HomeMy WebLinkAbout1962-06-07359 MINUTES Council Chamber, City Hall Huntington Beach, California Thursday, June 7, 1962 Mayor Lambert called the regular adjourned meeting of the City Council of the City of Huntington Beach to order at 7:30 o'clock P.M. The Pledge of Allegiance was given by all present in the Council Chamber. Councilmen Present: Wells, Stewart, Welch, Lambert Councilmen Absent: Gisler Bch.Front Toil. Bldgs. The Clerk presented a communication from Work Completed the City Engineer stating that work on the Beachfront Toilet Buildings had been completed according to plans and specifications, and recommending that payment be authorized to the Contractor, B. C. Grow, in the amount of $1,520.00 Work Accepted - On motion by Stewart, seconded by Welch, Final. Pint. Auth . Council accepted the work on the Beach - front Toilet Buildings, and authorized final payment to B. C. Grow in the amount of $1,520.00. Motion carried. Tract #4682 - A transmittal from the City Engineer of Agrees. Pres . Voucher, Agreement in Lieu of Improvement Bond, and Subdivision agreement for Tract #4682 - Marell Homes, Inc.,1 was presented for Council consideration. Agreements On motion by Stewart, seconded by Welch, Accepted Council accepted the Voucher and directed the Clerk to file same; and accepted the Agreement in Lieu of Subdivision Bond and the Subdivision Agreement for Tract #4682, and authorized the Mayor and City Clerk to execute same on behalf of the City. Motion carried. Agreements A transmittal from the City Engineer of Pres. - Tr. #4328 Voucher, Agreement in Lieu of Improvement Bond, and Subdivision Agreement for Tract #4328 - Marell Homes, Inc.,1 was presented for Council consideration. -10 (6/7/62) 60 Page #2 - Minutes, June 7, 1962 Agreements On motion by Stewart, seconded by Welch, Accepted -' Council accepted the Voucher and directed the Clerk to file same; and accepted the Agreement in Lieu of Subdiv- ision Bond and the Subdivision Agreement for Tract #4328, and author- ized the Mayor and City Clerk to execute same on behalf of the City. Lotion carried. Req. Trans. To P.D. The Clerk presented a communication from Mrs. Marilyn�Gro&an the Chief of Police to the City Clerk re- questing the transfer of Mrs. Marilyn Grogan, Typist Clerk in the Clerk's Department, to the Police Department in the position of Clerk -Dispatcher. Transfer On motion by Welch, seconded by Stewart, Authorized Council authorized the transfer of Mrs. Grogan to the Police Department, and the employment by the Clerk of a Typist Clerk as a replacement. Motion carried. Req. Refund of Dep. The Clerk read a recommendation from the To Michael S, Coronel City Administrator and the City Attorney for a refund of a deposit made by Mr. Michael S. Coronel on an offer to purchase Lots 2 and 4, Block 414, Seventeenth Street Section. The report informed the Council that it appeared to be doubtful whether the title to these lots could be cleared. Refund On motion by Welch, seconded by Stewart, Authorized Council authorized that a warrant in the amount of Five Hundred Dollars ($500.00) for refund of a deposit to Michael S. Coronel on an offer to purchase Lots 2 and 4, Block 414, Seventeenth Street Section, be approved; that the Treasurer be authorized to issue a check in this amount, and the Clerk be directed to;,weturn same to Mrs. Coronel with a letter informing him that the City is unable to clear title to same. Motion carried. Req. Offer To A recommendation from the City Attorney and Settle Hermann Case the City Administrator that the City accept the offer of settlement from Fred C. Hermann and Myrtle Hermann in Superior Court Case No. 95619, was presented for consideration by the Council. -2- (6/,7/62) 31 Page #3 - Minutes, June 7, 1962 Hermann Settlement A motion was made by Welch, seconded by Accepted Stewart, that in Superior Court Case No. 95619, City of Huntington Beach vs. Fred C. and Myrtle Hermann, the City accept Mr. Hermann's offer of settlement, through his attorney, of the above action, for the sum of $2500.00 for a Quitclaim Deed, taking title 'as is' to Lots 2 and 4, Block 414, Seventeenth Street Section, Huntington Beach, and the execution of a Dismissal With Prejudice of the above action, each party to bear his own costs; that the Mayor and City Clerk be authorized to ex- ecute and deliver the necessary Quitclaim Deed upon receipt, by the Clerk of the aforementioned $2500.00 by certified check or cash, together with the Dismissal. Motion carried. Ord. #911 - The Clerk gave Ordinance #911 a first First_ Reading reading in full - "AN ORDINANCE OF THE CITY OF HUNTINGTON BEACH DECLARING AN EMERGENCY TO EXIST; AND AMENDING THE HUNTINGTON BEACH ORDINANCE CODE BY AMENDING SECTIONS 7572, 7572.23 and 7572.24." Plan. Dir. Req. Planning Director Warner presented a 1.nterp , of 2onin& I request for an interpretation.by the Council as to whether a Retail Tire Store is similar to permitted uses in the C-1 Zone, P.C. Mr. Warner informed the Council that the Interpretation Planning Commission, by minute action, had determined that this use is similar, and recommended their interpre- tAtion to the Council. Councilman Stewart Councilman Stewart requested advice from Request.. the City Attorney regarding his considera- tion of this matter, due to his owning property across Beach Boulevard from the proposed tire store. Councilman Stewart It was established that Councilman Stewart Advised to Act was not prejudiced in this matter, and the City Attorney advised him to act thereon. Council Concurs On motion by Stewart, seconded by Welch, With P.C. the Council concurred with the Planning Commission is their interpretation that the tire store would be a permitted use in this Zone. Mayor Lambert called an informal meeting of 6/7162 - 7.ss P.M. the Council as a Committee of the Whole for June 7, 1962 at 7:55 P.M. for discussion of the proposed budget. Adjourned Mtg. On motion by Stewart, seconded by Welch, b/15162 - 7:30 P.M. the regular adjourned meeting of the City Council of the City of Huntington Beach adjourned to Friday, June 15th, 1962 at 7:30 o'clock P.M.
