Mr. Dolan, Acting Superintendent of Fountain Valley School District, addressed the Commission and requested street frontage on the east side of the proposed school site for the purpose of loading and unloading children. Kenneth Carlson, representing the applicant, stated that Yorktown Street, a secondary highway, does,not cross the river; therefore, it would not generate any traffic from the east. Sterling White, representing the subdivider, stated that the property is under"three different ownerships; thus creating definite problems of design. In view of these design problems, he requested a continuance to the July 3, 1962, regular Planning Commission meeting. There being no further comment, the hearing was closed. Located at the northwest corner of Yorktown Street and Bushard Street and legally described as being a portion of the SE4 of the NW4 of Section 6-6-10. The Subdivision Committee Report was read by the Secretary. The hearing was opened to the audience. Mr. Dolan, representing the Fountain Valley School District, asked whether or not a 10 ft walkway easement was provided over the Orange County Flood Control District Right -of -Way. The Secretary pointed out that the easement across the Orange County Flood Control Right -of -Way was indicated on the tract map. Assistant City Engineer, Bill Hartge, requested that a condition be added requiring improvement across the Orange County Flood Control Right -of -Way which would com- ply with City Standards. A MOTION WAS MADE BY CRABB AND SECONDED BY LETSON TO APPROVE TENTATIVE TRACT MAP NO 4743 UPON THE FOLLOWING CONDITIONS: 1. The revised layout dated June 15, 1962, shall -be the approved map. 2. A 6 ft chain link type fence shall be constructed along the Edison Co. right-of-way and Flood Control right-of-way. 3. The improvement of "A" Drive, "K" Lane and Bushard Street shall include the parcel labled "Not a Part." 41 Bushard Street shall be improved to City Standards across the Edison Co. and Flood Control Channel right-of-way. 5. A walkway and pedestrian bridge across the Flood Control Channel shall be provided near the northwest corner of the tract and a masonry wall 6 ft high shall be constructed along each side of the walk except where abutting the front yards'of adjoining lots where such wall shall not exceed 42 inches. 6. The rear and exterior side of all reverse corner lots shall be fenced with a 6 ft masonry wall in accordance with Planning Commission Standards. 7. No portion of this tract shall be recorded until such time .as further approval by the Planning Commission is secured certifying that a solution has been found to the problem of a public health hazard due to irrigation of nearby farm lands with sewer effluent. 8. The layout dated May 24, 1962, shall.be the approved map. 2. A 6 ft chain link type fence shall be constructed along the Edison Co. R/W and Flood Control Channel. 3. Bushard St. shall be improved to City.Standards across the Edison Co. and Flood Control Channel rights -of -way. 4. Dedication of Garfield Avenue to Primary Highway Standards. 2. Installation to City specif ications_of curb, gutter, sidewalk, and paving to the centerline of Garfield Avenue, 3. Redesign of the parking layout in order to provide a minimum of two parking bays at the front of the -building. 4. Widen the indicated 15 ft drive to 25 ft and provide a sign which indicates additional parking to the rear. 5. The size and arrangement of parking stalls will conform to Commission standards. 6. A minimum of 5% of the parking lot shall be landscaped and shall be permanently maintained. 7. A 6 ft high masonry wall shall be constructed on the north, east and west property lines, excepting the front 15 ft on the east -and west property lines, which shall be 421"'high. 8. Located at the northwest corner of Edinger Avenue and Edwards Street and legally described as the south 185 ft of the east 177 ft of the SW4 of Section•15-5-11 in the Rancho Bolsa Chica. The Secretary read the Staff report. The -hearing was opened to -the audience: John Prins from.Robert-H. Grant Company addressed the Commission and spoke in favor of the subject variance. Lawrence W. Weaver, representing the.Signal Oil Co., addressed the Commission and spoke in favor. He stated -that the canopies will not obstruct the view at the intersection. There being no other comment, the 'hearing was closed. Commission discussion was held. The Secretary pointed out -that the applicant'is requesting permission to encroach into the required 50-ft setback with two 20 ft x 22 ft free standing canopies and a service station building. It was further noted that encroachment within the required 50 ft setback does not meet wl•th the Code or with Commission policy. He also questioned the validity of the application because a local realtor has an ex- clusive listing on.the subject.property. Attorney for .Mr . Sprague, applicant, addressed the Commission and presented photographs of the subject property. The Commission asked Mr. Sprague if he was authorized to file the application. Howard•Miller,•5181 Heil•Avenue, Huntington Beach, addressed the Commission and stated that he was not opposing the proposed church and parish school;. however, he was opposed to an R-3 Zone which would allow apartment -development adjacent to single family development. A MOTION WAS MADE BY CRABB AND SECONDED BY LETSON TO ADOPT RESOLUTION NO 258 RECOMMENDING APPROVAL OF ZONE.CASE NO 258 TO THE CITY COUNCIL FOR THE FOL- LOWING REASONS -.AND UPON THE FOLLOWING CONDITIONS: 1. The property -is fronting on a major arterial highway. 2. The property is adjoining a C-2 zone located to the south. CONDITIONS 'c 1: Withhold second reading of the adopting ordinance until the right-of-way for Taylor Avenue is dedicated to City Standards. 2.
