MINUTES: On motion by Worthy and seconded by Miller, the Minutescf the Huntington Beach Planning Commission of February 20th, 1962, were accepted as transcribed and mailed by the Secretary. TENTATIVE TRACT MAP N0. 4350 - PORTION No. of Lots: 87 Subdivider: Macco Corp. Total Acreage: 37.821 Engineer: Voorheis-Trindle- Nelson, Inc. Located at the northeast corner of Adams Avenue and Cannery Street and legally described as being a portion of the SW-4 of"the SW4 of Section 6-6-10. The Secretary read a supplemental report to the Subdivision Committee Report of September 6, 1961, which recommended that only the design and layout of the tract be approved until such time as a'solution has been found to the pro- blem of irrigation with sewer effluent in the area. A letter submitted by the County Health Department dated March 5, 1962, was read by the Secretary stating that an agreement has been reached between•the subdivider and the Talbert Irrigation District to comply with the operating standards established by the Health Department and recommends that the portion of the Tract west of the Flood Control Channel be approved. Commission discussion was held. Jim Deane, representing Pacific Sands, stated that he was in accord with all suggested conditions for the proposed tract. Lots 64 thru 69 shall be deleted for single family use or an additional tier of lots shall be created across the street from said lots. 4. The hearing was opened to the audience. Mrs. Fox, adjacent property owner,,addressed the Com- mission and stated that she did not want the proposed home occupation to become a permanent business because of the increased traffic flow. Mrs. Ciddio, 5211 Heil Avenue, addressed the Com- mission and stated that any trucks or tractors will be kept at a different location and not at the home. Mr. David Maddox, 5231'Hei1 Avenue, addressed the Commission and stated that he is opposed to the variance on grounds that a residential area should be kept as stipulated in the Ordinance Code and no business should be allowed, Fire Chief Higgins stated that fire zone #2 requirements would create problems for business use. Chairman Stang questioned the exact location where the trucks will be kept. Mrs. Ciddio stated that 6052 Edinger Avenue has been the address and the only reason for requesting the variance is to have a private telephone in- stalled for taking business calls. the hearing was Slosed. at length. No trucks, tractors, or other equipment used in the business to be kept on the premises or on the streets in the vicinity. 2. Approval of UV #394 will expire on March 1, 1963. Mr. Thomas Turner, representing the applicant, addressed the Commission and stated that the applicant is maintaining adequate parking space and that he was for granting the variance. the hearing was closed. There being no further comment, Commission discussion was held at length. The Planning Director pointed out that the property was included in'a rezoning to C=4 which allows nurseries on the condition that fertilizer is stored within a building. The qudstion arose as to whether the zoning superceded the variance granted May 17, 1960, and whether or not the conditions imposed on'the variance would still apply. He further pointed out that the opinion from the City Attorney was to the effect that the zoning takes precedence and the variance and its conditions are - 7 - 84 Pa,,e #8 Minutes - 11. B. Therefore, there are only two conditions that are applicable to the nursery at present: (1) Fertilizer storage within a building, and (2) A 50 foot setback along Beach Blvd. It was further noted that during the past two years, there has gradually been encroachment into the setback area by fences, small sheds, and merchandise. The Planning Director pointed out that all of the above mentioned objects have been in violation of both the terms of the variance and the setback provisions. Tuesday, March 6, 1962 The hearing was opened to the audience. Mr. Charles Cather, Ocean Front Oil Company representa- tive, addressed the Commission and opposed the change of zone. Mr. W. M. Elliott, owner of property, stated that he was,opposing the zone change because there were too many -oil wells in.the vicinity to construct resi- dences. Mr. A. C. Marion, oil operator, also.opposed the zone change. C Mr. Jack Denardis,'19th-Street, Huntington Beach, stated that he was a manufacturer -and is oppoeed to the change. Mr. Jack Creed, 601 19th Street, Huntington Beach, addressed the Commission and stated that he has built his home among the few existing oil wells and -was "in favor of the.proposed change. Mr.. E . R . Haynes, 167-7 2 Ro s s Lame,, Huntington Beach, addressed the Commission and protested the rezoning on the grounds ,that not,ver-y at -tractive homes could be built in the area where existing oil wells are situated. Mrs. .Creed, owner; of, property on 19th Street, stated that there were a number -of -attractive. homes located near oil wells in -the remainder of the field. Mr. D.. Clausen, owner of pro- perty within the subject area, stated that he wants the area -to be rezoned to residential. C There being no further comment,. the hearing was closed. RESOLUTION NO. 234 A Resolution of the City Planning Commission Makin; Recommendation of Approval of Zone Case No 234 to the City Council, Except for the Proposed C-2-O-District on - both sides of 17th Street. A MOTION WAS MADE BY BAZIL AND SECONDED BY KAUFMAN TO ADOPT RESOLUTION 234 RECOMMENDING APPROVAL OF A PORTION OF ZONE CASE NO 234 TO THE CITY COUNCIL FOR THE - 10 - Pa-e #11 Minutes - H. B. Plannin- Commission Tuesday, March 6, 1962 FOLLOWING SPECIFIED REASONS: 1. The area has been subdivided into residential size lots that could not be utilized properly for industrial use and under the present zoning residences are not permitted. 2. Although the area is zoned for industrial use, it is basi- cally being used as an oil field and not industrially as such. 3. The proposed rezoning is a vital step to insure the future of the area as an extremely desirable residential area, because of its proximity to the beaches. ZONE CASE NO. 235 Initiated by Resolution of Intent A Resolution of Intention of the City Planning Commission of the City of Huntington Beach initiating an amendment to the Huntington Beach Ordinance Code by adding Article 868 to permit temporary directional subdivision signs in all zones with limitations on -the size and the number of signs permitted for any one development. The hearing was opened to the audience. Mr. Max Wisson, Attorney representing the Home Builders Sign Association, addressed the Commission and pointed out various suggested changes for consideration. He further stated that any kind of sign should be permitted in the C and M Zones. Jack Randall, representing the Home Builders Association, addressed the Commission and stated that the Commission should give further consideration to the proposal for reduction of existing signs and also stated that existing signs should be allowed for longer periods of -.time limit. John May, R. H. Grant Co. repre- sentative, stated that the signs are necessary to builders and the number and size of signs should not be limited. Mr. Glenn Swelterman, represent- ing the McCarthy -Sant Development Co., stated that he also feels Page #12 Minutes - H. B. Mr. Dan Meitenger, representing the Doyle and Shields Development Co., stated that he was of the same opinion as the previous representatives of different com- panies. There being no further comment, the hearing was closed. Commission discussion was held at length. It was suggested that perhaps a committee made up'of two Com- missioners, the Planning Director, and the City Attorney could review the suggestions of the Sign Association and the builders. The Chairman requested of those present that they submit their objections and suggestions in writing to the Planning Department by March 15 and that a Committee would review the matter to de= termine what changes might be advisable. The Chairman appointed Commissioners Letson and Bazil and the City Attorney and the Planning Director as a committee to review the suggestions for a report to the Commission at'the meeting of March 20. The Commission discussed a suggestion to rezone the area generally between Quincy, Yorktown, Alabama and Florida Streets. It was unanimously agreed to change the north side of Quincy Avenue from M-2-0 to R-3-0 and'the re- mainder of the area from M-2-0 to R-2-0.
