COMMISSIONERS ABSENT: None. MINUTES: On motion by Worthy and seconded by Miller, the Minutes of the Huntington Beach Planning Commission of April 3rd, 1962, were accepted as transcribed and mailed by the Secretary. TENTATIVE TRACT MAP NO. 4380 - Revised Number of Lots: 168 Subdivider: Wilford G. Lewis Total Acreage: 35 Engineer: Millet, King & Assoc. Located south of Edinger Avenue and west of Goldenwest Street and legally described as being a proposed subdivision of a portion of the E2 of the NE-1 of Section 22-5-11 SBB & M. was read by the Secretary. The Subdivision Committee report Jeff Millet, of Millet & King, engineer for the subdivider, addressed the Commission, and asked that the commercial corner be excluded from the require- ment of dedication and improvements. He further requested that the tentative tract map No. 4380 be continued to the May 1, 1962, meeting. Commission discussion was held. Committee recommendation. The Secretary read the Subdivision Attorney Dale Heinly, representing the applicant, addressed the Commission and stated that there was no comment regarding the Subdivision Committee's recommendation. Commission discussion was held. A MOTION WAS MADE BY BAZIL AND SECONDED'BY WORTHY TO APPROVE TENTATIVE TRACT MAP NO. 3750 WITH THE FOLLOWING CONDITION: 1. The Planning Director pointed out that the subject property is the preferred location for busi- ness since it is the only remaining corner which can be developed to a community shopping center to serve the needs of the several thousand people living in the vicinity. The Planning Director further pointed out the fact that the northeast corner is occupied by homes backing onto Bolsa Chica and the northwest corner is the ammunition depot. Also there is a very small shopping center at the southeast corner. RESOLUTION NO. 247 A Resolution of the Planning Com- mission Recommending Approval of Zone Case 247 to the City Council. A MOTION WAS MADE BY LETSON AND SECONDED BY KAUFMAN TO ADOPT RESOLUTION NO. 247 RECOMMENDING APPROVAL OF ZONE CASE 247 TO THE CITY COUNCIL FOR THE FOL- LOWING REASONS: 1. The property is located at the intersection of a Major and a Primary Arterial. 2. The property is situated at the corner of a section which is a more desirable location for commercial zoning. 3. The property is within a proposed subdivision and is intended to provide a commercial development to serve the needs of the people who will occupy that subdivision as well as surrounding subdivisions. Located north of Sugar Avenue and east of the Southern Pacific Railroad R/W and legally described as being a portion of the SW4 of the NE4 of Section 14-5-11 :: U was read by the Secretary. The Subdivision Committee report The Planning Director pointed out that this tentative map is a portion of the tract originally approved as Tract No. 4033. He further stated that the time limit for recording the final map expired two months ago, thus necessitating the filing of a new tentative map. Commission discussion was held. Folsum, 18371 Beach Boulevard, repre- senting the applicant, addressed the Commission and stated that the property is not large enough for industrial use. He spoke in favor of the proposed variance. the hearing was closed. There being no further comment, The Planning Director pointed out that. the lots between Warner Avenue and Washington Street are 50 ft. x 120 ft.; north of Washington, 50 ft. x 100 ft. He further stated that any individual lot of this size would be extremely difficult to develop to industrial use and the lots facing Warner Avenue are in a worse situation as they will be 50 ft. x 90 ft. after the street is widened. The Planning Director further -pointed out that obviously several lots will have to be combined for development to anything other than residential use. Commission discussion was held. Robert Grant, owner of a home within the tract, addressed the Commission and protested the change of zone. Also the following homeowners within the tract very strongly opposed the zone change: Mr. Foisy of Venturi Drive, Rich Martin of Linda Circle, Mr. Misslecart of Hummingbird Lane, R. K. Andres, Robert Rothman, Robert Stinson, Mr. DeRuby, Mrs. Nostrome, and Mr. Jacobson. Mr. Frank Doyle, developer of Middlecoff Homes, Inc., addressed the Commission and explained their plans for the complete subdivision. There being no further comment, the hearing was closed. RESOLUTION NO. 241 A resolution of the City Planning Commission of the City of Hunting- ton Beach, California, recommend- ing Approval of a portion of Zone Case 241 and recommending Denial of a portion of Zone Case 241. A MOTION WAS MADE BY LETSON AND SECONDED BY MILLER TO ADOPT RESOLUTION NO. 241 RECOMMENDING DENIAL OF THE R-4 ZONE AND RECOMMENDING APPROVAL OF THE R-5 ZONE FOR THE FOLLOWING REASONS: 1. The property is situated at the intersection of a Primary and a Secondary Arterial Highway. 2. The area in the vicinity of the proposed R-5 zone does not provide for any development of this type, which is necessary to meet the needs of the people in the area. The hearing was reopened to the audience. Mrs. Don Smith, Garden Grove, addressed the Com- mission and stated that she was opposing the residential zoning. She stated that the subject property is far more suitable for an M use. Wm. Mahaffey, Delaware Street, Huntington Beach, addressed the Commission and stated his opposition to the proposed zone change. Francis Horvath, representing Mr. Silva, owner of property within the area which is proposed to be rezoned, addressed the Commission at length opposing the zone change. RESOLUTION NO. 249 A Resolution of the City Planning Commission Recommending Approval of The Amendment to the Master Plan of Land Use to the City Council. A MOTION WAS MADE BY LETSON AND SECONDED BY WORTHY TO ADOPT RESOLUTION NO. 249 RECOMMENDING APPROVAL OF THE AMENDMENT TO THE CITY COUNCIL FOR THE FOLLOWING REASONS: 1. Promote the health, safety, welfare and convenience of the general public. 2. Serve as a general guide for the development of public and private lands. 3. Provide an authentic source of information for residents and investors of the City. 4. To obviate the menace to public safety and property values resulting from inadequate coordination and planning. The Planning Director pointed out that the subject property is an excellent location for multiple family use, particularly since the parcel is of a size and shape which would provide for a service road along Bushard Street for access, 'an alley at the rear and nine or ten lots about 150 ft. deep. Hoffman ' posed change of district boundary and use classification from: C-2 Community Business District to R-4 Multiple Family Residence District. Located north of Utica Street and approximately 180 ft. west of Beach Boulevard, and legally described as the west 100 ft. of Block 2108, East Side Villa Tract. The Staff report was read by the Secretary. The hearing was opened to the audience; there being no comment, the hearing was closed. Commission discussion was held. It was noted that the property owned by the applicant is an "L" shaped parcel fronting on both Utica Street and Beach Boulevard. The immediate corner of Beach Boulevard and Utica Street, being the inside of the "L', is a separate parcel now occupied by the American Stone Products Co. The Planning Director pointed out that the zone change involves that part of the property 50 ft. west of the Stone Products yard is a parcel 100 ft. x 300 ft., To the west the zoning is R-2. He further pointed out that the requested zone change to R-4 would provide a good buffer between a business area and the R-2 area to the west. RESOLUTION NO. 248 A Resolution of the City Planning Commission Recommending Approval of Zone Case 248 to the City Council. A MOTION WAS MADE BY LETSON AND SECONDED BY MILLER TO ADOPT RESOLUTION NO. 248 RECOMMENDING APPROVAL OF ZONE CASE NO. 248 TO THE CITY COUNCIL'FOR THE FOLLOWING REASON: 1. Planning Commission Tuesday, April 17, 1962 The Planning Director stated that the proposed fence will be 28 ft. from the corner and 10 ft. back of the front property line and should not obstruct the vision of traffic at the corner. Located at the northwest corner of Yorktown and Beach Blvd., and legally described as a portion of Block 2508, East Side Villa Tract. Winterberg, representing the applicant, addressed the Commission and explained the proposed sign structure. There being no further comment, the hearing was closed. A lengthy discussion was held. It was noted that the one sign included in the application is listed as 151 sq. ft. This is correct if only the area of the six blocks containing the.six letters of the sign is considered. The base to which the six blocks are fastened would also seem to be part of the sign. The Planning Director pointed out that if these are considered as part of the sign area, then Its total area is about 216 sq. ft. - 14 - 137 Page #15 Minutes - H. B. Planning Commission Tuesday, April 17, 1962 Secondly, it was noted that the application does not mention any variance to the height limit of the C-4 zone; which is 35 ft. The sign is shown as 51'3" above grade. The Planning Director pointed out that the application does not mention the small sign shown on the plot plan at the corner of Beach Boulevard and Yorktown Avenue. The Commission presumed that this is the usual "Banjo" type sign which is some 25 - 30 sq. ft. in area. This sign would have to be included in computing the 100 sq. ft. maximum area since that maximum included the total area of all detached signs and not each sign. The Planning Director pointed out that the developers of Pacific Sands are proposing to construct a recreation facility for use by the residents of the tract. He further stated that it will be private since it will not be open to the general pub- lic and all expenses are to be borne by the residents of the tract. The second part of the request is to allow the recreation building seven feet from the front property line instead of the required 20 ft. DISCUSSION: Re: PARKS Commissioner Miller opened dis- cussion on the subject of acquiring parks in the developing - section of the City. The City Attorney noted that the suit against the City for return of'Park fees was still pending and that the park fees -now being held should not be used in case refunds are necessary. The question arose as to how much park area is needed and Associate Planner Ken Reynolds noted that one acre of land per 1000 population is a good rule of thumb. It was also noted that there are different type of -parks needed such as neighborhood -parks, community parks, and regional parks. It was generally felt that neighborhood parks were most urgently needed. Also discussed was the possibility of whether or not subdividers could be required to dedicate land 141 Page #19 Minutes - H. B. Planning Commission Tuesday, April 17, 1962 for parks and not pay park fees. The City Attorney agreed that the subdivision ordinance could be amended to eliminate the option of paying park fees thus requiring that land be dedicated. It was the unanimous concensus that to secure adequate park areas and in the proper loca- tions, a Master Park Plan should be devised as a general guide. The Staff was requested to make investigations of park acquisition programs in other areas and to gather data on the type, location, and quantity of parks that the City should develop.
