hearing was held at which time there was no
one to speak for or against the change. After considerable
discussion, it was the concensus of the Commission that a lighter
industrial zone would be more suitable for the area than the
requested M-2 zone.

FOR THE FOLLOWING SPECIFIED REASONS:
1. It is the general feeling of the Commission that the area
should be zoned for light industry.
2. The heavy industrial uses permitted in the M-2 District
would be incompatible with those of light and more re-
strictive use.

Located west of Beach Blvd. and approximately 150 ft south of
Stark Street, and legally described as Lots 76 and 77, Tract
No 417, also known as 16201 Beach Blvd., Huntington Beach.
The Secretary read two communi-
cations from the City of Orange stating that they were personally
acquainted with the applicant, and each letter stated that it
was an asset to the neighborhood. Also read -was a letter from
the applicant.
The hearing was reopened•to the
audience.
Mr. William Guilliams, 406 West
Olive Avenue, Monrovia,•California, addressed the Commission
and protested the proposed variance. He stated that he now lives
within one quarter mile of an animal hospital in Monrovia and
stated the noise of barking dogs is very disturbing, especially
during the night hours.
Fire Chief Higgins stated that if
the proposed variance should be granted, to include a condition

that no dogs shall be allowed outside after 6:00 P.M., and not
before 8:00 A.M., because of many previous complaints in other
areas where animal shelters were existing.
The Planning Director
pointed out that this proposed variance is for an animal hospi-
tal of sound -proof construction which should make the business
quite acceptable to the neighborhood.
Commissioners Worthy and
Miller, who were appointed to inspect the applicant's existing
animal hospital in the City of Orange, stated that the noise
of animals on the premises was kept at minimum ana that the
animal hospital was well constructed'and sound -proof.' Com-
missioner Worthy further stated that they also -made inspections
in two other locations and found the animal hospitals very well
organized and generally not a nuisance to the neighborhood.
Where being no further
comment, the hearing was closed. Commission discussion was held.
A MOTION WAS MADE BY KAUFMAN
AND SECONDED BY WELCH TO APPROVE CONDITIONAL PERMIT NO Ill WII<-i
THE FOLLOWING CONDITIONS:
1.• No animals shall be allowed outside the sound -proof building
after 6:00 P.M., or before.8:00 A.M.
2. Solid panels shall be erected between outside.runs and the
proposed 7 ft masonry wall around the outside runs shall be
poured solid.
3. A 6 ft masonry wall shall be constructed across the rear of
the property.
4. Curbs, gutters, sidewalk and paving shall be constructed
along Beach Blvd. to City standards.

It was noted that this
application is another routine case of a subdivision sign to
be located on the tract property.
A MOTION WAS MADE BY LETSON
AND SECONDED BY MILLER TO APPROVE USE PERMIT NO 136 WITH THE
FOLLOWING CONDITIONS:
1. There shall be posted a $250.00 performance bond guaranteeing
removal upon expiration of Use Permit No 136.
2. A $250.00 bond for the requested sign shall be required to
be posted guaranteeing removal of the sign within one year
of the granting of this use permit, unless the City Council
at the end of one year agrees to extend the time. In the
event the specified sign is -not removed in accordance with
this use permit, the applicant shall forfeit bond and permit
the appointed agents of the City to enter the property and
remove all structures permitted under this use 'permit.
3. There shall be required a 100 ft setback from centerline
west of Edwards Street a;.55 ft setback of centerline north
of Edinger Avenue.

It was noted that the pro-

and the unenclosed covers were added to help "dress up" the
models. Since the tract has been sold out, the model homes are
being sold with the patio covers.

COMMUNICATION: ORANGE COUNTY PLANNING COMMISSION
The Secretary read a letter
submitted by the Orange County Planning Commission requesting a
recommendation from the Huntington Beach Planning Commission on
application for Use Variance UV #4859, for retail sales of milk
and dairy products at the existing dairy at the southwest corner
of Heil Avenue and Bolsa Chica Street.
The Secretary pointed out
that UV #4859 was approved by the.O.C.P.C. November 1st prior
to Huntington Beach Planning Commission meeting, therefore no
action need be taken by the Planning Commission.
A MOTION WAS MADE BY KAUFMAN
AND SECONDED BY LETSON. PLANNING COMMISSION ORDERED THE COM-
MUNICATION RECEIVED AND FILED.

COMMUNICATION: SOUTHERN CALIFORNIA PLANNING CONGRESS
The Secretary read a letter
submitted by the Southern California Planning Congress extending
an invitation to the Planning Commission to affiliate with the
Congress. Also included was the notice of their next meeting
to be held November 9, 1961, at the Disneyland Hotel.

The hearing was opened
to the audience; there being no comment, the hearing was
closed.
Commission discussion
was held at length. It was pointed out that Lots 58, 68 and
69, Tract No 4051, did not have an average of 20 ft rear
yard setback.
A MOTION WAS MADE BY
WELCH AND SECONDED BY LETSON TO APPROVE AREA VARIANCE AV #339
FOR LOTS NO 57, 70 and 71, AND NOT FOR LOTS NO 585 68 AND
69 FOR THE FOLLOWING REASON:
1. That the average of rear yard setback pertaining to Lots
No 58, 68 and 69 did not have an average of 20 ft.
