HomeMy WebLinkAbout1961-11-20IT MINUTES Council Chambers, City Hall Huntington Beach, California Monday, November 20, 1961 The regular meeting of the City Council of the'City of Huntington Beach was called to order at 7:30 o'clock P.M. by Mayor Ernest H. Gisler. The Pledge of Allegiance was given by all present in the Council Chamber. Reverend Loren Buelow of the Huntington Beach Lutheran Church gave the invocation. Councilmen Present: Wells, Lambert, Stewart, Waite, Gisler Councilmen Absent: None Charles L. Lyen - Mayor Gisler introduced Mr. Charles L. Introduced. Lyen, new Assistant City Attorney of Hunt- ington Beach, to the Council and audience. Police Report - On motion by Lambert, seconded by Stewart, Rec'd & Filed the report of the Chief of Police for October, 1961, was received and ordered filed. Motion carried. Commun. - H.B.Elem. A letter from the Superintendent of the School. -Vendors Huntington Beach Elementary School District regarding vendors selling merchandise to school children, together with a copy of a letter from the County Counsel regarding this matter, was presented for consideration of the Council. Ref. to City Admin. On motion by Waite, seconded by Lambert, the & City. Atty. communication was referred to the City Administrator and City Attorney for study regarding possible legis- lation to prohibit this sort of thing. Motion carried. Hagler Letter - The Clerk read a letter from Mr. & Mrs. A. Sidewalk Replacement M. Hagler, 905 12th Street, City, regarding replacement of sidewalk in front of their property. Ref. to City Admin. On motion by Lambert, seconded by Waite, & City Atty, the communication from Mr. & Mrs. Hagler was referred to the City Administrator -and the City Attorney for study and report. lotion carried. -1- (11-20-61) :i Page #2 - Minutes, November 20, 1961 Commun. - City of A letter from the City of Santa Ana, S.A.- Co.Fire Danp_er transmitting a copy of a proclamation adopted by their City Council, calling attention to the fire dan- ger within the County, was presented for Council consideration. City Atty. to Prepare On motion by Lambert, seconded by Wells, Similar Proclamation the City Attorney was directed to prepare a similar proclamation for issuance by the City. Motion carried. Commun. - Crest View A letter from Crest View School P.F.O. School P.F.O. - Req. To Sell At Parade requesting permission to sell coffee and popcorn at the Annual Christmas Parade, and a letter from the Kiwanis Club of Huntington Beach, also requesting permission to sell coffee at the parade, was presented for consideration of the Council. Crest View P.F.O. & On motion by Wells, seconded by Waite, Kiwanis - Permission Granted the Crest View School P.F.Q. and the Kiwanis Club of Huntington Beach, were granted permission to set up booths for the sale of coffee at the Annual Christmas Parade at locations designated by the City Administrator and Chief of Police. Motion carried. M.W.D. Letter - On motion by Waite, seconded by Lambert, Rec'd. & Filed a Letter from the Metropolitan Water District regarding the City's Declaration of Intention to pay a percentage of taxes derived from the M.W.D. area within the City, was received and ordered filed. Action carried. Camp Fire Girls - A letter from the Camp Fire Girls of Peanut Sale Request Orange County requesting Council permis- sion to conduct a peanut sale in downtown booths and door to door within the City from January 12th, through 29th, 1962, was present- ed for the consideration of the Council. -2- (11-20-61) Page #3 •- Minutes, November 20, 1961 Ref. To On motion by Waite, seconded by Lambert, the City-Admin. letter from the Camp Fire Girls -of Orange County was referred to the City Administrator for investigation, with direction that if the organization were local, they should grant the request, and if they were not a local organization, it would be denied. Motion carried. Public Hearing - Mayor Gisler announced that this was the day Reso. #1057 #216, and hour set for a public hearing on Reso- lution #1057 and #216 of the City Planning Commission, -recommending adoption of the SP-1 Special Zone (Cemetery) and Zone Case #216, and requested the Clerk to read the legal notice. The Clerk read notice of public hearing on Resolution #1057 and #216, as published in the Huntington Beach Ness on November 9th, 1961, setting the hour of 7:30 o'clock P.M., or as soon thereafter as possible on Monday the 20th day of November, 1961, in the Council Chambers of the City Hall, Huntington Beach, California, as the time and place for a public hearing for the purpose of con- sidering Resolution of Intention #1057 of the City Planning Commission, recommending adoption of a new zone district to be designated SP-1 Special Zone (Cemetery); and Resolution of Intention on Zone Case #216, relative to a proposed change of zone from R-4-K Suburban Res- idential District, as adopted by Interim Ordinance #668, to: SP-1 Special Zone (Cemetery) on property located at the northeast corner of Talbert Avenue and Beach Boulevard. Hearing 22ened Mayor Gisler declared the hearing open. The Clerk read the transmittal from the City Planning Director, together with Resolutions #1057 and #216 of the City Planning Commission, and informed the Council that he had received no written protests to the matter under consideration. Planning Director Planning Director Warner explained the Warner reasoning of the City Planning Commission in recommending the adoption of the Special Zone (Cemetery), together with approval of Zone Case #216. -3- (11-20-61) Page #4 - Minutes, November 20, 1961 Dr. David Payne Dr. David Payne of Talbert Road, City, addressed the Council and informed them of the reasons for the request for establishment of this Special Zone and the Zone Case. Hearing Closed There being no protests filed, either oral or written, against Resolutions #1057 and #216, Mayor Gisler declared the hearing closed. Reso. #1057 & #216 On motion by Waite, seconded by Stewart, Approved _ Council approved the recommendation of the Planning Commission on Resolutions #1057 and #216, and -dir- ected the Clerk to read Ordinance #880. Ord. #880 - The Clerk gave Ordinance #880 a first First Reading reading in full - "AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH AMENDING THE HUNTINGTON BEACH ORDINANCE CODE RELATING TO THE SPECIAL ZONES AND ADDING NEW SECTIONS THERE- TO.K Public Hearing - Mayor Gisler announced that this was the Reso. #1058 day and hour set for a public hearing on Resolution #1058 of the City Planning Commission, recommending adoption of the "'RA" Residential Agricultural District, and re- quested the Clerk to read the legal notice. The Clerk read notice of public hearing on Resolution #1058 as published in the Huntington�Beach News on November 9th, 1961, setting the hour of 7:30 o'clock P.M., or as soon thereafter as possible, on Monday, the 20th day of November, 1961, in the Council Chambers of the City Hall, Huntington Beach, California, as the time arid place for a public hearing for the purpose of considering a Resolution of Intent #1058, proposing to amend Article 932 of the Huntington Beach Ordinance Code, by adopting a new district to be,designated "RA" Residential Agri- cultural District. Hearing 0 ened The hearing was declared open by Mayor Gisler. -4- (11-20- 61) T-4 Page #5 - Minutes, November 20, 1961 The Clerk read the transmittal from the City Planning Director, together with Resolution #1058 of the City Planning Commission, and informed the Council that he had received no written protests to this Resolution. Hearing Closed There being no protests filed, either oral or written, against Resolution #1058, May Gisler declared the hear- ing closed. Reso. #1058 On motion by Waite, seconded by Stewart, Approved Council approved the recommendation of the City Planning Commission on Resolution #1058, and directed the City Clerk to read Ordinance #881. Motion carried. Ord. #881 - The Clerk gave Ordinance #881 a first First Reading reading in full "AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH AMENDING THE HUNTINGTON BEACH ORDINANCE CODE BY AMENDING THE TITLE AND SECTION AND ADDING SECTIONS TO ARTICLE 932." Public Hearing - Mayor Gisler announced that this was the day Term. of Drilling Bonds and hour set for a public hearing on Term- ination of Drilling Bonds on wells: Keegan A, Murphy -Goetz #3, Donna #4, and Sarrabere #7, as requested by Diliavou and Cox, re- presenting the owners. He then requested the Clerk to read the legal notice. The Clerk read notice of public hearing on Termination and Cancellation of Drilling Bonds as published in the Huntington Beach News on November 9th, 1961, setting the hour of 7:30 o'clock P.M., or as soon thereafter as possible, on Monday, the 20th day of November, 1961, in the Council Chambers of the City Hall, Huntington Beach, California, as the time and place for hearing protests against such termination. Hearing Opened Mayor Gisler then declared the hearing open. There being no protests filed, either oral or written, against the termination of the bonds, Mayor Gisler declared the hearing closed. Bonds On motion by Stewart, seconded by Lambert, Terminated Council directed that St. Paul Fire and Marine Insurance Company bonds #991006, #991313, #991380, and #991513, be terminated in compliance with Section 2427.4 of the Huntington Beach Ordinance Code, and the owners.notified.. Motion carried. Mr. W.N.Hoshor - Under oral communications, Mr. W. N. Addressed Council Hoshor, 2347 Josie Street, Long Beach, Field Manager for the Fuller Brush Company, addressed the Council and requested their interpretation of the application of the Green River Ordinance in regard to solicitors in the City. The Clerk informed Hoshor of the applic- ation being made of the Ordinance regarding door to door selling. Mr. Hoshor was informed that he might receive a copy of the Ordin- ance if he would come to the Clerk's office. Letter - Beach The Clerk read a letter from the Beach Blvd, Assn, Boulevard Association regarding numbering on the west side of Beach Boulevard. Mrs. Lorraine Webb Mrs. Lorraine Webb, secretary of the Beach Boulevard Association, addressed the Council to inform them of the difficulties which were being encountered by merchants in that area, Planning Director Planning Director Willis Warner explained Warner to the Council the change which had been made and the manner of notification of the residents in the number- ing of their places of business and homes. Mr. James Satterwhite Mr. James Satterwhite, President of the Beach Boulevard Association, addressed the Council regarding the matter. -6- (11-20-61) r Page #7 - Minutes, November 20, 1961 Delay Granted In On motion by Waite, seconded by Wells, New Numbering merchants on the west side of Beach Blvd. were granted a six month period before making the new numbers effect- ive, with the stipulation that new businesses use both the old and new numbers. Motion carried. Councilman Waite Councilman Waite requested, and was grant - Leaves Meeting ed permission to leave the meeting. Opening of Sealed Bids Mayor Gisler announced that this was the Assess. -Dist. No. 6101 day and hour set for the opening of sealed bids and proposals for the improvement of the streets in Assessment District No. 6101 in the City of Huntington Beach, California, as described in Resolution of Intention #1531, adopted by the City Council on October 16th, 1961, and requested the Clerk to proceed with the opening. Council Recessed Mayor Gisler called a recess of the Council at 8:35 o'clock P.M. Council Reconvened Council was reconvened at 8:50 o'clock P.M. by the Mayor. Purch. Agent. - The Purchasing Agent presented informal Informal Bids on Ton Pickup bids for one (1) half -ton pickup truck for the Parks Department, as follows: Name 1. Public Hearing Ordered On motion by Stewart, seconded by Lambert, Reso. J207 Council ordered a public hearing for Monday, December 4th, 1961, at 7:30 o'clock P.M., or as soon thereafter as possible, on Resolution #207 of the City Planning Commission, recommending denial of Zone Case #207, and directed the Clerk to publish notice of same. Extension of Time On -motion by Lambert, seconded by Wells, Authorized Council approved the Planning Commission recommendation; and authorized an extension of time for Tract #4027, with conditions as stipulated. Motion carried. Request - Subdiv. The Clerk read a transmittal from the -City Direct. Sign. Extension of Time Planning Director of a request for extension of time for a Subdivisional Directional Sign, granted under UV #186 (Columbia Outdoor Sign Company), recommended with conditions by the Planning Commission. Request Granted On motion by Stewart, seconded by Lambert, Council approved the Planning Commission recommendation and author- ized the extension of time, with conditions as stipulated. Grant Deed On motion by Lambert, seconded by Stewart, Accepted Council accepted a Grant Deed for street widening from the Mullins & Sloan Company to the City for property located in the northwest corner of Yorktown and Beach Boulevard, and directed the Clerk to record same with the County Recorder of Orange County. Motion carried. Tract #4409 - Subdiv. On motion by Lambert, seconded by Wells, the Agreement Accepted Council accepted a Subdivision Agreement for Tract #4409 (Pacific Sands-J.F.Deane), and directed the Mayor and Clerk to execute same on behalf of the City. Motion carried,. Plans, Specif. & Costs- The Clerk presented a transmittal from the Sewer Lines - Beach Blvd.. Sant), located at Golden West and Sugar Streets, and authorized the release of sub- division bonds. Motion carried. Agreement For Reimb. - A communication transmitting an agreement Storm Drain & Channel for reimbursement of money spent in con- struction of a storm drain and channel by William Lyons, developer of Tract #3862, was.presented for Council consideration. Agreement On motion by Lambert, seconded by Wells, Approved Council approved the agreement and direct- ed the Mayor and City Clerk to execute same on behalf of the City. Motion carried. Recomm. R.J. Nobel - A communication from the City Engineer Work Be Accepted recommending that work on Edinger Avenue between Beach Boulevard and 400, east of Golden West Street, per- formed by R. J. J. Nobel Contracting Company on Edinger Avenue between Beach Boulevard and 4001 east of Golden West Street and directed the Clerk to file a notice of completion. Motion carried. Agreement In Lieu of On motion by Lambert, seconded by Stewart, Bond - Acce ted Council approved an agreement in lieu of bond for Tract #4213 (Alco Pacific), and directed the Mayor and City Clerk to execute same on behalf of the City. Motion carried. Chief of Police - On motion by Lambert, seconded by Stewart, Expenses Autho. Council authorized reasonable expenses for travel and lodging and use of the City vehicle by the Chief of Police in attending a conference of the Northern and Southern California Narcotics Association in Fresno, on November 29th and 30th, 1961. Motion carried. Mrs. Alicia M. Wentworth On motion by Stewart, seconded by Lambert, Ernp , _._Approved Council approved the employment of Mrs. Alicia M. Wentworth as Intermediate Typist Clerk, Range 27, Step "A", effective November 21st, 1961, in the City Clerk's department. Motion carried. Mr. John Miller - On motion by Wells, seconded by Lambert, Leave Granted Mr. John Miller, an employee in the Engineering Department, was granted a leave of absence of 6 months to serve on active duty with the U. S. Air Force, to start on November 181, i961. Motion carried. Reclassification - On motion by Lambert, seconded by Wells, Mr. Lester A. Middleton Mr. Jack D. Ellis Council approved the reclassification of Mr. Lester A. Middleton to Equipment Operator, Range 33, and'Mr. Jack D. Ellis to Skilled Worker, Range 31, as requested by the City Engineer. Council authorized the employment of Mr. Claude F. Jones, as Assistant Director of Civil Defense, Range 35, Step "A0 on a half-time basis, effective November 21st, 1961. Motion carried. Employees Off The City Administrator presented the matter Nov. 24, 1961 of granting all City.Emplo.yees a day off on Friday, November 24th, following their regularly scheduled Thanks- giving holiday on November 23rd. Day Off Following some discussion by the Council, Granted on motion by Wells, seconded by Lambert, Council granted an additional holiday for November 24th, 1961, for all City employees. Motion carried. Request Autho. - The City Administrator requested authoriz- Bids to Move House Mun. Parking.Lot ation to procure bids for moving and setting down on the City Reservoir site, the house presently located at the Municipal Parking Lot. Autho. On motion by Lambert, seconded by Stewart, Granted the City Administrator was granted authority to procure bids for moving the house from the Municipal Parking Lot to the City Reservoir site, and setting same down on foundation. Motion carried.
