Gisler. The Pledge of Allegience was given -by all present in the Council Chamber. The invocation was given by Reverend Gordon Gilbert of the First Baptist Church of Huntington Beach. Councilmen Present: Wells, Lambert, Stewart, Waite, Gisler Councilmen Absent: None Departmental Reports - On motion by Lambert, seconded by Waite, Rec'e and Filed the reports of the dity Treasurer, --Collector, Building Director, Engineer, Lifeguard Chief,' Fire Chief, Recreation Director, Chamber of Commerce Manager, were received and ordered filed. Lambert that the second reading of Ordinance #884, "AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH DECLARING AN EMERGENCY TO EXIST: AMENDING SECTION 5531 and REPEALING SECTIONS 4048.1 and 2103.101 OF THE HUNTINGTON BEACH ORDINANCE CODE", be tabled indefinately. Motion carried. Richarc'. E. Chesley - A communication from Richard. Earl Chesley, Claim against City 3018 E. Gage Avenue, Apt. B, Huntington Park, California, regarding a claim against the City for damages in the amount of $1,112.88, was presented for consideration by the Council. Claim Denied On motion by Lambert, seconded by Wells, Council ordered the claim of Richard Earl Chesley denied, and refer- red same to the City Attorney and the City's Insurance Carrier. Motion carried. Lease - City of H.B. The Clerk presented a communication from & R.M. Marshall, et al. ' Attorney Robert G. Rove of Corona del Mar, regarding assignment of title and interest in lease between the City of Huntington Beach and Robert M. Marshall, Agnes A. Marshall, and Robert M. Scouts Granted Use On motion by Lambert, seconded by Wells, of Lakc Park 2/9-10/62 request from Mr. Clyde Rowe, Los Bolsas District, B.S.A. for use of Lake Park for an overnight Scout demonstration on February 9th and loth, was granted, subject to their providing temporary sanitation facilities for the group. A communication from the City of Fountain _ Re.so : #1557 _ Valley requesting Council approval of a Resolution of Intention of the City of Fountain Valley, re: Work to be performed in Huntington Beach streets, was presented for consideration of the Council, together with Resolution #1557, "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF HUNTINGTON BEACH, CALIFORNIA, GRANTING CONSENT TO THE CITY OF FOUNTAIN VALLEY FOR THE EXTENSION OF THE WORK OUTSIDE THE BOUNDARIES OF THE CITY OF FOUNTAIN VALLEY AND INTO THE TERRITORY OF THE CITY OF HUNTINGTON BEACH FOR THE CONSTRUCTION OF DOMESTIC WATER FACILITIES IN "CITY OF FOUNTAIN VALLEY - WATER ASSESSMENT DISTRICT NO. l;' AND APPROV- ING PROPOSED RESOLUTION OF INTENTION OF THE CITY OY FOUNTAIN VALLEY FOR SAID WORK." Sewers A Petition for property owners Located on Alhambra S- Glencoe Alhambra and Glencoe Avenues from Beach Boulevard to Silver Avenue; Silver Avenue from north of Glencoe to Heil Avenue; and Beach Boulevard from north of Glencoe to Heil Avenue, requesting Council to initiate proceedings under the 1911 Improvement Act for the construction of sanitary sewers in this area, was presented by the Clerk. Tyner, Claim Against City 822 13th Street, City, presenting a claim against the City in the amount of $1,389.50, for damages caused by sewer flooding home, was presented for consideration of the°Council. Inns . On motion by Stewart, seconded by Waite, a Rec'O.. & Filed letter from Mr. Jack J. Rimel, Attorney for Freedom Newspapers, Inc., re: Application of Huntington Beach Ordinance Sections 5531 and 5531.1, to solicitations by newsboys, was received and ordered filed. Motion carried. Sol Vista Tract Pet. - The Clerk presented a petition from 219 4hite Lines , Street Light property owners, all residents of the Sol Vista Tract, requesting Council to authorize the painting of white lines on the streets within Sol Vista and the erection of a street light at the intersection of Heil Avenue and Beach Boulevard, for consideration by the Council. Ref. to Cite Admin. On motion by Lambert, seconded by Stewart, En.-inecr the petition from the property owners of the Sol Vista Tract was referred to the City Administrator.and Engineer for study and report back to Council. Motion carried. Robert De Malignan - Under Oral Communications, Mr. Robert Rco. Pri. Patrol Sere, De Malignan of Santa Ana, addressed the Council and requested that he be given consideration in filing an application for a Certificate of Need and Necessity for private Patrol service. To Present Applic. Mr. De Malignan was informed by the City at next Mtn. Administrator that some consideration was being given to the letting of a contract for additional private patrol service because of the disqualification of one contractor, and that he would have until next meeting to present such applica- I ti.on. :fir. Geo. Goodwin - Mr. George Goodwin of the Coast Ambulance Coast Amb. Serv. Service addressed the Council and inquired whether any action had been made on disposition of custody cases by the ambulance company. City Admin. "Miller Mr. Goodwin was informed by City Adminis- trator Miller that they were working on it and had just recently received a ruling on the County's application for this situation. "Steering Committee" Mayor Gisler informed the Council and the Citizens Committee people gathered in the Council Chamber that he was making the following appointments of citizens to the "Steer- ing Committee" of the proposed Citizens Committee for the City: 5r. Motion carried. Ccrt. of Serv.- P.C. Mayor Gisler made the announcement of the Doutt 1_ Presson presentation of Certificates of Service to Mr. Paul A. Doutt and Mr. Earl R. Presson, former members of the Huntington Beach Planning Commission, in appreciation for their service to the City in that capacity. The Clerk informed the Mayor that he had been called by Mr. Doutt and Mr. Presson, and that due to illness and other reasons, neither of them were able to be present to receive the certificates, Public Hearin; - Mayor Gisler announced that this was the day Reso. �`t21f3 and hour set for a public hearing on Resolu- tion #218 of the City Planning Commission, recommending denial of Zone Case #218, and requested the Clerk to read the legal notice. The Clerk read notice of public hearing on Zone Case #218 as published in the Huntington Beach News on December 21st, 1961, setting the hour of 7:30 o'clock P.M., or as soon there- after as possible, on Tuesday, the 2nd day of January, 1962, in the Council Chamber of the City Hall, Huntington Beach, California, as the time and place of a public hearing for the purpose of consider- ing a petition for a change of zone, relative to proposed change of district boundary and use classification from: M-1-X Light Indust- rial District, as adopted by Interim Ordinance #668, to: R-3 Limited Multiple Family Residence, on property located on the Southeast comer of Cedar Street and Gothard Street. Hearing Cnened Mayor Gisler declared the hearing open. Call Mr. Richard B. Call, 17172 Palmdale Street, City, protested the zone change before the Council. 1Ir. H. E. Freeman Mr. H. E. Freeman, 1631 S. Lewis Street, Anaheim, representative for the Southern Pacific Railway Company, protested the zone change. Mr._Lucy Mr. Lucy, Public Relations Director for the Alpha Beta Markets, protested the zone change. Fire Chief Higgins Fire Chief Delbert Higgins addressed. the Council and protested the zone change because of oil tanks and a pumping station in close proximity to that territory. No Further Protests There being no further protests filed, either oral or written, against Zone Case #218, Mayor Gisler declared the hearing closed. Zone Case #218 - On motion by Stewart, seconded by Waite, Denied Council approved the recommendation of the City Planning Commission on Zone Case #218, and denied the change of zone. Motion carried. Public Hearing - Mayor Gisler announced that this was the R.c--so. #219 day and hour set for public hearing on Resolution #219 of the City Planning Commission, recommending approval of Zone Case #219, and requested the Clerk to read the legal notice. Zone Casc4'219 - On motion by Lambert, seconded by Stewart, Anprovec' Council approved the recommendation of the City Planning Commission on Zone Case #219 and directed the City Attorney to prepare an Ordinance covering same. Grant & Company to a denial by the City Planning Commission of UV #356, and requested the Clerk to read the legal notice. Pjannin�- Ureetor Planning Director Willis Warner gave the Warner Council a resume' of the reasons involved in the denial of the use variance 'at;. the. Planning.'Commission hearing. "`rJohn Prince Mr. John Prince, agent of R. H. Grant Co. addressed the Council and requested approval of the variance.for reasons which he presented. Mr. Jarncs Hodes Mr. James Hodges of Anaheim, designer for the R. H. Grant Co. addressed the Council and exhibited elevations for a proposed medical center, and explained why the use variance was being requested to allow parking in front of the proposed med- ical center. Hearing Cont'c,. Following considerable discussion by the LV ,r356 Council on this matter, a motion was made by Wells, seconded by Lambert, that the hearing on W #356 be continued until the meeting of January 15, 1962. Motion carried. Bids Presented - Mayor Gisler announced that this was the 2 Dumn `'rucks time for the presentation of informal bids for two (2) five cubic yard dump trucks for the Engineering Streets Department and two (2) dump bodies to be used on these trucks. Bodies the Purchasing Agent was authorized -to purchase two (2) Dump Truck bodies from Hercules Body Works, if they complied with the specifications which have been put out; and he was authorized to purchase from the next lowest bidder if the bid of Hercules did not meet the specifications. Annex. The Clerk read a certificate of the County Znsuff=. Petitions Clerk, Lynn B. Wallace, relating to the insufficiency of petitions for the annexation of inhabited territc to the City of Huntington Beach in the Sunset Heights Area, and informed the Council that this would remove this annexation from consideration for a period of one year. Agreement - City & An Agreement between the City of Hunting - Rainbow Disposal Co. ton Beach and Phil Hohnstei.n and Paul_ Loumena, dba Rainbow Disposal Company, covering trash and garbage pickup in defined areas within the City, was presented for Council consideration. Councilman Lambert Abstains from Ue1ib. Prior to vote on this matter, Councilman Lambert requested permission to abstain from consideration for the reason that the contractor had on occasion made purchases of gasoline from him, and he retired from the Council table. Agreement Acccpt. On motion by 'Waite, seconded by Wells, Council accepted the agreement between the City and the Rainbow Disposal Company and authorized the Mayor and City Clerk to execute same on behalf of the City. City Administrator Miller informed the Mayor and Council that Mr. Richard Sinclair and Mr. Jack Hanna of the Huntington Driftwood Corporation were present to discuss the provisions of the Lease between the Huntington Driftwood Corpora- tion and the City of Huntington Beach. Mr. 1inclair Mr. Sinclair and Mr. Hanna both addressed "Ir. Hanna the Council regarding the delays which they had had in endeavoring to fulfill the terms of the lease, during the past year, and requested that the starting time of the lease would be set ahead one year to December 27, 1961. They informed the Council that they could work out financial arrangements whereby they would waive any monies which had been paid as rent and would continue paying rent at the rate of $1,000 a month under the terms of the lease as extended. They also requested that the lease be assigned from the ineividual entities of Sinclair, Hanna and J.
