COMMISSIONERS ABSENT: None. MINUTES: On motion by Letson and seconded by Stang, the Minutes of the Huntington Beach Planning Commission of November 21st, 1961, were accepted as transcribed and mailed by the Secretary. ZONE CASE NO 218 - Continued Applicant - Edward and Victor Illi CHANGE OF ZONE, Relative to proposed change of district boundary and use classification from: M1-X Light Industrial District as adopted by Interim Ordinance No 668 to R3 Limited Multiple Family Resi- dence. The following parcel of real property as submitted on the applicant's petition is described herewith: That property located on the southeast corner of Cedar Street and Gothard Street, and legally described as the N 107.00 ft of the W 285.00 ft of Block G, Town of Wintersburg. The Secretary read a written communi- cation submitted by 36 property owners opposing the proposed zone change to an R3. Also written communication was submitted and read by the Secretary from the Alpha Beta Acme Markets, Inc., registering their protest against the proposed R3 Multiple zone. The Planning Director presented a land use study prepared by the staff for the Wintersburg area showing the existing and proposed land uses. He stated that High School District had been consulted in view of their proposed school site on the west side of Gothard Street and they had no objection to the area remaining in the industrial zone. Freeman, representing the Southern Pacific Railroad, addressed the Commission -and stated that his company was vehemently opposed to the rezonin;. A. J. Luciay, representing the Alpha Beta Inc., opposed the change of zone because it was not compatible with the industrial uses which are existing in the general area. John Graser, 17132 Palmdale St., Huntington Beach, also vehemently protested -the zone change. Fire Chief Higgins stated that he is opposing on grounds that there should be no residential development so close to the existing large oil tank. the hearing was closed. at length. RESOLUTION NO 218- There being no further comment, Commission discussion was held A Resolution of the City Plannin,; Commission Recommending Denial of Zone Case No 218 to the City Council. A MOTION WAS MADE BY LETSON AND SECONDED BY STANG TO ADOPT RESOLUTION NO 218 RECOMMENDING DENIAL OF ZONE CASE NO 213 TO CITY COUNCIL FOR THE FOLLOWING SPECIFIED REASONS: 1. A special land use study showed that the area surrounding the proposed change is in relatively large ownerships and the existing, as well as the proposed uses, are of an industrial nature. 2. The residences, if allowed, would be incompatible with the future'surrounding uses. 3. The amount of available industrial property in the city is. limited and residences infringing on the property would be a detriment rather than an asset to the area as well as industrial development in the city. A MOTION WAS MADE BY WORTHY AND SECONDED BY LETSON TO ADOPT RESOLUTION NO 219 RECOMMENDING APPROVAL OF ZONE CASE NO 219 TO THE CITY COUNCIL FOR THE FOL- LOWING REASONS: 1. The property is fronting on -a Primary Arterial Highway. 2. The property is directly across from the proposed Broadway, Shopping Center consisting of approximately 60 acres. 3. The proposed San Diego Freeway will have an interchange at Beach Boulevard and Edinger Avenue which is approximately 200 feet east of the property. 4. ZONE CASE NO 220 CHANGE OF ZONE, relative to Applicant - Andrew J. Davis, Jr. proposed change of district boundary and use classifica- tion from: Al-X General Agricultural District, as adopted by Interim Ordinance No 668 to C2 Community Business District with setback provisions. The following parcel of real property as submitted on the applicant's petition is described herewith: Located between Edinger Avenue and Aldrich Street and approxi- mately 250 ft W of Beach Boulevard and legally described as Lot 31, Tract No 417, property known as 7921 E.. Aldrich St. and Lot 16, Tract No 417, property known as 7922 Edinger Ave. The staff report was read by the Secretary. The hearing was opened to the audience; there being no comment, it was closed. It was noted that the property involved in this case adjoins the property involved in Zone Case No 219, and there is practically no difference between the two cases, except that this request is to extend the C2 zone through the block from Edinger to Aldrich Street. The Master Plan of Land Use indicates the commercial zoning extend- ing through to Aldrich Street for the entire block with multi - pie family zone south of Aldrich, therefore, the respected zone change does follow the Master Plan. Luis Stebile, representing the sub- divider, addressed the Commission and offered -to answer ques- tions for the Commission. There -being no further comment,•the hearing was closed. The Planning Director pointed out that this request was similar to many others in that it is for a sign advertising the tract upon -which it is located. Commission discus- sion was held. There shall be posted a $250.00 performance bond guaran- teeing removal upon expiration of Use Variance UV ,351. 2. A $250.00 bond for the requested sign shall be required to be posted guaranteeing removal of the sign within one year of the granting of the Use Variance, unless the Planning Commission at the end of one year agrees to extend the time. In the event the specified sign is not removed in accordance with the Use Variance, the applicant shall forfeit bond and permit the appointed agents of the City to enter the property and remove all structures. permitted under the Use Variance. 3. The Secretary read the staff Chairman Bazil stated he would abstain from deliberation on the proposed use variance due to interest in the property. Vice -Chairman Stang assumed the duties of the Chairman and opened the hearing to the audi- ence. There being no comment, the hearing was closed. The Planning Director pointed out that the applicant desires to connect the -garage to the dwelling which should technically observe the required rear yard. The Planning Director further stated that in this in- stance more than the equivalent yard area is being provided at the side of the proposed home. AREA VARIANCE: AV #354 Applicant - John Kovach, Jr. Chairman Bazil returned To allow construction of a 6 ft block wall within the exterior side yard on a corner lot in the R1 Sin le family Residence District. Located at the southeast corner of Marseille Drive and Granada Lane, and legally described as Lot No 36, Tract No. 3953 (Marina Pacifica) known as 8092 Marseille Drive, Huntin- ton Beach. The Secretary read the staff report. The hearing was opened to the audience. John Kovach, Jr., applicant, addressed the Commission and explained the proposal. There being no further comment, the hearing was closed. Commission discussion was held. It was pointed out that this was another routine case of an owner desiring to extend a 6 ft wall along the exterior side yard of his corner lot. The proposed wall will end approximately 40 ft from the property line and therefore, sight distance at the intersection should not be impaired. Jones of Upland, California; owner of nearby property', protesting the proposed variance. The hearing was opened to the audience. Mr. A. Lockett, 417 6th Street, Huntington Beach, addressed the Commission and opposed Use Variance #355 on grounds that no commercial use should be allowed in a residential zone. Mr. Richardson, appli- cant, addressed the Commission and stated that he was parti- ally retired and this proposed occupation would help,his income. Mrs. Ednd Herron; 416 7th Street, Huntington Beach, protested vehemently - Charles L. Sheppeard, 224 E. Van Koevering,'Rialto, California, also opposed the proposed Use Variance. Mr. Ross Miller, 209 N. Baldwin Avenue, Sierra Madre, California, adjacent proper- ty owner, also protested the proposed variance. CONDITIO\TAL EXCEPTION: UV #356 To allow -the use of vacant Applicant - Briarwood Homes, Inc. property for.parking pur- poses for future medical center development in the R1 Single Family Residence District. Located on the south side of Bolsa Avenue approximately 220 ft west of Edwards Street (Southeast corner of Bolsa and Rice Circle) and legally described as Lot 10, Tract No. 3846 (Briarwood Homes, Inc.). The staff report was read by the Secretary. The hearing was opened to the audience. John Prins, agent for the applicant, addressed the Commission and spoke in -favor of the proposed use variance. There being no further comment, the hearing was closed. A lengthy discussion was held by the Commission. It was noted that the property in question was designed, approved and recorded as part of the Single Family Subdivision and is zoned Rl, has no vehicular access rights to Bolsa Avenue. A 6 ft masonry wall was re- quired along the side and across the rear as a separation. These were requirements of the subdivision. The Planning Director pointed -out that for the size of-buildinos-proposed, a total of 52 parking spaces are required by the Code. The plan shows a total of 73 spaces available not including the 15 proposed parking spaces on the subject lot. It was further noted that in this case, it is felt that off-street parking will be a detriment to the homes on Rice Circle. - 10 - Page #11 Minutes - H. B. The Planning Director pointed out that this was a relatively simple rear.yard variance request. COMMUNICATION: ORANGE COUNTY HEALTH DEPARTMENT The Secretary read a letter r w s Page #12 minutes - H. B. Planning Commission Tuesday, December 5th, 1961 submitted by the Orange County Health Department and an en- closed letter from the Talbert Water District, dated November 20, 1961, in which operating procedures for the irrigation of crops with primary effluent were outlined. Also enclosed was a letter from the Orange County Health Department to the Talbert dater District, accepting the operating practices, and outlining the method whereby the Orange County Health Department will review and make recommendations on Tentative Tracts filed in or ad- jacent to the Talbert Water_ District. In order for the ' Orange County Health Department to review and make recommen- dations on a Tentative Tract in the area, the department re- quires a letter, jointly signed by the developer and the Talbert Water District, to the effect that the operating standards outlined in the Districts November 20th letter will be observed as they affect the Tentative Tract under consideration. Such a letter, together with the District complying with the bacteriological standards required by the Health Department,will be sufficient to recommend approval of the proposed subdivisions. The Planning Commission ordered the communication received and filed. PEAR YARD REQUIREMENTS STUDY The Commission discussed the problems of rear yard requirements, as they particularly affect constructing attached garages near the rear of property with access from an alley. It was felt that an attached garage could en- croach into the required yard provided there is adequate yard area provided elsewhere on the lot. Fire Chief Higgins mentioned the problem they are encountering on the lack of separation between buildings, particularly where developments are con- structed without alleys. - 12 - 486 Page #13 Minutes - H .
